Definitions : For the purpose of this ordinance the following terms shall have the meaning respectively indicated unless another meaning is• clearly intended or required by the content: A. Restaurant. The term °restaurant° shall mean restaurant, _ coffee shop, cafeteria, short order cafe, luncheonette,hotel dining room, tavern, sandwich shop, soda fountain, and all other public eating and drinking establishments by whatever name called, including the dining accomodations of clubs, all State institutions, and schools and colleges both public and private; provided, however, this ordinance shall not be construed to include facilities of public service corpora- -' ~tions under the jurisdiction of the State Corporation _ _ Commission. _ B. Employees. The term "employee" shall mean any person who handles food or .drink during preparation or serving, or who comes in contact with any eating or cooking utensils, or who is employed at any time°in a room in which food or drink is stored, prepared or served. C. Ea.tin~. Drinking and Cooking utensils. Commissioner. The chief executive officer of the Staty Board of Health and his duly authorized agents. i E. Health Officer. The term 'health officer" shall mean the director of health activities of Pulaski or his authorized rep~e- sentative. F. Person. The word "person" shall mean person,_firm, cor~i+or- ation or association. G. Unwholesome Food. ^Unwholesome food" shall mean any f~iod or drink not fit for human consumption. _ _ Section 2. Permits. 1 It shall be unlawful for any persons to operate a restaurant in the Town of Pulaski who does not possess. an unrevoked permit from the Health Officer and in whose place of business such permit ~ not posted in a conspicious place; and no local license to operate a restaurant shall be issued by an officer or official of the Tov~ of Pulaski until a Health Department Permit is presented by the Operator or Proprietor. Persons who meet the requirements of this ordi~fa.nce shall be entitled to receive and retain such permit or to secui~le a license to operate. It shall be unlawful for any person to work in, or operate j a restaurant without first securing a Food Handler's Permit fromythe Health Officer. To obtain such a permit the applicant shall f~.imish such information and laboratory specimens and submit to such m~idical examination and chest x-ray as the Health Officer may require.:. x~ Section 3. Placarding,,,_or Public Display of _Grade Notice. Every restaurant shall display at all times in a conspicio~js place approved. by the Health Officer a placard furnished by thd' Health Department stating the grade of the restaurant. Section 4. Responsibilit:Y for the Enforcelment of Ordinance The local Health Officer is hereby made responsible for th~l enforcement of this ordinance. Inspection shall be made as fre~a.entl.g as deemed necessary by the Heal th Officer. One copy of the inspection report shall be retained by the establishment; another copy shall be filed with the record of the Health Department. In ease the Health Officer .discovers the violation of any item of sanitation required for the grade then held, he shall make !! second inspection after a lapse of such time as he deems necessary for the defects to be remedied. If, upon the second inspeetio~ the same item of sanitation is found to be violated, the, restal~rant shall be required to display immediately a grade notice based upon the second inspection. ;' The Health Officer and any of his agents acting under his direction, may close any restaurant if the owner, manager, ope"'ator thereof has been guilt3r of flagrant or continued violation of is ordinance. In the event of such violations, it shall be his d ty to take such action. The sheriff of the county or Chief of Po~iice of the Town shall enforce such closure .until the closing order!~~is revoked in writing. Section 5. The Grading of Restaurants. The grading of all restaurants shall be based upon the standards. f ol~owing Grade A. Restaurants. Grade A. restaurants are those which comp with all o the following items of sanitation. Item 1. Floors. The floors of all restaurants shall be o such constructions as to be easily cleaned, shall be smooth, and s all be kept clean and in good repair. a 1~~3 Council Minutes Contd. Walls and ceilings of all good establishmehts shall be kept clean and in good repair, the kitchens finished in light color, and the walls of_ kitchens and wash r®oms shall have a smooth, washable surface up to the level reached by splash or spray. - Item 3. Lighting. Tf lighting or window space b® less than 10 per cent of the floor area, the equivalent 3n artificial light shall be provided. Items 4. Ventilation. A11 restaurants shall be well ventilated. Exhaust fans and metal hoods over ranges, equipped with ventilators, must be provided when necessary to prevent odors and condensation and to promote cleanliness. Item 5. Toilets. Adequate, approved toilet facilities must be provided for patrons and employees. Toilets must be provided for both sexes, constructed and m~a.intained in accordance with rules and regulations of the State Health Department. be provided with tight, self-closing do ors, and all must be aee.tibuled or properly shielded, and toilet ventilated by means of window or flue leading to the tablishments must new construction room must be outside. Handwashing signs shall be posted in each toilet room used by employees. Item 6. 1~'ater Supply. Any water supply used at a restaurant or other food establishment shall be properly located, constructed, operated and shall be easily accessible, adequate, and of a safe sanitary quality. Every restaurant shall be provided with hot and cold water under pressure. Item 7. Handwashing Facilities. Minimum handwashing facilities shall be construed to consist of approved stationary wash. bas ins, hot and cold water under pressure,-s oap and individual or single service towels for patrons and employees. Establishments serving only beverages, ice cream and short order, or those hereinafter referred to as itinerant restaurants, shall not be required to provide handwashing and toilet facilities for patrons; but this provision shall not apply to places serving beer for on-premises consumption. Ttem 8. Screening. All openings to the outer air shall be effectively screened and dorn s shall be self-closing and open outward, unlsss other effective means areprovided to prevent the entrance of flies. All other necessary means for the elimination of flies shall be used. Item 9. Construction of Utensils and Equipment. All eating and cooking utensils a1d all show and display cases or windows, counters, shelves, tables, refrigerating equipment, sinks, and other equipment or utensils used in connection with the operation of a restaurant shall be so constructed as to be easily cleaned and shall be kept clean and in good repair. Item 10. Dishwashing Equipment. Adequate facilities shall b® provided and maintained for the washing, rinsing and bactericidal treatmentof all eatingand drinking utensils, each to be a separate and distinct. operati on. Adequate approved stationary three-compart- ment sink and drain boards, and adequate number of aporoved dish baskets, or, in lieu of athree-compartment sink, an approved mechanical dishwashing machine may be used. An approved soap powder or detergent must be used. i 1 ~! Provided that nothing contained under this item _s hall be construed as debarring any equipment which has been demonstrated as of at least equal efficiency and is approved by the State Health Commissioner. Methods of Bacirerieidal Treatme~ R'eguired~~ One of the following methods must be used: Hot water for ehl4~in® chemicals. After washing and rinsing, utensils must be submd~rged in hot water at 170°F., or more, for at least two minutes; off' submerged in a chlorine solution containing not less than 50 parts per million of residual chlorine for at least two minutes. 1~'here mechanical dishwashing methods are used, the ora- tion of the machine, temperature of wash and rinse waters, a retention of dishes in the machine, must meet the approval o ;the State Health Commissioner. The practice of drying eating and drinking utensils'4with a towel shall be avoided. ~~ 1 Provided that nothing contained in this item shall b-e construed as debarring any other process which has been demo~trated as of at~least equal efficiency and is approved by the State^Health Commissioner. Item 12. Stora a and Handlin of Utensils and E ui nt. After bactericidal treatment no utensils shall be stored exc t in a clean, dry place protected from flies, dust, or other cunt ina- tion, and no utensil shall be handled except in such a manne#~ as to prevent contamination as far as practicable. Sing]a service utensils shall be purchased only in sanitary containers and ~~all be stored therein in a -clean dry place until used. If remov ~1d from original containers paper servcie utensils must be kept=yin an approved dispenser until used. Ice cream dispensing spoons dippers shall be kept in running or hot water (170oF). Item 13. Disposal of wastes. All wastes shall be ~Ikroperly disposed of and all garbage and trash shall be kept in suitai~l.e covered metal receptacles, in such a manner as not to become ~ nuisance. Drain and waste pipes from floors, wash sinks, soda ~' fountains, ice boxes, etc., must be of sufficient size, well.arapped and in a good state of repair.' Item 14. Refrigeration. Refrigeration, ice boxes,. tc., shall be of adequate size to store all perishable food, conscted of materials that will permit thorough cleaning, shall be pr~erly drained and ventilated shall be equipped with thermometer acid kept at a temperature of 50a-F., or lower, at all times, except d~jring periods of defrosting. Floors,-walls, ceilings, racks, hoo , pipes, etc.,, shall be kept clean. Drains from ice boxes sha not be connected directly to a sewer but shall drain into an ope fixture. Item 15. Milk and Cream. Only an approved or grade milk or cream shall be used or served in any restaurant. All mil must be served in the original container in which it was bottled t; the plant, or from a bulk container equipped with a dispensing d~ivice approved by the State Health Commissioner. Item 16. Storage and Display of Food and Drink. Affil food and drink shall be stored and displayed as to be protected f#!om dust, flies, vermin, handling, droplet infection, overhead liiakage, and other contamination. A11 fflod and drink shall be stored='above floor in such a manner as to afford easy cleaning underneath' No animals or fowls shall be kept or allowed in any room in whi~h food or drink is prepared or stored. Item 17. Cleanliness of Employee, and Restaurants.tAll employees shall wear clean outer garments and shall keep the hands clean at all times while engaging in handling food, dr nk, utensils, or equipment. All female personnel shall wear hai nets, bands, caps or some other effective device to prevent e falling of hair while engaged in handling, preparation ands ruing of food. None of the operations connected with a restaurant shall; be conducted in any room used for domestic purposes. Item 18. Miscellaneous. The surroundings of all r stau- rants shall be kept clean and free of litter or rubbish. Ad uate ,' ~~t7~ Council Minutes Contd. Pulaski, Va.,Nov. 10, 1949 lockers or dressing rooms shall be provided for employses~ clothing. Soiled linens, coats & aprons shall be kept in con- tainers provided for this purpose. No articles, polish or .substance containing any cyanide preparation or other poisonous material shall be used for the cleaning or polishing of eating or cooking utensils. Item 19. Tables, Shelves, Etc. All tables must be pro- perly constructed of material that can be thoroughly and easily cleaned. All table tops-must be of non-absorbent material when deemed necessary by the Health. Officer. Table tops must be free of unnecessary articles. Table covers, napkins, etc., must be clean and all shelves shall be clean, free of unnecessary articles and neatly arranged. All napkins shall be discarded or laundered after each usage. Item 20. Vermin and Rodent Control Methods. Methods used for the control of vermin and rodents must be effective of all restaurants. ' Grade B Restaurants. Grade B Restaurants are those which have been found on two successive inspections to have violated the same one of a1y- of the following items of sanitation required for Grade A restaurants: 1, 2, 3, 4, 18. Grade C Restaurant. Grade C. Restaurants are those which have been found on two successive inspections to have violated the same one of the following items of sanitation required for Grade A *estaurants; 5, 6, 7,~8, 9, 10, 11, 12, 13, 14, 15, 16, 17 and 20 for 30 consecutive days, or in emergencies, such longer periods as the Health Officer may deem necessary. Section 6. Examination and Condemnation of Unwholesome Food or Drink. Samples of food and drink may be taken and examined by the Health Officer, as often as he deems necessary for the detection of unwholesomeness.' The Health Officer may condemm, remove and destroy any food or drink which he deems unwholesome. Section 7. Notification of Disease. Notice shall be sent to the Health Officer, or, in the absence of a Health Officer, to the State Health Commissioner, immediately by the owner or manager of any food establishment, or by the employee concerned, if the manager or employee, or any member of his or her respective household contacts any infectious, or'communicable disease, or has a fever, skin eruption; a cough lasting more than three weeks, or any other suspicious symptom. It shall be the duty cf any such employee ~o notify the owner of manager of the food establish- ment immediately when any of said conditions exist, and if neither the manager nor the employee concerned notifies the Health Officer immediately when any of said conditions exist, they shall be held jointly and severally to have violated this section. Procedure when infection suspected: When suspicion arised as to the possibility of transmission of infection from any food establishment employee, the Health Officer is authorised to require any or all of the following measures.: `:(T ) The immediate exclusion o ~' the employee from all food establishments (2 ) The immediate elos ing of the food establishment• concerned until no further danger of disease outbreak exists, in the opinion of the Health Officer. (3) Adequate medical examination of the employee and of his associates, with such lstboratory examinatiA?~ as rnaff be.~ :' ~~ indicat®A. ~ -. Section 8. Repeal. All ordinances and arts of ordinances in conflict with this ordinance are hereby ~+~p~ed. Section 9. Unconstitutionality Claus®. Section 10. Penalty for Violation. Any person who volates any provision of this ordinance shall be fined not less than en dollars nor_more than one hundred dollars. Pulaski, Va., Nov. 10, 1949 (b) The said Town covenants and agrees that the Railway shall be and hereby is released from city or town taxes of every kind or nature whatsoever levied or assessed against the parcel of land hereinabov-e described; and further the Town covenants that the Railway shall be and hereby is released from and on account of any assessment, levy or tax which may be made or laid on account of or for the purpose of improving said street upon the premises of the Railway, for the paving or repairing of same, including sidewalks, or on account of installing or repairing sewer lines. (c) It is expressly understood and agreed between the parties hereto that the within easement shall cease and determine whenever the Railway, in its own sole judgment, shall have need of said premises for its own purposes, and upon thirty (30) days written notice from the Railway the Town agrees to and will g uietly and peacefully vacate said premises and surrender possession to the Railway, leaving same in th.e same condition as near as may be as when entered upon hereunder. The Tows Manager directed in the meantime to investigate the possibilities of sealing the deep trough gutters between 7th and 9th S'treet~ in order to better provide for traffic. PETITION A petition from the residents on South ~Pi~ie Street ~'or SEVER EXT . SOUTH sewer extension was presented. The Council deferred action o~ the PINE ST. petition, and requested the Town Manager to contact the property owners and to determine whether they were willing to participate in any portion of the cost of this construction. On motion duly made by W. F. White, seconded by 0. ~. Crowell, it was unanimously AUDIT RESOLVED, that the audit report of J. P. WATER The time of a proposed meeting with Mr. Martin John~lon IMPROVEMENTS of Wiley & Wils on, Consulting Engineers, Lynchburg, Virginia ', -Discussion was set for 4 p.m., November 15. RECREATION The possible methods of handling the recreation funs FUNDS appropriated by the Council was discussed, and the possibilit~t of establishing a Recreation Commission or other means of admins~ering -Com. these funds was considered. It was determined that a commit}iee appointed u should be appointed to mee~with representatives of the Y. M.CU A. t and the Junior Chamber of Commerc® to consider the matter. DECONTROL A petition from residents requesting improvement of an alley extending from Holly Street to Burch Street was presented. The matter was referred to the Town Manager for recommendation. A letter from Sheriff L. R. Summers, stating ' A petition from residents in the vicinity of Garner Avenue for street light was presented. The matter was Deferred to the Town Manager. A pe tition from residents in the vicinity of Dora Highway for increased size street light and traffic signal at intersection of Washington Avenue and Dora Highway was presented. The matter of the street lights was referred to the Town Manager for consideration. It was decided that the matter of the traffic signal would be considered in connection with the traffic survey. There was discussed the possibility of having a meeting with the Board of Trustees and other interested parties in the improvement and betterment of Oakwood Cemetery. It was determined that the meeting should be arranged for the regular Council meeting November 22 at 5 p.m. On motion duly made by W. F. White, seconded by T. F. Wirt, it was unanimously RESOLVED, that the Town Manager and Mr. I. R. Carper make~an inspection of Maple Street in the James Hill section for consideration of possible improvements. The request for a sewer in an alley adjacent to 5th Street, and parallel to Randolph Avenue to serve Mr. Sam Martins property wad dibenssed. Kersey appeared before the Council to request that, when the existing Commerce Street Bridge is removed, as much as necessary of the same be used to build a bridge to the Kersey Bottom Addition, to be located on Palmer Avenue to cross Peak Creek. P1Ir. Kersey state d. that'-he felt that he could construct the requested bridge at a cost of X1,000.00. This matter was deferred for future consideration. SEY~ER EXT. On motion of H. R. Imboden, seconded by O~Neal OFF 0 F5th Amos, it was unanimously PARALLEL RANDOLPH RESOLVED, that the Town accept the offer of Sam Martin to contribute Three Hundred(~300.00) Dollars and Martin- Lee Boothe Two Hundred 0200.00) Dollars toward the cost of Boothe offer accepted constucting sewermain to serve their properties on Randolph Avenue, and that the construction of the sewer main be autho- rized to extend along Fifth Street to an alley parallel to Randolph Avenue and dust east thereto, and extend nor therly along the alley to an intersection with another alley, and further, that an appropriation csf' Seven Hundred And Two appropria- (~702.62,}~Dollars and Sixty Two Cents be authorized from the tion General Fund for the constru.etion.
