GASOLINE TANKS The matter of bond and insurance on gasoline
PUBLIC RIGHT-
OF-U~AY storage tanks located within the public Right-of-way was
discussed by the Town Attorney, and it was decided that
it s~iould be determined as to the cost of insurance
premium to have the affected garages make the Town a
party to their general liability insurance.
On motion duly made by 0. 0. Crowell,
seconded by T. F. V~'irt, it was unanimously
?MADE H. RESOLVED, that the refund of taxes to 1-G'ade
HORTON
H. Horton in the amount of 17.35, authorized by amend-

TAXES ment to License Code June 7, 1949, and not accepted by
Mr. Horton in that he desired to make payment of these
taxes, be credited to the proper tax account.

AGREEMENT RESOLVED, that the Mayor be authorized to

Operator
THIS AGREEMENT made and entered into in
duplicate this day of July, 1949, by and between the
Town of ~Pulaski~irginia, a Municipal Corporation, party
of the first part, hereinafter referred to as the Town,
and Porter Ham of Pulaski, Virginia, party of the second
part, hereinafter referred to as the Operator.
W I T N E S S E T H:
That for the consideration and upon the
terms and conditions hereinafter mentioned, the said Town
doth hereby extend and grant unto the said Operator the
right and privilege of conducting flying at the airport
known as Loving Field, near the Town of Pulaski, Virginia,
beginning July 13, 1949, for student pilot training, charter
flying, and for all other usual and normal flying opera-
tions ordinarily conducted from airfields similarily situ-
ated to Loving Field, with the privilege of buying and
selling commercially, airplanes or airplane parts, equip-
ment, motor fuel, services and repairs in connection with
Loving Field; and the said Operator hereby agrees to pay
to the said Town a yearly rental of Eight Hundred and
Twenty (820.00) Dollars, payable quarterly in advance,
and in addition thereto, one percent (lf) of the annual
gross receipts in excess of Five Thousand 05,000.00)
Dollars derived from said operation, which said percentage
of the gross receipts shall be payable to the said Town on
or before the 15th day of January of each year during the
existence of this agreement, and the same shall be computed
for the year preceding the 1st of January of each year.
For the year 1949, this amount shall be one percent (1~)
of gross receipts above Two Thousand Five Hundred
02,500.00) Dollars.
The said Operator further agrees to operate
said Loving Field and all of its facilities in an efficient
and businesslike manner; to provide adequate flying equip-
ment, facilities, fuel, and services for the normal convenience

and requirements of all persons operating or flying in airp anes
to or from the same; to provide at all times sufficient per onnel
far' the. safe and efficient operation of the same; and to co ply
with all rules, regulations, and requirements of the C.A.A.'~cover-~
ing the operation of the same; and further, to abide by suc rule
and regulations for the operation of said field as may be p a-
scribed by the Town, provided the same shall not be in conf ict
with the C.A.A. regulations. f

The said field and all its facilities, incl
the books of the said Operator, shall be open to inspects
examination by the Town at any and all reasonable times.

The said Operator further agrees to maintain . 11
runways in a safe condition for landing and taking off of 1
types of aircraft normally operating from said airport; to cep
the runways and approaches to runways smooth and free of a ~essive
growth of grass, weeds or other unsightly or dangerous obs uc-
tion; to maintain fences surrounding the said airport in a least
such state of repair as will preclude the entrance of catt7, or
livestock of any kind upon said runways, but with respect ~b
fences, this agreement shall be construed to be only for tYal
benefit of the Town; and that he will further execute bond~n the
amount of Five Thousand (5,000.00) Dollars, payable to the`' said
Town, and conditioned upon the faithful, efficient perform ce of
the agreements herein contained. The Town further grants to the
said Operator the right and privilege of erecting Nearby b ~ not
upon the runways of said airport any necessary structures ~
facilities incidental to the operation of said airfield, p vided
the approval of the C.A.A. shall be first obtained, and in
addition thereto, that the same shall be placed and arrang and
constructed under the sa pervision of the Town Manager.
It is further understood and agreed that the laid
Operator is not to have the right to sub-let or assign any ~-ights~
granted hereunder without the consent of the said Town, an
further that the Operator will take out and carry adequate,,
insurance to protect and save harmless both himself and th ~ Town
as a result of any personal in3ury or property damage whit 'may
be a consequence of said Operators activities in connects ~.~with
said airport operation.
It is further distinctly agreed and understoc~~d
between the parties hereto that the privileges herein exte ed
to the said Operator and all flying in connection with sai field
shall be subject to all rights and reservations whatsoever ow
existing, car that may hereafter arise i connection with a ce-
ments and arrangements between the Tovm of Pulaski and the nited
States Government, and more particularl with reference to he
Civil Aeronazties Administration branch thereof, hereinbef e
referred to as the C.A.A., and all priv leges not herein ted
to the said Operator are retained and r served to the said own.
It is further understood hat during the lif of
this agreement, the Town will not grant any other persons iliac'

AIRPORT There was discussed the purchase of land from
A dd.Land E. P. Whitman and J.W. Lewey for enlargement of the airport
-Whitman
&Lewey which had been under considera-t ion ~'or some time. It was
j reported that the deeds from the respective property owners
were now prepared and ready for execution, and payment sho~zld
be authorized. The original arrangements on the purchase
of this land were contingent upon Pulaski County paying
fifty percent (50f), and it was considered that the Town
mi~?ht delay appropriating their share of the cost until such
time as the County had provided necessary funds.
E.V.DAVIS A request of E. V. Davis that the Town pay a
proportionate cost in the construction of a sidewalk in
front of his garage~on south'Washington Avenue was presented.
Pio action tive~s taken as it was suggested that this work was
i done for the individualts benefit to provide a driveway to
r the service station. _
LEAGUE REGIONAL The Town Manager presented a report of the
MEETING
discussions at the League Regional Meeting held June 28
at Pulaski, and advised the Council that it was considered
that this meeting had been successful and the League had
expressed appreciation for the Town serving as host.
RANDOLPH The Town Manager reported that there had

regarding the Randolph Avenue Widening Project, and that
there had been expressed on behalf of the Town a desire
that, unless absolutely essential, no trees be removed,
and further, that the Town would be agreeable to decreasing
somewhat the width of the pavement if necessary, but that
a standard curb and gutter should be included in the plans
and sidewalk on the west side, although walk space on the

RESOLVED, that the Town Attorney be instructed
to prepare an ordinance prohibiting the parking of unlice~.sed

vehicles on the streets and public Right-of-ways. ~~ ~

It was reported that certain street improvement
were desired by George Bouras on 2nd Street, west of Ran
Avenue. This matter was referred to the Street Committe
consideration and report.
A request that the alley off of and west of J
Avenue between the properties of Temple C. Painter and R
V7augh be oiled was discussed. No action was taken in t
vras considered that this might establish a precedent.
It was reported that D. Gray Langhorne would s
property, claimed to be owned~by him, and now being used ~,s
2nd street extended west of Altoona Road.
There being no further business, the Council was
ad3ourned at 6:10 p.m.
