Ratcliffe - two year term; Glen K, Aust, Mayor & C. E. Boyd, Jr., Earl D. Cabaniss and Ira S. Crawford, Council- Newly Elected Council members to serve four years. Members The Mayor-elect and the Councilmember-elect having duly qualified bef ore the Clerk of the Circuit Court of Pulaski C ounty, Virginia, as provided by Section IX of the Town ofPulaski Charter of 1948, and the Charter amendment approved by the 1956 Legislature, a meeting was held this lst day of July, 1982, at 4:00 P. Harman Approximately thirty citizens The invocation was given by Councilman Boyd. Mayor Ratcliffe advised the purpose of the meeting was to seat the Mayor and newly elected Council members, and to consider the reappointment of the various Department Heads and Officers of the Town. Councilman Graham moved that the copies of the Oaths received by the Clerk be received and filed. Motion was seconded by Council- man Johnston, and carried. At this time Mayor Ratcliffe stated that Council was honoring two of its retiring Councilmen and asked them to meet him in the front, where he presented to James M. Neblett, Jr., a plaque for his eight years of service on the Council, and presented a plaque to Robert M. Wallace for his four years of service on Council, in appreciation of their service to the Town. Justice Alex M. Harman, in his remarks to the newly elected Councilmen, stated that Councilmen Boyd and Aust, having previously served on Council, realize all that is involved in serving on the Town Council; and to Councilmen Cabaniss and Crawf ord, Justice Harman stated that 'you have been given the highest honor of service, and the citizens of the Town have given you an opportunity to serve for the betterment and weiface of the citizens of the Town". He further stated oftentimes being a Councilman is a thankless job, but the progress of the community depends largely upon those .serving as such. Thereupon, the newly elected officials were seated. Mayor Ratcliffe advised that a request had been received from a Council Member that an Executive Session be held on a personnel matter. At 4:20 P. M. Councilmember Holston moved that Council go into Executive Session on a personnel matter in accordance with Section 2.1-344 of the Code of Virginia. Motion was seconded by Councilman Boyd, and carried. At 4:35 P. M. Council returned to regular session. Mayor Ratcliffe advised a Vice-Mayor would now be elected for !~ the 1982-84 term. Councilman Aust nominated Andrew Graham for Vice-Mayor for 1982-84. Motion was seconded by Councilman Johnston. Mayor Ratcliffe inquired if there were other nomination, and Councilman Cabaniss moved that nominations be closed; seconded by ~~„~~ July 1, 1982 Councilman Boyd, and carried. Mayor Ratcliffe advised those who favor Andrew Graham as Vice-Mayor make it known by the following vote: John A. Johnston - Aye Andrew L. Graham, Jr. - Aye Pauline G. Mitchell - Aye Ira S . Aust - Aye Mayor Ratcliffe inquired of Town Manager Coake if he had a recommendation for appointment of officials and Department Heads. The closing date for receiving applications will be September 1, 1982. Councilman Graham moved the recommendation of Town Manager Coake be accepted. Motion was seconded by Councilmember Holston. Mayor Ratcliffe asked if the persons named be voted on in a block with the privilege of any member of Council to request a separate vote on any one or more of the persons named. "Do I hear a request", he asked. Councilman Boyd ,moved that each name listed be voted on separately. Motion was seconded by Councilwoman Mitchell, and carried. Mayor Ratcliffe stated Council would not proceed to consider each Department Head as they come up. He further stated one that Council had chosen to elect each/individually, and since Council has received a request from Mr. Bill Norris, Chairman of the Recreation Commission, appointed by the Council of Pulaski, a report had been received from Chairman Norris and Council members had a copy, as well as the Press, and all are familiar with it, so it would riot be re d at, this tip- state I~r. ~iorhr~~s w uld be recognized at t~iis time and i~'he~as any hang ur r go say, July 1, 1982 ~~~9 the Council will hear him at this time. As Chairman of the Recreation Commission created by the adoption of an Ordinance by the Town Council on the 15th day of November, 1977, Bill Norris stated the reasons and logic used by the Commission in making its report to the Council. He further stated that he had personally checked the Council minutes from 1975 thru 1982, and advised Council of the complaints found in the minutes relative to the Recreation Department operations. Mason A. Vaughan, Jr. a member of the Recreation Commission gave a minority report and did agree with the Commission report, stated the Commission felt the evidence justified the Commission in making its recommendation to the Council. re- Councilman Graham moved that H. Childress Chief of Police, requesting a lateral transfer to Captain effective September 15, 1982 was referred to the Personnel Committee for recommenda- tion to Council. He stated it was the recommendation of the Committee that Chief of Police Harry B. Childress be appointed as Chief of Police until September 15, 1982, or otherwise directed by the Town Coun31, ~~°~~ July 1, 1982 and that the Town Manager be directed to proceed to accept applications for the position of Chief of Police, with September 1, 1982 the clos- ing date for receiving applications, and so moved. Motion was seconded by Councilman Aust, Councilman Boyd stated Chief Childress did ask for the lateral transfer effective September 15, 1982 and the Town must secure applications and would need a Chief of Police to serve until a new Chief is selected, and he felt that it should be clearly understood that the person so selected will be in complete control of the Police Department as Chief of Police. During the discussion that followed each member of Council and the Mayor expressed their opinion relative to the reappointment of Mr. Bane and the operation of the Department as-its Director; some of which were ~ut3.te lengthy but have been made a part of the Recreation Department file in the Town Managers office. Aust - Aye Mayor Ratcliffe asked if any one wished to make any further statement, Whereupob, Councilman Boyd stated tltgt since there was a difference in the votes of the various Department Heads, suggested this matter be referred to the Personnel Committee for a complete evaluation, including the Management Study,. and that a report be made to the Council within Ninety (90) days, and so moved. M. on motion of Councilman Graham, seconded by Councilman Aust, and carried, the Organizational Meeting adjourned for a five minute recess bef ore going into Council's regular session. The first item of business in Council's regular meeting was the approval of the minutes of the June 15, 1982 meeting, as recorded. Mayor Ratcliffe advised that inasmuch as Town Attorney Moore must leave to attend another meeting, Council would hear his report at that time. Town Attorney Moove presented an Agreement, for Council's consideration, between the Town of Pulaski, Virginia and Issy J. Lepchitz, by the terms of which the parties would agree to close and fill two (2) coal storage areas under the public sidewalk adjacent to the south basement wall to the building belonging to Issy J. Lepchitz and to close the opening from the coal area into the basement of the Lepchitz property by byilding a wall in the opening, all at the expense of the Town of Pulaski. The agreement was read by Town Attorney Moore, together with a Resolution by which Council approved said Agreement and directed the .Mayor and Clerk to execute said Agreement. ,~ Councilman Aust moved it be referred to the Street Committee. After some discussion and the lack of a second, Councilman Aust withdrew his motion. Councilman Johnston moved that the Resolution be accepted and approved. Aust - Aye RESOLUTION RESOLUTION WHEREAS, the Town Manager has this day presented to ISSY LEPCHITZ the Council an agreement between the Town of Pulaski, Virginia, and Issy J. Lepchitz, by the terms of which the parties agreed to close and fill two :(2) coal: storage areas under the public sidewalk adjacent to the south basement wall of the building belonging to Issy J. Lepchitz and to close the opening from the coal area into the basement of the Lepchitz property by building a wall in the opening, all at the-expense of the Town of Pulaski. Town Manager Coake recommended that a public hearing be held at the next Council meeting, July 20, 1982 at 7:00 P. M. on the petition of Eastern Star to grant a special exception or use permit for the property located at 614 Maple Street in Pulaski to permit an assembly hall to occupy the property. Councilman Boyd so moved that a public hearing be held at 7:00 P. M, on July 20, 1982 on the petition of the Eastern Star request. Motion was seconded by Councilman Graham, and carried. In an effort to help parking on Mashburn Avenue, Town Council had directed Town Attorney Moore to prepare an ordinance for an access road to the Macgill Village Tennis Courts to be used by residents of Mashburn Avenue. The ordinance was presented by Mr. Moore and some discussion was had by Council. Councilman Graham moved that it be turned over to the Street Committee for recommendation to Council. Motion was seconded by Councilman Boyd, and carried. AWN REPRESENTATIVES ON: Councilman Graham moved that Mrs.. Louise Settle be the Citizen representative on the New River Valley Planning District Commission and John R. Powers, .Alternate. Motion was seconded by Councilman Boyd, and carried. Councilman Graham to continue as the Town's representative on the New River Valley Planning District Commission by unanimous vote of Council. 1 Councilman Boyd moved that Councilman Crawford replace Counil- man Neblett on the Life Saving Committee. Motion was seconded by Councilman Graham, and carried Councilman Graham moved that Councilman Boyd remain on the Town Planning Commission. Motion was seconded by Councilman Cabaniss, and carried. Councilman~Graham moved that Councilman Johnston remain on the Retirement Committee. Motion was seconded by Councilman Crawf ord, and carried. Councilman Graham moved that Mayor Ratcliffe be reappointed to the~New River Valley Airport Commission. Motion was seconded by Councilwoman Holston, and carried. Councilman Crawford moved that Councilman Graham be re- appointed as Alternate on the New River Airport Commission. Motion was seconded by Councilwoman Mitchell, and ~ rried. By unanimous vote of Council Mrs. Ruth Kirby would remain as representative on the Agency on Aging. On motion of Councilman Aust, seconded by Councilman Graham, H. B. Childress was reappointed to the Virginia Alcohol Safety Progrm. Motion carried. ~~ 1 ``3 July 1, 1982 On motion of Councilman Boyd, seconded by Councilman Cabaniss, Councilwoman Mitchell was reappointed to Area Council of Health System Agencies. Motion carried. On motion of Councilman Boyd, seconded by Councilman Cabaniss, Mayor Ratcliffe to remain as representative on Virginia Municipal League. Motion carried. Mayor Ratcliffe advised that Council would hear the public at this time and limit any one to fifteen minutes. Bill Norris thanked the Mayor and Council for their cooperation relative to the Recreation Commission's report; complaints heard and documents filed in Town Council's meeting minutes. He advised the Commission will hold a meeting at 7:30 P. M. on July 12th. Councilman Grahacri stated he hoped the Commission will come up with something about the County participation and how this can be worked out. Mr. Norris stated the Commission planned to do that and he was sure the Council will from time to time be hearing from the Recreation Commission. Councilwoman Mitchell suggested that when Mr. Bane makes his written monthly report that each Councilmember will get a copy, the same as those from-the other Department Heads. UTILITIES COMMITTEE Councilman Johnston reported the Utilities Committee considered the rates charged for water connections inside and outside the corporat limits by the Town in comparision with those of surrounding Town. The Committee recommended the following: Meter Size Inside Outside 5/8" $ 300.00 $ 400.00 3/4~~ 350.00 450.00 1" 400.00 500.00 and any meter installed larger than (1") one inch be billed on the basis of cost plus 15% for overhead. CouncilmanJohnston moved that Town Attorney be instructed to prepare an ordinance reflecting only thos new changes. Motion was seconded by Councilman Boyd, and carried. Councilman Johnston stated the Town will begin the smoke test program during July which is a phase of the I/I Study on private dwellings. People will be notified prior to the testing and a letter July 1, 1982 ~~~~ will be given to those property owners who have their roof drains connected to the sanitary sewer lines, POLLUTION & SANITATION COMMITTEE No report by Chairperson Mitchell. RECREATION COMMITTEE No report by Chairman,Cabaniss. LAND, BUILDING, PARKS, ETC. No report by Chairman Boyd. Mr. Boyd advised that the Planning Commission considered the need for revising the zoning ordinance to allow for the development of Town houses in the Town of Pulaski. The Commission prepared changes to the existing zoning ordinance and was of the opinion that Council should considerthe adoption of these revisions. Councilman Boyd moved these revisions to the zoning ordinance should be referred to the Ordinance Committee for consideration and report to Council. Motion was seconded by Councilman Crawf ord, and carried. F INANCE COMMITTEE Chairman Graham had no report. STREETS COMMITTEE Chairman Crawford had no report. ORDINANCE COMMITTEE Chairperson Holston had no report. REPORT OF TOWN MANAGER Town Manager Coake advised that a letter from the Town Planning Commission Chairman, Mrs. Settle, relative to the special use permit request by the Eastern Star, stated that it was the opinion of the Commission, and so recommended, that Council deny the request because the Commission felt this would be spot zoning since it would allow an Assembly Ha11 in an R-2 Residential Zone when the Zoning Ordinance restricts Assembly Halls to B-2 Business or lower zones. The Commission also felt that the Assembly Hall would increase traffic in the residential zone and off-street parking would be a problem. Town Manager Coake advised that a public hearing has been scheduled by the Virginia State Corporation on December 9, 1982 at ten o'clock A. M, in the C ommission's Courtroom in Richmond to hear the re- quest of the Tennessee-Virginia Energy Corporation for a rate increase in its actual Revenue by approximately $1,251,000.00. Mr. Coake recommended this be ref errred to the Finance Committee. Councilman Boyd so moved, ~~~~ July 1, 1982 seconded by Councilman Crawford, and carried. Town Manager Coake reported on July 4th activities and advised that the Town Offices would be closed on July 5, 1982 in observance of July 4th Holiday. Town Manager Coake stated the County Administrator advised by letter that the County has agreed to pay the Town $225.00 per fire call; however, in response to the Town's request by letter February 10, 1981 for a contribution to the Recreation Program, Mr. Clower stated the Board of Supervisors feel consideration to any additional funding allocation to the Town should come after a thorough review of the Consolidation/Annexation/City Status Study; the Board also feels that an analysis of funding policies must also include a review of the Sales Tax Sharing Agreement between the Town and County. Councilman Boyd moved the County'sresponse be referred to the Finance Committee. Motion was seconded by Councilwoman Holston, and carried. Either the Mayor or Town Manager were directed to write a letter disapproving of the Tax Bill concerning Municipal Bonds. At 6:40 P. M. Councilman Boyd moved that Council adjourn.
