There were present: Mayor Raymond F. Ratcliffe, presiding Councilmembers: John A. Johnston, Pauline G. MItchell, C. E. Boyd, Jr. Andrew L. Graham, Jr., Ira S. Crawford, Alma H. Holston, Glen K. Aust ~1 Absent: James M. Neblett Also present: Frank Terwilliger, Town Attorney D. E. McKeever, Town Manager Ruth A. Harrell, Clerk Visitors: Dee Lindsey and Eric Randall of the news media Nick Glenn Mary L. Copenhaver Vicki Futrell Gary Cutlip The invocation was given by Councilman Graham. WAIVER OF NOTICE OF SPECIAL MEETING We, the undersigned, duly .elected members of the Council of the Town of Pulaski, Virginia, hereby waive notice of a Special Meeting of said Council at 4:00 p.m. on the 21 st day of May, 1984, for the purpose of considering a resolution to member of General Assembly regarding Attorney General's opinion, and any other business that may legally come before the Council. WITNESS our signatures this 21st day of May, 1984. /5 L ?; ~i Mayor Ratcliffe advised the purpose of this Special Meeting today was for the purpose of considering a resolution to member of our General Assembly regarding the Attorney General's opinion and any other business that may legally come before the Council. ~~~~ May 22, 1984 Councilman Graham stated that other business to come before Council is to set a budget public hearing date. Town Attorney Terwilliger distributed copy of resolution and letter to SALES TAX Honorable Gerald L. Baliles, Attorney General of Virginia, regarding the ATTORNEY GENERAL S distribution of local sales tax revenues .and requesting an opinion from the OPINION Attorney General as to the proper formula to be used in distribution. Councilman Aust so moved to get matter on the floor, seconded by Councilperson Holston. Honorable Daniel Bird will be asked to request this opinion from Honorable Baliles. Mr. Terwilliger advised this opinion would give the Town the least amount the Town was entitled to under the code. Councilman Crawford stated we did not have any legal means to enforce resolution passed 16 years ago, and that Board of Supervisors could not pass a resolution that would fix all present Board of Supervisors to distribute this tax in future years. After considerable discussion by Council, vote was taken on Mr. Aust's motion and carried on the following recorded vote: John A. Johnston - Aye Andrew L. Graham, Jr. - Aye Pauline G. Mitchell -Aye Ira S. Crawford - Aye James M. Neblett - Aye Alma H. Holston - Aye C. E. Boyd, Jr. - Aye Glen K. Aust - Aye AFC(1T TTTT(1TT RESOLUTION WHEREAS, the Town of Pulaski, Virginia, is a qualified town SALES TAX not constituting a separate school district, under Section 58-441.49 (h) of the 1950 Code of Virginia, as amended, and, WHEREAS, there are. certain negotiations pending with the County of Pulaski involving the distribution of local sales tax revenues as well as other general fund appropriations; and, WHEREAS, it would be beneficial to all parties to have advice from the Attorney General of Virginia as to the proper formula for distri- bution under said section; NOW, THEREFORE, be it RESOLVED by the Town Council of the Town of Pulaski, Virginia, sitting at a special session on May 21, 1984, that the Town Attorney be and hereby is authorized to request from any person authorized by statute to do so, that such person request, in a form similar to Exhibit "A" attached hereto, an opinion from said Attorney General as to the proper formula to be used in distribution of sales tax revenues under said section. This resolution is effective upon adoption. At 4:24 p.m. Council recessed for Budget Work Session. At 6:10 p.m. Council returned to Special Session. Councilman Graham made a motion that we have a public hearing at 7:00 p.m. on June 12, 1984, on the 1984-85 proposed budget, seconded by Councilman Crawford and carried. Councilman Graham further stated Council would have a Budget Work Session Thursday, May 24, 1984, at 5:00 p.m. At b:12 p.m. Councilman Aust made a motion to adjourn, seconded by Council- man Crawford and carried.
