There were present: Mayor Gary C. Hancock, presiding Councilmembers: John A. Johnston, Robert N. Glenn, Andrew L. Graham, James M. Neblett, James R. Neighbors, W. H. Schrader Also present: Frank Terwilliger, Town Attorney D. E. McKeever, Town Manager .Anne Burgess, Assistant to the Town Manager Ruth A. Harrell, Clerk Visitors: Dee Lindsey of -the Southwest Times Ralph Grubb Joe. Weddle Pat Kirkland 14 area citizens The invocation was given by Councilman Graham. .Councilman Neblett moved that the minutes of the regular meeting of August 5, 1986, and the minutes of the special meeting of August 13, 1986, be approved as submitted, seconded by Councilman Schrader and carried. PETITION In hearing from the public, Mr. Pat Kirkland, Camper Street, submitted a OPPOSING petition opposing the rezoning of property on Memorial Drive, from P~ppers Ferry REZONING ~ ~% si Road to Route 11, containing signatures of people who not only live and work in ', Pulaski, but some signatures of people who work in Pulaski but live in surrounding areas and have a vested interest in Pulaski. Petition contained 1,063 signatures opposing rezoning. Clerk of Council was instructed to receive and file this petition, and Council will review prior to public hearing on August 26. In reviewing the public hearing scheduled for August 26, decision was made in order to give everyone an opportunity to speak, to have people register when entering the auditorium, or register with the Clerk prior to the meeting. In this manner, person speaking can go to microphone and can be heard. One microphone to be placed in each aisle, with a five minute limit on each speaker. Other speakers, not registered, will be given the opportunity to speak after the registered speakers are heard. UTILITIES COMMITTEE Chairman Johnston advised. that Pegper.s Ferry has signed a 25 year lease agreement with the City of Radford to establish a trash transfer station. Town Attorney to review this lease. Also the Director has been given a 5~ increase after one year employment. The next Peppers Ferry meeting will on the site on September 4, 3:30 or 4:00 p.m. PEPPERS Peppers Ferry also discussed state owned jurisdiction (Radford College) dumping FERRY wastewater in treatment facility and as to whether or not they come under certain regulations of industrial pollutants. Jurisdictions in the state are limited by the state law to a remedy of $25,000 and Peppers Ferry is trying to go to General Assembly and ask for a waiver. Radford Pump Station, 7A, is apparently behind in construction. 4B is on schedule and anticipated completion date is March, 1987. Mr. McKeever stated a final punch list will be made on contract 4A (Pulaski Pump Station) before it is turned over to the Town. We will need to come up with a plan to protect it this winter. If we go on line in March .and 7A is not completed, the operations and maintenance costs are assessed to a percentage basis. Also, our people have been informed that there are jobs available at Peppers Ferry. PUBLIC & PERSONNEL RELATIONS NOMINATING COMMITTEE Chairman Neblett had no report. PUBLIC OPERATIONS COMMITTEE Chairman Neighbors had no report. ~' ~~~ August 19, 1986 PETITION WIDENING TAYLOR ST. TOWN PROPERTY ADVERTISE FOR SALE AMENDMENT TO PEDDLER'S ORDINANCE Mayor Hancock advised that Mr. Raymond Rigney, Taylor Street, had filed a petition with him stating Taylor Street is not wide enough in places. This petition was referred to Public Operations Committee for their review. Mr. McKeever advised that person had expressed desire to purchase and move the old building (originally owned by F.AA) at Loving Field. If building were to be sold, we are required to advertise for bid. Councilman Glenn made a motion that Town Manager be authorized to advertise this building for sale, seconded by Councilman Neblett and carried on the followin recorded vote: John A. Neblett - Aye Mary Lou Copenhaver - Absent FINANCE COMMITTEE Chairman Crawford absent. ORDINANCE COMMITTEE Chairperson Copenhaver absent. Mr. McKeever advised the Block Party Subcommittee of the Centennial Committee has been trying to recruit crafts people and vendors to the Block Party, but are having problems since they fall under the Town's Peddlers Ordinance. It is recommended we exempt activites that are sponsored by the Town or one of its committees from the Ordinance. Mr, Terwilliger presented and read an Ordinance amending the peddler/itinerant vendors ordinance to waive fees on Town-sponsored events. Councilman Neblett so moved that Ordinance as presented be adopted, seconded by Councilman Graham and carried on the following recorded vote: John A. Johnston - Aye James R. Neighbors - Aye Robert N. Neblett - Aye Mary Lou Copenhaver - Absent ORDINANCE AMENDING THE PEDDLER/ITINERANT VENDORS ORDINANCE TO WAIVE FEES ON TOWN-SPONSORED EVENTS BE IT ORDAINED by the Council of the Town of Pulaski, Virginia, sitting in regular session on the 19th day of August, 1986, that the Town's Ordinance on peddlers and itinerant vendors be, and hereby is, amended by the addition of the following section, with a section number to be assiend administratively, but the text to be as follows: Section Waiver of Peddler/Itinerant Vendors License for Town-Sponsored Events There are exempted from the requirements of a Peddlers/Itinerant Vendors License any person of persons selling food or drink or handicraft items at events that are sponsored or co-sponsored by the Town of Pulaski or a duly authorized department of committee of the Town. This Ordinance is effective upon adoption and is adopted this 19th day of August, 1986. Councilman Neighbors advised he had received complaints on the condition of PARKING .the parking lot at Pulaski Mall. Mr. McKeever stated this has been an on-going LOTS problem on this private parking lot. Mr. Terwilliger advised that Hardees were open 24 hours a day, and you cannot prove who is going to Hardees and who is not going to Hardees. Unless the Police can see someone in an illegal act, there is a problem in trying to convict anyone of any trespassing when premises are being held open to the public. No overnight parking signs have been installed which may eliminate part of the problem. As a practical matter, it is difficult to enforce any no trespassing signs when you have an establishment that is lawfully August 19, 1986 8~j1 open for 24 hours. Mr. McKeever to write Roger Smith, owner, expressing concerns over the trash in parking lot and request he install trash receptacles. TOWN ATTORNEY'S REPORT. Mr. Terwilliger presented an Ordinance amending the Town Code to provide for a fee on returned checks given to the Town in the amount of $10.00 Councilman Glenn moved that reading of the ordinance be waived, seconded by Councilman Neighbors and carried. Councilman Neighbors made a motion that Ordinance be adopted, seconded by Councilman Neblett and carried on the following recorded vote: John A. Johnston - Aye James R. CHECKS ORDINANCE AMENDING THE TOWN CODE TO PROVIDE FOR A FEE ON RETURNED CHECKS GIVEN TO THE TOWN BE IT ORDAINED by the Council of the Town of Pulaski, Virginia, sitting in regular session on the 19th day of August, 1986, that the Town Code, be and hereby is, amended by the Addition of Section 9-6, to read as follows: SEC 9-6. Fee for passing bad checks to the Town There is hereby imposed a fee in the amount of ten dollars, for the uttering, publishing, or passing of any check or draft for payment of taxes or other sums due, which is subsequently returned for insufficient funds or because there was no account or the account has been closed. This fee shall in addition to, and not in lieu of any other remedy the Town may have against any person for uttering, publishing, or passing such bad check or draft, and shall not be in lieu of any penalty, interest, or other fee that may be due and owing. THIS ORDINANCE is effective upon adotpion, and is adopted this 19th day of August, 1986. Mr. Terwilliger presented an Ordinance amending Sections 29-20 and 29-24 of the Town Code to increase charges made for reconnection of water service. Councilman Glenn moved that reading of the ordinance be waived, seconded by Councilman Schrader and carried. Councilman Glenn so moved that ordinance be adopted, seconded by Councilman Neblett and carried on the following recorded vote: John A. Johnston - Aye James R. Neighbors - Aye Robert N. CHARGES AMENDING SECTIONS 29-20 and 29-24 OF THE ECONNECTION OF TOWN CODE TO INCREASE CHARGES MADE FOR RECONNECTION WATER SERVICE OF WATER SERVICE BE IT ORDAINED by the Council of the Town of Pulaski, Virginia., sitting in regular session on the 19th day of August, 1986, that Sections 29-20 and 29-24 of the Town Code, be, and hereby are, amended to read as follows: Sec. 29-20. Reconnection charges generally. A charge of five dollars shall be made each time water is turned on after same has been turned off at the request of the owner or occupants. However, in the event a request is made for reconnection other than during the hours of 8:30 a.m. to 3:00 p.m., Monday through Friday, inclusive, whether the turn-off was by request or was made for any other reason, a charge of ten dollars for each tiem the water is turned on shall be made. In addition, any other charges provided for in section 29-24 shall apply. g ~2 August 19, 1986 Sec. 29-24. Reestablishment of service after discontinuance for failure to pay bills or by request, when meter is removed. The town manager, or his authorized agent, shall not restore water service to any person whose service has been discontinued under the provisions of this article until the customer has, in addition to paying the delinquent bill and other charges herein ,provided, paid a reconnecting charge of fifteen dollars. In the event that water service is discontinued upon request or by failure to pay the water account and the town. finds it necessary to remove the meter to prevent further use of water, an additional charge of fifteen dollars is to be made for reinstallation of the meter and restoring the water service. THIS ORDINANCE is effective upon adoption and is adopted this 19th day of August, 1986. TOWN MANAGER'S REPORT Mr. McKeever advised that information had been distributed from John Banks, ELECTION Director, Division of Legislative Services. Mr. Banks has requested that each "CHANGES locality make a good faith effort to inform their citizens that there will be TO VA. CONSTITUTIOI~everal questions on the ballot in November concerning amendments to the Virginia Constitution and further read the four questions that will be included. Mr. McKeever to work with the Southwest Times so all citizens will be informed. Mr. McKeever reminded Council. to turn in their registration forms for the VML Conference in Norfolk. Mr. McKeever advised the Town Offices would be closed September 1, 1986, in observance of Labor Day.
