HomeMy WebLinkAbout02-15-559~ ~~~~ Council Minutes Pulaski, Virginia, February 15, 1~~5 The regular semi-monthly meeting of the Town Council of the Town of Pulaski, Virginia, was held on the 15th day of February, 1955, in the municipal building, Pulaski, • Virginia. There were present: Mayor C. V. Jackson, presiding " Councilmen J. R. Martin, W. A. Larson, W. F. White, W. M. Farmer, 0. 0. Crowell, C. T. Brookman, I. R. Carper, M. E. Booze James Sayers Mary Porter Edna Patterson The meeting was opened with a prayer by the Reverend Elwynn Williams, pastor of the Aldersgate Methodist Church~~ The minutes of the regular monthly meeting of February' 1, 1955, were read and approved. The Clerk read a request by James Montriville Sage t~! move his cab from Safeway Cab Stand to Star Cab Stand, whilih request was granted by the Town Council. The Clerk also read a request by Samuel Crockett Roope to move his cab from the Star Cab Stand to Safeway Cab Stand, which request was granted by the Town Council. Mr. R. I. Brown, Attorney at Law, appeared with and on behalf of Mr. J. C. Lyons and requested permission for ~Ir. Lyons to keep a small amount of coal on his property known as Claremont Grocery, Newbern Road, and to take orders for' larger amounts to be delivered from mine. Mr. T. C. Booze appeared before Council to explain th! benefits of his blanket insurance policy for volunteer firemen. Mr. James Sayers appeared before the Council in rega~td to the garbage fee assessment on a house he rents in which;! :f ~~~~~~ Council Minutes Cont'd Pulaski,Virginia, February i5~ 1955 the renter uses only one room and takes his meals out. Mayor Jackson advised Mr.Sayers there was nothing that could be done about the fee inasmuch as the ordinance states that every- one on the garbage route will be assessed. Mary Porter and Edna Patterson appeared before the Town Council requesting water service to their residences on Case Knife Road. The Mayor advised that the area was not to be developed until 1957 under the tentative water extension program. , Upon consideration of Mr. J. C. Lyon's request to sell coal from his property on Newbern Road and upon motion made by J. R. Martin, seconded by 0. 0. Crowell, it was unanimously RESOLVED that application for license be denied Mr. Lyons by reason of Section 9 - 5 of the Town Code. After a general discussion of the merits of the blanket insurance policy on volunteer firemen presented by Mr. Booze and the policy now carried by the Town, it was decided by the Council that Mr.Booze should make application for admittance to The Pulaski Fire and Casualy Insurance Board before his proposal could be further considered. The Town Attorney then read the amendments to the Garbage Collection and Disposal Fee Ordinance that had been adopted at the last regular meeting of the Town Council. Upon motion of W. A. Larson, seconded by 0. 0. Crowell, it was unanimously RESOLVED that the Garbage Collection and Disposal Fee Ordinance, with amendments, be approved. Section 9 - 23 - Schedule of Charges and Fees For the services rendered by the Town in 'providing for and making municipal collection and disposal of garbage and rubbish as provided in Chapter g, excepting, however, the provisions of Sec. 9 - 17, and such aections as may otherwise specifically be excepted from this section , there shall be, and hereby is, established monthly collection charges, together with the necessary provisions for estab- lishing said system of charges, assessing, collecting an+d ~ _. ~~~ 1 Council Minutes Cont~d Pulaski, Va. Said fees and charges are hereby set out as Schedules A and B, as follows : 1 1 1 Schedule A - iiesidential Charges ~'or single family dwellings consisting of 1 to 4 rooms, inclusive, X0.50 For single family dwellings, consisting of 5 car more rooms 0.75 Schedule B - Business Charges The minimum charge shall be 0.75 For from 1 to 5 total containers, 'inclusive, per month 0.75 For from 6 to 20 total containers, inclusive, per month 1.50 For from 21 to 30 total containers, inclusive, per month 2.00 For from 31 to 40 total containers, inclusive, per month 3.00 For from 41 to 50 total containers, u inclusive, per month 4.00 i+br from 5l to 80 total containers, inclusive, per month 5.00 For from 81 to 120 total containers, inclusive, per month 7.50 For from 121 to 160 total containers, inclusive, per month 10.00 For Prom 161 to 200 total containers, inclusive, per month 12.50 For from 201 to 260 total contact. Hers, inclusive, per month 14.00 "` For volume in excess of 260 total containers per month, the charge shall be at the rate oP X1.00 per each 100 containers h Section 9 - 24 -Procedure and basis of assessing charges under Schedule A ^ .~ .w ', s Schedule A as provided in Section 9 - 23 shall apply , to all single family detached dwellings located within they' corporate limits of the Town. The Town Manager shall determine by proper survey they number of rooms contained in all single family dwellings „, and shall compile and maintain records in the Town offices' of his findings. In ddtarm:ning the - numt~er of rooms within a dwelling under Schedule A, all rooms available for human occupancy or the conduct of household functions, whether or not in actual use, shall be aountbd, excepting, however, rooms exclusively used Por toilet purposes, a losets, open porches, attics, or basements.. In the event billing statements incorrectly record the number of rooms in a dwelling, or in the event the number of rooms in any dwelling is increased or decreased, the occupants or owner, as the ease may be, of said dwelling, shall immediatal,p notify the Town Manager. Charges under this Schedule shall be billed to the occupant of each dwelling; and, in the event the occupant is other than the owner and hasnot heretofore established a credit rating with the said Town, then the occupant shall, immediately upon entering the premises and at the time his request for water service is made, pay as a deposit a sum not greater than a minimum 'charge for services for a period of six (6) months. Said deposit made shall be refunded at such time as o®eupant shall move from the said premises after deducting therefrom any delinquent charges for services rendered hereunder. Section 9 - 25 - Procedure and basis of ss s'e s sine cahar~xes under Schedule B Schedule B as provided in Section 9 - 23 shall be applicable to all business establishments, apartment buildings, including duplex units, any ,buildings with two or more fam- ilies dwelling therein, lodging and rooming houses, hotels, industries, plants, schools, offices, office buildings, private and public institutions and establishments, and any and all other establishments, activities, or buildings not coming under Schedule A above. Fees and charges shall be assessed against each separate business establishment or activity within any particular building, and the billing shall be to the operator or owner, as the ease may be. Offieea or groups of offices within a building may be considered separately or collectively and charged under this Schedule asmay be determined by the Town Manager. However, charges made under this Schec3iile shall be determined on the basis of garbage and rubbish disposed of. The Town Manager shall make a survey of all the above set out commercial places and shall compile and maintain records of his findings in the Town offices, and shall from said information assess and establish appropriate charges for the services rendered under this Chapter. The Town Manager, by the aforesaid survey, shall deter- mine the average volume of garbage, rubbish, etc., regularly collected Prom each establishment, which average volume shall be stated igkerms of the number of 32-gallon containers re- moved Prom said locations. --.-. t y` i Ctru~.cil Minutes Cox~t t d Pulaski, Va. , February 15, 195 Charges shall be made upon the total number of such containers handled b.y the said Town at each location withi~i a period of one (1) month. In those establishments containing residential units,f, a minimum charge of 50¢ per occupied unit shall be assesse~t each month against each occupied unit in said establishment. However, in the event charges based on total volume disposed of in any such establishment or building shall exceed the total minimum Pee assessed for the building, then the higher rate shall apply. Bills for fees wand charges assessed against all apart ment buildings, or any 'like building with two or more fami.y dwelling units therein, will be billed to the owner of sai.~l building, or his agent. Section 9 - 26 - Miscellaneous procedure, information, etc. (1) The Town Manager is hereby authorized to print or cause to be printed all statements, bills, cards, or other pamphlets to set out schedules and to give the necessary inf ormation to residents of the said Town and to provide, and set up any other procedures necessary for the efficient carrying out of this Chapter, and Prom time to time to make minor and appropriate changes hereunder. (2) In the event any vacancy occurs in the oeeupancy~' of any unit under Schedule B, it shall be the responsibility of the owner or his agent to notify the Town Treasurer of said vacancy on forms to be provided by the Treasurer. Th~b Treasurer shall grant unto said parson filing the aforesail~ forms or notice of vacancy a credit which shall apply upon the next months bill, effective with the billing period cometeneing on the first day of the month following receipt of the said notification. Section 9 - 2? - Enforce~s~nt of ordinance by cutting off water servic®s and oth,Q~QJ3~i steps for collection. The Town Manager or Towh Treasurer is hereby authorized to direct the proper town officials to cut off water servi e to any establishment under Schedules A or B wherein the gad occupant refuses or fails to pay any and all charges assessed against him under this chapter, and is further authorized !to take any further or other ataps necessary to make collection of said indebtedness in any manner provided by law for col~+ lection of other town debts. Section 9 - 28 - Pro-ratA eharRes not allowed Charges hereunder shall not be pro=rated, and the minimum fee shall be assessed for a full month or any part thereof. ti~~~ Council Minutes Cont~d Pulaski, Va. February 15, 1.955 Section 9 - 29 - Application of ordinance to churchers_and parsonages The Town Manager or other authorized officials, in applying this ordinance to churches and church property shall be guided by the Following sections: (1) l~hferein a char ch and church parsonage are both located on the~same lot or property, the parsonage charge shall cover both Facilities and there shall be no separate assessment of the church. (2) Vrherein churches are located separately Prom the parsonage and have no facilities in such churches For the serving of meals or conduct of activities which would result in garbage or refuse, there shall be no charge or assessment made to such churches. (3) In such churches other than those exempted under A or B above, wherein there are facilities For cooking or other activities which normally result in garbage or refuse, assessments shall ba made in accordance with Schedule B of this ordinance. BE IT FtTRTHER RESOLVE~ID, that the Town Council does hereby reaffirm the purchase price of X500.00 for said property in accordance with previous action of the Town Council, and BE IT F[TRTHER RESOLVE, that the Clerk of the Council is hereby directed to take necessary action to have the said deed-recorded in the weed Books of the Clerk of the Court of Pulaski County. 1 1 1 h~ 1 ~j~r5~ Couz~~si1~ Minutes Contt d Pulaski, Virginia, February 15, 955 The Town Manager advised that Mr.. E. A. Ruehl of R. 3~Suart Royer & Associates, Consulting Engineers, would be here on; February 16, and he would like for the Annexation Committe! to meet with Mr. Ruehl at 4:00 in the Town office. The Town Manager further advised the Council that because of the severity of this winter the Torn had incurred a great deal more street work for this Spring than in prev~fou$ years and at a,latex~ date would request an appropriation t ~aomplete this work inasmuch as the funds from the present budget would not cover the cost of the work. Councilman Martin, Chairman of the Chartmr Study Com- ' zsittee stated that his committee had met twice and had nothing yet to present to Council. On motion of I. R. Carper, seconded by 11. A. Larson, it was unanimously RESOLVED, that Seven T housand Dollars 07,000.00} be transferred from the Street Bond Sinking Fund General accou~#t to the Street Bond Sinking Ptiin.d Savings Account in the Peop~ea National Bank, as provided in the current budget, and that Seven Hundred ~aelve Dollars and 50/100 0712.50 ) being ~ ~~ Jf / interest from Government Bond investments of the Sinking Fund be likewise transferred from present deposit in the Street Bond Sinking ~4,tnd General Account to the street Bond,; Sinking Fund Savings Account in the Peoples National Bank of Pulaski. M. Farmer, it was unanimously itESOLVED, that a deposit be made on rooms to be reserved at the Langley HAtel, Hampton, Virginia, for the League of Virginia Municipalities Convention on September 11, 12, and 13. The Mayor informad the Couneil that work had been com- pleted on the automatic gates constructed at the rai~.rpad crossings on 1~&ashington Avenue, Jeffers©n Avenue and Randolph Avenue, and request continents from the Council on the effee~--~ tiveaa$s of their operation.
