ORDINANCE 2008-20
ORDINANCE GRANTING A SPECIAL EXCEPTION FOR A DAY CARE CENTER
AND AN AFTER SCHOOL PROGRAM
WHEREAS, Memorial Baptist Church applied for a special exception under Section 405.3-5
of the Zoning Regulations of the Town of Pulaski, Virginia to operate a day care center and
after an school program on the church's property; and,
WHEREAS, the subject properties are zoned R-4 Residential District and are identified as
Tax Map Nos. 072-063-000B-0001 through 0025; 072-061-0000-0001 through 0006; and
072-060-0000-002A and are recorded in Deed Book 157, Page 515 and Deed Book 490,
Page 377 respectively; and,
WHEREAS, as required by law, duly noticed public hearings were conducted by the Planning
Commission on September 8, 2008 and the Town Council on October 7, 2008, wherein the
comments and concerns of the public were heard and the criteria for evaluating a special
exception request, as listed in Section 702.4-5 of the Zoning Regulations of the Town of
Pulaski, Virginia, were considered by the Planning Commission and Town Council; and,
WHEREAS, the Town Council did consider and found as fact that the proposed special
exception is compatible with the surrounding uses; is consistent with the intent of the Zoning
Regulations and the Comprehensive Plan; is in the public interest; and will comply with other
provisions of law and ordinances of the Town of Pulaski,
NOW, THERFORE be it ORDAINED by the Town Council of the Town of Pulaski, Virginia
sitting in regular session this 4th day of November 2008 that the application of Memorial
Baptist Church for a special exception to operate a day care center and an after school
program is hereby approved as submitted.
This ordinance is effective upon adoption and is hereby adopted this 4th day of November
2008 by the duly recorded vote of the Town Council of the Town of Pulaski, Virginia as
follows:
