Minutes of the regular meeting of the Pulaski Town Council held
January 2, 1990, at 4:00 p.m. in the Council Chambers in the Municipal
Building.
There were present: Mayor Gary C. Hancock, presiding
Council Members: James M. Neblett, J. R. Schrader, Jr.,

The invocation was given by Mayor Hancock.
On motion made by Vice Mayor Neighbors, seconded by Councilman
Neblett and carried, the minutes of the regular meeting of December 19,
1989, and special meeting of December 20, 1989, were approved as
recorded.
ST. COMPLAMs. Chris Henley, registered speaker, addressed Council regarding
the condition of Pump House Road, stating the Town had maintained the
road for the last 20 years. It is now in such condition that it is
unsafe and is causing a hardship on the four families it serves. This
road is in the County, however, the Town did carry gravel to this road
approximately two weeks ago.
Mr. Terwilliger stated a research of deed showed the Town had no
responsibility for the maintenance of this road. The Town's maintenance
has been done to get to the pump station. Ms. Henley can petition the
County for state to maintain road.
Councilman Neblett so moved this matter be referred to the Public
Operations Committee for their review and a report brought back to
Council, seconded by Vice Mayor Neighbors and carried.
Several years ago, Mayor Ratcliffe had informed Ms. Henley that the
Town did not have to maintain this road.
As there were no further comments from the public, Mayor Hancock
called for Council Committee Reports.

Chairman Neblett had no report.
ORDINANCE COMMITTEE
Chairman W. H. Schrader was absent, however, had requested an
Ordinance Committee Meeting for Tuesday, January 9th, at 4:30 p.m.
PUBLIC AND PERSONNEL RELATIONS, NOMINATING COMMITTEE
Chairman Neighbors had no report, however, he requested an
Executive Session.
PUBLIC OPERATIONS COMMITTEE
Chairman Graham had no report, however, stated the committee would
meet Saturday, January 6 following the viewing of rezoning request on
Pierce Avenue to make a field trip to Pump House Road.
FINANCE COMMITTEE
Chairman Crawford had no report.
MAYOR'S REPORT
Mayor Hancock reported the investigation had been completed on the
Courthouse fire. Ms. Burgess reported that no traces of arson were
COURTHOUSE found. It is suspected that this was an electrical fire which started
FIRE in the attic and traveled downward to the first floor. No injuries were
incurred.
The Town's assistance has been offered to the County. There were
351,000 gallons of water used, 34 hours worked at site and a total of 85
fire fighters from the Town and surrounding areas fought this
disasterous fire. Council extended appreciation to all the fire
fighters for their assistance.
TOWN ATTORNEY'S REPORT
N-S Mr. Terwilliger reported that a conversation had been held with
attorney for Norfolk-Southern Corp. and a deed has been executed for the
train station and is being forwarded this date.
TOWN MANAGER'S REPORT
Ms. Burgess reported that a call had been received from Mr. Neikirk
of Norfolk-Southern Foundation and he indicated they were trying to push
our request for funding through quickly and that they would advise us as
soon as possible.
Ms. Burgess advised that the ARB has initiated a letter to the
County offering their support in any way possible as far as the
preservation issues involved with the courthouse, and also to encourage
the preservation of the structure.
Ms. Burgess reported that a meeting was held with the employees and
Council Members on December 28th with the Blue Cross representative, Sam
Brown. Questions that employees had were answered.

INSURANCE
Councilman Neblett so moved that resolution setting Town's
contribution to employee health insurance be adopted, seconded by
Councilman Crawford and carried on the following recorded vote:

RESOLUTION
SETTING TOWN'S CONTRIBUTION TO EMPLOYEE HEALTH CARE
INSURANCE
BE IT RESOLVED by the Town Council of the Town of Pulaski,
Virginia, sitting in regular session on January 2, 1990, the Town of
Pulaski, Virginia will pay the sum of $120.00 toward the payment of the
health insurance premium of each qualified employee.
The amount of the Town's payment will remain subject to the Town's
right to change or delete such payments in the future.
THIS RESOLUTION is adopted this 2nd day of January, 1990, by
recorded vote of the Town Council.
Also, information has been received on the statewide health benefit
program and the associated legislation (HB1116). A public hearing will
be held on January 16, 1990 in Richmond. Town Treasurer Gary Cutlip
plans to attend and also the Town Manager and/or the Assistant Town
Manager.
LEGISLATIVE Ms. Burgess stated that a meeting had been scheduled with our new
ITEMS Delegate, Tommy Baker, for January 5, 1990, at 4:00 p.m. to review State
legislative issues of concern to the Council.
Ms. Burgess is to prepare a summary for presentation to Mr. Baker.
Ms. Burgess reminded that Council, Planning Commission and staff
were to make an on site visit to Pierce Avenue regarding the rezoning
request on January 6th at 10:00 a.m. Also, the Recreation Task Force
would meet at Dublin Town offices on January 8th.
Ms. Burgess requested that a Finance Committee meeting be held to
receive audit and also a personnel matter would need to be reviewed.
At 4:37 p.m., Council went into Executive Session, on a legal
matter as requested by Mayor Hancock under 2.1-344 A7, a personnel
matter requested by Vice Mayor Neighbors A7 and a real estate matter A3
as requested by Ms. Burgess, on motion made by Councilwoman Holston,
seconded by Vice Mayor Neighbors and carried on the following recorded
vote:

At 5:18 p.m. Council returned to regular session, and reading of
the Certification Resolution waived on motion made by Councilman
Neblett, seconded by Vice Mayor Neighbors and carried.

CERTIFICATION RESOLUTION
PULASKI TOWN COUNCIL
WHEREAS, the Pulaski Town Council has convened an executive meet g
on this date pursuant to an affirmation recorded vote and in accordance
with the provisions of the Virginia Freedom of Information Act; and,
WHEREAS, 52.1-344.1 of the Code of Virginia requires a
certification by this Pulaski Town Council that such executive meeting
was conducted in conformity with Virginia law;
NOW, THEREFORE, BE IT RESOLVED that the Pulaski Town Council hereby
certifies that, to the best of each member's knowledge, (i) only .public
business matters lawfully exempted from open meeting requirements by
Virginia law were discussed in the executive meeting to which this
certification resolution applies, and (ii) only such public business
matters as were identified in the motion convening the executive meeting
were heard, discussed or considered by the Pulaski Town Council.
At 5:20 p.m. Councilman Neblett so moved that Council adjourn,
seconded by Vice Mayor Neighbors and carried.
