Minutes of the regular meeting of the Pulaski Town Council held October
21, 1986, at 7:00 p.m. and a Joint Public Hearing with the Town Planning
Commission in the Council Chambers in the Municipal Building.

The invocation was given by Councilman Neblett.
On motion made by Councilman Neblett, seconded by Councilman Neighbors
and carried, the minutes of the regular meeting of October 7, 19$6, were
approved as submitted.
',.PUBLIC HEARING Mayor Hancock advised that as advertised, now was the time and place
(JOINTLY WITH for a public hearing to be held jointly with the Town Planning Commission
PLANNING
'COMMISSION on the issue of conditional zoning.
CONDITIONAL Messrs. Joe Weddle, Claud Kirland, Ralph Grubb and J. B. Warner
ZONING addressed Council with their concerns regarding this proposed amendment
to the zoning ordinance. Statements made included that they agreed with
the intent of proposed ordinance but expressed concerns that ordinance
could become a spot zoning ordinance; and felt there was not a need for
this ordinance.
Mayor .Hancock, Councilmembers, Town Attorney and Anne Burgess along
with Dr. Anneski and Mr. D'Ardenne from the Planning Commission gave
explanations of the ordinance, its purpose and enforcement; and answered
concerns that citizens expressed. Conditional zoning has nothing to do
with spot zoning and gives Council more control if they do decide to rezone.
Citizens were requested to watch advertisements for rezoning requests
and make their feelings known to Council.Mayor Hancock expressed appreciation
to the Planning Commission on all their hard work on this matter.As there
were no further comments from the public, Mayor Hancock. called for Council
Committee Reports.
UTILITIES COMMITTEE
Chairman Johnston advised that contract 4B, Wurno pump station, is
being built on schedule and completion should be around December 1st.
PUBLIC & PERSONNEL RELATIONS
NOMINATING COMMITTEE
RESOLUTION Chairman Neblett stated we have a resolution honoring Brooks Leonard,

PUBLIC OPERATIONS COMMITTEE
Chairman Neighbors requested a committee meeting be scheduled to
review the request for an alley to be reopened between Lagrange and Lake

Street on First Street. An Engineering report will be prepared for the committee.
FINANCE COMMITTEE
Chairman Crawford had no report, however, moved that Council have an Executive
Session on a legal matter under 2.1-344 (A6) and also a use of real estate matter
under 2.1-344 {A2).
ORDINANCE COMMITTEE
Chairperson Copenhaver had no report.
MAYOR'S REPORT
POLICE Mayor Hancock extended condolence to the family of Officer Bill Surber.. Town
OFFICER
BILL Attorney was requested to prepare a resolution to be forwarded to his family. Mr.
SURBER McKeever advised that on behalf of Council, a donation had been made to the Heart
Fund.
Mayor Hancock commended the Count Pulaski Day Committee on Count Pulaski Day
festivities and also our Town Police Department, Chief Joe Williams. other law
enforcement agencies, and Mr. Terwilliger on the excellent manner the Klan parade
was conducted.
TOWN ATTORNEY'S REPORT
Mr. Terwilliger presented an Ordinance amending Erosion and Sediment Control
Ordinance. Councilman Neblett so moved that reading of the ordinance be waived
and that ordinance be adopted as presented, seconded by Councilman Glenn and
carried.
ORDINANCE ORDINANCE
ADOPTED AMENDING EROSION AND SEDIMENT CONTROL ORDINANCE
BE IT ORDAINED by the Town Counci l of the Town of Pulaski., Virginia,
sitting in regular session
8.1-11 of the Town Code be, on the 21st
and hereby day of October, 1986, that Section
is, amended to read as follows:
Sec. 8.1-11. Inspections, monitoring and reports.
(a) Inspections. The engineering department may periodically inspect the
land-disturbing activity to insure compliance with the approved plan and
to determine whether the measures required in that plan are effective in
controlling erosion and sediment resulting from the land-disturbing activity.
The right-of-entry to conduct such inspections shall be expressly reserved
in the permit. The engineering department may request assistance from the
district or its cooperating agencies for such inspections.
(b) Failure to comply with approved plan. If the engineering department
determines that the permit holder has failed to comply with the plan, the
engineering department shall immediately serve upon the permit holder,
by registered or certified mail to the address specified by the permit
holder in his permit application, or by delivery at the site of the permitted
activities to the agent or employee of the permittee supervising such
activities, a notice to comply. The engineering department may request
a recommendation from the District or its cooperating agencies prior to
making such determination. Such notice shall set forth specifically the
measures needed to come into compliance with such plan and shall specify
the time within which such measures shall be completed. If the permit
holder fails to comply within the time specified., he may be subject to
revocation of the permit; furthermore, he shall be deemed to be in violation
of this chapter and, upon conviction, shall be subject to the penalities pro-
vided by this chapter.
(c) Adherence to approved plans and specifications. Upon receipt of a
complaint of a substantial violation of this chapter, the town may, in
conjunction with or subsequent to a notice to comply as specified in
subsection (b) above, issue an order requiring that all or part of the
land-disturbing activites permitted on the site be stopped until the
specified corrective measures have been taken. Where the alleged non-
compliance is causing or is in imminent danager of causing harmful
erosion of lands or sediment deposition in waters within the watersheds
of the Commonwealth, such an order may be issued without regard to
whether the permittee has been issued a notice to comply as specified
in subsection (b) above. Otherwise, such an order may be issued only
after the permittee has failed to comply with such a notice to comply.
The order shall be served in the same manner as a notice to comply, and

shall remain in effect for a period of seven (7) days from the date of
service pending applications by the town or permit holder for appropriate
relief to the Circuit Court of Pulaski County. Upon completion of corrective
action, the order shall immediately be lifted. Nothin in this section shall
prevent the town from taking any other action specified in 8.1-12.
This ordinance is effective upon adoption and is adopted this 21st day of
October, 1986,
RESOLUTION
BROOKS S. WHEREAS, Brooks S. Leonard became an employee of the Town of Pulaski
LEONARD in the Public Works Department on September 7, 1976, and continued
RESOLUTION his dedicated service to the Town of Pulaski until his retirement
on October 31, 1986.
Brooks S. Leonard came to work for the Town of Pulaski, Department of
Public Works in the Street Department. In 1977 he was transferred to
the Water and Sewer Department, where he has remained until his retire-
ment.
WHEREAS, during his ten years and one month of service, Mr. Leonard
provided very loyal and useful service, often over and above his
normal duty hours; and,
WHEREAS, the unselfish service rendered by Mr. Leonard has been an
inspiration to all that have known and worked with him, but he found
it was in his best interest to retire.
NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Pulaski,.
Virginia, meeting in regular session on October 21, 1986, wishes to
publically recognize Mr. Leonard's lasting contribution to the people
of the Town and hereby thank him for his may years of service and
kindnesses by which so many have known him, and wishes for him much
happiness and many leisure hours during this retirement.
BE IT FURTHER RESOLVED that a copy of this Resolution be recorded as part
of the minutes of this meeting and that the original thereof be delivered
to Mr. Leonard.
ADOPTED this 21st day of October, 1986.
TOWN M.ANAGER'S REPORT
Mr. McKeever stated that ISO Commercial Risk Services, Inc. had conducted
a survey of our water distribution system and fire protection services to evaluate
INSUR_41NCE whether our insurance ranking would be lowered for insurance purposes. Rating
has improved from a 6 to 5. As the Town continues to improve its water system
and fire equipment, this rating may again improve. Councilman Glenn advised that
on point certification of credits that were assigned to the community, out of a
possible 100, we picked up 57.61. If we go from a class 5 to a class 4 only
requires us to go over 60~. To make this goal, it would save the Town government
considerable money in insurance premiums on fire insurance. Ifwe could go to a
4 rating, home owner rates would also be reduced.
Mr. McKeever advised a draft of the Historic District ordinance had been
distributed. This ordinance has being recommended to Council from the Planning
Commission and they are requesting a joint public hearing be held.
PUBLIC HEARING Councilman Johnston made a motion that public hearing be scheduled for Decem
SCHEDULED 16, 1986, 7:00 p.m., seconded by Councilman Glenn and carried.
Mr. McKeever reminded Council that regular meeting for November 4 has been
rescheduled to November 5, 1986, 4:00 p.m.
By October 29th, those Councilmembers wanting to go on bus tour on November
3 with Commission on Local Government, should notify Mr. McKeever. Schedule of
activities is as follows:
ANNEXATION 8:30 a.m. - bus tour of the area
10:30 a.m. - oral presentations presented by Town and County at Appalachian
Auditorium
8:00 p.m. - Commission on Local Government will hold a public hearing at
Pulaski Middle School

Mr. McKeever advised that on agenda were documents we were prepared to offer
for adoption in reference to the housing grant. Questions from Richmond have been
raised about the program design, therefore,- this matter withdrawn from agenda.
It will require that a special council meeting be held prior to October 30th.
Councilman Crawford advised that he had received requests from several citizens
concerning changing-Halloween night on .October 31st as there .is a Cougar football
game and homecoming is scheduled for this night. Mr. McKeever will coordinate
with the County and bring back recommendation to the special council meeting.
Mr. McKeever advised that leaf pick up schedule should be published this
week.
Councilman Neblett seconded the motion made by Councilman Crawford to go into
Executive Session and motion then carried.
At 7:55 p.m. Council went into Executive Session.
At 8:30 p.m. Council returned to Regular Session on motion made by Councilman
Glenn, seconded by Councilman Crawford and carried.
CH.A.~IBER OF Councilman Crawford made a motion that for the year 1987 the Town Council waive
COI~IERCEthe $900.00 rent for the Chamber of Commerce for rent of the office space on the

RENT first floor of the municipal building, seconded by Councilman Neighbors and carried
