There were present: Mayor Gary C. Hancock, presiding Council Members: James M. Neblett, J. R. Schrader, Jr., Mary Lou Copenhaver, James R. Neighbors, Andrew L. Graham, W. H. Schrader, Jr., Alma H. Holston, Ira S. Crawford Also Present: Frank Terwilliger, Town Attorney Anne Burgess, Interim Town Manager Ruth A. Brugh, Dept. of Transportation Marvin Eanes Two area citizens The invocation was given by Councilman J. R. Schrader. PUBLIC HEARING TAXI CABS On motion made by Councilwoman Holston, seconded by Councilman J. R. Schrader, and carried, the minutes of the regular meeting of November 21, 1989, and minutes of the special meetings of November 27, 1989, and November 29, 1989, were approved as recorded. The annual public hearing required under Chapter 26 of the Taxic and Other Vehicles for Hire Ordinance, for determining the number of public vehicles, taxicabs, and for hire cars for which certificates should be issued during the calendar year 1990, and for the further purpose of determining to whom the certificates should be issued was then called to order. Ms. Burgess reported that during calendar year 1989, the Town approved 21 certificates issued for operation of taxicabs as follows: Blue & White Cabs - 13 Deluxe Cabs - 5 Jim Dandy Cabs - 3 The applications we have received for calendar year 1990 are as follows: Blue & White Cabs - 13 Deluxe Cabs - 4 Jim Dandy Cabs - 5 Ms. Burgess stated that a report from the Police Department showed that only seven cabs from Blue & White were presented for inspection. Two cars on the lot were completely disassembled and there was no evi- December 5, 1989 8654 dence of the other four cars and she recommended only seven certificates be issued to Blue & White Cabs. Councilman Neblett so moved that in accordance with Section 26-38 of the Town Code, the Town of Pulaski issue 16 certificates of operation of taxicabs for calendar year 1990, seconded by Councilman Neighbors. Mr. Eanes of Blue & White Cabs addressed Council advising they had purchased two new cars one day prior to hearing and requested that they be issued 13 certificates. He stated they have more cars coming, as insurance settlements are received. Councilman Neblett withdrew his motion and Councilman Neighbors withdrew his second. Councilman Neighbors then moved that in accordance with Section 26- 38 of the Town Code, the Town of Pulaski issue 22 certificates of opera- tion of taxicabs for calendar year 1990. And, in accordance with Section 26-38 of the Town Code, the Town of Pulaski issue certificates for operation of taxicabs to the following applicants: 22 CERTIFICATES Blue & White Cabs - 13 AWARDED Deluxe Cabs - 4 Jim Dandy Cabs - 5 Motion seconded by Councilman Crawford and carried on the following recorded vote: James M. Crawford - Aye In hearing from the public, Mr. Jake Blevins addressed Council with the request to widen creek and straighten creek behind his home to pre- vent flooding. He stated that the slag needed to be blasted, and that the cleaning and grubbing did not improve the flow of water very much. Mr. Blevins also requested that Council have the old gun in Dora Highway Park moved back into Jackson Park as it is deteriorating. The VFW has offered to paint this gun. Council discussed the old guns and felt that one had been taken in for repair. Also, one had been donated to the war effort in World War II. Ms. Burgess will prepare a report on these old guns and bring back to Council. Mr. Dan Brugh, Department of Transportation, addressed Council with the offer of the historic bridge in Montgomery County. They have offered $15,000 to dismantle the bridge. If the Town did not use the bridge we could notify Mr. Brugh and they would try to find a place for it. BRIDGE Councilman Neblett made a motion that we accept this offer contin- gent upon securing a contractor that could disassemble the bridge and move it for $15,000 or less. Crawford - Aye UTILITIES COMMITTEE I WATER Chairman Neblett advised that committee had met December 4th to review the Hager water bill for their laundrymat on Monte Vista Drive There was a water leak between the water meter and this business. Th Town had previously adjusted for the sewer charges. The Utility Committee felt the Town did not have any responsibility in this water leak, or any responsibility to credit owner for water bills during th period of the leak, i.e. from December, 1988 to June, 1989. ORDINANCE COMMITTEE Chairman W. H. Schrader did not have a report, however, he called an Ordinance Committee meeting for Tuesday, December 12th, and a brief committee meeting following the Council meeting. PUBLIC AND PERSONNEL RELATIONS, NOMINATING COMMITTEE Chairman Neighbors did not have a report. PUBLIC OPERATIONS COMMITTEE Chairman Graham did not have a report. FINANCE COMMITTEE APCo Chairman Crawford advised the committee had met prior to the Council meeting and discussed the Appalachian Power Company street light proposal. Chairman Crawford made a motion that we authorize Appalach Power to move forward immediately with the upgrade and new installati as listed in items 1 (upgrade 27 street light to 50,000 lumen high pressure sodium from Washington Avenue along Third Street out Main Street (Rt. 99) to where the existing lights end), at a cost of $1,035. Item 2 - install 32 new 50,000 lumen HPS lights and poles from the Golden Corral restaurant on East Main St. (Rt. 99) from where the existing lights end to just east of Xaloy Road and install one additional light and pole at the intersection of East Main and Dora Highway, at a cost of $9,680; and item 4 - install 9 9,500 lumen HPS lights on new poles in the Bainbridge Subdivision, at a cost if $2,750. He also recommended that APCo do whatever additional engineering work is necessary to come back to Council with the other items as far as upgrading the lights. Crawford - Aye EMPLOYEES Chairman Crawford stated that information had been received from RETIREMENT Virginia Supplemental Retirement regarding employees retiring at age 55 with 30 years service. Chairman Crawford so moved that this be added to our benefits now at no additional cost, seconded by Councilwoman Holston December 5, 1989 8656 and carried on the following recorded vote: James M. Crawford - Aye CHAMBER OF Chairman Crawford stated we have received a request from the COMM.Chamber of Commerce to again grant them office space in the municipal building for another year rent free, and he so moved that we grant them office space rent free, however, we would ask that this be granted in lieu of Chamber of Commerce dues in the amount of $1,265 for the Town of Pulaski for the coming year. TOWN ATTORNEY'S REPORT Mr. Terwilliger presented an ordinance closing a portion of Second Street, S.W. between Bertha St. and State St. Councilwoman Copenhaver so moved that reading of the ordinance be waived, seconded by Councilwoman Holston and carried. Crawford - Aye Ordinance Closing a Portion of Second Street, S.W. Between Bertha Street and State Street in the Town of Pulaski, Virginia WHEREAS, the Town Council of the Town of Pulaski received a request to close a portion of Second Street, S.W. in the Town of Pulaski, 8657 December 5, 1989 TOWN MANAGER Virginia, between Bertha Street and State Street; WHEREAS, after information was gathered by the Town staff the matter was duly advertised for public hearing with appropriate notices given, and the public hearing was held on November 21, 1989, and, WHEREAS, it appears that the subject portion never been opened and that due to topography it w open said street in a cost effective manner; and, interest to close the aforesaid street subject to that might exist in favor of the Town and subject runs between First Street. S.S. and Third Street, Street; of said street has ould not be possible to it is in the public any utility easeme to the alley which S.W. across said NOW, THEREFORE, be it ORDAINED by the Town Council of the Town of Pulaski, Virginia, sitting in regular session on December 5, 1989 that the portion of Second Street, S.W. lying between Bertha Street and State Street, in the Town of Pulaski, Virginia, as shown on the official Town map, be and hereby is, abandoned, closed, and vacated with title thereto if any be vested in the Town, reverting without warranty to adjacent property owners as provided by statute; reserving, however, an alley across said closed street so as to provide join existing alleys to provide a continuous alley from First Street, S.W. to Third Street, S.W., and reserving any and all utility easements which may exist in favor of the Town of Pulaski, its successors and assigns. This ordinance is effective upon adoption and is adopted this 5 day of December, 1989. Mr. Terwilliger informed Council that Mr. Holycross had returned two signed copies of contract that we tendered to him. Councilwoman Holston so moved that Mayor Hancock be authorized to execute the contract, seconded by Councilman W. H. Schrader and carried. Mayor Hancock stated that they appreciated Anne Burgess' help during this interim period when she has served as Acting Town Manager TOWN MANAGER'S REPORT STREETS Ms. Burgess reported that the milling and paving project for Phase II of Downtown Street Improvements as well as Valley Road, East Main Street and Graham Street is complete at a total cost of 550,335.35. Ms. Burgess advised that a restoration of the Pulaski Pass Benevolent Foundation. This is received the grant. Total cash today we received another 5200. stated there was another pledge $5,000 grant had been received for enger Station from the C. E. Richardson the seconded consecutive year we have and pledges todate is 519,987.10 and from the Bosang Fund. Mayor Hancock of $3,000 forthcoming. COUNCIL Council's attention was directed to the new Ridgeway Clock in the Council Conference Room, which has been donated by Pulaski Furniture through the efforts of Councilman Crawford. Mayor Hancock stated we normally meet with our Delegate before he goes to Richmond to express our concerns to him and give him our "wish list", and Mayor Hancock will set up a meeting with Mr. Baker. December 5, 1989 8658 TRAIN Ms. Burgess stated another request for the train station should be STAorwarded before the first of the year. A presentation will also be mffade before the Norfolk-Southern Foundation. Ms. Burgess informed Council that the Census Committee had been appointed . ZONING Jr.'s Used Cars on Pierce Avenue has been given a deadline of December 8 to comply with all of the regulations set forth in the first correspondence. After that time, penalties will start to accrue. At 4:50 p.m. Councilman Neighbors so moved that Council go into Executive Session as requested by Ms. Burgess and Mr. Terwilliger on Economic Development Matters under 2.1-344 A3 and A5, seconded by Councilman Graham and carried on the following recorded vote: James M. Crawford - Aye At 5:19 p.m. Council returned to Regular Session, waived reading of Certification Resolution, and adopted the Certification Resolution on motion made by Councilman Neblett, seconded by Councilman Neighbors and carried on the following recorded vote: James M. Crawford - Aye Certification Resolution RESOLUTION Pulaski Town Council ADOPTED WHEREAS, the Pulaski Town Council has convened an executive meeting on this date pursuant to an affirmation recorded vote and in accordance wit the provisions of the Virginia Freedom of Information Act; and, WHEREAS, 52.1-344.1 of the Code of Virginia requires a certification by this Pulaski Town Council that such executive meeting was conducted in conformity with Virginia law; NOW, THEREFORE, BE IT RESOLVED that the Pulaski Town Council hereby certifies that, to the best of each member's knowledge, (i) only public business matters were discussed in the executive meeting to which this certification resolution applies, and (ii) only such public business matters as were identified in the motion convening the executive melt- ing were heard, discussed or considered by the Pulaski Town Council.
