At a regular Municipal Election held for the Town of Pulaski,
Virginia, on May 5, 1992, the following officers were elected with terms
to begin July 1, 1992.
Mayor Gary C. Hancock - two year term; Elbert G. Black, Jr., Roy H.
D'Ardenne, Jr., Alma H. Holston and J. R. Schrader, Jr., Councilmembers
to serve four years.
The Mayor-elect and the Councilmembers-elect have duly qualified
before the Clerk of the Circuit Court of Pulaski County, Virginia, as
provided by Section IX of the Town of Pulaski Charter of 1948, and thQ
Charter amendment approved by the 1986 Legislature. A meeting was held
this 7th day of July, 1992, at 4:00 p.m. in the Council Chambers in the
Municipal Building.
There were present: Mayor Gary C. Hancock, presiding

The Organizational Meeting of Town Council was called to order at
4:00 p.m.
Mayor Hancock led the Pledge of Allegiance with the Invocation
being given by Rev. Jack Weikel.
Councilwoman Holston made the motion to appoint Rebekah Corso as
Acting Clerk of Council, seconded by Mr. Crispin, 'and so carried.
Mayor Hancock asked the Acting Clerk if she had received the
"Abstract of Votes" cast in the Town of Pulaski Municipal Election held
on May 5, 1992, and was advised by the Acting Clerk that she had
received same, and upon his request, the Acting Clerk read from the
Abstract of Votes the following: For Mayor of the Town of Pulaski, Gary
C. Hancock; For Council - Elbert G. Black, Jr., Roy H. D'Ardenne, Jr.,
Alma H. Holston, and J. R. Schrader, Jr.
As no one requested the Acting Clerk read entire Abstract of Votes,

Councilman Crispin made a motion that Abstract of Votes be received and
recorded as part of the minutes of this meeting, seconded by Councilman
J. R. Schrader, and carried on the following recorded vote:

Mayor Hancock inquired of the Acting Clerk if she had received

Court, and was informed she had received same. Councilman Crispin made

Councilman D'Ardenne, and carried on the following recorded vote:

Thereupon, the newly elected officials were seated.
Mayor Hancock welcomed new Councilmembers Roy D'Ardenne and E. G.
Black.
Mayor Hancock commended outgoing Councilmembers Neblett and
Copenhaver for their service to the Town, and requested that Resolution
#92-16 Honoring Mary Lou Copenhaver and Resolution #92-17 Honoring James
M. Neblett be considered for adoption.
Councilwoman Holston made a motion to waive the reading of
Resolution #92-16 Honoring Mary Lou Copenhaver and Resolution #92-17
Honoring James M. Neblett, seconded by Councilman J. R. Schrader, and so
carried.
Councilman D'Ardenne made a motion that Resolution #92-16 Honoring
Mary Lou Copenhaver be adopted, seconded by Councilwoman Holston, and
carried on the following recorded vote:

RESOLUTION 92-16
HONORING MARY LOU COPENHAVER
WHEREAS, Mrs. Mary Lou Copenhaver has been a member of Pulaski Town
Council since 1984; and
WHEREAS, Mrs. Copenhaver served as Chairperson of the Personnel
Committee since 1990, Ordinance Committee from 1984 to 1990 and Streets
Committee from 1984 to 1985; and
WHEREAS, She also served as a member of the following committees:
Finance, Recreation, Public Safety, Pollution and Sanitation, Land-

Building-Parks, Cemetery and Public Operations; and
WHEREAS, During her service, Mrs. Copenhaver has dealt capably with
numerous complex issues and projects affecting past, present and future
Town residents, including but not limited to the revision of the Town
Charter and Code, Pulaski Main Street, UDAG projects, annexation, Town
Centennial Celebration and the downtown street and sidewalk
improvements; and
WHEREAS, As a member of Council, Mrs. Copenhaver served all
citizens of the Town with fairness, honesty, kindness and respect.
NOW, THEREFORE, be it RESOLVED by the Town Council of the Town of
Pulaski, Virginia, sitting in regular session on July 7, 1992, that the
Town Council should and hereby recognizes the significant and lasting
contributions of Mrs. Copenhaver to the citizens of the Town of Pulaski
and commends her for her dedication and years of service.
This resolution is effective upon adoption and is adopted by
recorded vote of the Town Council of the Town of Pulaski, Virginia, on
this 7th day of July, 1992.

HONORING JAMES M. NEBLETT
WHEREAS, Mr. James M. Neblett was elected to serve on the Town
Council of the Town of Pulaski, Virginia, in 1974 and therefore served
by election and appointment for a total of fifteen years until June 3t},
1990; and
WHEREAS, Town Council appointed Mr. Neblett to serve the remainder
of Jim Neighbors term in September 1991; and
WHEREAS, During his previous term, Mr. Neblett served as Chairman
of the following committees; Public Safety, Nominating, Public and
Personnel Relations and Utilities; and
WHEREAS, Since his appointment in September 1991, Mr. Neblett has
attended all committee meetings of Town Council; and
WHEREAS, His many contributions to the residents of the Town of
Pulaski including assisting in the creation of the pilot projects for a
joint recreation program with Pulaski County and the Town of Dublin,
participation in the Pepper's Ferry Wastewater Treatment Plant, UDAG
projects, Main Street and the revision of the Town Charger and Code.
NOW, THEREFORE, be it RESOLVED by the Town Council of the Town of
Pulaski, Virginia, sitting in regular session on July 7, 1992, that the
Town Council should and hereby recognizes the lasting contributions of
Mr. Neblett to the citizens of the Town of Pulaski and commends him for

This resolution is effective upon adoption and is adopted by
recorded vote of the Town Council of the Town of Pulaski, Virginia, on
this 7th day of July, 1992.
Mayor Hancock commended Town Manager Don Holycross, Assistant to
the Town Manager Robert J. Lyons and Town Attorney Frank Terwilliger for
their service to the Council and the Town of Pulaski.
Mayor Hancock advised a Vice-Mayor would now

Mayor Hancock adjourned the Organization Meeting at 4:25 p.m.
The first order of business in Council's Regular Meeting was the
approval of the minutes of the Regular Meeting of June 16, 1992 and
Special Meeting of June 24, 1992. Councilman Graham so moved that
minutes be approved as submitted, seconded by Councilman Crispin, and
carried.
At this time Mrs. Mary Lee Duncan expressed her thanks to Council
for the passage of the ordinance controlling the train whistles.
As there were no further comments from the public, Mayor Hancock
called for Council Committee Reports.

ORDINANCE COMMITTEE
Chairwoman Holston advised that the Ordinance Committee had met
June 23, 1992, and reviewed an ordinance permitting the expansion of the
Pine Hill Trailer Park as a conditional use. Council has since approved
the conditional use.

TOWN ATTORNEY'S REPORT

. Sess. Mr. Terwilliger requested an Executive Session on an Acquisition of
Property for Public Purpose under 2.1-344 A3 and also to Consult with
Legal Counsel under 2.1-344 A7 on a specific legal matter pertaining to
potential litigation concerning the Newbern Road Renfro plant.
Mayor Hancock requested an Executive Session on an inquiry on a
legal matter, specifically a citizen's request that the Town purchase
property, under 2.1-344 A7.
Mr. Holycross requested an Executive Session under 2.1-344 A5
Economic Development to discuss a potential business prospect for the

downtown area.

Councilman D'Ardenne briefed Council on a seminar that he and Mr.
Lyons had attended related to Design Review Guidelines. Mr. Lyons
informed Council that they had shared with the Department of Historic
Resources the value of historic ordinances and guidelines and their
importance to the Architectural Review Board in making decisions and
additionally their value to the residents.
At 4:30 p.m. Councilman Crispin so moved that Council go into

Mr. Terwilliger read Ordinance 92-11:
ORDINANCE 92-11
ORDINANCE AUTHORIZING THE TOWN TO PARTICIPATE IN A PARKING LOT
ADOPTED PURCHASE WITH PULASKI COUNTY
Be it ordained by the Town Council of the Town of Pulaski,
Virginia, sitting in regular session on July 7, 1992, that the Town
Council does authorize the Town Manager to expend up to $15,732.50 from
UDAG funds to purchase from the Board of Supervisors of the County of
Pulaski, Virginia a one-half interest in Lots 18, 20, 22 and 24 Block 23
in the Town of Pulaski, County of Pulaski, Virginia, so that the parcel
of land can be developed by the County of Pulaski as a parking lot to
serve the citizens of the Town and County in a manner to be determined
by the Town and County. This Ordinance is effective upon adoption and
is adopted this 7th day of July, 1992, by recorded vote of Pulaski Town
Council.

PARKING LOT
ORDINANCE
Councilman Holston made a motion to adopt Ordinance 92-11,
Authorizing the Town to participate in a parking lot purchase with
Pulaski County, seconded by Vice-Mayor W. H. Schrader.
Councilman Crispin expressed his concern that although he approved
of the ordinance in principal, felt they were rushing to judgment, he
did not feel they had clear understanding with the County on how this
property is to be utilized by the Town and County. Therefore, under
these circumstances he was not in favor of the Ordinance.
Motion then passed on the following recorded vote:

Mayor Hancock requested that Vice-Mayor W. H. Schrader preside over
the next matter before Council.
Mr. Terwilliger advised he would ask that Council approve a
settlement agreement reached by Pulaski County and Renfro Corporation
with A & L Construction regarding claims they had against A & L
RENFRO Construction and its insurance company on the construction of the Renfro
CORP. Newbern Road Plant. There has been an agreement reached by the County
and all other parties, but the Town as the legal title holder to the
real estate and therefore the legal title holder of the building itself,
even though the County and IDA are the principals involved in the
settlement whereby the County will be paid $350,000 by the contractor in
settlement for various claims. The insurance company for the Contractor
has asked that the Town be one of the signatories of the agreement so
that there is no possibility the Town, as legal title holder, will come
back against them as well.
Councilman Crispin made a motion authorizing the Town Manager or
Vice-Mayor to execute an appropriate settlement agreement on behalf of
the Town, providing all other parties also execute the agreement, with
regard to the Newbern Road Renfro Plant, seconded by Councilman Glenn
and carried on the following recorded vote:
