Minutes of a Special Meeting of the Pulaski Town Council held June 28, 1984,
at 5:00 p.m, in the Council Chambers of the Municipal Building.
There were present: Mayor Raymond F. Ratcliffe, presiding
Councilmembers: John A. Johnston, Pauline G. Mitchell, James. M. Neblett,
C. E. Boyd, Jr., Andrew L. Graham, Jr., Ira S. Crawford,
Glen K. Aust

The invocation was given by Councilman Graham.
Mayor Ratcliffe advised this was a Special called Council Meeting for the
purpose of approving garbage rate ordinances.
Mr. Terwilliger stated that when the budget was adopted, the question was
raised if ordinances were needed to change the various fees that are charged for
garbage taken to Town dump, residential and commercial pick-ups and the change in
professional license fees.
Councilman Neblett made a motion to adopt ordinance to change the rate charged
for collection at residences and businesses, raising residential to $4.00 and raisi
business by 47~, seconded by Councilman Boyd and carried on the following recorded
vote:

ORDINANCE TO AMEND
SECTION 13-23 OF THE CODE
OF THE TOWN OF PULASKI, VIRGINIA
ORDINANCE TO
AMEND SECTION BE IT ORDAINED by the Town Council of the Town of Pulaski, Virginia
13-23 sitting in special session on June 28, 1984, that Section 13-23 of the
GARBAGE Code of the Town of Pulaski, Virginia, BE and HEREBY IS, amended, to
RATES change the rates charged to both residences and businesses for municipal
collection disposal of garbage and rubbish.
A copy of this Code Section, as now amended, is attached hereto
and made a part hereof.
This ordinance is effective July 1, 1984.
Article IV. -Rates and Charges for Garbage Service.
Sec. 13-23. Schedules.
The town, for services rendered by it in providing for
municipal collection and disposal of garbage and rubbish under
this chapter, does hereby provide for assessing fees, collecting
and enforcing the provisions of this article and does hereby more
particularly establish those certain charges and fees contained
in schedules A, B and C as follows:

For volume in excess of two hundred sixty total containers per
month, the charge shall be at the rate of Ten Dollars and Ninety
One Cents for each additional one hundred containers or any
fraction thereof.
Schedule C. Mechanical Containerized Collection.
The director of public works shall cause mechanical
containers to be placed upon the premises of those persons within
the town desiring to have such containers for the purpose of
disposing of garbage, waste, rubbish, Etc., from their premises.
Thy containers shall be placed upon such premises in such a
manner as not to impede or block traffic along adjacent public
ways or upon the avenues of ingress and egress to such premises.
Persons in charge of the premises shall see that all garbage,.
rubbish, etc., is placed within such containers and shall not
allow any accumulation of waste in and around them, nor shall
they overload the containers.
Containers used under the provisions of this chapter shall
nct be less than eight yards' capacity, except as may otherwise
be directed by proper resolution of the council of the town.
The town shall charge six dollars for each pickup made from
each container on the premises and the number of pickups for the,
various premises shall be established on a regular schedule on a
weekly basis. The director of public works shall establish .such
schedules with the persons in charge of the premises on which the
containers are located, and shall, from time to time, increase or
decrease the number of pickups in order to assure proper disposal
from such premises.
Special pickups or pickups over and above the number on the
schedule established for such premises will be made by the town
at a cost of twelve dollars per pickup, per container.
In addition to the fees provided above, a twelve dollar and
fifty cents monthly charge shall be added to the utility bill on
each container furnished, for maintenances and replacement costs
thereo.

Councilman Neblett so moved adoption of ordinance increasing the fee for the
commercial and industrial users of the sanitary landfill to $10.00 for all
vehicles above three quarters ton, seconded by Councilman Boyd and carried

of the Town of Pulaski, Virginia, BE AND HEREBY IS, amended, To raise the
fee for all commercial and industrial users of the sanitary landfill from
$5.00 to $10.00 for "all vehicles above three-quarters (3/4) ton."
A copy of this Code Section, as now amended, is attached hereto and
made a part hereof.
This ordinance is effective July 1, 1984.
Section 13-30. Commercial and industrial use of sanita~
landfill
All commercial and industrial users of the sanitary landfill
for disposal of garbage, rubbish, weeds, etc., shall pay to the
town the following fees:
(a) Schedule of fees:
Per Load
Pick-up trucks, :3/4 ton and under .....................$2.00
Trailers and other vehicles with load limit
not greater than 3/4 ton ............................. "1.00
Other vehicles above 3/4 ton ..........................10.00 `
However, there shall be specifically exempted from payment
of fees under this section hcmeowners, tenants or other
residential users when removing garbage, rubbish, waste, etc.,
from their own premises and not as a commercial operation.
(b) Vehicles to be covered, etc. All vehicles transporting
garbage, rubbish, waste, etc., shall provide a canvas or plastic
cover or some other method to prevent the garbage, rubbish, etc.,
from blowing out of or falling frcm the truck while moving such
garbage, rubbish, etc., from their premises to the town sanitary
landfill .
(c) Administrative procedures. The town manager or his

duly authorized agent shall establish a.method for collecting t e
fees payable hereunder, set times when the sanitary landfill will
be open and such other procedures required for the proper
administration of this section.
(d) Penalty. Failure to pay the fees herein provided, or
to-abide. by the_other_ e_~ms of this section, shall constitute a
violation thereof and shall be punishable by a fine not to exceed
five dollars for each violation. (7-1-84)

Councilman Neblett made a motion to adopt ordinance changing the professional
license fees from 15~ per $100.00 of gross receipts to 40~ per $100.00 of gross
receipts or $30.00 whichever is greater, seconded by Councilman Boyd and carried on
the following recorded voce:

ORDINANCE OF AMEND
ORDINANCE THE PULASKI LICENSE TAX CODE
LICENSE TAX TO
CODE INCREASE THE PROFESSIONAL LICENSE FEE'
FROM $.15 PER $100.00 OF GROSS RECEIPTS
TO
$.40 PER $100.00 OF GROSS RECEIPTS
WHEREAS, by Ordinance adopted April 20, 1982, and effective
May 2, 1982, the Town Council of the Town of Pulaski, Virginia, did amend
and reenact the Pulaski License Tax Code; and,
WHEREAS, under Part I. "Rates", Section 50, Classification;
Professional License, a license tax of $.15 per $100.00 of gross receipts
or $30.00, whichever is greater; and,
WHEREAS, by the terms of said Ordinance, this rate was effective
until otherwise amended;
NOW, THEREFORE, be it ORDAINED by the Town Council of the Town of
Pulaski, Virginia, sitting in special session on June 28, 1984, that the
aforesaid Code of the Town of Pulaski, Virginia, be and hereby is, amended,
to change the. tax applicable to Section 50, Professional Licenses, to $30.00
or $.40 per $100.00 of gross receipts, whichever is greater.
All provisisions of the present license Tax Code now in effect within
,the Town and not herein amended or repealed, are hereby reenacted and shallf
'be enforced until changed by appropriate action of the Council
This ordinance shall be effective on the 1st day of July, 1984.
Mr. McKeever advised he had taken bids on Town insurance coverage, including
Workers Compensation, Auto, Umbrella policy and on Contractors Equipment policy.'..
Mr. McKeever made the following recommendations: that Workers Compensation policy
INSURANCE be placed with Virginia Municipal League Group, Auto policy be placed with Burton
Cunningham Agency with Continental Insurance Co., our Umbrella coverage be place8
with Burton-Cunningham Agency, Hudson Insurance (on our umbrella coverage, Mr. McKeever
recommended our coverage be increased from $1 million to $10 million), and our
Contractors Equipment be placed with Virginia Mutual Agency, the Home Insurance ~o.
Mr. McKeever further stated our present umbrella liability coverage is $1 million
at a cost of $3,300 and for an additional $3,000 we can obtain an additional $9 million
of coverage to protect the Town.
Mr. McKeever advised we get an immediate 8~ return on the Virginia Municipal
League policy and if our loss this year is 17~ or less, we will have a large dividend
returned to us.
Mr. McKeever also advised we had abided by the Public Procurement Act and Mayor
Ratcliffe stated if local insurance bidders had questions, information was available
to them in the Town Manager's Office.

Councilman Boyd moved that Town Manager be authorized to accept these competitive
bids to be effective July 1, 1984, and Town Attorney to review same with Town Manager,
seconded by Councilman Graham and carried on the following recorded vote:

Mr. McKeever advised we had received the contracts from AT & T concerning
AT&T
CONTRACTS Purchasing our telephone equipment. These contracts have been reviewed by Mr.

Councilperson Mitchell questioned why Hercules was not requested to get a
permit for soil sedimentation erosion before they started moving any dirt, with Mr.
McKeever advising we do not always have knowledge of when construction action is
initiated. It is the contractor's responsibility. Once we found out about it,
the contractor did come in and get a permit.

WAIVER OF NOTICE OF SPECIAL MEETING
We, the undersigned, duly elected members of the Council of the
Town of Pulaski, Virginia, hereby waive notice of a Special Meeting
of said Council at S:OO p.m., on the 28th day of June, 1984, for the
purpose of approving garbage rate ordinances, and any other business
that may legally come before the Council.
