ELECTION
May 1, 1984
At a regular Municipal Election held for the Town of Pulaski, VA on
M 1, 1984, the following officers were elected with terms to begin July 1, 1984:

The Mayor-elect and the Councilmembers-elect having duly qualified before the
C ark of the Circuit Court of Pulaski County, Virginia, as provided by Section IX
o the Town of Pulaski Charter of 1948, and the Charter amendment approved by the
1 56 Legislature, a meeting was held this 3rd day of July, 1984, at 4:00 p.m. in
t e Council Chambers in the Municipal Building.

Mayor Ratcliffe advised the purpose of the meeting was to seat the Mayor 8nd
awly elected Council members, and to consider the reappointment of the various
apartment Heads and Officers of the Town.
Mayor Ratcliffe asked the Clerk if she had received the "Abstract of Votes"
sst in the Town of Pulaski Municipal Election held on May 1, 1984, and was
3vised by the Clerk that she had received same, and upon his request, the Clerk
ead from the Abstract of Votes the following: For Mayor of the Town of Pulaski,

As no one requested that Clerk read entire Abstract of Votes, the Mayor

Mayor Ratcliffe directed that the Oaths of Office be received and filed.
At this time, Mayor Ratcliffe stated that Council was honoring three of its
etiring Councilmembers and asked them to meet him in the front, where he

presented to Pauline G. Mitchell a plaque for her four years of service on
the Council, and Alma H. Holston a'. plaque for her four years of service on
the~Council. A plaque was presented to Andrew L. Graham, Jr., for his sixteen
years of service on the Council, with eight of the sixteen years being Vice
Mayor. These plaques were presented in appreciation for their service to the
Town.
Senator Daniel W. Bird, Jr., in his remarks to the newly elected Council-
members stated the Town of Pulaski had done a good job over the years in
selecting outstanding citizens to Town Council and for Mayor. Leadership has
been recognized in Richmond and Washington. Senator Bird stated there are
several traits as a leader in local government; mature judgment, listen to
complaints, have an open mind, try to disagree agreeably, and work together
as a body in a spirit of cooperation. He further stated their duty is a public
trust, and good communication with citizens, each other and Town Manager was
necessary. Take issues up with Mayor and Councilmembers and at appropriate
time with the department head or Town Manager. Senator Bird Challenged the new
members to make the most of their opportunities over the next four years in
their elected positions.
Thereupon, the newly elected officials were seated.
Mayor Ratcliffe advised a Vice-Mayor would now be elected for the 1984-86
term.
Councilman Neblett nominated John A. Johnston for Vice-Mayor. Motion did
not receive a second.
Councilman Glenn nominated James Neighbors for Vice-Mayor for 1984-86,
seconded by Councilman Boyd.
Mayor Ratcliffe inquired it there were other nominations, and Councilman

Boyd moved that nominations be closed, seconded by Councilman Crawford and
carried.

Mr. McKeever advised that he did, and upon the request of Mayor Ratcliffe, rt,

~ Mr. Larry Miller was then introduced to Council to Council and the public
and. Mr. McKeever advised he was presently the Recreation Director for Bedford
Recreation Commission and felt he was exceptionally skilled to handle our program.

to coming to Pulaski.
Councilman Boyd moved that Town Manager's recommendations be accepted,
seconded by Councilman Neblett and carried on the following recorded vote:

Mayor Ratcliffe advised on appoin tment of Standing Committees, a research
d been made of the books of the Town for the past 50 years and the Mayor had
esented the Standing Commit tees and Chairman to the Town Council for this
p riod of time. The change was made in 1948 and also a charter change in 1948, but
we found nothing that deals with appointing of these committees. Since 1948,
th Mayor has been presenting his committees and the Council has not voted on it.
Ma or Ratcliffe further advised a Councilmember had presented a good study on the
st ucture of these committees and recommended that we receive this recommendation
fr m Councilman Boyd and that it be evaluated.
Mayor Ratcliffe also advised the committees are preliminary and may be changed
in~favor of an improved schedule.

The Committees of Council with Town representatives on them were discussed
at length.
Councilman Crawford questioned the status of the Peppers Ferry Committee
a he was advised they were appointed for terms; with Mr. Boyd suggesting that a
co mittee be appointed to meet with the County.
Councilman Aust stated that since the County matter was such an important
issue, he felt it should come from the floor of the Council rather than from a
c ittee.
Councilman Neblett moved that the Nominating Committee take vacancies under
a isement that are given under committees that have Town representatives, seconded
b Councilman Boyd and carried.
Councilman Boyd made the request to put on agenda for next meeting of July 17,
h's recommendation to reduce the Standing Committee from nine to four, and also
t at Council be prepared to nominate the committee that will negotiate with the
C unty. Motion was seconded by Councilman Crawford and carried.
At 4:45 p.m. on motion of Councilman Neblett, seconded by Councilman Boyd,
a d carried, the Organizational Meeting adjourned for a five minute recess before
g ing into Council's Regular Session.
The first item of business in Council's Regular Meeting was the approval of
t e minutes of the Regular Meeting of June 19, 1984 and the Special Meeting of
J ne 28, 1984.
Mayor Ratcliffe advised that next on the agenda was the appeal of the Planning
ion's decision by Mr. Lincoln Baugh.
APPEAL OF

DECISION -

Mr. McKeever advised there might be a question about procedure and he felt
our Town Attorney should provide the necessary advice before we proceed with
Mr. Baugh's appeal

Mr. Terwilliger advised Mr. Baugh that on the original resubdivision of
this plat, he had come to him and talked with him for a few minutes. Mr.
Terwilliger was never retained but they had discussed the matter. Mr. Terwilli-
ger asked Mr. Baugh if he waived any conflict of interest; that Mr. Laymon did
the last time. Mr. Baugh stated "no", he did not waive any conflict of interest,
and Mr. Laymon was no longer representing him.
Mr. McKeever stated he could advise the Council the question of procedure.
He stated there is not any section in our Town Code that does allow for an
appeal from the Planning Commission to this body. In consultations with Town
Attorney, they believed there is no vehicle for that, therefore, it appears
that the decision from the Planning Commission should stand. There does not
appear to be any procedure for an appeal from that body to this body and without
this in our code, he did not believe that Council could hear Mr. Baugh's appeal.
Mr. McKeever advised that in the past, this body has heard the appeals and the
question has been asked by Mr. Eley who represents people in the neighborhood
who oppose this resubdivision and by an examination of our Town Code and State
Code, there needs to be a vehicle to allow this appeal and there apparently is
not.
Mr. Eley stated that section 15.1, 475 of the Code provides for the proce-
dure for taking up questions of variances and also subdivision ordinances and
provides that it properly go before the Planning Commission after going before
proper officials in the Administration and the appeal lies to the Planning
Commission itself. Once their decision has been made, then the proper procedure
is to take the matter to the Circuit Court of this County.
Councilman Boyd advised this has previously been before the Planning
Commission and we do need to get the matter resolved.
Mr. McKeever advised that Council could pass an Ordinance to enable them
to hear matters of this nature.
After discussing this matter at length, Councilman Boyd stated this item
should be dropped from the agenda.
In hearing from the public, Mr. Bill Hager, owner of the Child Care Center,
ALLEY again addressed Council on improvements to the alley, Pierce to Madison between
IMPROVEMENTS Dora Highway and First St. Mr. McKeever advised the Engineering Department had

DORA HGW. reviewed this request and three alternatives were selected; 1) closing the alley,

2) making repairs or gravel and asphalt, and 3) paving the alley. Closing the
alley would restrict traffic but there is not enough space to prove a turnaround.
Making general repairs would eliminate the dust and other related problems, but
not control the speeding. The final alternative would be paving and speed bumps.
Paving an alley would set a costly precedent and it is not recommended to place
speed bumps on a public right of way for liability reasons. Mr. McKeever stated
that general repairs (grading, filling potholes and blacktop repair) to each
entrance be made. Also, posting of speed signs and increased police patrols
to prevent speeding or reckless driving.
Mr. Hager also remarked on small businesses and being self employed.
Councilman Johnston moved for a voice vote approving this Administrative
Report, seconded by Councilman Boyd and so carried.
Mayor Ratcliffe advised that next item to be discussed was the street
closing request, the access road near 12th Street, N.W.
Mr. McKeever advised that several property owners in the vicinity of 12th
Street, N.W. have requested that an access road leading to their property be
closed.

Mr. McKeever advised a mobile home application had been received from
ictor Harrell to place a trailer on Pepper Street and a public hearing should
e scheduled.
Councilman Boyd so moved that public hearing be scheduled for July 17, 1984,
t 7:00 p.m., seconded by Councilman Neblett and carried.
Mr. McKeever advised this is the second hearing on this application and Mr.
arrell was coming back with legal representation.
Mayor Ratcliffe called for Committee Reports.
Chairper-sonsof the Standing Committees had no reports, however, Councilman
oyd requested an Executive Session on a personnel matter at the end of the
eeting.
Mr. McKeever advised he had included in the Administrative Report, a notice
hat if Councilmembers would notify him at earliest date about hotel reservations
or the VML Annual Conference, it would be appreciated. Mr. McKeever advised
e had reservations for twelve rooms and one suite.
Councilman Aust advised we had two Mayors, Mayor Jackson and Mayor
atcliffe, representing this area as Presidents of VML in past years.
Mr. McKeever advised that new Recreation Director would report to work
my 16th.
~ Mayor Ratcliffe advised a donation had been made to the First Methodist
hurch Library in memory of Mr. Lloyd Patterson who had twenty-some years as
own Treasurer.
Mayor Ratcliffe also advised an invitation had been received from Inland
otor Co. for open house on July 21, 1984, from 10:00 a.m. until 2:00 p.m.
Mayor Ratcliffe stated the U.S. Government had maintained the old weather
LOVING station at Loving Field and they have requested permission to vacate the building,
FIELD and Mayor Ratcliffe stated that we would receive it in its present form by
WEATHER
STATION previous oral agreement. A document has now been received to sign accepting
this station.
Councilman Neblett so moved we accept this station and Mayor Ratcliffe
authorized to sign acceptance document, seconded by Councilman Crawford and
carried.
REPORT OF TOWN MANAGER
Mr. McKeever advised he had submitted a proposal for a change in Council
Agenda format and requested that Council review. Councilman Crawford requested
that Executive Session be added to agenda.
Councilman Boyd moved that we adopt this new agenda and also a time limit
be set for speakers to speak no longer than ten minutes, with Exective Session
listed on it. Motion did not receive a second.
Councilman Boyd moved that the proposed agenda be put on the agenda for
the July 17, 1984, meeting, seconded by Councilman Crawford, and carried.
Mr. McKeever advised all Town Offices would be closed July 4th in obser-
vance of Independence Day.
Councilman Boyd made a motion to have an Executive Session on a personnel
matter under section 2.1-344 of the Code of Virginia, seconded by Councilman
Neblett and carried.

At 5:26 p.m. Council went into Executive Session.
At 5:47 p.m. Council returned to Regular Session.
Mr. Terwilliger advised he had had instances where citizens had
written to him asking for legal opinion as Town Attorney usually regarding
a matter concerning the Town. He gives his position as representing the
Town Council and does not represent every individual citizen. He so
advises citizens if it is a matter that should come before Council, they
should bring it to Council. He requested guidance from Council whether
this is the way he should continue handling it or in a different manner.
Council was in agreement that he was handling it correctly.
At 5:52 p.m., Councilman Neblett made a motion to adjourn, seconded
by Councilman Boyd, and carried.
