April 21, 1981, which would raise license rates by .01~ where applicable
and to the maxium flat rate as recommended by the State of Virginia
guidelines, to become effective May 1, 1981. Motion was seconded by
Councilmember Graham, and carried on the following vote:

held April 21, 1981 at 7:00 P. M. in the Council Chambers in the
Municipal Building.

The invocation was given by Councilmember Neblett.
The minutes of the regular meeting of April 7, 1981 were approved
as recorded.
Mayor Ratcliff advised that, as had been advertised in the local
newspaper, the Town Council would now hold its public hearing on the

ON CABLE TV request from Cablentertainment of Virginia, Inc., owner of Pulaski
RATE INCREASE
CATV Franchise, for authorization to increase certain rates now
charged by the Pulaski CATV System.
William R. Randles of Cablentertainment of Virginia, advised
the Company was asking the Council to allow an increase of 50C per

EXPLAINS month in Cable TV rates, to be followed by an increase over the

RATE INCREASE next three years not to exceed 50G. He stated increases would be
based on Consumer Price Index and would not exceed, but could be
less, than 50~ on June 1 of each year.
Mr. Randles advised that changes planned for deletion and
addition of channel net works, as given to the Town Council on April 7,
1981, would remain the same with the exception of deletion of Channel
12. However, due to the complaints received from subscribers since
that meeting, the Company had decided not to delete Channel 12 out of
Winston-Salem, but split Channel 3 where Home Box Office is now seen
This would mean the Christian net work could be seen from 2 AM to 2 PM.

A resolution was presented and read to the Council, and Council-
member Aust moved the adoption of the Resolution approving the 50C rate
increase request of Cablentertainment of Virginia, Inc. Motion was
seconded by Councilmember Holston.

Substitute motion by Councilmember Graham - the matter of approving
the rate increase as requested by Cablentertainment of Virginia, be
placed on the agenda for the next Council meeting. Motion was seconded
by Councilmember Boyd.

WHEREAS, Cablentertainment of Virginia, Inc., a Virginia
corporation, owner of Pulaski CATV Franchise, has heretof ore
petitioned the Council of the Town of Pulaski, Virginia, for
authorization to increase certain rates now charged by the Pulaski
TV Cable System; and
WHEREAS, the Council held a public hearing at 7:00 o'clock
P. M., on the 21st day of April, 1981, upon the proposed rate
increase and has given mature consideration to the petitioner's
request; and
WHEREAS, the Council of the Town has determined that the rates
requested are fair and reasonable and are designed to meet necessary
costs of the service, including a fair rate of return on the net
evaluation of the properties devoted to the said system.
NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of
Pulaski, Virginia, meeting in regular session on this 21st day of April,
1981, that:
Cablentertainment of Virginia, Inc., owner and operator of the
Pulaski TV Cable System, be, and they are hereby authorized to charge
and collect rates not to exceed the scheduled rates which are attached
hereto and designated "Schedule 1.3" to be attached to the Franchise
Agreement in place of the present "Schedule 1.2", which "Schedule 1.3"
shall remain in effect until changed or modified in accordance with the
standards set out in Section 24 of the Franchise Agreement or other
applicable provisions of said franchise or regulations.
BE IT FURTHER RESOLVED that a certified copy of "Schedule 1.3" be
transmitted to the Cablentertainment of Virginia, Inc., Pulaski Office
for their authority to increase rates, and that CATV give due publicity
thereto.

Council held a public hearing, as had been advertised in the
local newspaper, on amending .the the License Tax rates and certain other
provisions of the Pulaski License Tax Code. Mayor Ratcliff asked the
proposed ordinance be read by Town Attorney Moore.
PUBLIC HEARING
RE~ LICENSES After the reading of the proposed ordinance Mayor Ratcliff
advised that, if adopted, only a very small increase would be imposed
to take care of the flat rates and percentages as recommended by the
State of Virginia guidelines.
No one appeared to speak for or against the adoption of the
ordinance.
On motion of Councilman Wallace, seconded by Councilmember Boyd,
the Ordinance, as read, was adopted, on the following vote:

II. State License Tax Rate - set by the Code of Virginia
as amended
In any specific category in which no license fee is provided
above, the license tax shall be for that category the rate established and
provided in the Code of Virginia as amended.
The Town Treasurer in 'interpretation of the Town License
Code shall apply the definitions, limitations and provisions contained
in Title 58 of the Code of Virginia as amended in all instances
where the provisions of the Pulaski Town License Code is in conflict
therewith.
iII. Provisions of the Town License Tax Code
All provisions of the present License Tax Code :,,now in
effect within the Town and not herein amended or repealed, are hereby
re-enacted and shall be enforced until changed by appropriate action
of the Council.
This Ordinance shall become effective on the 1st day of
May, 1981.
Town Manager Coake advised there had been received a request

Councilmember Johnston stated for the purpose of discussing this
further, he would second Mr. Wallace's motion.
After further discussion, Mr. Graham withdrew his original
motion and Mr. Wallace withdrew his substitute motion.

Councilmember Johnston advised that the Committee had no report
at this time.
RECREATION CO MMITTEE:
Councilmember Mitchell reported that the Recreation Commission
and the Recreation Committee met April 15th with Recreation Director Ned
Bane, and the possibility of the Recreation Department being in charge of
the softball tournaments and the concession stand at Loving Field was
discussed. It was the consensus of those present that the funds from this

In an effort to increase Town revenue, Councilmember
Wallace proposed a relocation of Town boundaries to include the
businesses and area on Route 99 to Bob White Boulevard. Mr.

be annexation, but merely relocating the boundaries if the County
is agreeable.

Councilmember Boyd advised that at the last Council meeting
the construction of a Gazebo in Jackson Park was referred to the Land
& Building Committee, and stated the Committee had considered this
project and the Committee would like to express appreciation to the
Senior Citizens, who have shown an interest in their community and
supported this project; that it was the understanding of the Committee

Jackson Park as designated by the Town Council. Mr. Boyd advised

that the assistance of the Treasurer/Finance Director would be offered
to accept and record contributions for this project and to deposit these
funds in order to obtain the highest available interest rate. Also,
as could be scheduled, limited supervisory assistance of the town staff
in the design and construction of the Gazebo, would be available. Mr.
Boyd stated the Town would reserve the right to give final approval
to the project and to approve the plans for the Gazebo and any revision

of the plans. A building permit could be issued when sufficient funds
have been collected to purchase the materials, and the Town Building
Inspector will inspect the structure during construction and the person
in charge of the construction will be responsibile for notifying the
Building Inspector when inspections are necessary. Mr. Boyd stated that
if the Council is agreeable to these recommendations, representatives
of the Senior Citizen Advisory Council should be requested to meet with the
Land & Building Committee to review the proposed project, and so moved.
Motion was seconded by Councilmember Wallace, and carried.
Mr. Boyd asked that this item be placed on Council's agenda for
the May 5, 1981 meeting.

Mr. Boyd also reported the Land & Building Committee
considered the A-95 Review Comment Process concerning the apartment
project located at 230 North Washington Avenue, referred to as
"The Atrium". A building permit has been issued for this

COMMISSION recently considered other proposals for apartments with Section 8
Rent Subsidy, and did not support 'those proposals because of the
concern with the large number of Rent Supplement Apartments presently
located .within the Town; the number of people who occupy these apart-
ments that move here from other areas, and the concentration of low-and-moderate
income families which is not consistent with Federal Guidelines of
providing dispersal by income. Mr. Boyd stated the Committee felt the
letter to the Pla nning Commission should state the Town of Pulaski would
not oppose this project because it is the understanding of the Town
that only elderly, handicapped and disabled persons will occupy the
building. Mr. Boyd stated each member of the Council had received a
copy of a draft letter which Town Manager Coake will forward to the
Planning Commission.,

The Committee discussed whether the study should cover all three
options, i.e. Consolidation; Annexation or Creation of City. The
Committee agreed that advertisement for soliciting proposals from
Consulting Firms should appear in the Richmond Times Dispatch and the
Roanoke Times, and returned to the Town Manager's Office for the Town
of Pulaski no later than May 26, 1981, with inquiries being directed
to Mr. Coake, Mr. Sidney A. Clower, or Mayor Julian McMillian, Dublin.
