There were present: Mayor Raymond F. Ratcliffe, presiding. Councilmembers: C, E. Boyd, Jr ., John A. Johnston, Pauline G. Mitchell, Glen K, Aust, Alma H. Holston, James M, Neblett, Jr,, Robert M. Wallace Absent: Councilman Andrew L. Chamber of Commerce The invocation was given by Councilman Neblett. The minutes of the regular meeting of June 1, 1982 and Public Hearing of June 3, 1982, were .approved as recorded. At 7:05 P, M. Councilman Neblett moved that in accordance with Section 2.1-344 of the Code of Virginia, Council go into Executive Session to discuss a personnel matter. Motion was seconded by Councilman Boyd, and carried. At 7:50 P. M. Council returned to regular session. Councilman Boyd moved the adoption of the budget for fiscal year 1982-1983 prepared by Town Manager Coake and his staff, with changes that he has given. Motion was seconded by Councilman Neblett. At this point, Councilman Wallace inquired "are we going to make public the changes", and was advised that the only changes were adjustments in salary schedules, and the other changes had been discussed by Council. The following vote was taken on the motion to adopt the budget: John A. Johnston - Aye Andrew L. Graham, Jr. -.Absent Pauline G. Mitchell -Aye Glen K. Aust - Aye Robert M, Wallace -Abstained Alma H. Holston - Aye C. E. Boyd, Jr. - Aye James M. Neblett, Jr. - Aye Mayor Ratcliffe advised that Council would hear the public at this time - if there was anyone who wished to speak. Nick Saunders advised that he had a comment to make with the understanding that he had no personal animosity toward any member of the Town or the Governing Body; that in view that the next public meeting of Council would be its organizational meeting, his comment concerned the ~~~~ June 15, 1982 Director of Recreation; and considering what appears to be something less than a "fair perf ormance" of his duties, he would like the Town Council to take this into consideration in making. reappointments July 1; he stated the general comment from the citizens of the Town is that he was wasting his breath in bringing this to Council, because Council would never do anything about it. Mayor Ratcliffe asked Mr. Saunders if he had a recommenda- tion to present? Mr. Saunders stated that he recommended that "he will not be reappointed Recreation Director July 1st". Mayor Ratcliffe called for Committee repots. UTILITIES COMMITTEE Chairman Johnston had no report. RECREATION COMMITTEE Chairperson Mitchell had no report. STREET COMMITTEE Chairman Wallace had no Street Committee report; however, Mr. Wallace stated that since this was his last meeting on Council, he would like to say that serving on Town Council had been an experience and education, and he felt that everybody should experience some type of work for the Town. He stated his delepest regret was that so few citizens arrend Council meetings, and if anything is right or wrong, they have only themselves to blame because they had not put forth any effort to change things.; He felt some progress has been made and that Council is looking at things a little differently. Mayor Ratcliffe stated this does wind up Mr. Wallace's term on Council, and there have been some rough and some smooth spots during his tenure; that Mr. Wallace made it known when he did not agree on a matter, and there have been some difficult decisions to be made during his term. Other memters of Council expressed their pleasure in having served with Mr. Wallace and Mr. Neblett. Mr. Neblett stated his eitht years on Council had given him a better knowledge relative to the aspects of municipal government. June 15, 1982 ~~~~ LAND AND BUILDING COMMITTEE Chairman Boyd reported that the Downtown Renovation Committee met recently with Town officials, merchants and property owners, and discussed the upcoming work to be done on Main Street. Mr. Boyd advised there would be ground breaking ceremonies Saturday, June 19th, but the Courthouse fence would not be involved; that there would be all-day festivities and he hoped all would come out and participate. He advised the Contractor is about ready to go; the Town would lose four (4) parking spaces on Main Street when work is completed, and during concstruction there will be parking only on one side of the street. Mr. Boyd stated that if parking becomes a problem, suggested that consideration be given-for some type of ordinance for those people who continue parking in the downtown area .where they work. Councilman Boyd moved that the Ordinance Committee consider and recommend to Council some type of ordinance regarding parking in the downtown area. Motion was seconded by Councilman Aust, and carried, with Councilman Wallace voting "NO". Councilman Boyd called Council's attention to the memorandum from Town Manager Coake relative to the filoodplain, and if any explana- tion was. necessary Mr. Coake, or Mr. Hawley could explain. Councilman Boyd adivised that a request had been received from'Ms. Vicki Futrell, Executive Director of the Pulaski County Chamber of Commerce, for office space in the Municipal Building, as they will have to give up their office space in the Virginia National Bank Building. Councilman Boyd moved that the Town offer space on the first floor of the Municipal Building to the Pulaski Chamber of Commerce, and authorizedTown Manager. Coake to work out the details for renting the space for a six months trial period. Motion was seconded by Councilman Neblett. There was some discussion, and Councilman Wallace suggested that it be made clear to the Chamber they will not be able to use parking spaces on the lot or spaces marked "reserved". Boyd, Jr. - Aye James M. Neblett, Jr. -Aye rj~~a June 15, 1982 Councilman Boyd moved that the regular meeting of Council on July 6, 1982 be moved to July 1, 1982 at 4:00 P. M. to coincide with Council's organizational meeting. Boyd, Jr. - Aye James M, Neblett, Jr. -Aye Councilman Boyd reported that the Town Planning Commission met on the 14th of June and Townhouses for the Town of Pulaski was discussed. It was hoped a recommendation could be made at their next meeting regarding this development. ORDINANCE COMMITTEE Chairman Aust asked Town Attorney Moore if there were ordinances to be presented? ORDINANCE AMENDED Town Attorney Moore stated that Council adopted an ordinance on June 1, 1982 to amend its Retirement Plan. Since then Town Manager Coake has talked with Mr. Kenneth Campbell, the Town's Actuary, who suggested that the amendment to the Retirement Plan of April 1,, 1972, be effective as of July 1, 1982, and this effective date has been inserted. Councilman Boyd moved that the vote by which the ordinance to amend and revise the Retirement Plan and adopted on June 1, 1982 be reconsidered. Neblett, Jr. - Aye Councilman Neblett moved an Ordinance to amend and revise the Retirement Plan o~ April 1,.1972, for the employees of the Town of Pulaski, Virginia, by repealing Section F of Article IV, or so much thereof as in conflict with this Ordinance, and by enacting new Section F.1 of Article IV, and to make said amendment effective July 1, 1982, be adopted. Neblett, Jr. - Aye June 15, 1982 AN ORDINANCE to amend and revise the Retirement Plan of April 1, 1972, for the employees of the Town of Pulaski., Virginia, by repealing Section F of Article IV, or so much thereof as in conflict with this Ordinance; and by enacting new Section F.l of Article IV, and to make said amendment effective July 1, 1982 BE IT O~;DAiNED by the Council of the Town of Pulaski, Virginia, meeting in regular session on June 15, 1982, that: (1) Section F of ,Article IV, or so, much thereof in conflict with this Ordinance, be, and it is hereby, repealed and Section F.1, Article IV, Retirement Allowance - is hereby;enaeted in Lieu thereof, as follows: Section F.1 - Supplemental Retirement Allowance (Post- Retirement Adlustments) Each monthly retirement allowance payable to a Participant pursuant to Section A, B, C or D of this Article IV, any optional monthly allowance payable to a Participant, Contingent Annuitant or Beneficiary pursuant to Article V, and any monthly allowance payable to a Beneficiary ^ursuant to Article VI shall be subject to adjust- ments in accordance with the following paragraphs of this section. Annually on July 1 of each year, except as otherwise determined by the Town Council, the total amount of the retirement allowance then being paid from the fund to each recipent referred to in the preceding paragraph, including in such total the amount of any increases previously granted, shall be .increased by a percentage, determined as the lesser of: (a ) 5% (b) the percentage increase in the United States Average Consumer Price Index (Urban). All items, as published by the Bureau of Labor Statistics of the United States Department of Labor, from its value for the month of March in the prior year to its value for the month of March in the year for which the. determination is being tm de. '~~.~9 provided, however, that in the case of any ~.llowance which originally commenced subsequent to March 1 of the prior year, the applicable percentage increase shall be determined as one-twelfth of the lesser of (a) and (b) above, multiplied by the number of complete months in the period between the date of commencement and March 1 in the year of determination. (2) This amendment shall be, and it is hereby made effective upon passage. (3) This Ordinance is designated as the-Third Amendment to the Revised Retirement Plan for the Employees,of the Town of Pulaski, Virginia, adopted on the 18th day of July, 1972, effective April 1, 1972. POLLUTION AND SANITATION Councilwoman Holston stated that at Council's meeting September 16, ,~ 1980, she advised that the records of the landfill indicated that since the Town imposed a fee for dumping tires at the landfill there had been quite a decrease in the tires received at the landfill, and it appeared the tires were being dumped behind places of business, and a motion was ~~:~°,(~ June 15, 1982 passed that this matter be referred to the Ordinance Committee for study and report. Mrs. Holston advised the same condition seems to be in existance, and moved that the matter be referred back to the Ordinance Committee. Motion was seconded by Councilman Wallace. Councilman Aust stated he had talked with these tire people and they stack these tires up until they have a load before they are picked up. Councilman Boyd felt that Town Manager Coake should talk to them and get this settled,. and if the charge for dumping tires at the landfill is not working, then bring back a recommendation to Council. Motion carried. Chairperson Holston advised that the Town's landfill received a satisfactory rating from the Virginia Division of Solid and Hazardous Waste Management. ,She advised there are four items this C ommittee will have to consider. Mrs. Holston stated this may be her last meeting to report for this Committee, as there may be a new Chaiperson after the July 1st meeting of Council; however, she would furnish all the inf ormation she has relative to the need for the Town to provide a ground water monitoring and surface water monitoring program ~t the landfill, to the new Chairman of the Pollution and Sanitation Committee. She advised that Director of Public Works Leroy Early had been most cooperative and she had enjoyed working with him. PUBLIC SAFETY & PERSONNEL COMMITTEE Chairman Neblett stated he had no report, but asked Town Manager Coake to make a report on a personnel matter. Town Manager Coake read a letter from H. B. Childress, Chief of Police, addressed to Mr. Coake, as Town Manager and Pulaski Town Council, as follows: "I respectfully request a laterial transfer from the office of Chief of Police to that of Captain. I am making this request for personal reasons and hopefully for the betterment of the Police Department. I would like for it to become effective September 15, 1982. In the event you have not decided on a new chief by that date, I will be glad to continue as chief until the position is filled if you so desire. June 15, 1982 "I will work with the new chief and help him anyway I possibly can. "I make this request without any malice toward any town official or citizen of Pulaski. I hope and pray the citizens of Pulaski and council will support a new chief because without that support it is impossible to do the job the way it should be .done. "It has been an honor for me to serve as Police Chief for the past nine years." '71 ~1 Councilman Neblett moved that the letter be accepted and referred to the Personnel Committee for study, and report back to Council. Neblett, Jr. - Aye In the absence of Finance Chairman Graham, Councilman Neblett reported the Finance Committee had met and made the following recommndations: Councilman Neblett moved that $2,000.00 be approved for expenditure. Revenue Sharing Account ~~408.3 Paint Storage Tanks as previously budgeted. Motion was seconded by Councilwoman Holston, and carried on the f ollow- ing vote: John A. Johnston - Aye Andrew L. Neblett, Jr. -Aye Councilman Neblett moved that $2,000.00 be appropriated from General Fund Unappropriated Surplus to Account ~~900-935.1 Armory Roof Repairs. Motion was seconded by Councilman Boyd. Town Manager Coake stated this was for repairs to the roof over the boilerroom only, and that the National Guard had agreed to split the cost with the Town. Neblett, Jr. - Aye Councilman Neblett moved that Ordinance for Tax Relief for the Elderly be prepared so as to be compatible with the present County of Pulaski ordinance for Relief for the Elderly, said ordinance. to be effective Janusry 1,.1983. Motion was seconded by Councilman Johnston. Following a discussion relative to an ordinance for the Elderly for tax relief, the motion and second were withdrawn, and Councilman Neblett moved this matter be referred to the Ordinance Committee for report to Counel. Graham, Jr. -Aye Glen K. Aust - Aye Alma H. Holston - Aye James M. Neblett, Jr. - Aye Mayor Ratcliffe advised that a letter from American Legion Post ~~7 had been received thanking the officials of the Town of Pulaski for use of Jackson Park and the National Guard Armory in their I~ Memorial Day programs. Also,, a letter was received from the Merchants Council relative to the ground breaking, ceremonies on Saturday, June 19th on the Courthouse lawn, and Council has been invited to attend, with refreshments being served throughout the day. Mayor Ratcliffe called attention tothe Institute of Municipal Officials Seminar to be held in Charlottesville July 7 - 9 and Blacksburg July 14 - 16, and advised that Councilmen just coming on .the Council in the past have found these seminars to be very helpful to them. June 15, 1982 REPORT OF TOWN MANAGER '7~.~3 Town Manager Coake advised that the first professional baseball game in Pulaski this seas:bn will be at 7:30 P. M. in Calfee Park on June 26, 1982. He also reminded members of Council of the ground breaking ceremonies on Saturday, the 19th. Councilman Wallace stated that inasmuch as he and Mr. Neblett were on Council when the Consolidation Study was authorized, he would like to be inf ormed of any developments, or outcome of the Study.
