There v~ere present: Mayor E. 'du.Calfee, presiding; Lottie R. Runion, clerk; A. d. Gatewood, director of public works, and Councilmen: A. T. Eskridge, T. J. '~a..th~~e~-~, L. F. Whitesell, J. E'. Bunts, F. y. Sea~;le, T. L. James and G.C. Hall. Absent: A. M. B~~shong. The minutes of the regular. meeting held on July 14th, 1942, were read and approved. S~:.id bills are given at the conclusion of these minutes. The following building permits, coming within the requirements were granted: To A. Marzelle Schrader for a frame coal and storage house on the west side of Randolph kvenue, between Sixth..ahd Seventh streets, l~. :"~., to cost X250.00; to Harry A. Ring for frame coal bin and repairs to property on the south side of Mt Olivet Road, to cost x•150.00,. °: The: applications of Fred A. Jackson for permit to build 3 frame dwellings on 7th Street, East Pulaski, to cost X500.00 each were referred to Councilmen of the Second '~iard, Messrs. Eskridge and Whitesell, for investigation. Mr. E. H. Ruehl, representing the Virginia League of municipalities, appeared before the Council asking the town to re-affiliate with the League. After discussion, action on the matter was deferred. On motion duly made, seconded and unanimously passed, the Council authorized the purchase of 6 sets of drop inlet grate s for the Street Dep::rtment. On motion duly made, seconded and unanimously passed, the Council authorized the employment of Mr. James P. Tviiller, CPA, to audit the town books for the year ending August 31, 1942. A. ~cyew,i,a.nd improvements to Chestnut Alley, requested by N. ti. Kersey, were referred to the Street committee for investigation and report. CO?'1TR.ACT The Pulaski Baseball Club presFnted a contract agreeing PULE; SKI B~:SEBALL to turn over to the TOPJn of Pulaski, the lighting system recently LIGHTING SYSTEM installed at Calfee Park, which contr~_ct, conditioned on certain stipulated amendments, was, on motion duly made, seconded and unanimously passed, accepted. The contract as amended is as follows: THIS BILL OF SALE AND AGREF':~~ENT, executed in dunlic«te this 4th day of August, 1942, by and between PULASKI BASEBALL CLUB, INCORPORATED, of Pulaski, Virginia., party of the first part, and the TOWN OF PULASKI, VIRGINIA, party of the second Hart. W I T N E S S E T H: Pr`HEREAS, there has been cor.str~zcted at the ~pense of the party of the first part a baseball lighting system situp±te and installed at Calfee Park in the Town of Pulaski, on the property of the party of the second p«rt; and WHEREAS, the said party of the first part now desires to convey its entire interest ir. said baseball lighting system, to the party of the second part to be oV~rned and maintained by said party of the second part in the interest of more efficient service and benefits to the community as a whole; and WHERFhS, the party of the second Hart has agreed to purchrse said baseball lighting equipment aMd maintain the sam19 as a community project for the mutuel use of any and a.ll or- ganizations desiring to use the same end to whom permission to, use the same might from time to time be ¢ranted by the party of the second part. NOW, THEREFORE, in consideration of the release a.nd cancellation by the party of the second part of an indebtEdnes of Three Hundred Dollars (~'~OO.OU) due by the party of the first part to the party of the second part for rental on Calfee Parke. for the 1942 season, and for other good and valuable considerations, the receipt of all of which is hereby acknowledged, the party bf the first part does hereby grant, bargain, sell and convey unto the party of the second part, all of its right, title and interest in and to the baseball lighting system now installed' and located at Calfee Park in the Town of Pulaski, Virginia-, aid consisting of 8 - 80 Ft. Creosoted Pir•e Poles, 1 - 40 ft. Creosoted Pine Pole, ~4-Double lamp Porcelain Enamel Reflector, 20- Single Lamp Porcelain Enamel Reflectors, 1 - 200 Volt Oil.; Circuit Creaker. All primary and secondary wire, guys and guys wire, cross arms, insulators, arresters, fused cutouts, and hardware a.nd other material installed in this baseball lighting system, but excepting therefrom 6- 15 KVA Transformers and 1- w 5 KVA Transformer, which are the property of the Appalachian Electric Power Company, and also excertina 20 - Single Lamp Porcelair_ Enamel Reflectors which are distinctly marked as be-. longing to and being the property of the Pulaski High School Athletic Committee. cont'd 388 Council Minutes Contd. Pulsski, Va., August 4, 1942 CONTRACT The party of the first part hereby expressly warrants PULE SKI that the entire lighting equipment hereby sold to the party BhSF_ of the second part is free and clear of any indebtedness of B~:LL the Pulaski Baseball Club, Incorporated, and that there are LIGHTING no creditors of the Pulaski Baseball Club, Incorporated, SYSTEM having the right to assert any claim against said equipment. (cont~d) In consideration of the conveyance of said lighting equipment to the party of the second part, it is covens.nted and agreed between the parties hereto th~.t so long as Pulaski Baseball Club is locally owned, the party of the second part will grant permission to the party of the first part to use Calfee Park in the Town of Pulaski, Virginia, equipped with the same, or equally as good a lighting equipment as novr installed so long as the party of the first part retains its charter as a corporation and so long as it retains its franchise in the Virginia. League, or any other professional baseball league to sponsor a professional baseball team, and the rental vrhich the party of the first part shall pay to the party of the second part for the use of Calfee Park shall be fined from year to yee.r by mutual agreement between the party of he first part and the party of the second part.. The .foregoing agreement ras been regularly and duly authorized by vote of the stockholders and directors of the Pulaski Baseball Glub, Incorporated, at meetings duly called and had on the 7th day of July, 1Q42, and has been approved by resolution of the Town Council of the Town of Pulaski, Virgini2_, at a meeting held on the 4th ddy of 2ugust, 1942.
