Minutes of the regular meeting of the Pulaski Town Council held September 15, 1987,
7:00 p.m, in the Council Chambers in the Municipal Building.
There were present: Mayor Gary C. Hancock, presiding

The invocation was given by Councilperson Copenhaver.
Councilman Neblett made a motion that the minutes of the regular meeting of
September 1, 1987, be approved as submitted, seconded by Councilman Glenn and carried.
A welcome was extended to visitors by Mayor Hancock.
Mayor Hancock presented certificates to retiring Planning Commission members Ben
C. Tate, Michael J. Barbour and Tamera Nash. He also read resolutions honoring these
members for their service to the Town.
Vice Mayor Neighbors moved that resolutions be adopted, seconded by Councilman Glenn
and carried.

RETIRING PLANNING COMM.
MEMBERS
Resolution Honoring
Ben C. Tate for his Services
on the Town of Pulaski Planning Commission
WHEREAS, Ben C. Tate has served as a member of the Town of Pulaski Planning
Commission since February 22, 1982; and,
WHEREAS, Ben C. Tate has served as Vice Chairman of the Town of Pulaski Planning
Commission since March 14, 1983; and,
WHEREAS, Ben C. Tate has successfully completed the Virginia Certified Planning
Commissioners Program; and,
WHEREAS, Ben C. Tate has carried out all duties assigned to him as a member
and Vice-Chairman of the Town of Pulaski Planning Commission with diligence and
dintinction;
NOW, THEREFORE, be it RESOLVED by the Town Council of the Town of Pulaski, VA
that Ben C. Tate be, and hereby is, HONORED by the Town Council of the Town of
Pulaski, Virginia, for his contributions to the future of the Town of PUlaski through
his membership on the Town of Pulaski Planning Commission.
This Resolution is effective upon adoption and is adopted this 15th day of

RESOLUTION HONORING MICHAEL J. BARBOUR
FOR HIS SERVICES ON THE TOWN OF PULASKI
PLANNING COMMISSION
WHEREAS, Michael J. Barbour has served as a member of the Town of .Pulaski
Planning Commission since February 18, 1986; and,
WHEREAS, Michael J. Barbour has carried out all duties assigned to him as a
member of the Town of Pulaski Planning Commission with diligence and distinction;
NOW, THEREFORE, be it RESOLVED by the Town Council of the Town of Pulaski, VA
that Michael J. Barbour be, and hereby is, HONORED by the Town Council of the Town
of Pulaski, Virginia, for his contributions to the future of the Town of Pulaski
through his membership on the Town of Pulaski Planning Commission.

RESOLUTION HONORING TAMERA NASH FOR HER
SERVICES ON THE TOWN OF PULASKI PLANNING
COMMISSION
WHEREAS, Tamera Nash has served as a member of the Town of Pulaski Planning
Commission since September 16, 1986; and,
WHEREAS, Tamera Nash has carried out all duties assigned to her as a member of
the Town of Pulaski Planning Commission with diligence and distinction;
NOW, THEREFORE, be it RESOLVED by the Town Council of the Town of Pulaski, Virginia,
that Tamera Nash be, and hereby is, HONORED by the Town Council of the Town of Pulaski,
Virginia, for her contributions to the future of the Town of Pulaski through her
membership on the Town of Pulaski Planning Commission.
This Resolution is effective upon adoption and is adopted this 15th day of
Sepgember, 1987, by unanimous vote of the Town Council of the Town of Pulaski, VA.
Dr. Anneski, Chairman of the Planning Commission thanked Messrs. Tate and Barbour,
and Mrs. Nash for their fine efforts.
Mr. Andy Morikawa, Executive Director, New River Community Action, Inc., made a
presentation to Council regarding their organization's funding for F/Y 1987-88. Mr.
Morikawa was assisted in his presentation by Ms. Janet Johnson, Mr. Phil Sadler, Mr. Ronn
Powers .
WATER In hearing from the public, Edward Clark (County), Kay Doyle, Virginia Smith, Betty
BILLS
Clark, Vanessa Black, Mrs. Surface, Ann Jessie, Jane Christley, Mary Bruce, James Mabke,
Tad Steger, Carolyn Hager spoke in opposition to the 85~ increase in sewer rates and 65~
increase in the water rate. It was their feeling that persons on fixed incomes could not
pay their bills. Also, Rental Towel Service representative, James Mabe, stated they would
probably look for another location for their business.
Mayor Hancock stated that Council had been informed by the Health Department that we
must invest $2M into our filter plant for expansion to service the Town. Also, the sewer
rate was increased to pay for the Peppers Ferry project for the treatment of the Town's
sewage. The sewer fund and the water funds are enterprise funds and cannot be supplemented
by the general fund.
In answer to Jim Shepher's inquiring regarding water pressure on Mashburn Avenue,
he was informed that the project for Mashburn was included in the proposed bond issue at
an approximate cost of $45,000.
Two citizens also expressed disapproval of the stop sign installed on Burgis Avenue.
Mrs. Doyle, Rt. 2, Box 23 (Newbern Rd.) complained of a sewer odor which will be
checked out by the Town.Mr. McKeever was asked for justification for doubling County rates
to next Council meeting to determine if relief can be obrained. Also, once annexed, there
will be few County customers left.
Jake Blevins asked for the status of work on Peak Creek.
PEAK Councilman Graham, Chairman of the committee to study Peak Creek, advised that
CREEKcommittee had met.The committee recommended, and Councilman Graham so moved, that
due to the fact that it does not appear cost effective for a full scale stream widening
project for Peak Creek and Sproules Branch, it is recommended that the Town proceed with
normal stream channel maintenance inside the present corporate limits on Town property.
It is further recommended that this project be referred to the Finance Committee for cost
data and timing of the channel main'~nance to be completed. .Motion seconded by Councilman

As there were no further comments from the public, Mayor Hancock called for Council
Committee Reports.
UTILITIES COMMITTEE
Chairman Johnston advised that Peppers Ferry had met. The pump shaft bearing su t
has been repaired and contractor will conduct an inspection and/or certification.
Charges to date are $2,500. They are awaiting analysis of cause and any associated
costs before billing the responsible party.
Mr. McKeever advised that a meeting will be held with the contractor on Thursday.
PUBLIC AND PERSONNEL RELATIONS, NOMINATING COMMITTEE
APPOINTMENTS Chairman Neblett advised that committee had met, and so moved that Joseph L. Weddle
be appointed to the Planning Commission to replace Tamera Nash with term to expire
August 7, 1988, seconded by Councilman Glenn and carried.
Chairman Neblett made a motion that John T. Bolen be appointed to the Board of
Zoning Appeals to replace David Warburton. Further, that Mr. J. B. Billheart be reappointed
to the Board of Zoning Appeals. That Town Attorney prepare the proper Order to be entered
by the Judge of the Pulaski County Court for these appointments for terms of five years.
Motion seconded by Councilman Glenn and carried.
Chairman Neblett moved that Pam Jones and Robbie Gardner be appointed to the Parking
Authority, with terms to expire August 6, 1992 and August 6, 1988, respectively. Mot
seconded by Councilman Glenn and carried.
Chairman Neblett so moved that Mrs. Ruth Kirby be reappointed to the New River Valley
Agency on Aging. Term to be from October 1, 1987, through September 30, 1988. Motion
seconded by Councilman Glenn and carried.
PUBLIC OPERATIONS COMMITTEE
Chairman Neighbors advised that he had attended the Pulaski County Recreation Committee
meeting.and the Town will receive $4,050. A request was made for $27,000. A vote was
taken to distribute funds which are distributed quarterly.Chairman Neighbors also stated
that some of the funds to be distributed was withheld and it was felt the Town might be
entitled to a portion of this.
FINANCE COMMITTEE
Chairman Crawford advised the Finance Committee had met and reviewed the Treasurer's
report of delinquent taxes. For the one-half year of 1987, the Finance Committee felt
we should wait and get the entire year of 1987 before publishing names in local newspaper.
Chairman Crawford presented and read resolution on Delinguent Tax List, 1987, and so
moved that resolution be adopted, seconded by Councilman Glenn and carried.

BE IT RESOLVED that the ABOVE set out Town Treasurer's report for delinquent
taxes for the one-half year 1987, as certified to the Council accepted; that the Treas-
urer be certified with the amount shown to be delinquent and that said list of delinquent
real estate tax be filed with the Treasurer of Pulaski County, VA to be recorded and
indexed by him; that a list of unpaid personal property and any other taxes be prepared;
that such lists be posted at the Courthouse and other public places all said proceedings
to be in accordance with the provisions of the Code of Virginia, 1950 Edition, Title 58.1
and all applicable amendments to the said code. The Treasurer is further directed to
continue to collect the unpaid taxes and said lists.
Chairman Crawford read resolution concerning elderly tax relief for taxes for the one
half year of 1987, and so moved that resolution be adopted, seconded by Councilman Glenn

BE IT RESOLVED that the Treasurer's list of elderly. tax relief for taxes for the
one half year 1987 be submitted to the Commission of Revenue for further verification;
that when same has been verified by the Commissioner of Revenue for Pulaski County, VA
as being elderly tax relief, the Town Treasurer is hereby directed to correct tax tickets
accordingly and Gary L. Cutlip is hereby relieved from the duty and responsibility of
collectionof same.
Chairman Crawford moved that reading of the resolution be waived covering the summary
delinquent tax list for 198 b, seconded by Councilman Neighbors and carried. Chairman
Crawford so moved that resolution be adopted, secondedby Councilman Glenn and carried

Chairman Crawford read a resolution pertaining to improper and erroneous assessments
for taxes for the year 1986 and so moved that reading of .the resolution be waived,

BE IT RESOLVED that the Treasurer's list of improper and erroneous assessments for
taxes for the year 1986 be submitted to the Commissioner of Revenue for further verifica-
tion; that when same has been verified by the Commissioner of Revenue for Pulaski County,
VA as being improper and erroneous, the Town Treasurer is hereby directed to correct tax
tickets accordingly and is relieved from the duty and responsibility of collection of same.

BE IT RESOLVED that the certified list of Town Treasurer for the year 1985 showing
remaining delinquent taxes be accepted, and it ordered that the revised list of real estate
be transmitted to the Treasurer of Pulaski County VA to be filed, and the Treasurer is
further directed to contineu to collect the unpaid taxes on said list.
Chairman Crawford advised that bids had been received for demolition of two buildings
in the downtown area with low bid in the amount of $19,400. There is some concern by
D the Fimance Committee in that there is some disparity between the low bid and the next
E bid up. Chairman Crawford made a motion that the Town Manager negotiate and award con-

Councilman Graham made a substitute motion this be brought to Council at next meeting

Chairperson Copenhaver advised that an Ordinance Committee Meeting was scheduled
for September 22 at 5:00 p.m. dealing with zoning. All of Council invited to attend.
Members requested to bring copy of zoning ordinance with them.
Mr. Terwilliger stated the land use plan is our general goals and objective for long
range planning and is one aspect of the comprehensive plan.
MAYOR'S REPORT
Mayor Hancock presented a resolution proclaiming September 16, 1987 as Celebration
of Citzenship Day. Councilman Glenn made a motion that reading of the resolution be
waived, seconded by Councilman Neblett and carried.
Councilman Johnston made a motion that resolution be adopted, seconded by Councilman
Schrader and carried.

Proclaiming a Celebration of Citizenship
on September 16, 1987
WHEREAS
On September 16, 1987, Americans will have the unique opportunity to honor the
Constitution of the United States in a "Celebration of Citizenship". In this year of t e
Bicentennial of the signing of the Constitution, it is fitting that we celebrate our
heritage of freedom under the law that was granted by this national charter.
WHEREAS
In 1787, the United States was a nation of 13 sovereign states, independent of each
other, aligned along the eastern seaborad, from New Hampshire to Georgia. They were
the United States in name only, barely held together by the Articles of Confereration. Only
six years after the War of Independence, the new experiment of democracy was in danger
of collapse. Most of the states had their own armies, printed their own currencies,
and charged tariffs to other states for using their ports and roads.

A Convention was called in Philadelphia, for the sole purpose of making revisions
to the Articles. But national leaders like Madison, Hamilton and Franklin feared that
unless a strong central government was created, the country would fall apart,

a government of the people. In the 200 years since that Convention, WE THE PEOPLE have been
fine tuning the concept of republican government. Today, our Constitution is the oldest

WHEREAS
All Americans will be celebrating t~Q Bicentennial of the Constitution's signing
on September 17, 1987, and the establishment of the new government under the Con-
stitution in later years, through the commemoration of the ratification of the Bill
of Rights in 1991.
WHEREAS
All Americans can participate in this celebration on September 16, during a
CELEBRATION OF CITIZENSHIP. On this day, Millions of students, across the country
and in American schools abroad, will learn about the blessings of liberty bestowed by
our Constitution. All Americans can join our youth in recognizing and honoring the
rights and responsibilities of citizenship. At 1 P.M. E.D.T., a live national radio
and television broadcast front hewest front steps of the U.S. Capitol will enable all
Americans to join in the Pledge of Allegiance, as well as to hear the words of the
Preamble to the Constitution.
NOW, THEREFORE, be it RESOLVED by the Town Council of the Town of Pulaski, Virginia,
that the Town of Pulaski should, and hereby does, PROCLAIM its participation in the
CELEBRATION OF CITIZENSHIP which will take place nationwide on September 16, 1987.
This Resolution is effective upon adoption and is adopted by unanimous vote of the Town
Council on this 15th day of September, 1987.

SELLING
TOWN ORDINANCE AUTHORIZING SALE
PROPERTY OF SURPLUS PROPERTY ON
FAYETTE STREET IN THE TOWN OF PULASKI, VIRGINIA
WHEREAS, the Town of Pulaski, Virginia had certain surplus property lying on
Fayette Street in the Town of Pulaski, Virginia, as described in a deed from Dorcus J.
Rogers and William Rogers, dated September 19, 1981; and,
WHEREAS, the Town of Pulaski, Virginia, caused saidproperty to be duly advertised
and received sealed bids for the purchase of said property; and,
WHEREAS, Buford Junior Redd was the high bidder with a price of One Thousand Two
Dollars. ($1,002.00) which bid was accepted by the Town Council sitting in regular
session on September 1, 1987, and,
WHEREAS Buford Junion Redd has asked that a deed be prepared conveying the property
to himself and William B. Redd;
NOW, THEREFORE, be it ORDAINED by the town Council of the Town of Pulaski, Virginia,
that theMayor of the Town of Pulaski be, and hereby is, AUTHORIZED and DIRECTED to execute
a deed between the Town of Pulaski, Virginia, as grantor, and Buford Junior Redd and
William B. Redd as grantees, conveying the aforesaid property with special warranty of title.

TOWN MANAGER'S REPORT
Mr. McKeever advised we will be conducting a census of the annexed area to determine
what type of service needs we may have in the annexed area after January 1, 1988.
Also, it is our understanding that the Judge has set hearing for December 7th.
Mr. McKeever advised that Jefferson Mills has taken their spring water out of the
sewage system and diverted it to the-storm drains.
Mr. McKeever advised that from the Eastern Utilities report, we now know specifically
where some problems are.There are 28 roof drains on private property that need to be remove
Councilman Neighbors so moved that 28 property owners be written a letter, giving them
60 days to remove this from the sewage system, seconded by Councilman Glenn and carri
We need to further identify specific locations of leakage. Through dye testing, rai 1
simulation and ultimately closer t.v. inspection, we will locate exact location of the reak.
After confering with Eastern Utilities, Mr. McKeever and Staff will bring back to Council
what the }next step is and how much this will cost. They are recommending $35,000
to dye test and rain fall simulate the 156 sources of inflow. We do not feel we have
to do all of this.
Mr. McKeever advised that no further water problems had been encountered in
Longview Court.
In the matter of our filing to close the Gatewood Road, Mr. Terwilliger felt it
would be 30-60 days for a court date.
Mr. McKeever reminded Council of the Fishnic to be held Thursday, September
17, 1987.
At 9:05 p.m. Councilman Graham made a motion to adjourn, seconded by Councilman
Neblett and carried.
