HomeMy WebLinkAbout01-14-83January 14, 1983 ~c~ ;+~ Minutes of a Special Meeting of the Pulaski Town Council held January 14, 1983, at 6:00 p.m. in the Council Chambers in the Municipal Building. There were present: Mayor Raymond F. Ratcliffe, presiding Councilmembers: John A. Johnston, C. E. Boyd, Jr., Alma H. Holston,,, Pauline G. Mitchell, Glen K. Aust, Andrew L. Graham,Jr., Earl D. Cabaniss Also present: Mr. Gannett Moore, Town .Attorney Ruth A. Harrell, Clerk of Council Visitors: J. R. Schrader of the News Media The invocation was given by Councilman Aust. Mayor Ratcliffe advised the purpose of this Special Meeting was to consider new legislation to be presented in Richmond. Mayor Ratcliffe advised that we have been advised by Senator Danny Bird and Del. Robert Dobyns that the subject of allowing the forming of a new consolidated government is going bef ore the committee Tuesday morning, January 18, 1983. Also, Mr. Mason Vaughan, Mayor Julian McMillian, and Mayor Ratcliffe will appear bef ore the committee on Tuesday morning. Mayor Ratcliffe advised that this bill would be state wide and no localities, towns, etc. were to be named in the proposed bill. Mr. Garnett Moore defined the provision in the proposed bill describing when you will be considered a town with the purpose being to eliminate the communities which are called towns, but never have an election and they do not really operate as a town, citing Draper and Newbern as examples. He also stated that geographical subdivisions of the consolidated county or counties be known as shires or boroughs may be established, which shall be the same as and bear the names of the existing county, town, community or portion of counties, etc. Councilman Graham questioned page 6, lines 23, 24, and 25, boundaries of special services or districts may be altered from time to time by ordinance of the governing body dully adopted after a public hearing. Mr. Moore stated this would apply to a district or shire that did not have water and sewer., and should water and sewer be put in, this area would not be entitled to a lower tax rate so you would change the boundary of the district. Mayor Ratcliffe advised boundary of such special service districts ..would be altered from time to time by ordinance of the governing body and duly adopted after a public hearing. Considerable discussion followed concerning taxation proposals and handling of consolidation. '7t~`a'~ January 14, 1983 Councilman Boyd made a motion that we endorse in principle a bill to amend and re-enact 15.1-1130.1 and 15.1-1135 of the Code of Virginia, and to amend the Code of Virginia by adding a section numbered 14.1-84.6:2, the amended and added sections relating to consolidation agreements among counties, cities, and towns and law enf orcement expenditures, seconded by Councilman Aust. Councilman Graham made a substitute motion the Resolution be approved on condition that it would be state-wide~and not to be construed that Council approves or disapproves of Consolidation at this point and time, seconded by Council person Holston. Councilman Johnston advised that there were a lot of serious questions in the Consolidation Study. He thinks it would be wrong for someone to say that they are for or against consolidation based on information we have at this point. Mr. Moore advised that we would have plenty of time to have everything said that was needed and every vote we need to make on questions arising on Consolidation and as to being for or against. Councilman Graham withdrew his substitutre motion and Councilperson Holston withdrew her second. Mayor Ratcliffe advised that this draft bill would be a tool to be used for Pulaski or any other locality within the State that wanted to consolidate towns and counties, and they are asking us to support it. Mayor Ratcliffe called for a recorded vote on the original motion of Councilman Boyd and carried on the following recorded vote: John A. Johnston - Aye Andrew L. Graham, Jr. - Aye Pauline G. Aust - Aye WHEREAS, The Town of Dublin, the Town of Pulaski and the County of Pulaski have been engaged in an analysis of the advantages and disadvantages uF~nr.rrr-rnN of consolidation of said jurisdictions into one government unit, and consolidation Legisla- WHEREAS, The consolidation of said three jurisdictions will require changes tion and additions to the Code of Virginia in order to permit orderly and equitable operation of the consolidated government, and WHEREAS, The governing bodies of said three jurisdictions have requested the Honorable Daniel Bird, Senator, and the Honorable Robert Dobyns, Delegate, to introduce, certain legislation to the Virginia General Assembly, theref ore BE IT RESOLVED that the Council of Town of Pulaski hereby endorses in principle a bill to amend and re-enact 15.1-1130.1 and 15.1-1135 of the Code of,Virg~.nia, and to amend the Code of Virginia by adding a section numbered 14.1-84.6:2, the amended and added sections relating to consolidation agree- ments among counties, cities, and towns and law enf orcement expenditures co- patroned by Senator Bird and Delegate Dobyns. Burnette January 14, 1983 ~~~~~ 4 r'.+ Mr. Moore advised that on the proposed legislation, bef ore they would make a local law from it, our representatives would be notified, and then they would take whatever action they felt was necessary. Mr. Moore also stated that bef ore our representatives agree to an amendment to make itlocal law, if possible they would probably contact us. Councilman Graham moved that Council go into Executive Session at the request of Mr. Moore to discuss legal matter (purchase of land) seconded by Councilperson Holston, and so carried. Councilman Boyd was excused at this time due to another scheduled apointment. At 6:50 p.m. Council went into Executive Session. At 7:10 p.m. Council returned to Special Session. At 7:16 p.m. on motion of Councilman Aust, seconded by Councilperson Mitchell, and carried, Council adjourned.
