PT~SENT There were present: Mayor C. V. Jackson, presiding '° Councilmen: I.R. Carper, 0.0. Crowell, J.C.(~umbley, W . A. Larson, F. Vlt. Mars hall, J. R. Martin, V[r. F. whits. j Absent: J. L. Keeling. Also present: Town Manager: Julian F. Hirst Clerk: Louise D. Logan Town Attorney: Garnett S. Moore Visitors : Billy B. Flint of the Southwest~imes Inc.,. ANNEXATION The Mayor called tY~.e meeting to order. TOI~i'N MANAGER The Town Manager, called upon for a few intrductory OUTLINES ANNEXATION remarks relative to annexation, stated that a report on the PROCEDURE feasibility of annexation prepared by Mr. Edward Ruehl of ~j. , Stuart Royer & Associates, RicYanond, Virginia, several yea~$ts ago, presented some conflict in its reference to the old and nevi law of annexation, but that all references to the old law shou~-3~ be ~ ~ entirely disregarded as the new annexation law adopted in 52 by the General Assembly would apply. ~'' x Mr. Hirst outlined the steps in annexation tube: d®cision by Council as to whether the Town will annex, andif so, what territory; consultation with engineers to prepare the~case for annexation, together with the Town Attorney; case as petition submitted to Court for a court to be appointed to sit on tll~s case; appointment by State Supreme Court of ;three judges to sit ~h the annexation ease, which thr®® are composed of the local jud~ja and two others selected by him; meeting of the three appointed; judges with the Town Attorney and other Town officials wit any $~ attorneys representing opposition groups, at which meeting settlement of certain premises is arrived at; the sitting ~~ of ~~~-i~ ~~~. It was advised that any decision finding ann®xation not feasible, thus denying th® petition of the Town, was arrived at solely on the opinion reached by the three fudges, their opinion being arrived at in consideration of whether people in annexed territory would benefit therefrom, whether the Town would benefit from annexation, wh®ther the Town would be in position to take care of the annexed territory the the relationship of the proposed area to the Town on such factors as employment, -public services, education, religious facilities, etc. Following which was Court decisi on as to requirement of Town as to capital outlay expenditures in annexed territory and the standing by of the Court for a period of five years to assure the expending of the established amount. He stated that, should the Town ~ s petition for annexation be refused, however, there was a waiting period of five years before another petition could be presented. The Town Manager advised Council that a~major consideration by Council would be determination as to whether the Town was in a position to take care-of the annexed territory, and also, whether the annexed territorg would be of benefit to the Town. }~E~_ He advised it was his opinion that any LXPEI~DITUFtE BALANCE revenue received from the annexed territory for the first PRIMA3~ CONS TDERATIQ~ive years would have to be used for capital improvements which would include street improvements, water, sewer and general budgetary items considered as capital improvements. He stated further that the State Highway Funds and the A. B. C. minds would be increased appreciably but such operating expenses as police, fire and regular water and sewer maintenance, plus garbage collection would be met from such additional revenue, plus revenue from existing Town sources. SPECIAL The Council decided to hold a special meeting on MEETING January 21, 1954 at 4 p.m. to further discuss the sub~ectt of annexation.
