Council Minutes Pulaski, Va., April 18, 1950
The regular semi-monthly meeting of the Town
Council of the Town of Pulaski, Virginia was held in the
Municipal Building at 4:00 p.m., April 18, 1950.
PRESENT There were present:

MINUTES The minutes of the regular monthly meeting held
on April 4, 1950 were read and approved.
On motion duly made by G. R. Steger, seconded by
0. O.Crowell, it was unanimously
APPLICATIONS RESOLVID, that the following applications for
BUILDING
PERMITS building permits be granted: To Parks-Belk Company (by
-Parks-Belk Norman A. Smyth Company) for one and one-half story brick
and concrete business building on the east side of Washing-
ton Avenue between 2nd and 3rd Streets, estimated to cost
-Bane X85,000.00; To M.G.Bane for one and one-half story frame
dwelling on west side of Prospect Avenue, between 12th and
13th Streets, estimated to cost 10,000.00; To Mrs. J. G.

LAUNDRIES There appeared before the Council JohnW. B.
& DRY CLEANERS
-Deeds re Deeds, representing the dry cleaners and laundries in the
licenses
matter of license tax. It was requested that the Town
adjust its license rates on these businesses so as to
require a higher rate on the out-of-town business, com-
parable to the prior yearts rate. This matter was dis-
cussed at considerable length and no action was taken.

MAPLE There appeared Dr. M.A. Santa Cruz and George Carter with

Alley and Pulaski Street. The possibilities of relocating the
stream bed so as to provide the least crossing for a bridge on

Roby K. Sutherland appeared before the Council, representing
Miss Effie Boothe with tie request that the Town take action j.n
order to provide for parking other than R. C. A. employees in the
block between Prospect and Madison Avenues on Fifth Street. It was
stated that R. C. A. was improving a parking lot for its employees,
and it was considered that after the parking lot had beenc ompleted,
the matter would again be considered.
PETITION A petition was presented, and T. ~. Dickerson spoke in

between Jefferson Avenue and Belleview Avenue, requesting that this

along Hill Terrace. This matter was referred to the Town Manager
and the Street Committee for further investigation.

The matter of a-curb-cut for Christ Episcopal
Church on Washington Avenue was again discussed, and on

A request from C. L. Plunkett for a curb cut to
serve his property to be rented to the Safeway Cabs for a
stand was presented. On motion duly made by G. R. Steger,
seconded by T. F. U~trirt, to grant this, on question, no
notes were cast in favor of same.
On motion duly made by 0. 0. Crowell, duly
seconded by W. D. Aust, it was unanimously
RESOLVED, that the application for permit of
Pulaski Motor Company, Inc. for extension of gasoline service
line approximately 150' East of Madison Avenue, to cross East
Main Street, adjacent to the railroad siding and parallel
thereto, and to extend to the Huff Coal Yard be granted,
contingent upon the Town undertaking that portion of the
vt~ rk in the public right-of-way at expense of the Pulaski
Motor Company, Inc.
On motion duly made by T. F. Wirt, seconded by,
W.F. White, it was unanimously
RESOLVED, that the request foz° approximately 2001
of curb and gutter between Washington and Lexington Avenue,
on the south side of 4th Street, S. E., contingent upon the
property owners paying one-half of the cost be approved,
and that an appropriation not to exceed Four Hundred Fifty
(~450.00}rD ollars be made for this work.
On motion duly made by G. R. Steger, seconded by
H. R. Imboden, it was unanimously
RESOLVID, that the sum of One Thousand Eight
Hundred Fifty 01,850.00) Dollars in the Water Construction
Fund, not immediately needed, be invested in the Pula i
National Bank on a savings account.
On motion duly made by G. R. Steger, seconded by
H. R. Imboden, it was unanimously
RESOLVED, that the sum of Seven ThousandThr®eHundred
Sixty Two° ID~callars and - - Fifty- - Cents 07, 362.50 ) in
the Sinking Fund, not now needed, be invested equally between
the Pulaski National Bank and the Peoples National Bank on a
savings account.

Imboden, it was unanimously
RESOLVID, that the Mayor be authorized to execute
and the Clerk to attest. the following agreement between the
Town of Pulaski and the Pulaski Counts, Inc. for use of Calfee
Park:
THIS AGREEMENT made and entered into in duplicate, this
the day of April, 1950, by and between the Town of
Pulaski, a Municipality, hereinafter referred to as the Town,
party of .the first part, and the Pulaski Counts, Incorporated,
hereinafter referred to as the Counts, party of the second part.

THAT FOR and in consideration of and on the terms and
conditions hereinaf ter set out, the said Town doth grant unto
the Counts the right and privilege to use the Town-owned ath-
letic field, with grand-stand, bleachers, buildings, and such
parking areas located adjacent to, but not inside of, said
athletic field; the said premises being know and herein referred
to as Calfee Park.
The parties hereto do agree that said grant of rights
and privileges herein shall be upon such, terms and conditions as
follows:
1. The Town shall initially place in good condition
and repair structurally the bleachers ( except the section at
southeast end of field), grandstands, screening in front ~'
grandstand, and bleachers adjoining same, dugouts, buildings
and fence, all of which shall be maintained and kept in good
condition during the season. The Counts shall be responsible
for general clean up of buildings, grounds, grandstands, and
bleachers during the season and shall leave these in a satis-
factory condition upon conclusion of the season. In event of
damage to Town property resulting from fire, rain, windstorm,
or lightning, the Counts shall have no responsibility for the
same. The Town will turn over to the Counts a set of keys to
all locks now in use. Any and all locks or keys lost, removed,
misplaced or damaged shall be replaced by the Counts and the
keys to all locks in use at the end of the season shall be
delivered to the Town at the conclusion of the baseball season.
2. The Counts shall improve and sod the field as
they may so desire, and shall keep the playing field and
embankment of east side mowed and trimmed. The Counts may lay
off a baseball infhld, bases, mounds, etc., as is customary for
use in baseball, to be in the same general location as they are
now. i~owever, these markings of mounds and bases shall be main-
tained by the Counts and at the conclusion of the baseball
season, they shall smooth the ground and leave it in as satis-
factory a condition as possible for use as a football field.
3. It shall be the duty of the Town to provide,
have ready for use at the beginning of the season, the ele
lighting system; at that time it shall be the further duty
the Town to see that the system is in a good state of reps
they shall make any necessary repairs and replace such
reflectors, flood lamps, etc., which have been dam aged sin
the last preceeding season. However, during the season th
Counts shall be responsible for replacing any burned out 1
and samaged reflectors, and shall at the end of the season
return the lighting system in as good condition as it was
initially provided, ordinary wear and tear excepted.

4. The Counts shall pay for all electric power
used during the season. They shall have the privilege, if they
so desire it, of paying the bills through the Town, and thus
obtaining any advantage which might accrue to them by use of
the municipal service rate. Details as to billing, etc. must
be worked out through the Town Manager.

5. Police officers of the Town shall be
admitted without charge to any and all games. The Town
will provide police protection to the extent available.
Tree Counts, in addition, shall provide at all games, at
least two police officers acceptable to the Town, and
under the Towns supervision. The Counts may, in addi-
tion, employ a caretaker who can be deputized as a
special police for the Calfee Park. In accordance with
the legal requirements for special police. Such police
shall be acceptable to the Town, and his police authority
shall be under the supervision of the Town.
6. The Counts shall have all the rights and
privileges to use Calfee Park during the baseball season,
from April 15, 1950, to September 15, 1950, both for
practice and regular games. For the use of the park, the
Counts shall pay to the Town Three Dollars 03.00) for
each and every game, for which admission is charged, except
that in event there are two games on one day and only one
admission is charged, then only one park rental of Three
Dollars 03.00) will be charged. The regular rental shall
be paid for every game, scheduled and advertised, whether
played or not. The rental shall be paid at the end of each
month and shall be for all the games theretofore unpaid
for.
7. In the event that the Counts have need fo r
or wish to use the field for games or events on days other
than those days on which regular scheduled games and events
are set, they shall first obtain permiss-ion for said use
from the Town Manager, such permission will be granted
provided:
a. Some other person or group has not received
permission to use the park on the day requested, and have
in reliance on said permission, previously granted,
scheduled some activity.
b. That said event or use, for which permission
is requested, is a permissable use of said park.
8. This agreement is not to be considered as
providing the Counts the exclusive use of the park, as the
Town reserves the right and privilege to permit other
athletic activities to have use of the park upon making
proper request and obtaining permission from the Town.
The use of the field by any other party,- group or organi-
zation within twelve (12) hours prior to a scheduled game
by the Counts shall first have approval of the Counts. At
any other time the Town may give any organ ized athletic
group permission to use the field or any part thereof.
Inasmuch as the Counts shall be responsible for the care of
the baseball diamond, mowing of grass, and electric bill,
the Town shall reimburse the Counts for this upkeep when
the park is used by other activities as follows:

The reimbursements to the Counts herein provided
shall bd made only in those cases where the Counts are
responsible for the electric bill and for cleaning up sub-
sequent to such use by others.
9. The Counts shall be responsible for the safe-
keeping of all its equipment, material and supplies of
every sort or nature which may be placed within or upon
said Calfee Park, and there shall be no liability upon the
Town by reason of the loss thereof or damage thereto by
any clause whatsoever.
IN WITNESS 1l~HEREOF the Town of Pulaski, Virginia
has caused this agreement to be executed for and on its

Incorporated, has caused this agreement to be executed for and
on its behalf by Howard R. Imboden, its President and duly
attested by Carl Shufflebarger, its Secretary.

PARKING LOT
3RD STREET RESOLVID, that the Town improve and make available
the County-owned lot on Third Street, N. for a public parking
space at a cost not to exceed Five Hundred (500.00 ~ Dollars.
DEER A requ est from Mrs. Alice B. Dyer for removal of
~emoval trees in front of Re sthaven and the Hurst Apartments was pre-
sented. This matter was not favorably considered.
