Minutes of the regular meeting of the Pulaski Town Council
held July 15, 1980 at 7:00 P. M, in the Council Chambers in the
Municipal Building.

The invocation was given by Councilmember Johnston.
The minutes of the regular meeting of July 1, 1980 and
special meeting of July 2, 1980 were approved as ame~-ded~:.
Mayor Ratcliffe advised this was the time and place, as
had been advertised in the local newspaper, for Council to hold a
public hearing to consider the petition of W. L. Tate, Kalima D. Tate,
PUBLIC HEARING and New River Oils, Inc., for the closing of two alleys located in

AS REQUESTED
BY TATE & Town Attorney Moore advised that the Petition and Notice
NEW RIVER OILS
had been accepted and filed by the Council at its June 17, 1980
meeting, and the Council adopted a Resolution naming the viewers and
alternates. Mr. Moore reported that the Viewers: Curtis C. Jordan.,.
Warren J. Bain and Daniel C. Bell met on July 14th and went upon
the property and after being instructed by written instructions,
filed their report indicating that it will not cause any inconvenience

Viewers are hereby instructed by the Town Attorney as follows:
(1) That your appointment was made by the said Town under
authority granted in Title 15.1-364 of the Code of Virginia of 1950,
as amended, and any and all other general powers granted said Town.
(2) That as viewers appointed by said Town, you are instructed
to view the alleys described as follows:
ONE: An eleven foot alley running north and south through
a portion of Block 115 along the western side of Lots 16
through 25 in Block 115 as shown on the map referred to
as The Official M~ of the Town of Pulaski, Virginia.
INSTRUCTIONS
TWO: An alley of various widths running east and west
TO VIEWERS from LaGrange Street to Lake Street at the northern
terminus of the eleven foot alley described above;
All as shown on a revised plat showing the survey of
- property of L. A. Dunlap, prepared by E. H. Millirons,
dated December 23, 1946, a copy of which is attached
hereto.
(3) You shall determine by your view and your evaluation
thereof whether or not any inconvenience would be caused by the
closing of the alleys described above, and if any, what inconvenience
would result and to whom by abandoning and vacating the said alleys
as a part of the system of public ways of the Town of Pulaski, Virginia.
(4) To report in writing your findings as above instructed
in this matter to the Council of the Town of Pulaski, Virginia.
This report is to be filed as soon as convenient after you
have viewed the proposed portions of said alleys to be closed, abandoned
and vacated, and of ter your evaluation thereof from your view, and from
such other facts you determine to be pertinent thereto.

We, the undersigned viewers duly appointed by Resolution of the
Town of Pulaski, Virginia adopted on the 17th day of June, 1980,
convened in the office of the Town Attorney at 10:00 A. M. on the 14th
day of July, 1980, and at the time were given written instructions by the
Attorney for said Town of Pulaski, Virginia, upon our duties as
viewers, the original of the instructions being herewith attached as
a part of these proceedings.

REPORT OF After reading the instructions, the undersigned personally
visited the location described in the aforementioned Resolution and
VIEWERS instructions, and agree that the closing of the alleys lying between
the boundaries of the parcels of real estate owned by the Petitioners will
cause no inconvenience to any one.

Mr. Moore advised that all adjoining property owners have
been contacted ;Kahn & Feldman, Inc, and Gemmell's Transfer) and a

letter was presented and read by Town Attorney Moore stating that
LETTER FROM Kahn & Feldman, Inc., consents to the closing of the alley running
KAHN & FELDMANbetween the properties owned by Kahn & Feldman, Inc., and the W. L.
Tate property known as Meredith & Tate, Inc. This Letter was
marked "Received and Filed".
Also, James Gemmell of Gemmel's Transfer was contacted and he
has indicated he will file his letter to the effect that he consents
ALSO to the closing of the alley as set out in said Petition. Mr. W. D.
GEMMELL TSFR.
Macgill of New River Oils, Inc. also stated he had contacted Mr.
Gemmell, who advised that a letter would be forthcoming giving
their approval.
Town Attorney Moore presented and read an Ordinance to close
ORDINANCE and vacate two alleys lying in Block 115 as shown on the map ref erred
TO CLOSE to as the Official Map of the Town of Pulaski, Virginia.
TWO ALLEYS
ADOPTED Mayor Ratcliffe advised the Council would hear anyone who
wished to speak either for or against the closing of said alleys.
However, no one spoke. Mayor Ratcliffe stated these alleys had been
dormant for more than thirty years.
Councilman Neblett moved the adoption of the Ordinance as
read by Town Attorney Moore. Motion was seconded by Councilmember
Brockmeyer, and carried on the following vote:

AN ORDINANCE TO CLOSE AND VACATE TWO ALLEYS
LYING IN BLOCK 115 AS SHOWN ON THE MAP
REFERRED TO AS THE OFFICIAL MAP OF THE TOWN
OF PULASKI, VIRGINIA.
WHEREAS, W. L. Tate, Kalima D. Tate and New River Oils, Inc,
filed their petition on the 17th day of June, 1980, with the Council
of the Town of Pulaski, Virginia, after postint notice in at least
three places in said Town, on the 6th day of June, 1980, as required
by law, which posting was at least ten days prior to the filing of
said petition, requesting the Town to vacate and abandon two alleys
as described in the petition; and,
WHEREAS, upon filing of the aforesaid petition, the Council
did appoint Daniel C, Bell, J. R. Glenn and Warren J. Bain as viewers,
and Odell Mayberry and Curtis C. Jordan, as alternates, pursuant to
ADOPTION OF Section 15.1-364 of the Code of Virginia of 1950, as amended, and set
a Public Hearing on the closing for 7:00 P, M, on July 15, 1980; and

WHEREAS, subsequent thereto, all the landowners who would be
ORDINANCE affected by the vacation of the two alleys lying in Block 115 were
notified of the filing of said petition and of the Public Hearing thereon
set for the 15th day of July, 1980, in the Council Chambers of the Town
Office of Pulaski, Virginia, said notice being delivered to the landowners
TO CLOSE and also by proper publication in the Southwest Times, a local newspaper,
on the 27th day of June and the 4th day of July, 1980; and
WHEREAS, on the 15th day of July, 1980, the Public Hearing was

in the Petition should be vacated and abandoned as public alleys, and
upon the viewers' report dated the 14th day of July, 1980, and filed
herein stating that in their opinion no inconvenience would result from

appearing at the Public Hearing opposed to the closing and vacating; and
WHEREAS, the Council of the Town of Pulaski, Virginia, is of the
opinion and so finds that there are no objections to the petitioners'

alleys as described below; and that all requirements of law have been

Pulaski, Virginia, that the two alleys described as follows:
NEW RIVER
ONE: An eleven foot alley running north and south through
a portion of Block 115 along the western side of Lots 16
OLIS, INC. through 25 in Block 115 as shown on the map ref erred to
as The Official Map of the Town of Pulaski, Virginia.
TWO: An alley of various widths running east and west
from LaGrange Street to Lake Street at the northern
terminus of the eleven foot alley described above;
All as shown on a revised plat showing survey of property
of L. A. Dunlap, prepared by E. H. Millirons, dated
December 23, 1946;
BE, and the same are hereby closed and vacated as public alleys in the
Town of Pulaski, Virginia, subject to any existing easements for use by the
Town for existing utilities located thereon or for use in the future
for public utilities.
BE IT FURTHER ORDAINED that the Town Manager cause to be
recorded in the Deed Books of the County of Pulaski, Vir ginia, located
in the Clerk'S Office of said County, a copy of this ordinance.

BE IT FURTHER ORDAINED that Daniel C. Bell, Warren J. Bain,
and Curtis C. Jordan, the three acting viewers, be paid the sum of Ten
Dollars ($10.00) each, and that all the costs involved in the
vacating of the aforesaid street be paid by the petitioner.
This ordinance shall become effective upon passage.
Gordon N. Dixon, Executive Director of the New River Valley
Planning District Commission, with Robert West of the Commission,
presented a detailed report of a Study which the Commission has
recently completed on Phase III Solid Waste Disposal. Copies of the
study report were given to members of the Council and Mayor Ratcliffe.
Mr. Dixon stated that the modular incinerator, although new

PRESENTS REPORT and has not been proven, is lower in cost and would be a better method

SOLID WASTE of solid waste disposal than the Pellet method, or Wat erwall Process.
DISPOSAL
The waterwall process being one of the more expensive types. Mr.
Dixon stated the incinerator process would reduce the volume of solid

waste which must be buried in a landfill, and it could create revenue
from the steam produced in its operation. However, he stated larger items,
such as refrigerators, etc. would still have to be buried in a landfill.
MADE COMMENTS Also, the revenue produced from the sale of steam would reduce
operating costs of the incinerator.
Mr. Dixon stated the Commission had a Firm conduct_a survey to
determine if the industrial waste in this area could be incinerated;
Landfills were also looked at, but there were objections from indivi-
duals; a site location, which has not as yet been designated; and a
scope of services, which would require an engineering approach to the
sites. That Klopman or Western Electric would be better sites for
disposing of "heat".
Mr. Dixon stated "this is a priority project for the Commission
because all local governments have this problem; that the report is
only to give you some background information on what we are mak.~g
an effort to bring to this area", and was based on 1985 projected costs.
"We need to designate some group to act; select a site where we can get
funds to cover 75% of the cost of such a study, and get local grants
involved".
Cecil Ward of 127 South Washington Avenue, complained to
Council relative to the pollution and noise of that area; stating

COMPLAINT muffled motor cycles. Mr. Ward stated he understood the same law that

covers automobile mufflers also covers the motor cycles, and he appealed
to Council for some relief from this noise.
There was discussion relative to state law requirements. Town
Attorney Moore advised that the Town now has an ordinance in force which
complies with the State requirements, or what is allowed.

Mayor Ratcliffe called for Committee reports.
Councilmember Johnston stated work is being done on the necessary
details for an agreement between the Town of Pulaski and Town of Dublin

prior to the Council meeting, and the new members as well as the old

Councilmember Graham stated the Finance Committee had considered
the rate schedule for Equipment and Stores and felt these rates should be

Councilmember Graham advised that the budget was adopted with
the assumption that there would be adopted an ordinance establishing water
rates and charges for users outside the corporate limits. Such an ordinance
was read by Town Attorney Moore, and on motion of Councilmember Graham,
seconded by Councilmember Mitchell, the following ordinance was adopted
on the following vote:

AN ORDINANCE TO AMEND SUB-SECTION (b) OF SECTION
USERS OUTSIDE 29-14.2, AND TO RE-ENACT AS SUB-SECTION (b.l) OF
29-14.2 AS AMENDED, OF THE CODE OF THE TOWN OF
PULASKI, VIRGINIA, ESTABLISHING WATER RATES AND
CORPORATE LIMITS CHARGES FOR USERS OUTSIDE THE CORPORATE LIMITS
BE IT ORDAINED by the Council of the-Town of Pulaski, Virginia,
meeting in Regular Session on this 15th day of July, 1980, that Sub-
section (b) of Section 29-14.2 be, and it is hereby amended and re-
enacted as follows:
(b) Comsumers in the same category as sub-section (a) of
29-14.2 but are outside the corporate limits who purchase water
directly from the Town shall pay for the water at the following rate:
First 3,000 gallons minimum $7.00
Next 20,000 gallons 0.80 cents per thousand gallons
Next 200,000 gallons 0.70 cents per thousand gallons
Next 777,000 gallons 0.60 cents per thousand gallons
Over 1,000,000 gallons 0.50 cents per thousand gallons
This ordinance shall become effective upon passage for water
services beginning August 1, 1980.
Councilmember Graham advised it was the recommendation of the
Finance Committee that the monthly pay rate for the Mayor be increased

of the Committee be: approved and the increase be paid from General Fund

Councilmember Brockmeyer reported the Ordinance Committee met
and discussed several items bef ore that Committee one of which was the

Mr. Brockmeyer also reported the Committee will be considering
other matters before the Committee, such as Dog Ordinance and an
Ordinance fiving elderly persons some tax relief, as background
information is secured by Assistant Town Manager Coake.
Councilmember Brockmeyer advised that a couple of months

There was some question relative to State laws govering the
raising of salaries of government officials while in office, and
Councilmember Brockmeyer withdrew his motion until a legal opinion
could be secured.
Councilmember Holston advised that the Pollution and Sanitation
Committee had not. met, but that she had had several conversations with
Assistant Town Manager Coake and C. E. Boyd, former Chairman of the
Pollution & Sanitation Committee, as well as having been in touch'

Holston also stated the last inspection report from the State
indicated a satisfactory rating; that she had discussed with Mr.
Coake the leachate problem, and she understood Old Dominion Contractors
of Wytheville were the low bidders ($80,242.56) for the Valley Road sewer
line, and asked Mr. Coake to give a report on this. Mr. Coake advised
that. application for grand funds for this project had been filed.
Councilmember Neblett reported that the Public Safety

for Town Employees.

by Councilman Brockmeyer, and carried.
Mayor Ratcliffe advised that the Downtown Renovation Committee has
recommended to Council that the following persons be appointed by Council
to participate in -the Wcdcshop the week of July 21, 1980: Mike Johnston;
Ted Aaron; John Columbus; Sr.; Ben Tate; Dan Rooker and Jane Wysor; and

Mayor Ratcliffe recognized a letter from Mrs. Virginia Kelly in

RECOGNIZED which she thanked the Pulaski Town Council for its appropriation to the
Pulaski County Library.
Councilmember Mitchell advised that funds have been set aside
