Council Minutes Pulaski, Va. September 20, 1955
The minutes of the regular semi-monthly meeting of
~ti
the Town Council of the Town of Pulaski, Virginia, held
in the municipal building at 4 p.m., September 20, 1955.
There were present:
Mayor C. V. Jackson, presiding,
Councilmen: Vtf. A. Larson, W.b~. Farmer, J. R. Martin,
M. E.. Lester, I.R. Carper, C, T. Brookman
0. 0. Crowell.
Absent: W. F.White
Also present: Town P~anager J. F. Hirst

The Rev. S. Browne Hoyt, pastor of the Anderson l~remorial
Presbyterian Church opined with meeting with a prayer.
In the absence of the Clerk of theCouncil, the Council
designated the Town Manager to~serve as Clerkfor the purpose
of recording the minutes of this meeting.
Mr:R. I.F3rown appeared bef ore Council stating that he
represented the interest of Mr. C. N.Tester in the matter
of the subdivision of certain property on the North side
of Fifth Street, S. E. between Pierce Avenue and Graham
Avenue. lt~~r. Brown stated that in June, 149, M r. Tester
had subdi-.-ided the property at this location into four lots
facing onto Fifth Street, S.E., The Plat of this subdivision
had been properly recorded in the records of the Clerk of
the Circuit Court, Pulaski Co~znt,y. He noted that two of
the lots h~.d been sold and that houses had been constructed
on them, and further that at this time there was an interest
for the purchase of a third lot. However, a question had
been raised in regard to an alley which extends through
this lot. Mr. Brown noted that the Tester Subdivision was
not in conformity with the map that is generally known as
the map of the Town of Pulaski. However, he observed that
the greater portion of land in that section of Pulaski was
not in conformity witL~ the so-called ofi'ficial map of the

Town and he further observed that the map so far as the
Southeast section of Town was concerned had never been
recorded.
On motion of I. R.Carper, seconded by J. R. Martin,
it was unanimously
RESOLVED, that the matter be referred to the Street,:
Committee and the Town Attorney to check, with the Counc~~
to take such formal action as the~,r mrould recommend at they
next meeting.
Mayor Jackson reported on the attendance by represer~ta-
tives of theTown at the League of Virginia Municipalities
Convention at Old Point Comfort. He noted that the meet~hg
had been interesting and beneficial to those present and;,
was always advantageous to any who could attend. Partict~~
larly he stated that one of the benefits from attendance ~t
such conventions was the opportunity of discussing municipal
problems with others having similar difficulties.
On motion of I. R. Carper, seconded b,y C. T. Brookman~~
it was unanimously
RESOLVED, that the Mayor, Chairman of t'ne Water 'Cornm.ttee,
Chairman of the Sewer Corrmlittee, Town Attorney and Town
.,Manager be officially delegated to appear in behalf of the
Town Council bef ore the meeting of the State rater Contro~
Board on September 29, 1955. Be it further RESOLVED that's
any other members of Counc i.l who would have an opport~nit~t
or would be interested in attending would also serve as
representatives of the Council.
On motion of ~. A. Larson, seconded by 0. 0. Crowell~j
it was unanimously
RESOLVED, that the Town w7ar_ager is authorized to enter
into an agreement with the Virginia Department of Highway;
for the construction of the sidewalk, curb and gutter in
front of the 0. N. Meredith property at the North corpora~e
limits of theTown of Pulaski on the basis that the Highwa
1~epartment shall furnish the necessary materials for the
project and such cost to be borne by the State with the

Town providing labor at the expense of theTown.
This action of the Town Council was taken upon the
advice of the Tos.'~~n r:Zanager that he 'riad been informed by
Mr.W.F. Smith, Urban engineer of the Virginia Department
of Highways that the 50-50 cost sharing agreement previously
proposed by the State had been determined by the Highway
department as being contrary to the normal Highway Department
policy.
Qn motion of W.A. Larson, seconded by J.R. Martin, it
was unanimously
RESOLVED, that the 11Ra,por and theClerk of the Council
be hereb:,r authorized to affix their signatures on behalf of
theTown to an agreement dated day of September, 1C55,
between O. H. Meredith and Ora N. Meredith, his wife, parties
of the first part and the Town of Pulaski. Said agreement
to provide for th.e construction of a sidewalk, curb and
gutter on the North side of U.S. 11 at the North corporate
limits of theTown. Said curb and gutter and sidewalk to
follow the property line as established in the a=~reement of
0. H, reredith. and to join the present sidewalk on the North
side of Fifth,Street at Sprouls Branch with the sidewalk on
the west side of the four-lane highway of U.S. 11 immediately
North of the north corporate limits.
TheTown Manager submitted to the Council a proposal
by ViEiley & l(~'ilson, Consulting Engineers, Lynchburg, Virgi nia
for the preparation of plans and specifications for a new
municipal building. The Town ~~anager also submitted to
Council a proposal by the engineering firm of Hayes, Seay,
t~Aattern ~ P;Zattern, Roanoke, Virginia, for the preparation
of a preliminar-,r study of the reconstruction of the bridge
at the interstion of Thid Street and Franklin Avenue across
Peak Creek. Both matters were taken under advisement
pending receipt from Wiley ~c ~?'ilson of a proposal in t'neir
behalf forthe preparation of a ^preliminary study of the
bridge design.

A request of ".?r. Edwin Fay Hall for the removal of ~ ',

was referred to the Street Committee.
The Town Manager read a letter from Tu~r. Martin John~':on
of the firm of Wiley & Wilson wherei..n Mr. Johnson indicated
the olainion of his firm that it would be definitely inad$'is-
able for theTown to permit insofar a~ it had the power tl~e
commercial development of any recreational areas on the
west fork of Peak Creek.
On motion of W, M. Farmer, seconded by I.R. ~%arper,it
was unanimously
RES€TLVED, that the Town Council does hereby go on r~tcord
as opposing any development, commercial, private or othe~i!Vvise,
or any activities in the water shed of Peak Creek which vtbuld
restr/~.~h hinder or interfere with the water in the creek;
as may be necessary for the Town of Pulaski.
At the request of Councilman V'dhite, the interest of
Mr. D.B. Kersey in securing construction of a bridge acrdhs
Peak Creek at the East entrance to Kersey bottom was refdlcred
to the Council. The Town Manas?er reported the estimated r
cost of such a bridge would be X3,860.00. The request w~is

referred to the Street Committee and other members of the
Council in order that they might have an opportunity to
familiarize themselves with the situation.
On motion of I.R.Carper, seconded by J.R. martin, ttie
following changes were authorized in the taxicab certific~~tes.
Cancel certificates of ~It'illiam Hayden Hall, one, and George
Rupert Johnson, Johnson~s Gabs, two. Approve application
of Arnold Lee Q,uesenberry to operate one cab at Safeway C.~as
and Elbert E. Kinzer to overate one cab as Rainbow Cabs,',.
It was noted t'nat the two cancellations together with
cancellation of two cabs of Fred P. Davis, May 17, 1955 a~.d
July 19, 1955, had reduced the number of cabs to 38 and to
two above approvals returned the number to the maximum
a~.zthorization of 40.
The need for a new backhoe to replace the Badger w hi~2h
had been purchased by the Town approximately ten years ag~,

was discussed. The Town Manager advised that he and ~Zr.
Howard Jackson had been doing some recent investigation
as to the cost of equipment. He reported that used equip-
ment could be obtained in the X7,000 to 8,000 bracket.
A new 3~8 ,yard hoe would cost approximately X10,500, and
a new 1~2 yard hoe would cost in the range of X16,000 to
X17,000. The Town P,~ana~;er also stated investigation vrould
be continued and that a proposal for the purchase of
equipment would be presented to Council at an early date.
It was reported by the Town Tanager that Mr. E. H.
Kuehl of R. Stuart Royer & Associates, Consulting Enn;i.neers
of Richmond, had indicated that the revised annexation
survey would be made available to the Council not later than
the last week in Qctober.
The Pitayor raised a question as to the status of the
sub division ordinance and the Town attorney and Town Manager
reported that the recent draft o" the Town Attorney of an
ordinance revising the planning Commission's proposal was
under continuing study. The P1Tayor commented that the
ordinance was needed 'ooth to c~ntr~l subdivisions and
also to give encoura~;ment to the Planning Commission as an
indication of the appreciation of the Council of their work.
He noted that the Commission feels the ordinance should be
pushed and brought to final conclusion. Councilman Martin,
a member of the Planning Commission said that the Commission
was at a standstill until the Subdivis~_on Ordinance could
be handled and that zon_n~;, ~^~hich v~~as the next project of
the Commission, was being delayed, although some work had
been done until the Su.bdivi_sion proposal could be concluded.
It waa agreed by the members of Council that the Subdivision
Or finance should be continued on the agenda.

Council on previous occasions had a~zthorized this action~~
The Town Pr~anager promised that the matter would be handled
as promptly as possible.
The Council was advised by the Town A~anager that he

had been contacted by NTr. L.D. Shavlan, Chairman of the
Chamber of Commerce that 1~2r. Shavlan had asked that the
Council rive a general concensus as to what its reaction
would~be should it receive a proposal at a later date for;`
the metering of the public parking lot on Third Street.
t~4r. Shavland had stated that the subject would come before
the meeting of the ?~:Zerchant's Council in the coming; week ';
and also that the Board of Supervisors had indicated their!
approval to metering; the lot. The Council took no formal''
action but indicated that it would prefer to await the
action of the Ptlerchantr s Council, however, there was a
general opinion that if any additional meter:~ng were done
in that area it would be preeerable to meter Third Street'
prior to considering the public parking lot.
The Town P.2anager reminded the Council of the annual

employee's picnic which was scheduled for September 21 at
the T2ayor ~ s farm.
There was some disclzssion on the general public respd~se
to the publicity riven to the Council's action at the lash!
meeting on the matter of people curtailing the barking of;
dogs at ninht. Councilman "rookman noted that cooperation!
of residents in his area had been excellent. Councilman
Carper stated that the problem still prevailed in the vichity
of his home although the Chief of Police had made contact
in the area. Mr. Carper asked that no action be taken fort
a few days in the particular matter in which he was intere~fited.
It was noted that some persons who had received parki,~hg
tickets in front of the Post Office had complained on the '!;

olzt in accordance with Council action in Anril, 1952, was not
clearly eliminated. Therefore, the persons who had recen~ly
been ticketed felt the suns were confusing and misleading.
The Town N~anager~was instructed to check into the condi ti~'on
of the suns to insure that they would clearly read »5 mi~n-
ute parking at all hours."'
The meeting adjourned at 6:10 p.m.
