There were present: Mayor A. T.Eskridge, presiding;
Lottie R. Runion, clerk; A. W. Gatewood, director of public
works; Roby K. Sutherland, attorney; B.C.Taylor, treasurer;
L. S. Boothe, chief of police, and Councilmen: 0. P. Jordan,

The minutes of the regular meeting held on June 4th
and special meetings of June 22nd and June 24th were read
and approved.
The regular bills and payrolls for the month of June
were read, approved and ordered paid. Said bills are -given
at the conclusion of these minutes.
The police repo~~ for the month of June was submitted
and read.
A report signed by A. ~N. ~~haley, sanitation officer,
on inspections of restaurants within the town for the month
of June was read and filed.
The following building permits, coming within the
requirements of the ordinance, were granted - subject to
governmental regulations: R. G. Carson for 1~-story brick
dwelling on the north side of 6th street N. between Washington
and Madison avenues, to cost X10,000.00; Fred A. Jackson for
one-story frame dwelling on the north side of 5th street, S. E.
between Floyd and Peirce avenues, to cost X4,000.00; C. G. Byrd
for one-story frame dwelling on the north side of Clark Street,

were approved, with the provision that the Cotihty of Pulaski
pay one-half of the same, and that any necessaryetpenses
in acquiring the properties for the purpose of enlarging the
Airport, authorized by the Council at its June 4th meeting,
would be on a 50-50 basis with the County.

SIDE~~ALg The director of public works reported that the

AVENUE sidewalk had been constructed on the east side of Jeffersonf
Avenue, between 2nd and 3rd streets, N. W. fronting the
properties of T. ~. Seagle, C. E. ~cNew and a portion of ~i
the prOpe~+ty of ~. G. Bane and E. T. Howard. He also
reported that he was unable to get Bar. Bane to agree to -~ ~~~
replacing the sidewalk along the entire frontage of his
property. fir. Gatewood stated that there was some ob~ectio~l
to the new sidewalk on account of it being slightly above
some of the openings to the buildings, the walk being
constructed to conform with the standard sidewalk elevation
and grades with reference to the finished level of the
street, and he stated that these Openings could be corrected
easily and cheaply by the property owners,t0 conform to thep
elevation of the new sidewalk.

In the matter of a proposed ordinance regulating
and grading food establishments in the town, read at the
tray 7th meeting and referred back to the committee to b e
redrafted and resubmitted, the committee resubmitted the
proposed ordinance with certain amendments, which, 8fiter
mature consideration, on motion of F'. A. Seagle, seconded

Section 1, ~fi~itipns.
A. ~,~aurant -- The term "restaurant" shall mean;
restaurant, coffee shop, cafeteria, short order cafe,
luncheonette, hotel dining room, tavern, sandwich shop, soa

B. Other Faod Establishments.-- "Other food establishment"
shall mean all places that manufacture, pack, store, sell, or
distribute food or food products and beverages, that are not
eating or drinking establishments.
C. Employees.-- The term "employee" shall mean any
person who handles food or drink during preparation or serving,
or who comes in contact with any eating or cooking utensils.
D. ~~ng,~Dri~king_ and Cooking Utensils.--"Eating,
drinking and cooking utensils" shall include any kitchenware,
tableware, cutlery, containers, or other equipment with which
food or drink comes in contact during storage, preparation or
serving.
E. Health 0~ icer.-- The term " Health Officer" shall
mean the director of health activities of the town of Pulaski
or his authorized representative.
F. arson.-- The word "person" shall mean person, firm, ~'
corporation or association.
G. gnwhol,~some Food.-- "Unwholesome Food" shall mean
ar~,y food or drink not fit for r,.uman consumption.
Section ~. perm.}~5.-.- It shall be unlawful for any
person to operate a restaurant in the town of Pulaski who does
not possess an unrevoked permit from the health officer
and in whose place of business such permit is not posted in a
conspicuous place; and no license to operate a restaurant shall
be issued by an officer or official of the town of Pulaski
until a health department permit is presented by the operator or
proprietor. Persons who meet the requirements of this ordinance
shall be entitled to receive and retain such permit or to
secure a license to operate.
It shall be unlawful for any person to work in a
restaurant or other food establishment without first securing
a permit from the health officer. To obtain such permit the
employee shall furnish such information and laboratory specimens
and submit to such physical examination as the health officer
may require, and receive instructions on personal hygiene and
an explanation of the items of the ordinance. Each permit shall
re~uain in force until revoked for cause.

Every restaurant shall display at all times in a conspicuous
glace approved by the health officer a placard furnished by
the health department stating the grade of the restaurant.

Foo or IIrink.-- Samples of food and drink may be t~tkQn and
examined by the health officer as often as he deems necessary
for the detection of unwholesomeness. The health officer may
condemn, remove and destroy any food or drink which he deems
unwholesome.

eliminated by Council.)
Section 6. Inspection ~ kgsta~ants and theF Food
Establi,~hmg~~,~.-- The local health officer is hereby made re-
sponsible for the enforcement of this ordinance. Inspection sYlall
be made as frequently as deemed necessary by the h~~ith office.
One copy of the inspection report shall be retained
by the establishment; another copy shall be filed with the reeds
of the health department. ~
In case the health officer discovers the violation of*
any item of sanitation required for the grade then held, he sha~.l
make a second inspection after the lapse of such time as he
deems necessary for the defect to be remedied. If upon the sec+~nd
inspection the same item of sanitation is found to be violated
the restaurant shall be required to display immediately a grader,
notice based upon the second inspection. );,
Section 7. 1'??e G~.ading of Res~a~an ~.-- The grading ,
of all restaurants shall be based upon the following standards.:

Item 3. Li,ghtin~.-- If lighting of window space be
less than IO per cent of the floor area, its equivalent in
artificial light shall be provided.
Ttem 4. Ventilation.-- X11 restaurants and other food
establishments shall be~well ventilated. Exhaust fans and
metal hoods over ranges, equipped with ventilators, must be
provided when necessary to prevent odors and condensation
and to promote cleanliness.

must be .provided for employees. Toilets must be constructed
and maintained in accordance with the rules and regulations
of the State health Department.
Toilets must be entirely separate and apart from any
room used for the manufacture, storage or handling of food
products. Flush toilets used in any restaurant or other food
establishment must be provided with tight, self-closing
doors, and all new construction must be vestibuled, and toilet
room must be ventilated by means of window or flue leading to
the outside. xll flush toilets must be connected to an
approved sewer system or provided with properly constructed
septic tank.

adequate, and of a safe sanitary quality.
Item 7. hamdwashing F'acilitie~.-- till employees must
observe a high standard of personal cleeliness, and they must
be constantly supervised in this respect by the employer.
The hands of all employees must be washed thoroughly with
soap and water after visiting the toilet. Employees, such
as clerks, waiters, cooks, etc. must keep their hands away
from the mouth and nose and wash their hands immediately
with soap and water should they become contaminated with
oral or nasal secretions. Employees must keep fingernails

Adequate handwashing facilities include running

supply of clean water, soap, and a clean individual towel
for each employee.

All eating and cooking utensils and all show and display cas~bs
or windows, counters, shelves, tables, refrigerating equipme~at,
or utensils used in connection with the operation of a
restaurant or other food establishment shall be so constructed
as to be easily cleaned and shall be ke~at clean and in good
repair.
Item 10. Dishwashing Equipment.--t~dequate facilities
shall be provided and maintained for the washing, rinsing
and bactericidal treatment of all eating and drinking utensils,
each to be separate and distinct operation requiring a minimum
of a three-compartment sink. Adequate facilities for heating
water for cleaning must be provided. xn approved washing
powder must be used. ~ sufficient number of approved dish
baskets must be provided.
In establishments where only beverages and ice cream aple
served , cold water washing of glassware and silver may be
approved if thorough and effective.
Provided, that nothing contained under this item
shall be construed as disbarring any other equipment which
has been demonstrated as of at least equal efficiency and is
approved by the health officer.
Item 11. Methods o~Ba~tericidal Trea ent Recom~nende~.-
One of the following methods must be used; Hot water or
chlorine chemicals. Utensils must be submerged in hot water;'
at 170 F., or more, for at least two minutes; or submerged
in a chlorine solution containing not less tha fifty parts
per million of residual chlorine for at least two ninutes.

The practice of drying eating and drinking utensils
with a towel shall not be permitted.
Provided that nothing contained under this item shall
be construed as disbarring any other process which has been
demonstrated as of at least equal ~effCl.ehcy and is approved
by the health officer.
The above requirements apply to manual dishwashing
methods. Where dishwashing machines are used, the operation
of the machine, temperature of wash and rinse waters, and
retention period of dishes in the machine must meet the
approval of the health officer.
Item 12. ~,tpr~r~P and Handl.~g ,Qf j]tPnGil,g and
Ec~uinment.-- After bactericidal treatment no utensil shall be
stored except in a clean, dry pls.ce protected from fiies,
dust, or other contamination, and no utensil shall be handled
except in such a manner as to prevent contamination as far as
practicable. Single service utensils shall be purchased
only in sanitary containers and shall be stored therein in a
clean dry plae until used..
Ttem 13. Dispo,~s~. of ~rastes.-- All wastes shall be
properly disposed of, and all garbage and trash shall be
kept in suitable covered receptacles, in such manner as not
to become a nuisance.
Drain and waste pipes from floors, wash sinks, soda
fountains, ice boxes, etc., must be of efficient size, well
trapped, and in a good state of repair.
Tte~ 14. Refrigeration.-- Refrigerators, ice boxes,
etc., shall be of adequate size to store all ~rishable f"ood,
constructed of materials that will permit thorough cleaning,
shall be properly drained and ventilated, shill. be equipped
with thermometer and kept at a temperature of 50 F`., or
lower, at all times, except during periods of defrosting.
Floors, walls, ceiling racks, hooks, pipes, etc., shall be
kept clean. Drains from ice boxes shall not be connected
directly to a sewer but shall drain into an open fixture.

Item 15. i~i1k and Cream.-- Only graded milk or cream:.'
shall be used or served in any restaurant. Official placard,
stating the grade of milk served, whether pasteurized or
raw, must be displayed in a place designated by the health

food and drink shall be so stored and displayed as to be

protected from dust, flies, vermin, handling, droplet infect ton,
overhead leakage, and other contamination. No animals, or
fowls shall be kept or allowed in any room in which food or
drink is prepared or stored. All means necessary for the
elimination of flies shall be used.

wear clean outer garments and shall keep their hands clean
at all times while engaged in handling food, drink, utensils,
or equipment.
Item 18. ~tiscellaneQu .-- The surroundings of all
restaurants and other food establishments shall be kept clea~i
and free of litter or rubbish. None of the operations connelpted
with a restaurant shall be conaucted in any room used for do~estic
purposes. adequate lockers or dressing rooms @h~ll be provided
for employees clothing. Soiled linens, coats, and aprons
shall be kept in containers provided for this purpose.
No articles, polish or substance containing any cyanidle
preparation or other poisonous material shall be used for
cleansing or polishing of eating or cooking utensils.
Item 19. Tabi es~„b~,~~ygs. etc.-- A.7.1 tables must be
properly constructed of materials that can be thoroughly and
easily cleaned. All table tops must be of non-absorbent matetrial
when deemed necessary by the health officer. Table tops muse
be free of unnecessary articles. Table covers, napk---etc~,

Item ~0. vermin and Rodent Control Methods.-- Methods
used for the control of vermin and rodents must be effective
at all restaurants and other food establishments.

required for Grade A restaurants: 1, 2, 3, 4, 18.
Grade C Restaurants.-- Grade C restaurants are those

officer may deem necessary. The enforcement of this item
insofar as closing the establishment is concerned shall be
by action of the Mayor and Council health committee and submitted
to the council.
Section 8. Examination and Condemnation of Unwholesome
Food or Drink.--- Samples of food and drink may be taken and
examined by the health officer as often as he deems necessary
for the detection of unwholesomeness. The health officer may
condemn, remove and destroy any food or drink which he deems
unwholesome.
Section 9. Notification 4~ Disease.-- Notice shall
be sent to the health officer immediately by the owner or manager
of the restaurant or other food establishment, or by the
employee concerned, if the manager or any employee or any
member of his or her respective household contracts any in-
fections, contagious or communicable disease, or has a fever,
a skin lesion or eruption, a cough lasting more than 3 weeks,
or any other suspicious sympton, it shill be the duty of any
such employee to notify the owner or manager of the restaurant
or other food establishment immediatelywhen any of said con-

concerned notified the health officer immediately when any
of said conditions obtain, they shall be held-jointly and
severally to have violated this section.
Section 10. procedure 4~n Infection S,~gpected.--
iNhen suspicion arises as to the possibility of transmission
of infection from restaurant or other food establishment employee,
the health officer is authorized to require any or all of the
following measures: (1) the immediate exclusion of the employe
from all restaurants or other food ests.blishments; (2) the
immediate closing of the restaurant or other food establishmen;
concerned until no further danger of disease outbreak exists,
in the opinion of the health officer; (3) adequate medical ex-
aminations of the employee and of his associates, with such
laboratory examinations as may be indicated.
Section 11. Repeal.-- X1.1 ordinances and parts of
ordinance in conflict with this ordinance are hereby repealed.
Section 12. jn on ,~~.t?ti onali ty C;-~suse.-- Should any
section, paragraph, clause or phrase of this ordinance be decldred
unconstitutional or invalid for any reason, the remainder of
said ordinance shall not be affected thereby.
Section 13. Penalties.-- r~ny person who is convicted o
violation of any provision of this ordinance shall be fined
not more than X25.00 at the discretion of the court having
jurisdiction. Each and every violation of the provisions of t~tis
ordinance shall constitute a separate offense.
This ordinancd shall become effective 30 days from date`
of passage.
