BE IT ORDAINED by the Town Council. of the Town of Pulaski, Virginia, as follows: Section 1. That Chapter 125 of the Code of Virginia of 1936 as amended, or hereafter to be amended, be, and the san1~ hereby is, adopted by the Council of the Town of Pulaski, Virgi~~ia, in so far as the same relates to the organization, existence and functioning of a Volunteer Fire Department for the Tov~n ~; of Pulaski, Virginia, the same as if the provisions of said ~ti Chapter 125 were herein set out in words and figures except in such respects as it may be herein differently ordained, consistent with the powers granted to the Town Council. by said?' Chapter 195 of theCode of Virginia. Sect n ~. The name of the organization shall be the- Pulaski Volunteer Fire Department of Pulaski, Virginia. 'ect on 3i. The active membership shall consist of not less than twenty (20) nor more than twenty-five (25) able bodied white male citizens residing in the-Town of Pulaski, Virginia, and who are not less than t~p~enty-one (21) nor more tl1~.n forty-five (45) years of age, with the exception th«t said age ~' limit shall not be applicable to the position of Principal Engineer hereinafter provided for in Section Five. Pulaski,Va., Nov. 17, 1939 S ct on_~. _Election to active membership shall be upon application filed with the Council of the Town of Pulaski, Virginia, and no person shall be elected to active membership except upon the vote of the majority of the Council of the Town of Pulaski, Virginia, and before any person is so elected to active membership he shall submit to and pass a thorough physical examination by some medical doctor designated by the Council and the fee for which examination shall be paid by the Town of Pulaski, Virginia. Sec on 5. The Council shall, from the active membership of said Fire Department, appoint a Principal Engineer who shall also be designated as the Chief of the Pulaski Volunteer Fire Department, and shall also appoint from said active membership a first fire warden, a second fire warden and a third fire warden, all of which said appointments shall be first made upon the effective date of this ordinance and each of which appointments shall be for a term of two (2) years. Section 6. There shall be vested in the Town Council the full, absolute, complete and exclusive right to expell any active member including the Principal Engineer and the fire wardens hereinbefore provided for at any time and for any reasons which to the Council may seem necessary or advisable for the best interests of the Fire Department, and when any such vacancy shall occur or upon any vacancy created by voluntary resignation of an active member, the same may be filled by the Council in the same manner hereinbefore provided for the election of active members and appointment of the Principal Engineer and fire wardens. The Council shall further have the right at any time during the term of office of the Principal Engineer and fire wardens to declare any or all of said offices vacant and appoint others in their stead without expelling said officer or officers from membership, and which action shall rest in the sole discretion of the Council. Sect n ~. (a) The Principal Engineer, appointed by virtue of Section Five hereof, shall be a full time employee of the Town of Pulaski, Virginia, and for his services shall (cont) ~ ~ 1,~ .~ Council minutes Cont. Pulaski, Va., Nov. 17, 1939 receive such salary as may from time to time be fixed by the Council and he shall receive no other compensation for his servid~s as such Princi~,al Engineer, or as an active member of the Fire .Department. (b) Active .members shall receive for their services the following fees: (1) For attendance upon each regular monthly meeting Fifty Cents (50¢). (2) For attendance upon a called meeting for the purpose of conducting either a school or fire drill, not exceed-` ing one meeting per month, One Dollar 01.00). '(3) For responding to afire alarm and doing such things as are needful and necessary to be done as a result thereof, regardless of whether there actually is or is not a ,~~, fire, One Dollar 01.00).. r-~ . (4) No fee shall be received for attendance upon the regular semi-annual meetings required by statute to be had in April and October of each year. (c) The fees hereinabove provided for shall be paid by the Treasurer of the Town of Pulaski, Virginia, to the Secretary-Treasurer of the Pulaski Volunteer Fire Department and by him disbursed to the respective parties entitled thereto. Sec~ic,~n $. (a) The principal Engineer shall reside at the Fire house provided by the Town of Pulaski and shall remain there at all times as far as practical and shall not at any time depart there from without leaving either the first, second or third warden in 'command; he shall be custodian of and responsible for all fire equipment and apparatus, keeping the same clean and in running, usuable and workable condition at all times and shall see that the club rooms and equipment are in proper condition for use of the members and s~iall attend all regular and called meetings of the Fire Department; he shall take command of the Fire Department and all fire apparatus and equipment when the fire alarm is turned in, and shall be in absolute command and control during all fires and he shall have command over all fire wardens and active members and over all other persons who may be present and shall have all the duties, obligations and authority imposed upon or vested in him by virtue of Chapter 125 of the Code of Virginia, and Acts Amendatory thereof, and he shall further have the right, in case of emergency and necessity, to deputize any male citizen con ^~ 116 Council minutes Cont. Pulaski, Va., Nov. 17, 1939 of the Town of Pulaski, Virginia, other than an active member of the Department to assist in the extinguishment or suppression of a fide and any such person so deputized shall, during the time he is so deputized, be entitled to all the benefits and subject to all the duties and obligations of regularly elected active members; it shall further be the duty of the Principal Engineer to keep a record of all active members in attendance at any regular or called meeting, or at fire schools or drills and a record of all active members responding to a fire alarm, or in attendance at afire and at the end of each calendar month he shall make up a detailed report showing the name of each active member, the number of regular and called meetings attended and fire alrams responded to, together with the amount of fees to which each active member is entitled and the aggregate amount due to the entire active membership by rea-s~n oi' such fees for the period covered by ~sd}Yr~~ort~:sma~E~smbmt"3'.h~:sla~ae~to.rthe~~oundil. In the event any active member shall be tardy in his attendance at any meeting or tardy in his attendance upon afire, or response to afire-alarm and upon his failure to give an explanation thereof which, to the Principal Engineer shall seem reasonable, the Principal Engineer shall have the right to refuse to allow to such tardy member the fee to which he would otherwise be entitled; the Principal Engineer shall further be authorized to, from time to time, promulgate rules and regulations consistent with the pro- visions of this ordinance in regard to the more efficient administration thereof, but any such rules and regulations shall first be approved by the Council and when so approved, shall be as valid and binding upon members as if made a y' part hereof. - (h) The first, second and third fire wardens shall be subject to all the duties, obligations and responsibilities of active members as hereinafter defined, except that while in attendance at afire they shall, subject to the authority and command of the Principal Engineer and also subject to the authority and command of the warden 117 Council Minutes Cont. Pulaski, Va., Nov.-17, 1939 or wardens having superior rank, be first, second and third in command,-respectively, of the active members and in the event of the absence or disability of the Principal Engineer upon the sounding of afire alarm, or vahile in attendance of any fire, the first, second and third wardens shall be first, second and third, respectively, in command, and that the war- den present who possesses the highest rank shall have all the duties and authority hereby vested in the Principal Engineer. (c)(1) It shall be the duty of every active member to attend all regular and called meetings including call meetings for the purpose of conducting fire schools ~~ w~ ~~.~ and fire drills and to report at such meetings promptly ~'C ~ at the hour at which they are called. (2) It shall be the duty of every active mem- ber upon an alarm of fire to go immediately to the fire house or place of -fire and hold himself in readiness to.perform any=' duty for which he may be detailed by the officer or officers in charge and to devote his 'efforts faithfully and diligently. to the discharge of said duties, and be at all times obedient to the command of superior officers in charge. (3) It shall be the duty of each active member upon ariving at the fire house or place of fire in response to a fire alarm to report his presence to the Principal Engineer or to such person as the Principal Engineer may desi~- nate for that purpose and each active member present ~ a fire, or responding to afire alarm shall after the extinguish- went of afire assist in loading the hose and other apparatus in order that the same may be returned to the fire house in good condition and shall in all casea accompany the apparatus°~ back to the fire house and answer roll call unless excused by the Principal Engineer, and,for the failure of any such active member $o to do, he shall forfeit his right to the fee to which he would otherwise be entitled. (4) No member shall remove from the fire hou~le ~; anything belonging to the Department or appertaining to the `I ~R fire house or apparatus for sny other purpose than to extingu fire without permission from the Principal Engineer. 1.18 Council Minutes Cont. Nov. 17, 1939 (5) No member shall appear at a meeting of the Department, or on duty at a fire in a state of intoxi- cation, nor shall he be guilty of using insulting and indecent or improper language, nor be guilty of conduct unbecoming a gentleman, or otherwise bringing disgrace upon .the Fire De- partment,and any active member reporting,tr at any fire or re- sponding to any fire alarm shall be considered on duty from the time he reports until dismissed at the fire house, or excused by the Principal Engineer. (6) A member may withdraw from the De- partment by submitting his written resignation to any regular meeting of the Council of the Town of Pulaski, Virginia. (7) All active members shall be exempt from fury duty pursuant to the laws of the State of Virginia in such cases made and provided. Sect o _~, Any active member having any complaint in regard to the conduct of any of the active members of~ officers or any complaint touching upon any matters involving the welfare of the Fire Department shall have the right to make the same to the Council of the Town of Pulaski, Virginia, and shall be entitled to a hearing thereon and said Council shall have the exclusive right to deal with the complaint in any manner deemed proper or necessary not inconsistent with this ordinance or the laws of the State of Virginia. Section ~0. (a) All fire apparatus and equipment with the exception of uniforms for members of the Fire Department shall be furnished by the Town of Pulaski,Virginia, and neither the Pulaski Volunteer Fire Department as a whole, nor any indi- vidual member thereof, nor any person for them shall have the right to solicit funds for the said Fire Department, nor to stage any benefits of any character whereby funds will be obtained either directly or indirectly for the benefit of the Pulaski. Volunteer Fire Department, without first having ob- tained permission from the Councill. (b) All funds voluntarily contri- 1 buted or donations voluntarily mode shall be paid by the person or persons, firms or corporations making ss.me directly to the Secretary-Treasurer of the Pulaski Volunteer Fire Department ~~ ~ 19 Council Minutes Cont. Pulaski, Va., Nov. 17, 1939 and any such funds shall be expended in any such manner as may from time to time be decided upon by the active members of the Department. .,Sect on 1~. The proper officials of the Town of Pulaski, Virginia, are hereby authorized and directed to immediate- ly place in effect adequate compensation and accident insurance: to fully provide for and protect the Town of Pulaski, Virginia, against any liability by .reason of the financial relief for volunteer firemen provided for in Chapter 125 of the Code of Virginia of 1936, and ,Acts Amendatory thereof. (a) Tmmediately upon the effective date of this ordinance the duly elected active members are ~.. ..,A, ~;~ hereby authorized and directed to file a writing in the Clerks mot' ~ Office of the Circuit Court of Pulaski County, Virginia, stating the formation of the Pulaski Volunteer Fire Department with the names of the active members thereto subscribed pursuant to Chapter 125 of the Code of Virginia of 1936 and Acts Amendatc~#~y thereof, and at-which time they shall effect an organization of said Fire Department for the purpose of carrying out the. social and business functions of the Department and a regular meeting of which organization shall~be held. on the first Monday of each month, and the officers of said arganization shall con- sist of a president, a vice-president and a secretary-treasurer and which said officers shall be elected annually by the majority vote of the active members and said organization is hereby further authorized to adopt such by-laws consistent witY~~ this ordinance and the laws of the State of Virginia as may be necessary to promote the objects and best interests of said Fire Department, but any such by-laws so adopted shall first be approved by the Council of the Town of Pulaski, Virginia. Upon the elect9ion of a Secretary-Treasurer by said Fire Department, he shall, befa~e he assumes his office, enter into a bond in the penalty of Threa Thousand Dollars 03,00.0.00) with surety approved by theCouncil to faithfully discharge the duties of his office and he shall keep minutes of all regular and called meetings and for his services he shall receive the sum of Three Dollars ($3.00) per month payable out of the treasury of the Fire Department, and books of account shall be annually audited by an auditor select 120 Council Minutes Cont. Pulaski, Va., Nov. 17, 1939 by the Council or at any ..such other time as the Council may direct and the cost of said audit shall be paid by the Treasurer of the Town of Pulaski, Virginia. (b) Any person who has heretofore been a member of any previous fire department for the Town of Pulaski, Virginia, sha~.l automatically be an honorary member of said fire department, and the active members shall have the right to elect such other persons to honorary membership as they shall from time to time see fit and any honorary member shall be entitled to attend all regular meetings and en- titled to the use of the club room, but shall not be entitled to vote or hold office, nor shall they be entitled to the fees provided to active members for their attendance at said meetings. Section ~. The effective date of this ordinance ADJOURN- ~ENT shall be the first day of January, 1940, and all prior ordinances of the Town of Pulaski,Virginia, re3ative to a fire department, or purporting to deal with same, are hereby expressly repealed.
