Minutes of the regular meeting of the Pulaski Town Council held October 7, 1986,
at 4:00 p.m, in the Council Chambers in the Municipal Building.
There were present: Vice Mayor James R. Neighbors, presiding
Councilmembers: John A. Johnston, Robert N. Glenn, Andrew L. Graham,
James M. Neblett, W. H. Schrader, Mary Lou Copenhaver
Also present: Frank Terwilliger, Town Attorney
D. E. McKeever, Town Manager
Anne Burgess, Assistant to the Town Manager
Grace Bowers, Acting Clerk
Visitors: Dee Ann Lindsey of the news media.
The invocation was given by Councilman Neblett.
On motion made by Councilman Neblett, Grace Bowers was appointing Acting
Clerk, seconded by Councilman Graham and carried.
Councilman Neblett moved that Dr. John Knaar be reappointed to the Housing
APPOINT. Board of Ad"ustment and A
HOUSING ~ ppeals rather than John Sadler as appointed in meeting
BD. OF of September 16, 1986, seconded by Councilman Graham and carried.
ADJUST. Councilman Neblett made a motion that the minutes of the regular meeting
& APPEALS
of September 16, 1986, be approved, seconded by Councilman Schrader and carried.
As there were no comments from the public, Vice Mayor Neighbors called for
Council Committee Reports.
UTILITIES COMMITTEE
Chairman Johnston reported that Utilities Committee had met and discussed
participation in incinerator plan and as a portion of this discussion involved
a legal matter, requested an Executive Session.
PUBLIC & PERSONNEL RELATIONS
NOMINATING COMMITTEE
Chairman Neblett had no report.
PUBLIC OPERATIONS COMMITTEE
Chairman Neighbors so moved that a public hearing be scheduled for November
18, 1986, at 7:00 p.m. for discussion of the 911 Emergency Telephone System and
also house numbering, seconded by Councilman Glenn and carried.
FINANCE COMMITTEE
Chairman Crawford absent. Mr. McKeever advised the Rt. 11 sewer line was
RT. 11 originally intended to be installed following the 1958 annexation. The low bfd
SEWER two years ago was $48,000. The Pleasant Hill sewer line runs up Rt. 11 and the
AWARDED
Prince Ave. sewer line were both put out to bid with low bid coming in at $46,600
from Dixon Construction Company, Galax, VA.
Councilman Neblett made a motion that Dixon Construction Company be awar+~ed
the contract for these projects at a cost of $46,600, seconded by Councilperson
Copenhaver, and carried on the following recorded vote:

ORDINANCE COMMITTEE
EROSION & Chairperson Copenhaver advised committee had met September 30, 1986.
SEDIMENT Committee discussed an amendment to the Erosion and Sediment Control Ordinance.
CONTROL' Legislation came out in the 1986, that allows for a "stop work order", Chairperson
Copenhaver made a motion that recent legislation be adopted, seconded by Councilman
Glenn and carried.. Mr. Terwilliger will prepare a written ordinance.
Committee also discussed the town tags on the vehicles of the volunteer
AMEND.
TRAFFIC firefighters and volunteer police officers for the Town. Mr. Terwilliger presented
ORDIN_ANCEand read an ordinance amending motor vehicle code to except volunteer fire fighters
and volunteer police officers from Town license requirement. Chairperson Copenhaver

ORDINANCE
AMENDING MOTOR VEHICLE CODE TO EXCEPT
VOLUNTEER FIRE FIGHTERS AND VOLUNTEER POLICE OFFICERS
FROM TOWN LICENSE REQUIREMENT
BE IT ORDAINED by the Town Council of the Town of Pulaski, Virginia.,
sitting in regular session on the 7th day of October, 1986, that the
Town Motor Vehicle Code be, and hereby is, amended by the addition of
Section 16.1-213, in the following form:
Section 16.1-213. Exemption for Volunteer Firefighters
and Auxiliary Police Officers.
In addition to any other fee or expense payments to which volunteer
firefighters and auxiliary police officers are entitled, each such
firefighter or police officer shall be entitled to one (1) free Town
license tag on such firefighter or officer's automobile without pay-
ment of the license tax imposed by this article.
The Town Manager is authorized to designate from time to time whether
a special decal or license plate shall be used to designate such
vehicles, or if the standard Town license decal will be issued without
charge.
The Town Treasurer is authorized and directed to issue the decal or
license so designated to such volunteer firefighters and auxiliary
police officers as are certified by the Fire Chief and Chief of
Police respectively.
PROVIDED, HOWEVER, that nothing contained herein shall authorize a refund
of Town license taxes paid prior to the enactment of this Ordinance.
This Ordinance is effective upon its adoption and is adopted this 7th day
of October, 1986.
Chairperson Copenhaver advised the committee was reviewing a loitering
ordinance, and also had for Council's consideration an ordinance keeping of
inoperable automobiles on property zoned for residential, commercial, or
agricultural purposes. Mr. Terwilliger summarized the ordinance.

October 7, 1986, seconded by Councilman Glenn and carried on the following

ORDINANCE ORDINANCE.
INOPERABLE
VEHICLES BE IT ORDAINED by the Town Council of the Town of Pulaski, Virginia,
sitting in regular session on the 7th day of October, 1986, that 16.1-
401 of the Town Code be, and hereby is, amended to read as follows:
Sec. 16.1-401. Keeping of Inoperable Automobiles on Property Zoned
for Residential, Commercial, or Agricultural Purposes.
(a) It .shall be unlawful for any person, firm, or corporation to keep,
except within a fully enclosed building or structure or otherwise shielded
or screened from view, on any property zoned for residential or commercial
or agricultural purposes, any motor vehicle, trailer or semi-trailer, as
such are defined in Section 46.1-1 of the 1950 Code of Virginia, as
amended, which is inoperative. As used in this section, an "inoperative
motor vehicle" shall mean any motor vehicle which is not in operating
condition; or which for a period of 60 days or longer has been partially
or totally disassembled by the removal of tires and wheels, the engine or

other essential parts required for operation of the vehicle, or on which
there are displayed neither valid license plates nor a valid inspection
decal. However, the provisions of this section shall not apply to a
licensed business which on June 26, 1970, was regularly engated in business
as an automobile dealer, salvage dealer, or scrap processor.
Violation of this subsection is punishable as a Class 3 Misdemeanor.
(b) It is further provided that:
(1) The owners of property zoned for residential or commercial or agricul-
tural purposes shall, within 14 days of a mailing of a notice by the Town
or its agent to the owner of the property, remove therefrom any such
inoperative motor vehicles, trailers, or semi-trailers that are not kept
within a fully enclosed building or structure;
(2) In the event that the owner of the premises, after such notice, has
failed to do so, the Town through its agents or employees may remove any
such inoperative motor vehicles, trailers, or semi-trailers;
(3) In the event the Town through its agents or employees removes any such
motor vehicles, trailers, or semi-trailers, after having given such reasonable
notice, .the Town may dispose of such motor vehicles, trailers, or semi-
trailers after giving additional notice to the owner of the vehicle;
(4) The cost of any such removal and disposal shall be chargeable to the
owner of the vehicle or the premises, and may be collected by the Town as
taxes or levies are collected; and,
(5) Every cost authorized by this section with which the owner of the
premises has been assessed, shall constitute a lien against the property
from which the vehicle was removed, the lien to continue until actual
payment of such costs has been made to the Town.
This Ordinance is effective upon adoption and is adopted this 7th day
of October, 1986.
Chairperson Copenhaver stated the committee discussed the adoption of the
BUILDINGVirginia Uniform Statewide Building Code, Volume II, Building Maintenance Code
CODE 1884 Edition and what the advantages this building code would have for the Town.

Mr. Terwilliger summarized this ordinance.
Chairperson Copenhaver moved that the ordinance to re-enact the Virginia
Uniform Statewide Building Code be adopted, effective October 7, 1986, seconded
by Councilman Glenn and carried on the following recorded vote:

ORDINANCE
TO RE-ENACT .THE VIRGINIA UNIFORM STATEWIDE BUILDING CODE
BE IT ORDAINED by the Town Council of the Town of Pulaski, Virginia,
sitting in regular session on October 7, 1986, that to the extent not previously
enacted, the Virginia Uniform Statewide Building Code, including both volume
I and II (Building maintenance Code), be and hereby are, enacted, in the form
of the 1984 Edition as amended through October 1, 19$6.
BE IT FURTHER ORDAINED that future amendments to said Virginia Uniform
Statewide Building Code shall be considered to be adopted by this Council in
the absence of action overruling said amendments.
This Ordinance is effective upon adoption, and is adopted this 7th day of
October, 1986.
Chairperson Copenhaver advised the committee had discussed finalizing several
changes in the Personnel Policy, particularly the grievance procedure which needs
to be updated at least once a year according to state law.
Committee has also reviewed the Historic Zoning Ordinance. Final draft
is being forwarded to the Planning Commission, After their review, it will then

come before Council.
Committee also discussed financing out of town water and sewer extensions
and this should now be reviewed by the Finance Committee.
Chairperson Copenhaver advised that next year notification would be sent
to all Town residents reminding them when their Town tags are due.
TOWN ATTORNEY'S REPORT
Mr. Terwilliger presented ordinance and deed conveying a 0.32 acre lot on
Newbern Road in the Town of Pulaski to New River Valley Habitat for Humanity,
Inc. and summarized the ordinance and conditions in the deed.

BE IT ORDAINED by the Town Council of the Town of Pulaski, Virginia,
sitting in regular session on 7th day of October, 1986, that a 0.32 acre
lot or parcel of land, being portions of lots Numbers 11, 12, 13 and 14,
of Mashburn Subdivision, in the Town of Pulaski, Virginia, be conveyed
to the New River Valley Habitat for Humanity, Inc.
BE IT I7URTHER ORDAINED that conveyance of said lots shall be by deed of
Special Warranty in the form attached hereto, and shall be subject to
the conditions set forth in said deed.
BE IT FURTHER ORDAINED that Vice-Mayor James R. Neighbors, be and hereby
is, authorized and directed to execute said deed on behalf of the Town
and to deliver the same to the Grantee.

Mr. McKeever stated that recently we participated in a study with the State
NEW RIVER Water Control Board on the New River Basin Water Supply Plan. This study

CONT. PLAN identified water problems and supply problems through the year 2030. The State
Water Control Board has requested that the Town adopt a resolution agreeing that
the recommendations appear to be reasonable and plan that they have drawn should
be used as a guide for any water supply implementation program undertaken by
the Town.

RESOLUTION
WHEREAS the Virginia Water Control Board is developing water supply plans
for each river basin in the State; and
WHEREAS the Virginia Water Control Board has developed a draft of the
New River Basin Water Supply Plan; and
WHEREAS Town of Pulaski has had the opportunity to provide input and
comments into the planning process through a local representative on an
advisory committee; and
WHEREAS Town of Pulaski agrees with the general concepts and recommenda-
tions presented in the Plan for the Town of Pulaski's service areas;
RESOLVED, that Town of Pulaski agrees that the recommendations appear
to be reasonable and that the plan should be used as a guide for any
water supply implementation program undertaken with the Town of Pulaski's
service areas.
This Resolution is effective upon adoption and is hereby adopted this
7th day of October, 1986.
ANNEXATION Events occurring on November 3, 1986 are as follows:
8:30 a.m. -Bus tour for the Commission on Local Government members.
10:30 a.m. - The Town and County will make oral presentations before the
Commission at-the Appalachian Power auditorium.
8:00 p.m. -Public hearing at the Pulaski Middle School on Pico Terrace
Drive.
COUNCIL As the first meeting in November falls on Election Day, Council meeting

Councilman Neblett made a motion that the November 4, 1986, meeting of Council
be changed to November 5, 1986, seconded by Councilman Graham, and carried.
MEAL'S Mr. McKeever advised the Town collected $9,665.83 in Meals Tax for the month
TAX of August. This would be equivalent to $115,989.96 annually.
Mr. McKeever advised that the one-way traffic on Main Street was still
understudy.
Councilman Johnston made a motion that Council go into Executive Session
under 2.1-344, (A6), seconded by Councilman Neblett and carried. Councilman Glenn
voted no'to this motion.
At 4:30 p.m., Council went into Executive Session.
Mayor Hancock arrived at Council meeting at this time.
At 5:30 p.m., Council returned to Regular Session.
Mayor Hancock advised he had received a letter and packet from Mayor Geering
of New Zealand.
At 5:36 p.m. Council adjourned on motion made by Councilman Neblett, seconded
by Councilman Glenn and carried.
