Council Minutes Pulaski, Va., December 20, 1955
The minutes of the regular semi-monthly meeting of

the Town. Council of the Town of Pulaski, Virginia, held
on the 20th day of December, 1955, at 4 p.m. in the
municipal off ices.
There were present:

The meeting was opened with a prayer by the Reverend
Glenn Garner, pastor of the First Church of the Brethren,.
On motion of W. F. White, seconded by ?,1. A. Larson.,
it was unanimously
RESOLVED, to dispense `rith the reading of the
minutes of the regular monthly meeting of December 6, 1855
and. the special meeting of December 15, 1955•
Mr. G. C. Hall stated he was spokesman for the grct'up

appearing before Council as residents in the vicinity of the
lot at the corner of First Street and Sout'_z Washington
Avenue upon which said lot was contemplated the building`
of a filling station. He stated they were opposed to the
building of the service station because of dirt, noise,
damage to value of property, a.nd the hazard it would caUSe
being so close to the elementary school. Considerable
discussion followed between the Council and the persons
present.

~~r. Philip M. Sadler, Chairrrlan of the Planning
Commission, displayed the proposed zoning map. He stated.
the Town would be zoned in six catagories, namely: business,
residential, industrial, schools, playgrounds and cemeteries.
He advised- Council that before the Town could be zoned, a
Z'nr_ing Commission would have to be a~~pointed by the
Juc~ne of the Circuit Court.
Upon motion duly made by W. A. Larson., seconded. by
M. E. Lester, it was unanimously
RESOLVID, that the necessary officials petition the
Circuit Court requesting the Town Planning Commission be
appointed as Zoning Commission for the Town of Pulaski,
pursuant to Section 15-824 of the Code of Virginia of
1950, as amended.
Upon motion of W. F. White, seconded by 0. 0. Crowell,
it was unanimously
RESC~LVID, that the Town Attorney and the Town Manager
are directed to prepare the necessary defense to the peti-
tion of Bascom E. Hopkins a.nd. Paul C. Roop to the Judge
of the Circuit Court of Pulaski County, for the issuance
of a building permit for a gasoline service station at
Fifth and DTorth Washington Avenue, which said permit was
denied by this Council in regular meeting on December h, 1955.
Upon. motion of W. A. Larson, seconded by W. F. ;Jhite,
it was unanimously
RESOLVED, that action be deferred on the building
permit application of °d. D. Macgill, Jr., for a service
station at the P?orth?nest corner of First Street South and.
'.~lashin~ton Avenue.
The Counca_1 reviewed and discussed the bids as
submitted and as recorded in the minutes of the special
meeting of December 15, 1955, for cor_struction of a million
~~
gallon water storage tank between Bertha and Chestnut Streets,
together ?~rith foundation therefor and. altitude valves for
the new tank, the Ride Street tank and the Filter Plant tank.

Engineers, Lynchburg, recommending the acceptance by th0
Town. of the low bids as submitted. Whereupon on motion of
J. R. ASartir, seconded by W. A. Larson., it was unanimou~~y
RESOLVED, that the Towr_ Council does hereby accept
the bid of Davis and Armentrout, Pulaski, Va., in the
amount of ?23,100 and the bid of Richmond Engineering CQ.,
Richmond, Va., in the amount of X33,274.00 for Division x
and Division II respectively of plans and specifications
as prepared for the Towr_. by Wiley & Wilson for the const~ruc-
tion of a one million gallon storage tan'r anal related
features.
The Council noted that X58,000 had been appropriated
for the construction of the tanl, and related items in t
1955-56 Budget and further noted that t'zis amount was not
sufficient for the estimated cost of construction of
X72, ~+-Q.00 as itemized ir.. the minutes of December 15, 19'5,
plus `~~+,650.00 for engineering fees ma'iing a total of
X77,199.00. It was the decision of Council that the
project would be proceeded with and that if necessary ad~.i-
tional appropriations would be made when necessary or if
additional funds should not become due in the current buget
.year that the remainder would be appropriated in the 195-57
budget.
Cn motion duly made by 'v~l. A. Larson, seconded by
~~J. F. White, it was unanimously
RESOLVED, that the Town A?anager is instructed to pace
or~er for the 12 inch cast iron pipe necessary for the water
line from Commerce Street to the proposed tank site. Sad
pipe to be delivered when necessary and that the Counci
will appropriate funds in payment thereof upon receipt off'
billing from the supplier.
Upon motion of W. A. Larson, seconded by J. R. Margin,
and by recorded vote as follows:

RESCLVID, that the following revision be made in
Section 5. (2'7) of the Totm Charter:
5. (2'7) Licensing of motor vehicles. To require
every owner, tahether it be a person, firm, or corporation, or
every resident, of the Town who shall own, or have in his
custody, or under his control, a vehicle of any kind
which shall '~e operated on the streets, alleys, or public
ways of the Town, or every person, firm, or corporation
rot a resident of the Town who shall habitually keep or
garage a vehicle in the Town of Pulaski, and every person,
firm or corporation not a resident of the Tom who shall
operate on the streets, alleys or public ways of the Town
a vehicle of any kind for the purpose of pick-up or delivery
in furtherance of or in connQction with the conduct of a
busir_ess located Urithin the Town, to annually register such
motor vehicles, on a date to '~e designated by the Council,
and to obtain. a license to operate the same by making applica-
tion to such as may be designated by the Council of s,~:id
Town to issue sa.i.d license, and to require the said owner,
resident, or custodian to pay an annual license fee therefor
to be fixed by the Council, and to prohibit the use of
streets, alleys or public ways of the Town without such
license. No such license shall be required of a. non-resident
of the Town who shall use a vehicle exclusively for his own
personal transportation to and. from his place of employment
within the Town.. And further to provide a license plate as
evidence of the registration of said motor vehicle and pay-
ment of the license fee, and to require that said license
plate be attached to and prominently displayed upon the
motor vehicle so licensed.
BE IT FURTHER RESOLVED, that the following r~vi~ion
be made in Section 8. (1)
COUNCILMEN
SECTIOn' 8. (1) Election Councilmen shall be
elected for the first time under the provisions of this
Charter on the second Tuesday in Jur_e, 1956, and on the
second Tuesday in June every two (2) years thereafter, as
herein provided. At the first election to be held under
tti~is Charter on the second Tuesday in. June, 1956, there
shall be eight (8) councilmen elected at large from the
Town of Pulaski; four (!~-) councilmen thereof to be elected
for a term of four (4) years and four (~-+-) councilmen to be
elected for a term of two (2) years, with the determination
of which of the councilmen shall serve four (~!-) years and
which of the councilmen shall serve two (2) years to be
made at the council's organizational meeting held in
September after the said election. At the organizational
meeting in September, 195b, eight (8) slips of paper shall
be *~laced. in a container. On four (~+) of said slips there
shall be written "Two Years", and on fQUr (~-) slips there
shall be written "Four Years". Each councilman elected
at the first election after the effective date of this
Charter shall draw one slip from said container,. and each
council~ran shall be declared elected for the term of years
designated on the slip of paper which he draws.
After the First election held in June, 1956, there
shall be an election held on the second Tuesday in June
every two (2) years thereafter, at which time four (L+-)
councilmen shall be elected at large from the Town of

Of the eight (8) councilmen to be elected in the
Town of Pulaski after the effective date of this Charter
all thereof shall be elected at large from said Town, thi~.t
is to say, there shall be no designation or no referenceEto
the election of any councilmen by wards.
(2) .Qualifications and electors. Any person
elected to or seel;ing the office of councilman shall be a
freeholder and a resident within and of the Town of Pul~ski~
and shall be a aualified voter in the Town election in w~iich
he or she offers and. any such person shall be eligible for
the office of councilman. All qualified voters who are
residents of the Town shall be entitled to vote for the
person seeking election as councilman t~rithout respect to any
t+rard in which either the councilman resides or the voter'
resides and he or she shall be entitled to vote for all.

(3) Term of Office. The eie~ht (8) coun~#il-
men elected as herein provided shall enter upon the disc2#arge
of their duties of office on the first day of September #lext
succeeding their election, and four (4) of said. c~uncilmetl
shall continue in office for a term of two (2) years and`: four
(~+) of the councilmen shall continue in office for a ter~i of
four (~+) years; the designation of which councilmen shah:
serve for two (2) years and which councilmen shall serve for
four (~~) .years shall be determined as hereinabove providlgd~
and shall continue in office until their successors are
qualified. The terms of office for all councilmen elected
after the first election held. hereunder shall be four (~-~
years, or until their successors are qualified.
BE IT FU'~'.THER RESOLVID, that the following r~visi~n
be made in SECTION 19. (1) (a). The Totitirn shall be gover ed
by a council composed of a mayor elected at large and ei ht
(8) councilmen elected for the term and in the manner he ein-
before prescribed. The mayor and the councilmen respectively
and. the council as a collective body, consisting of the Mayor
and. councilmen, shall have and exercise all the powers, t;
functions and duties conferred upon them respectively by~~this
charter or by general law, except such as they may from ~~ime
to time delegate to the town manager, and the delegation`bf
ar_y such potirers may at any time be revoked by the counc~'l.
Upon motion duly made by J. R. Martin, seconded by
~~i. A. Larson, and by vote of all members present with the
exception of W. M. Farmer, who abstained from voting be !it
resolved that
?dH~'REAS, the Town Council has been formally notifi~~l
of the rejection by the Board of Supervisors of Pulaski
C^unty of the Subdivisior_ Ordinance as passed on first r9~rad-
ing by the Town Council on nTOVember 1, 1955, and as served
on the membership of the Board of S~,pervisors by duly
authorized action of the Town. Council, and

WHEREAS the Town Planning Commission has recommended
this date to the Towr.. Council certain revisions in the
ordinance as follows:
1. That the right of way widths of subdivision streets
be a minimum of 60 feet be revised to permit a minimum of
50 feet for local subdivision streets and roadways and
require a minimum of 60 feet width for primary through
streets anc~ roadways as referred. to in Section 7.2
2. To delete the requirement that lots having public
sewer connection but not having public wafter connection shall
have a minimum of 15000 square feet in area as provided for
in Section 7.17.
3. To delete the requirement for surfacing of streets
or portions thereof as maY be located outside the corporate
l:i.mits in subdivision partly within and partly itirithout the
corporate limits.
~+. To delete the requirement that the subdivider tap
t1rater and sewer mains for individual lot lines and extend
service lines into and substitute therefor the require-
ment that su^h extensi~;ns and. tapping sha_11 be in acccrdance
with the existing or current specifications, rules and
regulations of the Town.
5. To make minor revisions throughout the ordinance
which do not change the ir_tent of the provisions therein but
merely clarify and further explain such provisions Therefore
BE IT RESOLVED, that the Town Council does hereb~T
accept such recommendation of the Planning Commission in
their entirety and does hereby direct that the ordir.an_ce as
passed ley first reading bey accordingly, revised and b..ereby
adopted on this the second readings and
BE IT FURTHER RESOLVID, that the followi~ ordi ranee
is hereby adopted;

ordinance, as revised from its first reading, on its secd~nd
reading, the Town Clerk shall hasTe certified copies thereof
lawfully delivered. or served on the Commonwealth's Attorney
for the County of Pulaski, the Chairman of the Board of
Supervisors and each member of said Board, the Chairman ~f
the County Planning Commission and each member of the
Commission, which delivery or service shall constitute notice
to the governing body of the County of Pulaski of the ink
tention of the Town of Pulaski to adopt the regulations ~~n-
~ained in this ordinance, as revised, and a request of sV~~ch
governing body to review and approve or disapprove such
regulations, pursuant to the provisions of the Code of
Virginia of 1950, as amended.
The Town Manager brought to the attention of the

Mayor and the Council the fact that a recorded vote shou~tl
have been taken to confirm postponement of delinquent tart
sale scheduled for December 12, 1955, which action was
ta?~en at the regular meeting of Council on December 6, 1955.
The motion of W. F. White as seconded by J. R. Martin, was
read and the following recrorded vote taken:

Following recommendation by the Town Manager and
Chief of Police, on motion duly made by J. R. Martin,
seconded by 'JJ. M. Farmer, it was unanimously

operation of taxicabs, ~revicusly in effect, be approved
for the year ending December 31, 1956, subject to all of
the terms and conditions of the Taxicab Ordinance:

had been pending for new cabs which were not renewed at this
hearing ..n accordance with policy. They therefore are

Councilman Martin gave a report on the meeting of the
Rural Affairs Committee with the Curb Market Committee of
the Chamber of Commerce. He stated his committee assured
them they could use same space beside the firehouse next
,year as they had this year and the Curb Market Committee was
asked. to mike a list of things they would need that could
be presented to Council for their consideration. Councilman
Martin further stated that nothing was discussed about
charges; however, they do expect to pay their way.
The Mayor advised the Council that he had discussed
with Mr. E. P. Bunts the possibility of the Town purchasing
the building owned by him on the Southeast corner of First
Street, North a.nd Washington Avenue for a municipal building
and that Mr. Bunts is desirous of selling the building.
The Town Manager gave Council a description of the building
and discussed renovation necessary to make the building
adaptable to the needs of the Town.
On motion of W. F. White, seconded by 4d. A. Larson,

RESOLVED that the Mayor pursue the matter as to
price and bring it back to Council for further consideration.
The Town Manager recommended to Council that some
negotiations be undertaken with the County to see if som9t
thing can be worked out on procuring a water truck which'
the Town can maintain and operate for county fires. He
stated it is necessary to take the flusher out of fire
service inasmuch as it is not equipped nor properly built
for fire fighting.
On motion of W. I'. White ~ seconded by W. A. Larson ~
it was unanimously
RESOLVED that the Town Manager appear before t.~e
County Board of Supervisors to see what arrangements can 'be
made .
The meeting adjourned at 6:10 p.m.
