HomeMy WebLinkAbout07-19-05 Minutes of the Town Council Meeting held Tuesday, July 19, 2005 at 5:00 p.m. in the Council Chambers of the Municipal Building. There were present: Charles L. Wade, Mayor Council: Jeffrey S. Worrell, Lane R. Penn, John T. Bolen, Joel B. Burchett, Jr. Absent: Dan Talbert, Jr., Bettye H. Steger Staff: John J. Hawley, Town Manager John White, Economic Development Director Sherry Boyd, Finance Director Dave Hart, Parks and Facilities Director Gary Roche, Police Chief Bill Pedigo, Town Engineer Randolph D. Eley, Jr., Town Attorney David Quesenberry, Asst. to the Town Manager Patricia Cruise, Clerk of Council Others: Elrica Graham Jonathan Hagee Kelly Barker, Press Councilman Penn moved to modify the Agenda by adding item 4a, request for assistance to the state tournament and item 7b, Ordinance 2005-32. The motion was seconded by Councilman Burchett and carried on the following recorded vote: Jeffrey S. Worrell - Aye Lane R. Penn - Aye Dan Talbert, Jr. - Absent John T. Bolen - Aye Bettye H. Steger - Absent Joel B. Burchett, Jr. - Aye Mayor Wade moved on to the Public Hearing for a request to lease space at the Maple Shade Center to Hope City Cafe. The Hearing opened at 5:02 p.m. From the Public, Mrs. Elrica Graham addressed Council advising that she and Gail Long, (who could not attend the meeting), were in favor of the request. There being no further comments, the Hearing was closed at 5:04 p.m. Councilman Worrell inquired into the status of the renovations at the building? Mayor Wade summarized the extent of the work to date and advised that the shop hoped to open on August 5th. Mayor Wade moved on to the baseball request. John Hagee addressed Council advising that the baseball team won the District Regional title. They would be traveling to Powhatan for the next phase of the tournament. Mr. Hagee requested a donation from Council to help cover the costs for rooms, food etc. during the tournament. He advised that the group had been washing cars, requesting donations from businesses etc., but had not yet gained enough funding. He advised that they were short $500. Following discussion, the consensus of Council was that Council could make individual donations, but should not spend the tax payer’s money. Police Chief Gary Roche advised that the Police Department had a Community Policing account, with no tax payer funds in it. He advised that the Police Department would make a donation to the team from that account. Mayor Wade moved on to Ordinance 2005-30, Amending Rules and Regulations of Oakwood and Pinehurst Cemeteries. Mr. Hawley advised that Council and staff had been reviewing the financial status at the cemeteries compared to the maintenance and repair needs. As a result of those discussions, Ordinance 2005-30 was created. The Ordinance states that 75% of the funds from each sale shall be used for maintenance and perpetual care of the cemeteries and the remaining 25% shall be placed in Trust for investment and for the purposes stated in the terms of the Trust. Further, seventy-five percent of the income from the Trust shall be transferred annually to the general fund for the sole purpose of maintenance and perpetual care of the cemeteries. Following discussion, Councilman Worrell moved to adopt Ordinance 2005-30, Providing for Rules and Regulations of Oakwood and Pinehurst Cemeteries. The motion was seconded by Councilman Penn and carried on the following recorded vote: Jeffrey S. Worrell - Aye Lane R. Penn - Aye Dan Talbert, Jr. - Absent John T. Bolen - Aye Bettye H. Steger - Absent Joel B. Burchett, Jr. - Aye Mayor Wade moved on to Resolution 2005-33, Lease for Hope City Café. Councilman Bolen moved to adopt Resolution 2005-33, Lease for Hope City Café, seconded by Councilman Penn and carried on the following recorded vote: Jeffrey S. Worrell - Aye Lane R. Penn - Aye Dan Talbert, Jr. - Absent John T. Bolen - Aye Bettye H. Steger - Absent Joel B. Burchett, Jr. - Aye The next item on the agenda was Ordinance 2005-33, Establishing the Junior Volunteer Firefighter Program for the Town of Pulaski. Fire Chief Webb explained that this Ordinance allows the establishment of programs for minors and provides protection for the Town regarding child labor laws. Councilman Penn moved to adopt Ordinance 2005-33, Establishing the Junior Volunteer Firefighter Program for the Town of Pulaski, seconded by Councilman Bolen and carried on the following recorded vote: Jeffrey S. Worrell - Aye Lane R. Penn - Aye Dan Talbert, Jr. - Absent John T. Bolen - Aye Bettye H. Steger - Absent Joel B. Burchett, Jr. - Aye Mayor Wade moved on to Ordinance 2005-32, regarding the Industrial Development Authority. Mr. Hawley advised that this Ordinance allows the Town Manager to contract with the Pulaski County Industrial Development Authority to share the burden of the financing of bonds for the site preparation costs and fees of the Pulaski Business Park. Councilman Bolen moved to adopt Ordinance 2005-32, Adoption of a Contract Between the Town of Pulaski and the Pulaski County Industrial Development Authority, seconded by Councilman Penn and carried on the following recorded vote: Jeffrey S. Worrell - Aye Lane R. Penn - Aye Dan Talbert, Jr. - Absent John T. Bolen - Aye Bettye H. Steger - Absent Joel B. Burchett, Jr. - Aye Mayor Wade asked that the 04-05 Year Review scheduled on the agenda be moved to a later date. Council agreed. Next, Councilman Worrell moved to adopt the Council minutes of June 20, 2005, seconded by Councilman Penn and carried on voice vote. Councilman Penn moved to enter into Closed Session under Virginia Code 2.2-3711 (A-5) Prospective Business and (A-1), Discussion, consideration or interviews of prospective candidates for employment; assignment, appointment, promotion, performance, demotion, salaries, disciplining or resignation of specific public officers, appointees or employees of any public body. The motion was seconded by Councilman Bolen and carried on the following recorded vote: Jeffrey S. Worrell - Aye Lane R. Penn - Aye Dan Talbert, Jr. - Absent John T. Bolen - Aye Bettye H. Steger - Absent Joel B. Burchett, Jr. - Aye Mayor Wade – Aye Council returned from Closed Session and adopted the Certification Resolution for the Closed Session on motion by Councilman Burchett, seconded by Councilman Bolen and carried on the following recorded vote: Jeffrey S. Worrell - Aye Lane R. Penn - Aye Dan Talbert, Jr. - Absent John T. Bolen - Aye Bettye H. Steger - Absent Joel B. Burchett, Jr. - Aye Mayor Wade – Aye There being no further business, the meeting adjourned.
