1742 ' 1 PRESENT Council Minutes Pulaski, Va., Dec. 5, 1950 The regular monthly meeting of the Town Council of the Town of Pulaski, Virginia was held in the Municipal Building at 4:00 p.m., December 5, 1950. Moore The minutes of the regular meeting held on November 9, 1950 were read and approved: CERTIFICATF~ OF Applications for renewal of certificates of CONVENIENCE AND NECESSITY convenience and necessity for the taxis were presented. Harman, Jr., local attorney, representing ORDINANCE AMEND. City Cabs and the taxicab operators in general presented a sta~lement to the Council, showing the financial conditions of the taxi o~era- tors, indicating the need for an increase .in the present taxi ate ~, due to the rising cost of operation, and requested that the i.cab Ordinance be amended. On motion duly made by T. F. Wirt, seconded by 0. 0. Crowell, and carried~by a unanimous vote BE IT ORDAINED that Section 24 titled "Rates",°~of i the Taxicab Ordinance of the Town of Pulaski, Virginia, enacted February 18, 194'7, Subsection (a) be amended to read as follow; ~+ For the transportation of one (1) or more passgers from a common embarkation point within *Zone 1" to a common d~lsti- nation within "Zone 2", or for the transportation of one (1) o~ m©re passengers from a common embarkation point within "Zone 2'~ to common destination within "Tone 1", the following rates shall ~pply:' 1. For one passenger. .-. .35 cents 2. For two passengers --.~-. ..45 cents - - 3. For three passengers .55 cents i 4. For four passengers. .65 a®nts - ~ ~' 5. IGtcgill, dr., it was unanimously RESOLVID, that this matter be referred to the dater Committee for further consideration and.such action as they cosider necessary. !; PETITION A petition from a number of residents on Q~arne GARNER AVENUE Avenue for improvement to the roads was presented, stating the the RESIDENTS- - road needed stone and improvements similar to these made last ear , 1"~4~ Council Minutes Contd. Crowell, it was unanimously _ RESOLVED, that the request for improvements to Garner Avenue be referred to the Town Manager. HI(~LA1QD The Town Manager presented a letter from TERRACE Mrs. Inez Dalton with regard to.opening a street in the Highland Terrace Addition. This was discussed, and it was determined that a letter of acknowledgment should be sent to Mrs. Dalton. It was felt that no action could be taken immediately toward opening this street. SOCIAL A letter Prom the (}overnor and from the SECURITY League.of Virginia Municipalities acknowledging the Councils resolution with regard to Social Security for town employees were read. Wallace, dr. for one room shop, cinder block - brick faced, on the north side of -Third Street, ~ N.W., rear of Wallace Apart- ments, to be used by Snyders Florists for preparing flowers, estimated cost not known; To Mrs. Mary A. Phillips for repair of pcr ch roof, asphalt shingles at 221 Valley 3~treet, estimated cost not given. On motion duly seconded by .T. F. Wirt, it was CURB CUT _ _RESOLVID, that 3RD ST . Bunn, Jr.~s new buildings, be approved, subject to the property owner paying the entire cost, and that, if the property owner desires a valley gutter acrgss the side- walk, this be subject to instructions in accordance with recommendations of the Town Manager, but not to exceed a 1" depth. RESOLUTION On motion duly made by T. F. Wirt, DEATH OF seconded by d. R. Martin, and unanimously passed, the COUNCILMAN following resolution was adopted: ~ . D . Aust; That this body convey to his widow and members o~' his family our deepest sympathy in their bereavement; That a copy of this resolution be spread on the minutes of the Council, a' copy be sent the family and one forwdrded to the Southwest Times for publication. APPROVED - ~~~~ The Town Manager reported on the number of residents AVENUE - SEWER that had paid connection charge for the Franklin Avenue sewer.. Thfs matter was discussed at considerable length. The Town Attorney reported that there appeared to be no deed granting these to the town, and that they were obtained by dedication of subdivisions. It was decided that the matter of removal The matter of the use of parks on 6th Street of instructions on ball playing be left to the decision oP the Mayor and the Town Manager. INVESTMENT On motion-duly made by T. F. f3.rt, seconded OF WATER ' by 0. 0. Crowell, it was unanimously CONS . F'U ND B(}~NDSSIN~KING RESOLVED, that the sum of Ten Thousand FUND Seven Hundred Dollars (~10,?00.00) of the 1Rater Construction Fund, not immediately needed, and that the sum of Seven Thousand Four Hundred Forty Three Dollars and 3sventy- Five Cents 07,443.?5) in the Street Bond Sinking Fund, not now needed, be divided equally bettyeen the Pulaski National Bank and the Peoples National Bank, and placed on a time savings account. On motion duly made by I. R. Carper, seconded by J. R. Martin, it was unanimously FUND INVEST. RESOLVED, that the Finance Committee and the FR. bOV~T. BOND MATUR. Town Manager jointly be empowered to invest the funds to be received Deeember 15, 195© from Government Bond maturing and due the Water Construction Fund in U. S. Treasury Certificates, such investment'to be made in the amounts scheduled to mature so as to b8st meet the payments due the contractors on the general water improvement project. CONTRACT On~motion duly made by w. D. Macgill, Jr., RECODING seconded by J. R. Martin, it was unanimously ORDINANCES APPROVED RESOLVED, that the Mayor and the Clerk be authorized to execute a contract with R. V. Becky Town ffianage#J~ the terms and conditions of his employment to be particularly out~iined in this contract; and, WHEREAS, the party of the second part has accept~ld this employment subject to the provisions hereinafter set forth, NOW, THEREFORE, in consideration of the mutual covenants herein contained, the parties hereto do hereby contract with each other as follows: (l) In pursuance-of this employment, the party of the 1 second part shall perform the following services; (a) Recodify all ordinances of a general nature, specifically including therein a complete administrative ordinance, of the Town of Pulaski, prepare and write any and all necessary new ones. (b ) Revise and edit the ordinances to such e~ttent ~I as in his judgment is needed, it being understood that such r~Ivisio~t, y. wherein substantive changes are involved, shall be subject to,the approval of the party of the first part. ' (c) Consolidate related ordinances and amenctenta thereto, to the end that overlapping sad duplication may be a~!oided. (d) Review each ordinance to determine its c~ln- _ ~; ~; stitutionality and make such revisions as in his judgment mays#be :~ necessary or desirable to the end that all of the ordinances ay be in conformity with the constitutions and legislation of the IIited ~, States and the Commonwealth of Virginia. (e) Classify the ordinances according to ther subjects and group the same together in appropriately designated chapters. (f) Eliminate conflicting provisions and incn- sistenciee. (g) Prepare a comprehensive index of all oP ordinances. ~~~~ Council Minutes Contd. _Pulaski, Va., Dec. 5, 195 (h) submit a tentative draft of the revised code to the party of the first part upon com- pletion thereof, for its review and suggestions for improvement. (i ) Prepare a final. draft of the revised code to include additions, changes or improvements, if any, suggested by the party of the first part, or any of its duly designated officers, so that the coda in this final form shall give to the Town of Pulaski, Virginia, a complete code of necessary general ordinances; and the party of the first part to be furnished three typewritten copies of the final draft of said revised code. (~) The party of the second part shall complete the performance of his work as expeditiously as possible consistent with a thorough and careful treatment of the details involved, and warrants that his work will be satisfactory to the party of the first part. The party of the first part contracts and agrees; (1) That it will pay to the party of th• second part as compensation for the services hereinabove enumerated the total sum of Twelve Hundred Dollars 0120D.0©), one-half of which sum shall be paid at the commencement of his work and the remaining balance to • be paid when his work has been accepted and approved by the party of the first part. (2) On such occasions as the party of the second part shall personally come to the Town of Pulaski at the request of either of its duly designated officers, his actual travelling expenses to and from the town shall be paid by the party of the first part, it being under- stood that such travelling expenses shall not exceed the amount of his railroad Pare or, should he elect to travel by auto, the sum of seven (?) cents per mile travelled to and from the town. , (3) The party of the first part shall forward to the party of the second part at his office in pF9~ Council Minutes Contwd. COUNCIL At the close of the meeting it was determined tht MEETINGS the Council would forego the m®eting scheduled December 19th,;and that the meeting scheduled January 2 will be postponed to Jan~iary 9.
