There were present: Mayor C. V. Jackson, presiding. Councilmen: W. A. Larson, I. R. Carper, W. S, Cummings, F. L. Carrico, W. F. White, J. R. Martin, W. H. Wysor Councilmen-elect: T. J. McCarthy, Glen Aust Also present: Town Manager: T. B. Noland Town Attorney: Garnett S. Moore Visitors: Evelyn S. Hall, reporter for the Southwest Times William A. O'Flaherty, representing the Tobacco Tax Council of Virginia Joe Jelf Marvin Lenett CALLED MEETING TO DTSCIISS CIGARETTE LICENSE TAX ORDINANCE Mayor Jackson explained that as noted in the announcement of the meeting, the meeting was called for the purpose of further consideration of the cigarette license tax ordinance, the question of awarding the contract of the Pumping Station, further consideration of the retirement plan for Town employes and other matters that Councio may deem necessary to discuss. In the absence of Town Clerk, Mrs. Gladys Dalton on motion made by I. R. Carper, seconded by J. R. Martin, it was RESOLVED, that Town Manager T. B. Noland be designated to serve as Clerk of Council for this meeting. In opening the discussion of the cigarette tax ordinance, Mayor Jackson ppinted out that there had been some street talk about the public hearing on the Council mina. contd. Aug. 27, 1958 on'~h® proposed cigarette license tax ordinance to the effect that there were objections from some on the manner in which the hearing was conducted. The Mayor further explained that the hearing had ~~~~.~ ~~~ ~; r' been conducted according to State Law and wide i' ~; f~ spread custom in Pulaski as well as other Municipali~l ties, and that since all those who wished to speak had been afforded the opportunity to do so, crib- . cism of the conduct of the hearing was not justified! Then, Mayor Jackson invited any visitors present to again express themselves on the proposed cigarette ordinance. CIGARETTE LICENSE TAX ~~ Attorney Moore explained the changes which he ~. ORDINANCE DISCIIBBION felt should be made in the draft of the cigarette ordinance which had been considered by Council at a previous meeting, the changes being of a technical. nature and for purposes of clarity. Mr. Moore state ~. that as soon as Council adopts the ordinance it can be completed and made ready for distribution in a very short while. At this point Mr. O~Flaherty made a suggestion to the Town Attorney on the specific wording of one section and was assured by the Attorney that he had already determined the need; for the suggested change. Councilman Carrico stated that the proposed ordinance might hurt some merchants and that he feels it wrong for the Town to do anything to damageF; the business of even one merchant. Agg.27, 1958 with respect to personal property taxes. Other visitors present, who again expressed themselves as being opposed to the ordinannce, were Mr. Joe Jelf and Mr. Marvin Lenett. There was some dis- cussion between the visitors present and several members of Council. On motion of Mr. Larson, seconded by Mr. w. H. Wysor and on the affirmative vote of I. R. Carper, W. S. Cummings, W. H. Wysor, J. R.Martin, W. A. Larson, W. F. White, with F. L. Carrico abstaining, it was RESOLVED, that the Cigarette License Tax Ordinance as suggested by the Town Attorney be adopted with an effective date of October 15, 1958. (Cigarette Ordinance on page 2954-A, etc.) Following the adoption of the ordinance Mayor Jackson assured the visitors present that Council would keep a close watch on the workings of, and the effect of the new Ordinance.' The Town Manager reported that the Consulting GATT 7M~RF. & ~jy AWARDED CONTRACT FOR 1~0A5TRUCT20N OF NE~n1 PEAK CREEK PING STATIONS IAB BID $31,974.©© Engineers had analyzed the (3) three contractors bids on the construction of the Peak Creek pumping Station, with the recommendation that the award be made to Gallimore & Lively on the basis of their low bid of 531,974.00. On motion of W. F. White, seconded by W. S. Cummings, and carried on the unanimous vote of those present it was RESOLVED, that contract for construction of the Peak Creek Pumping Station be awarded to Gallimore & Lively. Council Mips. contd. Aug. 27, 1958 After hearing the Town Attorney's explanation of kl a proposed plan for providing for retirement of i certain disabeled employes who might be included in the Retirement Plan, the Attorney was authorized ~. At this point Mayor Jackson took note of the facto that three of the present Councilmen were ending NOTED THAT 3 CCRJNCILMENtheir terms on August 31, pointing out that Mr. Lemons ATTENDING IAST MEETING CARPER. RAVING SERVED i 14 y~ and Mr. Wysor had served for two years and that Mr. Carper was finishing fourteen years service as a Councilman. The Mayor recognized the interest, sincerety, and value of the public service which had',. been rendered by the retiring Councilmen and paid special tribute to Councilman Carper for his long service. Mr. Carper stated that he feels this to be a good. time to step down because milestones of progress, aridl i projects in which he had been interested had been ;. accomplished and that he took pride in having a part' in them. Mr. Carper indicated that he would con- time his strong interest in town affairs and Mayor Jackson assured him that he would be welcome at anytime and that Council ~rould value his future suggestions. Aug., 27, 158 on Town Council because of its value as affording the opportunity to learn that most municipal problems look quite different to a citizen after he gains a seat on the Council.
