There were present: Mayor Raymond F. Ratcliffk, presiding. Councilmen: C. E. Boyd, Jr., James M. Neblett, Jr., Robert M. Wallace, Andrew L. .Graham, Jr., Blair B. Brockmeyer, Arthur L. Meadows, William A. House, John A. Johnston Also present: H. R. Coake, Assistant Town Manager Gladys R. Dalton, Clerk Garnett S. Moore, Town Attorney Roger A. Williams, Town Treasurer Visitors: Dave Vascek, and Jane Graham of the news media Eugene L. Nuckols, Ms. Mary Cox and Ben Tate, Members of the Downtown Renovation Committee The invocation was given by Councilman Brockmeyer. The minutes of April 15, 1980 were approved as recorded. The first order of business was the holding of public hearings on trailer applications of James J. Turman and Harman A. Webb, as had PUBLIC HEARINGS been advertised in the local newspaper. No one appeared regarding either WEBB & of the applications. TURMAN TRAILER Assistant Town Manager Coake advised that James J. Turman had APPLICATIONS applied to the Council for a permit to place a mobile home on Lot 3, Section 3 of the Villamont Addition, which lies on Baywood Street. Mr. Coake gave a detailed report of an investigation by the Engineering Department, and advised that the Engineering Department contacted owners in the vicinity of the proposed trailer and received objections from three people who asked that their names not. be mentioned in the public meeting. Inasmuch as it is Council's policy not to approve trailer applications where there are objections, Councilman Neblett moved that TURMAN the matter be tabled until the matter of the three objectors could be APPLICATION TO BE HELD solved. Motion was seconded by Councilman House, and carried. IN ABEYANCE UNTIL 3 Assistant Town Manager Coake then presented the application OBJECTORS CONTACTED of Harman A. Webb, who desired to place a mobile home on Lot 8 of the C. C. abell Subdivision, and gave a full report to the Council which included the fact that there is presently a trailer on this lot and that Mr. Webb wishes to connect the two trailers and form a double-wide mobile home. There were no objections from property .owners. ~]~~~~~ May 5, 1980 Councilman Brockmeyer moved that the application of HARMAN WEBB Harman A. Webb be granted for sin gle family occupancy only. Neblett, Jr. Aye Mr. Eugene Nuckols, Vice Chairman of the Downtown Renovation Committee, advised Council that the Committee appointed by the Council had been quite busy since its appointment, and upon receiving approval from the Council of the concept, prepared and mailed out re- quests for proposals to different firms that is ~aas.f~lt would be able to handle the project. Mr. Nuckols advised that three (3) proposals were received, and each firm was asked to come to Pulaski for an interview. Mr. Nuckols advised the three proposals received were from EUGENE Wiley & Wilson, VVRK Associates in Roanoke, and Babcock & Schmid of NUCKOLS Bath, Ohio. REPORTS Mr. Nuckols further advised that after the interviews were TO COUNCIL completed the Downtown Renovation Committee met and discussed further ON DOWNTOWN the Proposals, and it was the recommendation of the Committee that the RENOVATION firm of Babcock & Schmid be recommended to the Town Council as the PROPOSALS best firm, in their opinion, to prepare the Master Plan for the re- & novation of the downtown area in Pulaski. COUNCIL Mr. Nuckols gave Council a detailed report of the proposal FAVORS of Babcock & Schmid as presented by its representative, Mr. Brewster. Mr. Nuckols advised the three proposals presented were as follows: Babcock & Schmid $47,500; Wiley & Wilson $27,500; and VVRK Associates of Roanoke $37,500. Councilman Neblett moved that the proposal submitted by Babcock & Schmid of Bath, Ohio, in the amount of $47,500 on the down- town renovation project, be accepted. Motion was seconded by Councilman House. There followed a full discussion by the Council and members of the Downtown Renovation Committee in which it was brought out that Babcock & Schmid of Ohio was the successful bidder in the Winchester ,+ Virginia downtown renovation project, and that Town Manager Marshall had made inquiries relative to this, and Councilman Boyd stated he felt that Mr. Marshall's report should be heard and considered before making a decision on which proposal to accept. r- ~~ U May s, 19so BOYD FAVORS REPORT Mr. Boyd made a substitute motion that this project be OF TOWN MGR. ON RENOVATI4ontinued until Town Manager Marshall returns and gives Council a first- N - hand report on what he has found out about the Winchester job. Johnston - Aye James M.Neblett, Jr. - Aye Councilman Graham, Chairman of the Utilities Committee, asked EXECUTIVE that an executive session be held on a legal matter at the conclusion of SESSION the Council meeting. In answer to an inquiry from Councilman Graham, Assistant Town WINDSOR Manager Coake advised that the Windsor Circle sewer project should have CIRCLE .~r- SEWER gotten underway that morning. UNDERWAY Councilman Graham, as a representative of the Town on the New River Valley Planning District Commission, stated there should be some COMMENTS policy established concerning comments on A-95 projects where it affects TO BE MADE ON A-95 the town and the community. PROJECTS Councilman Brockmeyer reported that the Recreation Committee met and discussed Gatewood Camping Site and the Reservoir. He advised that last year the Town lost two or three thousand dollars because of the change in the policies concerning rental of the camping area. Mr. Brock- meyer reported it was the feeling of the Committee that the $3.50 per day fee remain, but should a party wish to camp for four weeks, they be required to pay for only three weeks and the fourth week would be free. COUNCIL The Committee also felt the same opening and closing dates should be ADOPTS RECOMMENDATIOIj~aintained. He stated there was also discussion regarding additional OF RECREATIONfishing on the lake and the possibility of stocking the lake. COMM. RE: GATEWOOD Councilman Brockmeyer moved the adoption of the Recreation CAMP RENTAL Committee's recommendation. Motion was seconded by Councilman Neblett. During the discussion that followed, the motion and second were with- drawn. Councilman Brockmeyer moved that a charge of $73.50 per month be maintained for camping at Gatewood Camp site, and there be no change in the rate of $3.50 per day. NOW COMPLETE EXPLORING SPACE FOR LITTLE LEAGUE BALL STREET COMM. TO LOOK AT SITUATION AT KERSEY BOT. DURING HEAVY RAINS Councilman Brockmeyer reported the change in the 980-1000 telephone system has now been completed whereby all calls coming thru that number would be handles in the Police Department after 5 P. M, each day. Councilman Brockmeyer also reported that space for practice fields for Little League Baseball is now being explored. Councilman Wallace reported that at the last meeting of Council several Plant Street citizens complained of not being able to get in and out of their property during heavy rains, and this was referred to the Street Committee. Mr. Wallace advised that he and Mr. Early had looked at the situation and Mr. Early feels he has a plan for correcting this situation. Councilman Johnston had no report. Councilman House reported it was necessary to appropriate the $1,604.87 APPROPRIATED FOR UNEMPLOY- MENT INS . amount of $1,604.87 from General Fund Unappropriated Surplus to Account No. 190-211.6 for Virginia Unemployment Compensation Insurance to the State for funds paid during the quarter ending March 31, 1980, and so moved. Johnston - Aye James M.Neblett, Jr. - Aye Councilman House advised that in the present budget there is $90,000 RESTRICTED FOR BOND RETIREMENT RE: STREET COND OBLIGA- TION a line item of $100,000.00 for Street Bond Redemption, and these funds are presently invested in money market certificates at 13% interest which will mature in August of this year. Mr. House adivsed further that Council needed to restrict the amount of $90,000.00 for the purpose of retirement of street bond obligations, and so moved. Johnston - Aye James M.Neblett, Jr. - Aye ossl~ May 5, 19so Councilman House advised that Council will need to hold a public hearing on the Real Estate Tax increase, and in order to meet all legal publication requirements, moved that the public hearing be scheduled for June 16, 1980 at 7:00 P. M. and the proper newspaper publication appear in the local newspaper on May 7th and May 14th, 1980, with such publication to read as follows: "Take Notice that the Pulaski Town Council will hold a Public Hearing at 7:00 P. M. on the 16th day PUBLIC HEARING of June, 1980 in the Council Chambers of the Municipal Building of the RE:TAX RATE Town for the purpose of increasing Real Estate Tax rate levies by 25%. INCREASE Individual property taxes may, however, increase at a percentage greater than or less than the above percentage, pursuant to Section 58-785.1 of the Code of Virginia". Moore to read the proposed ordinance which would enact a Bank-Franchise Tax for the Town of Pulaski, in accordance with Section 58-485.01 of the Code of Virginia, as amended. The ordinance was read by Town Attorney Moore, and on motion of Councilman House, seconded by Councilman Meadows, and carried on the following vote, the following ordinance was adopted: Andrew L. Meadows - Aye James M.Neblett, Jr.- Aye AN ORDINANCE TO ENACT A BANK-FRANCHISE TAX FOR THE TOWN OF PULASKI, VIRGINIA; TO PROVIDE THE EFFECTIVE DATE OF THIS ORDINANCE, AND A PENALTY FOR FAILURE TO COMPLY WITH THE ORDINANCE BE IT ORDAINED by the Council of the Town of Pulaski, Virginia, meeting in regular session on this 5th day of May, 1980, that: There is hereby imposed a Bank Franchise tax on all banks as defined in Sec. 58-485.01 of the Code of Virginia of 1950, as amended, located within the corporate limits of the Town of Pulaski, Virginia, and on all branch extensions or affiliates of banks located within the corporate limits of the Town with principal offices located outside the corporate limits of the Town, the proceeds therefrom shall be paid unto the General Fund of the Town for its support, for payment of the Town debt and interest, and for any other municipal purposes and expenses. 06619 May 5, 1980 Town of Pulaski, Virginia, Bank Franchise Tax Section 1. Definitions. For the purposes of this ordinance, the following words shall have the meaning ascribed to them by this section: A. "Bank" shall be as defined in Section 58-485.01 of the. Code of Virginia. B. "Net Capital" shall mean a bank's net capital computed pursuant to Section 58-485.07 of the Code of Virginia. Section II. Imposition of Town Bank Franchise~Tax. A. Pursuant to the provisions of Chapter 10.01 of Title 58 of the Code of Virginia, there is hereby imposed upon each bank located within the boundaries of this town a tax on net capital equalling 80% percentum of the state rate of franchise tax set forth in Section 58-485.06 of the Code of Virginia. BANK-FRANCHISE B. In the event that any bank located within the boundaries of this town is not the principal office but is a branch extension or TAX ORDINANCE affiliate of the principal office located outside the corporate limits hereof, the tax upon such branch shall be apportioned as provided by Section 58-485.012 of the Code of Virginia. CONTINUED Section III. Filing of Return and Payment of Tax. A. On or aflter the first day of January of each year, but not later thab March 1 of any such year, all banks whose principal offices are located within this town shall prepare and file with the Town Treasurer a return as provided by 6ection 58-485.013 of the Code of Virginia in duplicate which shall set forth the tax on net capital computed pursuant to Chapter 10.01 of Title 58 of the Code of Virginia. The Treasurer.. shall certify a copy of such filing of the bank's return and schedule and shall forthwith transmit such certified copy to the State Department of Taxation. B. In the event that the principal office of a bank is located outside the corporate boundaries of this town and such bank has branch offices located within this town, in addition to the filing requirements set forth in Section A hereof, any bank conducting such branch business shall file with the Treasurer of this Town a copy of the real estate deduction schedulQ, apportionment and other items which are required by Section 58-485.012, 58-485.013 and 58-485.014 of the Code of Virginia . C. Each bank, on or before the first day of June of each year, shall pay into the treasurer's office of this town all taxes imposed pursuant to this ordinance. Section IV. Effective Date of Ordinance. The provisions of this ordinance shall be effective for the year beginning January 1, 1980. Section V. Penalty upon Bank for failure to comply with Ordinance. Any bank which shcali fail or neglect to comply with any provision of this ordinance shall be fined not less than one hundred nor more than five hundred dollars, which fine shall be recovered upon motion. after five days' notice in the circuit court of this locality. The motion shall be in the name of the Commonwealth and :shall be presented by the attorney for the County of Pulaski, Virginia. An emergency exists and this Ordinance shall become effective upon passage. May 5, 1980 oss~o Councilman Boyd advised that he felt the Town was losing considerable UTILITY & FINANCE COMMS . TO LOOK AT LOSS OF WATER & SEWER REVENUE BY MOVING INTO COUNTY revenue because of businesses moving outside the corporate limits, and moved that the Town's outside corporate limits water and sewer rates be referred to the Utility and Finance Committees for study and a report to the Council. Johnston - Aye INCINERATOR FOR SOLID WASTE TO BE CONSIDERED Wzlliam A. House - Aye C. E. Boyd, Jr. - Aye Arthur L. Meadows - Aye James M. Neblett, Jr. - Aye Councilman Boyd advised the possibilities of an Incinerator for the Town's solid waste had been investigated and it now appeared that the next step would be a presentation tot he Council. Councilman Boyd inquired if work had begun on the Entrance Sign for Route 11, and was advised by Mr. Coake that a meeting on the RT. 11 ENTRANCE SIGN REPORT site was held recently with representatives of the Sunset Garden Club, and it was hoped to get an easement from Mrs. Wyatt for a better location. Councilman Boyd also asked the Administration to see what could be STORM DRAIN done about the water running in the basement of the New Hope Baptist INTO CHURCH BASEMENT Church on Case Knife Road. This complaint having been brought to CASE KNIFE ROAD Council's attention several meetings ago. Councilman Meadows had no report for the Ordinance Committee. Mr. Meadows reported he had been approached by residents, who asked that the alley that provides entrance to their homes on 16th street be STREET C~MM TO CONSIDER cleaned up. Councilman Meadows moved that the request be referred CONDITION OF 16th ST, to the Street Committee for report to Council. Motion was seconded by Alley Councilman House, and carried. Councilman Neblett had no report. Mayor Ratcliff advised that notice had been received of the 1980 AP,C'o . FUEL FACTORFuel Factor proceedings for Appalachian Power Company. Notice was LTR. FILED received and filed. Town Attorney Moore advised that Notice of Application to-.the 13TH STREET Town Council of the Town of Pulaski, Virginia, for vacation of a certain ALLEY CLOSING PETITION & alley located within the Town of Pulaski as provided for in Section FILED 15.1-364 of the Code of Virginia, as amended, filed by Petitioners 0661 May 5, 1980 Calvin A. Roseberry and Irene H. Roseberry and Janie H. Hancock, had been posted by the Sheriff's office, as required. Mr. Moore presented the petition of the petitioners, and on motion of Councilman Graham, seconded by Councilman House, the Petition was received and filed on the following vote: Andrew L. B, as shown on the Revised Map of Montclair Addition to the Town, said lot owned by petitioners Roseberry; thence with the east line of the Roseberry property North 2 deg. 00' East 135.05 feet to the sotth boundary line of a 1Q-foot alley; thence therewith South 88 degs. 00' East LO feet to the north west corner of Lot No. 33, South 2 degs. 00' West 135.05 feet to the north line of Thirteenth Street; thence therewith North 88 degs. 00' West 10 feet to the point of Beginning. Hancock, Calvin A. Roseberry, and Irene H. May 5, 1980 06624 Town Attorney Moore presented and read to Council an Ordinance to amend and re-enact, as amended, Section 58 of the License Tax Ordinance t of the Town of Pulaski, establishing a License Tax for Undertakers. Councilman Neblett moved, seconded by Councilman Graham, that the Ordinance, as read, establishing a license tax for Undertakers be adopted. The following vote was taken: Andrew L. Neblett, Jr= Aye ORDINANCE RE: LICENSE TAX FOR UNDERTAKERS AN ORDINANCE TO AMEND AND RE-ENACT AS AMENDED, SECTION 58 OF THE LICENSE TAX ORDINANCE OF THE TOWN OF PULASKI, VIRGINIA, ESTABLISHING A LICENSE TAX FOR UNDERTAKERS BE IT ORDAINED BY the Council of the Town of Pulaski, G Virginia, meeting in regular session on this 5th day of May, 1980, that': Section 58 of the Town License Ordinance be amended as follows: Section 58: Undertakers On every undertaker, embalmer or funeral director, there shall be a license tax of Thirty Dollars ($30.00) or Thirty-two Cents (.32) per $100.00 of gross receipts, whichever is higher. This Ordinance shall become effective upon passage. ~J 06625 May 5, 1980 Assistant Town Manager Coake advised Council that the Town may be eligible for Grant funds for various projects through the Urban Development Action Grants program administered by the Department of Housing and Urban Develop- ment upon submitting applications to HUD to determine the Town's eligibility for the program. Johnston - Aye James M.Neblett,Jr. Aye FOR HUD GRANTS UNDER URBAN RESOLUTION DEVELOPMENT WHEREAS, the Urban Development Action Grant Program of ACTION GRANTS PROG. the United States Department of Housing and Urban Development provides for funding of eligible projects that: L. Promote public and private section partnerships to overcome problems of development; 2. Assist distressed areas in revitalizing their stagnating economics; 3. Johnston - Aye James M.Neblett, Jr. - Aye 066~~ May 5, 1980 RESOLUTION WHEREAS, the Town of PUlaski and the Town of Dublin, Virginia, two members of the Pepper's Ferry Regional Wastewater Treatment Authority, have reached an agreement upon the participation of the respective Towns in the construction, op~ration and maintenance, and the division of the revenue, of the sewer line from Pulaski to the Pepper's Ferry Regional Wastewater Treatment Authority equalization basin at or near the Fairlwan Sewer Treatment Lagoons; and WHEREAS, under this agreement, the Town of Pulaski will pay all the cost of construction, operation and maintenance of the pressure line from the pumping station at the site of the present Pulaski Sewerage PEPPERS FERRY Treatment Plant, to the Town of Dublin's Sewerage Treatment Plant, and will accept by contract waste water, including that from established RESOLUTION BET. collection systems at designated locations along the line, and will receive all revenue from such users. The two Towns will share jointly TOWN OF PULASKI the cost of the construction, operation and maintenance on the gravity flow line from the Dublin Sewerage Treatment Plant to the Pepper's Ferry & TOWN OF DUBLIN Regional Wastewater Treatment Plant equalization basin, and will accept by contract waste water, including that from established collection systems piped to the line, with both costs and revenue shared on the basis of 80% by Pulaski and 20% by Dublin; and WHEREAS, it is understood that the line from Pulaski to Pepper's Ferry Regional Wastewater Authority equalization basin shall not be less than is presently designed; and WHEREAS, both Towns agree that they shall give to the Pepper's Ferry Regional Wastewater Treatment Authority, the Virginia State Water. Control Board, and other governmental agencies requesting same, a Letter of Intent stating the above agreement, and thereafter will enter into and execute such contracts as they deem necessary for the Towns' joint participation in the project. NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Pulaski, Virginia, meeting in regular session on the 5th day of May, 1980, that: L. The terms of the agreement between the Town,of Dublin and the Town of Pulaski, Virginia, as hereinabove set out, BE, and they are hereby ratified and approved, and the Mayor of Pulaski is author- ized and directed to advise the Town of Dublin of the adoption of this Resolution, and to join with Dublin in preparing a Letter of Intent to the Pepper's Ferry Regional Wastewater Treatment Authority and the Virginia State Water Control Board advising that Dublin and Pulaski have agreed to construct, operate and maintain the sewer line from the site of the present Pulaski Sewerage Treatment Plant to the Pepper's Ferry Regional Wastewater Treatment Authority's equalization basin under the terms stated in this Resolution. The Mayor is further, authorized to sign the Letter for and on behalf of the Town of ,Pulaski, and after the "Letter of Intent" has been signed by both Towns, it shall, together with a certified copy of this Resolution, be forth= with delivered to the Pepper's Ferry Regional Wastewater Treatment Authority, the Virginia State Water Control Board, and to such other governmental agencies who request same, or to others designated by the Mayor of Pulaski. The Towns have further agreed to accept wastewater PEPPERS FRY. at designated locations on the line, including wastewater from established collection systems by contract with the users, and to ECT. share the revenue derived from such outside users of said line. Under the agreement Pulaski will pay all the costs of construction and the line from Pulaski to Dublin and receive all revenues from outside users from that portion of said line, and Pulaski and Dublin will jointly pay all the costs of construction, operation and maintenance on the gravity flow line from Dublin to the Peppers Ferry Regional Wastewater Treatment Authority's equaliza- tion basin, and will accept wastewater at the line, including waste water from established collection systems, and shall share costs and revenue from such outside users on the basis for both costs and revenues of 80% for Pulaski and 20% for Dublin. Contracts between Dublin and Pulaski containing the details under which the two Towns will carry out the basic terms set out in their respective Resolutions will be considered and entered into at the appropriate time as they deem advisable.
