Minutes of the regular `meeting of the Pulaski Town Council held September 16,
1986, at 7:00 p.m. in the Council Chambers in the Municipal Building.
There were present: Mayor Gary C. Hancock, presiding
Councilmembers: John A. Johnston, Robert N. Glenn, Andrew L. Graham,
James M. Neblett, James R. Neighbors, W. H. Schrader,
Ira S. Crawford, Mary Lou Copenhaver

The invocation was given by Vice Mayor Neighbors.
Councilman Neblett moved that the minutes of the regular meeting of September
2, 1986, be approved as submitted, seconded by Councilman Crawford and carried.
PROCLAMATION A Proclamation honoring the Boy Scouts of America was signed by Mayor Hancock
BOY in the presence of David East, local Scout Leader and Tammy Johnson, Director
SCOUTS
of Boy Scouts in this region.
WHEREAS, for fourteen years the Blue Ridge Mountains Council, Boy Scouts
of America in cooperation with community organizations, churches and educational
institutions has exerted a powerful and continual influence for character building
citizenship training, and personal fitness training among boys in our community.
WHEREAS, Here as everywhere the Boy Scouts of America through outdoor activities,
service projects, merit badge colleges, and leadership training has implemented
the idea of obligation to self and others and has stressed among boys of learning
new skills.
NOW, THEREFORE, as the Boy Scouts of America begins its annual membership
drive to invite boys ages 7 - 102 to join the Tiger Cub, Cub, and Boy Scout program
and because of the importance of this occasion and this organization, the Town
of Pulaski of Pulaski County does hereby proclaim Monday, September 22, 1986 as
School Night for Scouting night in the Town of Pulaski in testimony to the value
of this splendid youth service agency.
Mr. J. B. Warner addressed Council as spokesperson for a group of concerned
citizens regarding conditional rezoning. He stated we should look at the entire
zoning ordinance as it is 20 years old. He questioned if present ordinance
properly protected the citizens of Pulaski. Mr. Warner further stated the
conditional rezoning was being pushed and it bothered them as to why the haste.
He requested that conditional rezoning be put on hold until citizens have been
allowed an opportunity to review the ordinance, and have meetings with Mr. McKeever
to explain the conditional rezoning. He would like Council to have citizens'
input into this ordinance before enacting it.
Mayor Hancock then called for report from Ordinance Committee.
ORDINANCE COMMITTEE
PUBLIC Chairperson Copenhaver advised we had been requested by the Planning Commission
HEARINGto set a joint public hearing on the conditional zoning and so moved that a public
SCH.
COND. hearing. be scheduled for October 21, 1986, at 7:00 p.m., seconded by Councilman
ZONING Neighbors.
Ms. Burgess advised the Planning Commission had done an in-depth study of
this ordinance since mid July.
Motion then carried.
Two copies of proposed ordinance to be sent to Mr. Warner and any other
information he desires will be forwarded to him.
Mr. Terwilliger advised that basically most rezoning changes are instituted
in one of three ways. One, it originates in Town Council, secondly, the Planning
Comu-ission or petition by the property owner or someone who has a contractural

interest in the property. The amendment put in by the Planning Commission amends
the Town Code to spell this out more clearly. The entire zoning ordinance is
currently undergoing a comprehensive review by our zoning consultant, Mr. John
Cofer. When his report is received, public hearings will also be held.
Mr. McKeever advised our zoning consultant is working with the New River
Valley Planning District Commission who is rewriting our Comprehensive Plan and
our Land Use Plan. We are hoping they both come back at approximately the same
time.
Mr. Warner had expressed he would like to see his area zoned R-1. Mr.
Terwilliger advised that when we say ordinance, we also include changes to the
zoning map.
UTILITIES COMMITTEE
Chairman Johnston advised that contract 4A, pump station, is substantially
completed and approximately 99% of monies has been paid out. We are working with
Peppers Ferry to try and decide on maintenance, etc. On contract 4B, there is
some concern on part of our engineers that it is not moving quite as fast as it
should and steps have been taken to accelerate the work.
PUBLIC & PERSONNEL RELATIONS
NOMINATING COMMITTEE
APPOINTMENTS Chairman Neblett made a motion that John E. Sadler, James F. Logan, and
TO Thomas G. Powers be reappointed to the Housing Board of Adjustment and Appeals,
HOUSING seconded by Councilman Graham and carried.
BOARD OF
ADJ. & Chairman Neblett so moved that Tamera Nash be appointed to the Planning
APPEALS Commission, seconded by Councilman Graham and carried.
& PLANNING Chairman Neblett also requested an Executive Session on a legal and personnel
COMMISSION
matter.
PUBLIC OPERATIONS COMMITTEE
Chairman Neighbors advised that committee met on September 8th. The committee
discussed request for a County contribution toward a purchase of a new ladder
truck for the Fire Department. The Board of Supervisors has this request under
RECREATION study. Also discussed was the County Recreation Program. We have been trying

COUNTY g Y participate in part of the fees and Mr. Morgan has expressed
the desire to meet with the committee on this. The committee was in agreement
not to make any change at this time. Statistics will be gathered and presented
to Mr. Morgan.
Committee also discussed the maintenance problems at the cemeteries. A major
cleanup program is necessary and this has been discussed with new Director of
Public Works. We hope to have action on this in the very near future.
Maintenance work on Main Street was reviewed by the committee. This area
also needs a major clean up. Committee recommended that new trash cans be purchased
and extra. effort be made to clean up the downtown area..
The dumpsters in the Town that are owned by individual businesses are being
utilized by County residents. This is to be discussed with Mr. Morgan.
The broken flower containers on the bridges are to be removed and also
the telephone which we hope will prevent loitering.
Chairman Neighbors advised that letters had been written to owners of private
parking lots concerning the trash and condition of their lots. This problem is
to be reviewed by the Town Attorney to determine what steps the Town can take
to correct these situations.
Committee also discussed the 911 emergency telephone system for the Town.
C&P State law allows us to adopt an ordinance a.nd pass the cost onto the user. For
911
EMERGENCY two years, we would collect 51~ per month per telephone line. This money would

buy the equipment and after equipment is installed, cost is 62~ per month to
maimtain it. Cost of equipment is approximately $50,000. Under the 911 system,
when calls come in they can be directed by the dispatcher to fire department,
rescue squad, or police department.
Mr. Terwilliger advised that the Town, by ordinance, can go onto a parking
lot if necessary after a reasonable notice to the owners, to remove the trash.
They are charged forthis and collected in the same way as taxes levied against
the property.
FINANCE COMMITTEE
Chairman Crawford advised the Finance Committee had received the Director
of Finance annual report on delinquent taxes, improper and erroneous assessments
for the year 1985, 1984, 1983 and 1982, and there were several resolutions they
must consider and take action on.
Resolutions on the summary delinquent tax list, 1985; summary delinquent
taxes for 1984 and summary delinquent taxes for 1983 were presented and read.
Chairman Crawford so moved that resolutions as read be adopted, seconded by
Councilman Glenn and carried on the following recorded vote:

RESOLUTION BE IT RESOLVED that the above set out Town Treasurer's report for delinquent
taxes for the year 1985, as certified to the Council accepted: that the Treasurer
be certified with the amount shown to be delinquent and the said list of delinguent
real estate tax be filed with the Treasurer of Pulaski County, Virginia, to be
recorded and indexed by him; that a list containing all unpaid real estate tax
as of Juen 30, 1986, to be published in a local newspaper on September 17, 1986,
that a list of unpaid personal property and any other taxes be prepared: that
such lists be posted at the Courthouse and other public places all said proceedings
to be in accordance with the provisions of the Code of Virginia, 1950 Edition,
Title 58.1 and all applicable amendments to the said code. The Treasurer is further
directed to continue to collect the unpaid taxes on said lists.

The committee discussed ways that could be used to collect some of our delinquent
taxes.
Chairman Crawford expressed his disappointment with the Public Operations
Committee's recommendation that we not make a change at this time on the County
Recreation Program as we had discussed this for the last two budget sessions.
Chairman Crawford advised committee discussed the. purchase of a used ladder

TRUCK truck for the Fire Department at a cost of $45,000. It has been indicated that.
the County would make some contribution toward this purchase. A $9,000 deposit
was need to hold the truck for us.
Chairman Crawford so moved that $9,000.00 be appropriated to account number

Chairman Crawford advised that since we were not receiving revenue sharing
monies that we have in the past, cuts had been made which include car for Town

Engineering, radio repairs for Fire Department, chemical spreader, proposals
for Recreation Department and for landfill complete closeout expenditures as
we keep our landfill open but on inactive status.
Expenditures from revenue sharing need to be made. Chairman Crawford so

to donate apiece of property to Habitat for Humanity. This property has been

located on the corner of Newbern Road and Mashburn Avenue be donated to Habitat
for Humanity of the New River Valley for the purpose of constructing a house
on that site. Further moved that the Town Attorney be authorized to prepare
the deed with certain restrictions, seconded by Councilman Glenn.
Mayor Hancock disqualified himself on this issue and Vice Mayor Neighbors

Chairman Crawford stated that the bond issue had been discussed and would

like to move forward as the timing is right. At present, the interest rates
are good and he requested that a Council work session be scheduled.
Mr. McKeever advised we have applications into the Economic Development
Administration and Appalachian Regional Commission which will go in tomorrow
for 50~ funding of the water treatment plant expansion. This funding could come
through as early as January, 1987.
In order to obtain these funds, we must be able to advise where the additional
money is coming from.
MAYOR'S REPORT
Mayor Hancock announced that through the cooperative effort of concerned
citizens and Town employees that has resulted in an impressive campaign focused
on enhancing the downtown area. Well over 200 labor manhours have recently been
devoted to improving the appearance of town streets, parks and cemeteries.
Efforts have included extensive street
cleaning, tree trimming and weed control in addition to paving and sidewalk

Special attention has been given to the restoration and maintenance of cemeteries with
emphasis on exposing sidewalks and installing directional signs.
Projects scheduled for the immediate future include the spraying .of weeds along P
Creek and the autumn leaf collection. Each step towards a cleaner community
also represents an investment in our future. With the energy and enthusiasm
already generated by these efforts, we can be proud of our progress and anticipate
continued success in improving our community.
TOWN ATTORNEY'S REPORT
Mr. Terwilliger advised an informational copy of the enabling statute under
the State Code which allows the Town to clean up junked vehicles had been distri-
buted. We have such a statute but he felt it needed to be amended to conform
with Town Code. A draft ordinance will be prepared and given to the Ordinance
Committee.
Councilman Crawford questioned if we could not enforce our laws regarding
dumping trash along our roads.
TOWN NLANAGER'S REPORT
Mr. McKeever reminded Council of the Virginia Municipal League Conference
to be held in Norfolk September 21-24th.
Mr. McKeever also advised Council that the annual Fire Parade would be held
Thursday, October 9, 1986, 7:00 p.m. Council invited to ride in parade.
Mr. McKeever advised that on September 23, while at Virginia Municipal
League, the Commission on Local Government will meet and formally be presented
with our petition to annex a portion of the County. The object of this meeting
will be to schedule a public hearing and a tour of the annexed area. Council
requested to give Mr. McKeever dates in October and November that will not be
conducive to hold a public hearing as they will be coming from Richmond. This
will most probably be a three day event.
Councilman Neblett made a motion that Council go into Executive Session under
2.1-344, a legal matter (A6) Conflict of Appointments, and a personnel matter
(A1), seconded by Councilman Neighbors and carried.
At 8:08 p.m., Council went into Executive Session.
At 8:43 p.m., Council returned to Regular Session.
At this time, Mayor Hancock disqualified himself from presiding, and Vice
