There were present: Mayor Raymond F. Ratcliff, presiding. Councilmen: John A. Johnston, Robert M. Wallace, Blair B. Brockmeyer, C. E. Boyd, Jr., William A. House, Andrew L. Graham, Jr., James M. Neblett, Jr., Arthur L. Meadows Also present: J. E. Marshall, Town Manager Gladys R. Dalton, Clerk Garnett S. Moore, Town Attorney Visitors: Dave Vascek, Jane Graham, from the news media Sam Skeens, Chas. Kemp, Brady Richardson, and several other persons who did not identify themselves, but interested in the Gatewood Camp site matter The invocation was given by Councilman Johnston. APPROVED The minutes of the regular meeting of March 20th and special MINUTES meeting of March 30, 1979 were approved. as recorded. Mayor Ratcliff welcomed the visitors, and advised that Council WELCOMID VISITORSwould hear the public at this time. Sam Skeens, who stated he was a citizen of the Town of Pulaski and a weekend camper at Gatewood Lake Camp site, suggested to Council that the Town do away with permanent camping at the Lake, and suggested also that camp site rates be rased and signs be installed to inform the public on how to get to Gatewood Lake Camp site. Charles Kemp and Brady Richardson, who are from Christiansburg, DISCUSSION Virginia, and who have been camping at Gatewood on a year-round basis ON CAMPi~iG and paying a rental rate of $250.00 per year, advised Council that to AT GATEWOOD eliminate parking as it has been in the past, the Town would be losing in AND RECOrID. the neighborhood of $3,400. a year. Much discussion followed, concerning this matter. Councilman Brockmeyer stated the Recreation Committee had met recently and this matter of camping at Gatewood Park was discussed, and it was the recommendation of the Committee that a rate of $3.50 per day be established for campers, plus tax, making a total of $3.64 per day; that campers equipped with air condition be charged an additional $1.00 per day; ~~~~ April 3, 1979 and, further, there be no permanent ca{nping at the Park, and that the Park be open from April 1st and closed October lst each year, with no parking at the Park after October 1st. Councilman Brock~neyer moved the adoption of the recommendation of the Recreation Committee, as REC. Johnston - Aye James M.Neblett, Jr. Aye Councilman House moved that the Town continue to operate at Gatewood at the present rate until the adoption of the new ordinance at Council's meeting of April 17th. Motion was seconded by Councilman Graham, and carried. The existing signs at Calfee Park regarding the use of the CALF EE PARK Park was reported on by Councilman Brockmeyer, and discussed by REPORT Council and Town Manager. Councilman Wallace had no report for the Street Committee. Councilman Johnston as Chairman of the Land and Building MEETING ON Committee, reported that a draft copy of the Economic Impact Study ECONOMIC had been received from the State Water Control Board, and it was IMPACT STUDY hopes g Committee meeting could be scheduled soon in order that a TO BE report could be made to Council. SCHEDULED Councilman House reportisag for the Finance Committee, stated the Committee at its recent meeting discussed the bid of Prillaman & Pace of $16,385. for the laying of a water line on Taylor TOWN TO SIGN CONTRACT WITH Street, and it was the recommendation of the Committee that the Town PRILLAMAN & PACE FOR WATER secure a contract with Prillaman & Face for the installation of the LINE TO TAYLOR ST. water line on Taylor Street, and so moved. However, at this time the bids indicated there would be a savings of $523.41 over the budgeted amount. Councilman House moved $9,910 APPROPRIATEDthat in accordance with Council's past policy regarding Revenue Sharing F OR PUR . OF TRUCKS expenditures, the amount of $9,910.,00 from Account ~~4061 be spent for the purchase of the trucks. Motion was seconded by Councilman Neblett, and carried on the following vote: Andrew L. SESSION Councilman House asked Town Attorney Moore to read the ordinance which had been prepared creating the positions of Assistant Town Manager and Dir ector of Engineering and Development. The following ordinance was read by Mr. Moore, and Councilman House moved its adoption. Motion wa s seconded by Councilman Neblett, and carried on the following vote: ORDINANCE ESTABLISHING Andrew L. Johnston - Aye James M.Neblett, Jr.- Aye AN ORDINANCE TO ESTABLISH THE POSITIONS OF DIRECTOR OF ENGINEERING AND DEVELOPMENT, AND ASSISTANT TOWN MANAGER FOR THE TOWN OF PULASKI, VIRGINIA BE IT ORDAINED by the Council of the Town of Pulaski, Virginia, meeting in regular session on this 3rd day of April, 1979, that: (1) There be hereby established the position of Director of Engineering and Development and the position of Assistant Town Manager for the Town of Pulaski, Virginia. The of oresaid positions shall be ',~ filles by Council unless otherwise directed by a duly adopted resolution. (2) The Director of Engineering and Development and the Assistant Manager shall each have a general knowledge of all functions of local government, and such college degrees, training or other qualifi- cations established and approved by the Town Council. In addition to the above general requirements, the Director of Engineering and D velopment must hold such degrees and certification in engineering as required, established or acceptable to the Town Council. April 3, 1979 ~~~g The Director of Engineering and Development may also be designated by Council as the Assistant Town Manager in which case he shall assist;the Town Manager in_the perf ormance of his executive and administrative duties as described in the Charter of the Town, by the General. Laws of the State of Virginia, or other duties directed by Council. The Assistant Town Manager; in the absence of the Town Manager or when the Town Manager is unavailable to perf orm his duties by reason of illness or for any other reasons, shall perform all the executive and administrative duties the Town Manager is required to perform by the Charter of the Town of Pulaski, general laws of the State of Virginia, or as may be assigned by the Council of the Town. This ordinance shall become effective upon passage. Town Manager Marshall recommended that H. R. Coake be promoted to the position of Assistant Town Manager and Director of H . R . COAKE NAMED ASST Engineering and Development for the Town of Pulaski, effective immediately. TOWN MGR . ETC. Johnston - Aye James M.Neblett, Jr.- Aye AN ORDINANCE TD AMEND AND RE- ENACT SECTION 42 ~OF THE LICENSE ORDINANCE CODE OF THE TOWN OF PULASKI, VIRGINIA, REQUIRING WHOLESALE MERCHANTS LICENSES; EXCEPTIONS BE IT ORDAINED by~the Council of the Town of Pulaski, Virginia, meeting in Regular Session on this 3rd day of April, 1979, that: Section 42 of the License Tax Ordinance be amended and re- enacted as follows: Sec. 42. Wholesale Merchants Every person who has an established place of business located in Town, engaged in the business of a merchant for the purpose of distri- buting goods, wares, and merchandise to its or other retal stores or outlets for sale at retail shall be required to obtain a separate merchants licence for each distributing house or place of business. Such license shall not be required of a person who manufactures and sells goods, wares, etc., at wholesale at places of manufacture. 1 C~ 1 The tax herevy imposed on each wholesale merchant- shall be computed on the previous users purchases by said wholesale merchants as follows: April 3, 1979 '609 ~; +;~,, 13 cents on each $100.00 of the first two millions of purchases 05 cents on each $100.00 of the next one million of purchases O1 cent on each $100.00 of puechases above three million 1 If any merchant has not previously been engaged in such wholesale purchase, the tax shall be computed by making a reasonable estimate of expected purchases for the year, which shall be adjusted at the end of the year to conform to actual purchases. The tax shall then be adjusted accordingly. This ordinance shall become effective on May 1, 1979. Councilman House reported that at the last Council meeting the 1 TOWN TO TAKE NO POSITION IN "BROWN BAGGING" AT ARMORY FUNCTIONS question was raised about the use of the Armory by various groups and the possibility of getting the approval of the ABC Board for "brown bagging". Councilman House moved that the Town take no position in the matter of various groups using the Armory for various functions and the possibility of getting the approval of the ABC Board for "brown bagging", but that this matter exist between the ABC Board and. the interested group. Neblett, Jr.- Aye Councilman Boyd reported the Pollution and Sanitation Committee met, but there was no report to be made at this time. Mr. Boyd reported that Council had received from the Town REQUEST FOR REPORT ON STOLEN AUTOS FROM POLICE DEPT. Manager a report of Police Department activities for the month of February, and asked that the Police Department furnish a report on the number of auto thefts in the Town of Pulaski; estimate of loss involved in these thefts; who made the investigation and how many vehicles have been re- covered. Mr. Boyd stated he was very much dissatisfied with this situation as it now exists and asked Town Manager Marshall to confer with the Police Chief and bring back a report to the Council. Councilman Boyd also asked that something be done at the Macgill 1 ':i VANDALIS~~ AT MACGI, VILLAGE PLAY GROUND Village Playground on Newbern Road, which has been vandalized repeatedly and damaged by vehicles being driven through it. Councilman Meadows reported that the Ordinance Committee had met on March 26th and as a result of that meeting several ordinances had been presented and adopted at this meeting. Mr. Meadows presented an ordinance which would amend the Town's present ordinance dealing with security deposits ~~?~ April 3, 1979 for water and sewer services. The ordinance was read and councilman Meadows states it was the recommendation of the Committee ,that it be adopted. Meadows - Aye James M.Neblett, Jr. -Aye 1 AN ORDINANCE to amend Sections 29-6, 29-20.x, 29-24, and Re-enact as amended Sections 29.6.1, 29.;20.1(a), 29-24.1 and 29-42.1, and enact_a new Sec. 29-45.1(a), increasing security deposit for water service and re- connection charges for re-establishing water and sewer services. ADOPTION OF ORDINANCE BE IT ORDAINED by the Council of the Town of Pulaski, Virginia, RE: WATER meeting in regular session on this 3rd day of April, 1979, that: SERVICE AND SECURITY ARTICLE II - Water DEPOSITS Sec. 294~,~1. Application for water service; deposits. Any person desiring to connect with the town water lines and to introduce town water into his premises shall make application for such service to the town treasurer upon a form to be provided by the treasurer. The town manager, or his authorized representative, may in his discretion repuire a twenty dollar deposit, to be paid to the treasurer at the time application for new water service is made, in any case where the water service has been discontinued due to delinquency or failure to make payment of water bills, or where the applicant has a bad credit rating, or has not established. a good credit rating by prior accounts with the town, or in any case wh re the town manager or authorized representative believes it is necessary to insure payment of water accounts. However, if the applicant owns in fee the real estate for which the water service is requested, he shall not be required to make a deposit, unless his credit record with the town is bad. 1 Any person making application for restoration of water service shall in addition to making such deposit as may be above required, pay all past due accounts, together with penalties, or any other sums due for service received at any location before restoration of water service is made. Sec. 29-20.1(a) Re-connection charges when cut off by request and when cutoff for any reason made after the Town's normal working hours A charge of $2.00 shall be made for each time water is turned on after same has been turned off at the request of the owner or occupants. However, in the event a request is made for re-connection at times other than during normal working house of the Department of Public Works, whether the turn-off was by request or was made for any other reason, a charge of $5.00 for each time the water is turned on shall be made. In addition, any other charges provided for in Sec. 29-24. 641 April 3, 1979 Sec. 29-24.1. Re-establishment of service - after discon- tinuance for failure to pay bills or by request, when meter is removed. The town manager, or his authorized agent, shall not restore water service to any person whose service has been discontinued under the provisions of this article until the customer has, in addition to paying the delinquent bill and other charges herein provided, paid a re-connecting charge of Five Dollars. In the event that water service is discontinued upon request or by failure to pay the water account and the Town finds it necessary to remove the meter to prevent further use of water, an additional charge of $15..00 is to be made for re-installation of the meter and restoring the water service. ARTICLE III - Sewer-and Sewage Disposal .. ............ . Sec. 29-45.1(a) Re-establishing sewer service after discontinuance for failure to pay sewer accounts Sewer service shall not be restored to any person where the service has been discontinued f qr failure to pay sewer bills and the sewer lines were disconnected and plugged ,off, until a re-connection charge of $15.00 has been paid to the Town. This ordinance shall become effective upon passage. Councilman Neblett reported the Safety Committee had met on a couple of items. Mr. Neblett moved that the ordinance on Fire Lanes FIRE LANE which the Committee has considered, be referred to the Ordinance Committee ORDINANCE REF. TO for report to Council. Motion was seconded by Councilman Graham, and ORDINANCE COMMITTEE carried. Town Manager Marshall stated Council had been advised of the approval by the State Department of Personnel and Training of the Town's Employee Grievance Procedure and cited the major changes which had been CHANGES made in order to conform with Section 15.1.-7.1 of the Code of Virginia. RECOMMENDED IN GRIEVANCE Also, copy of the new procedure had been furnished to each member of Council, PROCEDURE REF. TO as well as to all Department Heads. ORDINANCE COMMITTEE ~ Councilman Graham recommended and so moved that the new Grievance Procedure be turned over to the Ordinance Committee. Motion was seconded by Councilman Boyd, and carried. Town Manager Marshall also stated that Council had been furnished a list of names of several employees of the Town as possible members of the i ~ Town Retirement Committee; .iCounci~man:Graham nominated Mrs. Frances Lookabill to the Town Retirement Committee, which nomination was seconded FRANCES LOOKABIL by Councilman Wallace. Bowling and wife, re- garding the rezoning of the property at the corner of Lee Highway and Memorial Drive. Town Manager Marshall reported that in January a petition had been presented to Council concerning the installation of a guard- INSTALLATION rail on Bluff Street. Town Manager Marshall advised it had been brought to his attention by Finance Director Roger Williams that Section 59 of the VENDING MCH. Town Business and Professional License Code covering vending and ORDINANCE REF. TO weighing machines is no longer valid according to an amendment made ORDINANCE COMMITTEE to the State law. Mr. Marshall recommended that this be referred to the Ordinance Committee, Town Attorney, Finance Director and Town Managers to prepare the proper amendment. Councilman Graham so moved, seconded by Councilman Wallace, and carried. Shelton, 416 Birch Street, Pulaski, ON SHELTON for a trailer permit was presented to Council. Councilman Neblett moved TRAILER APPLICATION that the proper procedures be followed and a public hearing be held on this request. Motion was seconded by Councilman Wallace, and carried. At 6:30 P. M.
