Council Minutes
Pulaski, Va., January 3, 1856
The minutes of the regular monthly meeting of the
Town Council of the Town of Pulaski, Virginia, held on
the 3rd day of January, 1956, at 4 p.m., in the municipal
offices.
There were present:

The meeting was opened with a prayer by the Rev.
George Ogilvie, pastor of the First Presbyterian Church.
The minutes of the regular monthly meeting of December 6,
1Q55, the special meeting of December 15, and the semi-
monthly meeting of December 20, 1955, were read and
approved.
Kenneth Williams, a resident of Bowling Court,
appeared before Council and asked. that the block in which
he resided be chan~edon the zoning map from Commercial to
residential. AIr. Williams was assured that his request
would receive consideration.
The Town Mara¢er reported that the revised Subdivision
Ordinance was served on the members of the Board of
Supervisors on December 2°, 1955.
The Council was advised of the appointment by Circuit
Court order dated December 31, 1955, of the Planning
Commission as the official Zoning Commission of the Town.
The Town Manager reported that the Zoning Commission
had met earlier ire the afternoon and had adopted formally
a zoning map for the Town, being the same map as presented
at the last meeting of Council. This map was discussed

briefly by Messrs. Sadler and Bailey. The Council furth~~
was advised that the Zoning Commission. had reviewed ant
interim zoning ordinance which had been prepared for the~~
consideration and. that the Zoning Commission found its
provisions to be in accordance with the anticipated requ~~e-
ments of a formal zoning ordinance. The Council reviewed and
d_is~zssed the proposed. interior, zoning ordinance with the
Town Attorney.

T~IHEREAS, it is the desire and purpose of the Council of
the Town. of Pulaski, Virginia, to regulate the location"af
trade and. ir_dustry within the Tot,rr. and to set aside certain
areas thereof for the location of residence homes; to lilt~it
the height and bulk of buildings erected therein; to pretent
the over-crowding of l~.nc~. and avoid. the undue congestionof
population ~.rd public highways; to protect and stabilize
property values, and in general to promote the public health,
prosperity, safety, and welfare by the adoption of an ordinance
dividing the area of the Town into districts and prescri~ling
suitable, appropriate and reasonable restrictions for th4
use of property in said districts as may be necessary fob the
fulfillment of the purposes of this ordinance; and,
WHEREAS, the Council did authorize and establish a~:
Planning Commission for the Town of Pulaski, Virginia, ~
February 20, 1951, and said Town chid, by further action ~
December 20, 195, request the Circuit Court of Pulaski `

County, Virginia, to appoint the said Planning Commission
as the Zoning Commission for the Town. of Pulaski, Virginia,
pursuant to the Acts of the CTeneral Assembly of Virginia
in such case made and provided; and,
WHEREAS, by odder of said. Court of December 31, 1855,
the said Planning Commission was designated as Zoning
Commission for the Town of Pulaski, Virginia; and,
Tf1HEREAS, the said Planning Commission has, since its
inception, studied the land area of the said Town, made sur-:
vet's and. maps thereof, and given much consideration to a
comprehensive zoning plan and has had certain preliminary
zoning maps prepared; and,
?,~1HEREAS, the Planning and Zoning Commission of the
Town of Pulaski, Virginia, did. in a special meeting on the
3rd day of January, 195h, consider the contents of the draft
of a proposed Interim Zoning Ordinance and find it in basic
agreement with the ideas and plans which they have under
consideration for inclusion in a final zoning ordinance
which it is their intention to propose for adoption bZT the
Council of the Town of Pulaski, Virginia, and representatives
of said Commission have so advised the Council this date.of
that fact;
NOW, TF?EREFO?~E, BE IT ORDAII~?ED AS FOLLOWS:
SECTIOT? ~ - General Regulations.
(a) No Lot, building, or structure shall hereafter be
used, and no building or structure, or part thereof, shall
be constructed, erected, raised, reconstructed, extended,
enlarged or altered except in conformity with the regula-
tions prescribed by this ordinance.
(b) That no permit for any construction shall be
issued by the Council of the Town of Pulaski, or by its
Building Inspector at its direction, without the applica-
tion for such building permit being, first referred to the
Planning and Zoning Commission for consideration and
recommendation to the Council;
(c) No existing building within the Town not now
lawfully used. for ~n~austry or business purposes shall be
altered, re-modeled, or converted for industry or busir..ess
purposes without a permit from the Council of the Town of
Pulaski., and no such permit shall be issued without the
application for same being referred to the Planning and
Zoning Commission for consideration and recommendation to the
Council.
(d) Nothing in this ordinance shall prevent the
strengthening or restoration to a safe or lawful condition
of any part of any building or structure declared unsafe or
unlawful by the Building Inspector, the chief of the fire
d.epartmert, or other duly authorized town official.
(e) The occupancy of a building or premises by a
watchman or caretaker for sleeping quarters shall not
constitute residential occupancy ~,Jithin the meaning of this
ordinance.
(f) No temporary buildings or structures used or
intended to be used as a place of public assembly, such as
tents, stands, platforms and booths shall be erected or
occupied in any residence or business district; and no
temporary building or structure shall be erected or remain
in any type district for a period exceeding 60 days. This
is not intended to prohibit the erection of temporary tents,
stands, pllatforms and booths ir_ public streets or on public
property when such structures are authorized by the Town, nor
the erection and use of temporary buildings by contractors at
the site of constructie~n work.

SECTIOP? II - Classification of Districts. For the
purpose of this ordinance the Town o,f Pulaski is hereby
divided into three classes of districts as follows:
(1) Residence district,
(2) Business district,
(3) Industrial district.
SECTIOP? III - Boundaries of Districts; Zoning Maps;
Determination of questions as to Boundaries. The boundaries
of each of the districts provided for by Section I above are
hereby established as shown on the map entitled "Zoning Map
o.f Pulaski, Virginia", dated January 3, 1956, signed by the
Mayor and. Clerk of the Council, ~~~hich said map is hereby d~-
clared to be a part of this ordinance. These district
boundary lines are intended to follow street or lot lines
as they existed or. the date of said map. In the case a
district boundary line is not clearly referenced or there
is a doubt in a particular instance as to tirhat line is
determining, the question of such d.etermir~ation shall be
adjudicated by the Town Council. The said map and all
notations, references any designations shown thereon shal7~~~
re as much a part of this ordinance as if the sane were alb
fully described herein.
SECTIOAT IV - Definitions. For the purpose of this
or~?inance certain. terms and words are herein defined as
follows: Words used in the present tense may include the
future; the singular number include the plural, and plural
the sir..gular; the word "structure" includes the word "bu~.lk~ing".
Terms not herein defined shall be construed as may be defied
in the Building Code of the Town of Pulasl~i.
(1) "Accessory building" : A subordinate building o3
the same lot with a main. building, whose use is incidental'to
that of the main building.
(2) "Building": Any structure for the support, shelter,
or enclosure of persons, animals, chattels or property of ~.ny
kind.
(3) "Building, temporaries": Any structure which is
intended to be used or occupied for only a limited time or
which is not permanently supported by a foundation. `~
(~') "Dwelling": Any building or portion thereof whch
is designed or used exclusively for residential purposes.
(5) "Dwelling, single family": A bu~.lding designed:
for or occupied exclusively by one family.
(6) "Dwelling, two family": A building designed for
or occupied by two families.
(7) "Dwelling, multiple": A building, or portion thl~re-
of, designed for and occupied by more than two families, at~l
all living units of which are to be maintained under singly
ownershi or management.
(8~ "Family": One person. or any number of persons :'
living together as a sinffle housekeeping unit whether related
to each other legally or not; and shall be deemed to incline
servants.
(9) "Structure": An edifice or building of any kind,
or any piece of work artificially built up or composed of
parts joined. together in some definite manner.

SECTIOT? V - Use regulations of residence district.
`vdithin a residence district as indicated on the zoning mape
r_c lot, building or structure shall be used and no buildi g
or structure shall be erected which is intended or designe
to be used, in whole or in part, for any industrial, manu-
facturing, trade or commercial purposes or for any other than
the following specified purposes: (a) sir_~gle family dwel~;ings;
(b) two family dwelling (c) multiple family dwellings;
(d) accessory uses and structures customarily incident to'
private residential uses as private garages, servant's qua+ters,
a poultry house, and private fuel storage buildings.

Section VI - Business district - use regulations.
~~Jithin any business district as indicated on the zoning map,
no lot, building or structure shall be used and no building
shall be erected. which is intended or designed to be used in
whole or in part for any industrial or manufacturing purpose
or for any other than the following specified purposes;
(a) bakeries and confectionaries whose products are sold
at retail and only on the premises; (b) banks; (c) barber-
shops and beauty parlors; (d) filling stations or automobile
service stations; (e) greenhouses and. nurseries; (f) dry
cleaning anc~ laundry ~~lants; (g) restaurants; (h) retail
stores; (i) places of amusement and assembly; (j) any
retail or wholesale business or service not specifically
restricted. or prohibited; (k) signs applicable to goods
sold and. services ren~ered on the premises upon which signs
are displayed; (1) funeral homes and undertaking establish-
ments; (m) printing plants and newspaper offices; (n) tourist
courts and. tourist camps.
SECTION VII - Industrial district - use regulations.
In any industrial district as indi ~.ted on the zoning map
there shall be no restrictions as to use except no lot,
bl.l;lding or structure shall be used and no building or
structure shall be erected which is intended or designed
to be used in whole or in part for any use which is in
conflict Urith any ordinance of the Town of Pulaski now
existing or hereafter enacted, nor for any use or purpose
which as determined by the Town Council will create or is
likely to create conditions of smoke, fumes, noise, odors
or dust detrimental to the health, safety or general welfare
of the community.
SECTIOr? VII - Non-conforming uses. Any use or structure
existing at the time of the enactment or subsequent amend-
ment of this ordinance but not in conformity with its pro-
visions, may be continued with t1~ following limitations.
Any use or building which does not conform to this ordinance
may not be: (a) changed to another non-conforming use;
(b) re-established after discontinuance for twelve months;
(c) extended, except in conformity to this ordinance; or
(d) rebuilt after damage exceeding two-thirds of its fair
sale value immediately prior to damage.
SECTION IX - _Application of ordinance to bull
permits were issued prior to effective date o
and/or amendments. Nothing herein contained shall require
any change in the plans, construction, size or designate use
of any building, structure or part thereof for which a build-
ing permit was granted by the inspector prior to the effective
date of this ordinance and the construction of which from said
plans is commenced. not later than 60 days following said
effective date.
SECTIOT? X - Interpretation, purpose a.nd conflict. In
their interpretation and application, the provisions of this
ordinance shall be held to be the minimum requirements adopted
for the promotion, health, safety, morals or the general
welfare of the community.
It is not intended by this ordinance to repeal, abrogat
annul or in any ~~ray to impair or interfere with any other
existing provision of law or ordinance, or any rules, regu-
lations, or permits adopted or issued or which shall be
adopted or issued, pursuant to law regulating the use or
construction of building or premises; provided, however,
that where this ordinance imposes a greater restriction upon
the use of buildings than are imposed or required by such
existing provisions of law or ordinance or by such rules,
regulations or permits the provisions of this ordinance shall
control.

SECTIOT`T XI - Administratio r..
(a) This ordinance shall be enforced by the Town
Manager and/or the Building Inspector, who shall in no ca3e
grant any permit for the construction, alteration or use
any building or use of any lot, unti_1 and after the procedures
as set forth in Section I hereof shall have been completed
and fulfilled.
(b) It is the intention of this ordinance that all-
questions arising in connection with enforcement of the
ordinance shall be presented first to the Building Inspector
of the Town.
SECTIORT XII - Penalties. Any person violating any
provision of this ordinance shall be deemed guilty of a
misdemeanor and shall upon conviction be fined not less tT~ian
Ten Dollars (?510.00), nor more than One Hundred Dollars
0100.00) for each offense. Each day such violation con-
times shall constitute a separate offense.
SECTIOPT XIII - Effective date. This interim ordina~ice
shall take effect and be in force immediately after its
adoption., the public welfare demanding it and an emergency
existing. ~,
The Town Manager presented a revision of the proposdid
metes and bounds description of the corporate limits of tTe
Town with particular reference being made to the description

TIHEREAS, the Towr. of Pulaski, Virginia, through a
d~~ly appointed Charter Committee, did study several chart9~r
proposals for amendments to the Charter of the Town of
'~ulas'~i , Virginia, and,
;ru~EAS, upon. recor^mendatior: of the Charter Study
Commission, the said Town did, in regular session, on the
6th day of September, 1955, adopt an ordinance setting ou13
a proposed. change in the form of Town Charter pertaining
to the election of councilmen and authorizing the Town,
through its proper officials, to petition the Circuit Cou~"~t
of Pulaski, County, Virginia, to call a referendum for the
purpose set out in said ordin_arce; and,
?~IKEREAS by proper procedure, a petition was filed ~t~d
said Court did order an election, which election was held !on
the 22nd day of r?ovember, 195, pursuant to order entered
in the Circuit Court of Pulaski County, Virginia, on the $th
day of October, 1955, in the matter of "Proposed Change i~
the Form of Government of the Toti~rn of Pulaski, Virginia"; Viand,

MOTOR VEHICLES
SECTION 5. (27) To realuire every owner, whether i~
be a person, firms or corporation, or ev^ry resident, of the
Town who shall own, or have in his custody, or under his
control, a vehicle of any kind which shall be operated on~the
streets, alleys, or public ways of the Town, or every pef~so n,
firms or corporation not a resident of the Toti~rn who shall,
haoitually k"ep or garage a vehicle in the Town of Pulaski,

Town who shall operate on the streets, alleys or public ways
of the Town a vehicle of any kind for the purpose of pick-up
or delivery in furtherance of or in connection with the
conduct of a business located s~rithin the Towr, to annually
register such motor vehicles, on a date to be designated by
the Council, ~~_nd to obtair_ a license to operate the same by
making application to such as may be designated by the Council
of said. Town to issue said license, and to require the said
owner, resident, or custodian to pay an annual license fee
therefor to be fixed by the Council, and to prohibit the use
of streets, alleys or public ways of the Town tirithout such.
license. No such license ~ all be required of a non-resident
of the Town who shall use a vehicle exclusively for his own
personal transportation to and from his place of employment

evidence of the registration of said motor vehicle and pay-
ment of the license fee, and to require that said license
plate be attached to and prominently displayed upon the
motor vehicle so licensed.

SECTION 8. (1) Election.
Councilmen shall be elected for the first time under
the provisions of this Charter on the second Tuesday in June,
1956, and on the second Tuesday in June every two (2) years
thereafter, as herein provided. At the first el~Ction to be
held un~er this Charter on the second Tuesday in June, 1956,
there shall be eight(8) councilmen elected at large frorl the
Town of Pulaski; four (~+) councilmen thereof to be elected
for a term of four (~-+-) years and four (~-) councilmen to be
elected for a term of two (2) years, with the determination of
which of the councilmen shall serve four (~) years and which
of the councilmen shall serve tT~ro (2) years to be made at
the Council's organizatioral meeting held in September after
the said election. At the organizational meeting in September,
1956, eight (8) slips of paper shall be placed in a container.
On four (~-'-) of said slips there shall be written "Two years",
and on four (~-+) slips there shall be written "Four years".
Each councilman elected at the first election after the
effective date of this Charter shall draw one slip from sa~.d
container, and each councilman shall be declared elected for
the term of years designated on the slip of paper which he
draws.
After the first election held in June, 1g56, there shall
be an election held on the second Tuesday in June every two
(2) years thereafter, at which time four (~-) councilmen shall
be elected at large from the Town of Pulaski for a term of
four (1+) years.
Of the eight (8) councilmen to be elected in the Town
of Pulaski after the effective date of this Charter, all
thereof shall be elected at large from said Town, that is to
say, there shall be no designation or no reference to the
election of any councilmen by wards.
(2) Qualifications and Electors
Any person. elected to or seeking the office of council-
man shall be a freeholder and a resident ~rrithin and of the
Town of Pulaski, and shall be a qualified voter in the Town
election in ~~rhich he or she offers, and any such person shall
be eligible for the office of councilman. All qualified voters
who are residents of the Town shall be entitled to vote for
the person seeking election as councilman without respect to
any ward in ~rhich either the councilman resides or the voter
resides, and he or she shall be entitled to vote for all
coundilmen see?~ing office in that election.

(3) Term of Office.

The eight (8) councilmen elected as herein provided
shall enter upon the discharge of their duties of off ice mn
the first day of September next succeeding their election
a_nd four (~~-) of said councilmen shall continue in office fir
a term of two (2) years and four (~+) of the councilmen shall
continue in office for a term of four (~-+) years; the desi ~ia-
tion of which councilmen shall serve for two (2) years an~
which councilmen shall serve for four (~-) years shall be
determined as hereinabove provided, and. shall continue in
office until their successors are qualified-. The terms o
office for all councilmen elected after the first election
held hereunder shall be four (~-) years, or until their
successors are qualified.
SECTION? 19. (1) (a) The To~,~1n shall be governed by
a council composed of a mayor elected at large, and eight;
councilmen elected. for the term and. in the manner hereinb~ore
prescribed. The mayor and. the councilmen respectively an
the council as a collective body, consist~.ng of the mayor
anc~ councilmen, shall have and exercise all the powers,
functions and duties conferred. upon them respectively by
this charter or by general law, except such as they may
from time to time delegate to the town mar_ager, and the ;.
delegation of any such powers may at any time be revoked ~~
the council.
NOW, THEREFORE, BE IT RESOLVED:
(1) That the To~.•m of Pulaski does hereby formally

request the General Assembly of the State of Virginia to
amend and re-enact the said Charter as proposed.
(2) That the To~•m of Pulas'Ti, Virginia, request thy'
member of the General Assembly from Pulaski County to present,
for re-enactment, the said Charter, as hereinabove amended
and re-ordained, to the General Assembly of the State of
Virginia which convenes in regular session on January 11,

(3) That the members of the said Council did record'
their vote as hereinbefore stated.
The Town. Manager presented a proposal yahereby the
Federal Government would. advance the engineering expenses ~'or
engineering studies on several long range projects, such a
the East Main Street bridge, Third Street and parking lot
over Peak Creek. Council discussed the matter at some length
with particular emphasis being given to the East Main Strut
bridge; however, no action was taken.
Upon motion of W. F. White, seconded by I. R. Carper
it was unanimously
RESCLVED, that the Mayor and Town Manager investigate
the possibility of the Town obtaining from the estate of M~!.

Frank Wysor such interest as the late Mr. Wysor might have
had in Peak Creeks should the Creek Channel be determined
as privately owned.
Councilman C. T. Brookman asked that Council be given
time ~.t the next meeting to discuss the future plans and
progress -if Pulaski.
Ma~ror Jac?son advised Council he had no report to
make on the Bungs property.
Upon motion of W. M. Farmers seconded by I. R. Carper
it was unanimously
RESOLVID~ that the Town assume its pro rata share of
taxes on the tar.'r site property recently purchased on Bertha
Street.
On motion of W. N". Farmers the meeting adjourned at
6 :05 p.m.
