There were present: Mayor Raymond F. Ratcliff, presiding. Councilmen: Robert M. Wallace, John A. Johnston, Andrew L. Graham, Jr., William;A. House, C. E. Boyd, Jr., Arthur L. Meadows, Blair B. Brockmeyer, James M. Neblett, Jr. Also present: J. E. Marshall, Town Manager Gladys R.;Dalton, Clerk Garnett S. Moore, Town Attorney H. R. Cgake, Assistant Town Manager Roger A. Williams, Finance Director Visitors: Dave Vaseek, Barbara English of the News Media Mary Cox, Merchants Council Approximately five other visitors Roy Rives, Hercules, Inc. Bill Norris, Coleman Furniture Corp. The invocation was given by Councilman Graham. The minutes of the regular meeting of July 3, 1979 were approved as recorded. Mayor Ratcliff advised this was the time and place for Council to hold a public hearing on the application of Douglas Brooks to place a mobile home at the corner of Stuart Avenue and Elm Street, and Council would be glad to hear anyone who wished to speak on this matter. No one spoke, and Mayor Ratcliff called on Town Manager Marshall for a report. Mr. Marshall advised that two additional objections had been PUBLIC HEARING BROOKS TRAILEreceived over and above those objectors set out in his Administrative R APPLICA- report to Council. Mr. Marshall advised that in light of the objections received, it was his recommendation that Council withhold any action at this time on the application and advise Mr. Brooks of the objectors, to see if he is willing to contact these objectors to resolve their objections j objections and if successful, present Council with this inf ormation and f Council can then reconsiaer the matter and act upon the application. Councilman House moved that the recommendation and procedure outlined by Town Manager Marshall be followed and this matter be placed BROOKS ~ 0 TRY ANID, on the Council agenda for the next regular meeting of Council. Motion RESOLVE OBJECTIONS was seconded by Councilman Brockmeyer, and carried. .6'4 L ~ July 17, 1979 Mayor Ratcliff advised the next item on the agenda was a public hearing on the proposed landfill User Charge ordinance. Councilman Boyd, Chairman of the Pollution & Sanitation Committee, commented briefly on the necessity for the Town to adopt an PUBLIC HEARING industrial and commercial user charge for the landfill operation. LANDFILL USER Mr. Boyd reported the Committee felt this was a step in the right CHARGE ORD. direction in an effort to make the landfill operation self sustaining, and recommended its adoption Roy Rives of Hercules, Incorporated, Commerce Street, advised that he felt the proposed ordinance was fair and realistic; however, he pointed out that by Council's action in adopting this ordinance, which increases the tax liability of industry, he hoped EXPRESSIONS that Council would recognize the fact that Council could "run industry out of town" . FROM PUBLIC Bill Norris of Coleman Furniture proposed that residential users also be charged a fee inasmuch as they get approximately two free seasonal pickups (spring cleanup and fall leaf pickup), and that industrial users be allowed two free loads a week and be charged for the additional loads. EXPRESSIONS Councilman Brockmeyer stated he was opposed to the tax at this FROM COUNCIL- time; that it seems "we look to industry first and residents second", MEN and stated he did not believe it was reasonable to increase the tax at the landfill at this time. Councilman Wallace advised this was not a tax but a user charge and stated he did not believe the residents of the Town should be taxes for the industries. Councilman Boyd reported the Committee felt this was the place to get the additional revenue, and moved that there be established Section 13-30 - and that all commercial and industrial users of the sanitary landfill shall pay to the Town the following fees for disposal of garbage, rubbish, weeds, etc.: Pick-up trucks, 3/4 tons and under $ 2.00 per load Trailers and other vehicles with load limit not greater than 3/4 ton 2.00 " Other vehicles above 3/4 ton 5.00 " " r 1 July 17, 1979 s~~9 Motion was seconded by Councilman Meadows. Further discussion was had abd Councilman Boyd then withdrew his motion and Councilman Meadows with= drew his second. Councilman Boyd asked the Town Manager to read the entire Ordinance on the proposed User Charge for use of the Sanitary Landfill. Councilman Boyd ehtn moved that the ordinance to Amend Chapter 13, LANDFILL USER CHARGE ORDINANCE ADOPTED EFFECTIVE 8/1/79 Garbage, Rubbish and Weeds, Article IV, by adding Section 13-30, as read by the Town Manager, be adopted, to become effective August 1, 1979, and. violation of said ordinance to be punishable by a fine not to exceed $5.00, for each violation. Motion was seconded by Councilman Meadows, and carried on the following vote: Andrew L. Graham, Jr. - Aye William A. House - Abstained Blair B. Brockmeyer - No C. E. Boyd, Jr. - Aye Robert M. Wallace - Aye Arthur L. Meadows - Aye John A. Johnston - Aye James M.Neblett, Jr. - Aye Councilman House asked that the record show that he did not vote and took no part in the discussion. AN ORDINANCE TO AMEND CHAPTER 13, GARBAGE, RUBBISH, AND WEEDS, ARTICLE IV, BY ADDING SECTION 13-30 - COMMERCIAL AND INDUSTRIAL USERS OF THE SANITARY LANDFILL; RATES; COVER OF WASTE MATERIAL DURING TRANSPORTATION; EXEMPTION OF RESIDENTIAL USERS; PROCEDURE BE IT ORDAINED by the Council of the Town of ,Pulaski, Virginia, meeting in regular session on this 17th day of July, 1979, that Chapter 13 be amended by adopting Section 13-30, as follows: Sec. 13-30 - Commercial and Industrial Users of the Sanitary Landfill; Rates All commercial and industrial users of ,the sanitary landfill for disposal of garbage, rubbish, weeds, etc., shall pay to the Town the following fees: (1) Schedule of fees: Per Load: Pick-up trucks, e/4 ton and under $ 2.00 Trailer and other vehicles with load limit not greater than 3/4 ton 2.00 Other vehicles above 3/4 ton 5.00 ,~ However, there is specifically exempt from payment of fees under this ordinance, home owners, tenants or other residential users 4 when removing garbage, rubbish, waste, etc., from their own premises and not as a commercial operation. (2) All vehicles transporting garbage, rubbish, waste, etc., shall provide a canvas or plastic cover or some other method to prevent the garbage, rubbish, etc., from blowing out of or falling from the truck while moving said garbage, etc., from their premises to the Town Sanitary Landfill. ~:~'D July 17, 1979 (3) The Town Manager or his duly authorized agent shall establish a method for collecting the fees payable hereunder, set times when the Sanitary Landfill will be open and such other procedure required for the proper administration of this Ordinance. (4) Failure to pay the fees herein provided, or to abide by the other terms of this Ordinance shall constitute a violation thereof, and shall,be punishable by a fine not to exceed Five Dollars for each violation.- 1979. This Ordinance shall become effective on the 1st day of August, A representative from the Dollar Store on Route 99 was advised REMOVAL that the Town Manager would make a report on the matter of removal OF MEDIAN STRIP of the median strip along that Highway later in the meeting. Council heard further complaints from residents of'Overton Drive relative to the curb and gutter recently installed by the Town OVERTON DR, CURB & GUTTER on the north side of Overton Drive. It was the consensus of the Council that all parties concerned in this undertaking get together and work out some solution to the existing problem to the satisfac- tion of all concerned. Mayor Ratcliff called for Committee reports. Councilman Graham had no report. Councilman Brockmeyer advised that he had no report for the Recreation Committee. However, Mr. Brockmeyer suggested that a Downtown Improvement Committee be appointed, and gave a list of BR OCKMEYER RECOMMENDS names of persons who might be appointed to the Committee. Mr. DOWNTOWN IMPROVEMENT Brockmeyer stated he planned to bring back to Council at its COMMITTEE next regular meeting a recommendation regarding this Committee. Councilman Wallace had no Street Committee report. Mr. NUMBER OF Wallace inquired about the number of Campers there have been this CAMPERS AT GATEWOOD PARK season at Gatewood Camping Park.; Councilman Johnston advised there would be a Flood Workshop to be held in Abingdon on the 24th, and he hoped as many of Council as possible would attend this workshop. Mr. Johnston stated the Land FLOOD WORKSHOP and Building Committee would meet and he hoped to have a report for IN ABINGDON, VA. Council at its next meeting. 1 1 1 July 17, 1979 ~~~•1 Councilman House reported the Finance Committee was advised that the pick-up truck used in the Recreation Department operations is beyond repairs, and a secondhand four-wheel drive truck has been found, at a cost of $4500.00 and the Recreation Director has asked that this truck be purchased. Councilman House moved that the sum of $4500.00 $4500.00 APPROP. be appropriated from E & S Surplus Fund, Account 6051, for the FOR PUR . OF 4-WHEEL purchase of the pick-up truck. Neblett, Jr. - Aye Councilman House reported that the Finance Director and Treasurer has advised the need for replacing the old validating machines now in use, $6750.00 APPROPRIATED and Councilman House moved that the amount of $6,750.00 in Revenue FOR 3 VALIDATING Sharing Fund - Account ~~4051 - be approved for the purchase of three (3) MACHINES FOR TREAS. OFF. new validating machines. .Motion was seconded by Councilman Neblett, and carried on the following vote: Andrew L. Graham, Jr. - Aye William A. House - Aye Blair B. Brockmeyer - Aye C. E. Johnston - Aye James M.Neblett, Jr. - Aye Councilman House reported that ehe Pollution & Sanitation Committee and Finance Committee had met and discussed the purchase of APPROVED. a Pan for the landfill, the cost of the Pan being $178,670.00. Mr. BUDGET ITEM $178,000 House further reported the budget carried an account ~~407.8 in the FOR PUR . OF PAN FOR amount of $178,000 for the purchase of a Pan for the landfill LANDF ILL operation, and the terms for the purchase of this equipment was 50% down and 50% in thirty days. It was the recommendation of the two Committees, and M. House so moved that the amount of $178,000 in Revenue Sharing Fund Account ~~407.8 be approved for the purchase of this equipment, Motion was seconded by Councilman Boyd, and carried on the following vote: Andrew L. Johnston - Aye James M.Neblett, Jr. - Aye Council.~,an Boyd advised there was no further report from the NO REPQ T FR. POD & pollution and Sanitation Committee at this time. SANIT COMM. ~~~Z July 17, 1979 Councilman Meadows advised that the Ordinance Committee had met since the last Council meeting, but than there was no report at this time. Councilman Neblett advised there was no report from the Safety Committee at this time. Councilman Neblett advised that if any member of Council . wished to make some comment relative to persons for filling the HEAR FROM vacancies on the various Committees and Commissions of Council, MEMBERS OF COUNCIL RE: to please. get in touch with him. Councilman Boyd felt that perhaps VACANCIES ON COMMITTEES & some publicity could be given to this, and there might be some COMMISSIONS citizens who would like to come forward and offer their services. TO SEEK Councilman Boyd moved there be advertised in the local news- CITIZEN INPUT paper the various vacancies existing on these Committees. Motion was seconded by Councilman Neblett, and carried. Town Attorney Moore advised there were several Town Ordinances that should be reviewed and amended because of recent changes in State ORDINANCE COMMITTEE TO laws. Councilman Graham moved that the Ordinance Committee, the REVIEW ORDS. - FOR CHANGE administrative staff and Town Attorney consider these changes and BECAUSE OF ` STATE LAW bring in a recommendation to Council. Motion was seconded by Council- CHANGES man Boyd, and carried. Town Manager Marshall reported that as had been requested by 21 TAXICABS Council the number of Taxicabs in operation at this time, an inspection IN OPERATION by the Police Department indicated the following: Davis Cabs - One; Deluxe Cabs - 3; ana Blue & White Cabs - 17. Town Manager Marshall reported that by letter dated July 9, 1979 the Town had again requested the District Traffic Engineer, Mr. REQ. DIST. TRAFFIC ENGR. L, C. Taylor of Salem, to come to Pulaski and view on the ground TO VIEW PROBLEMS several problems that have been presented to the Council, and that RT. 99 & WASH.AVE. the removal request by 7-Eleven on Route 99 was one of the problems INTERSECTION to be addressed. No reply to this request has been received at this time. Town Manager Marshall advised that the Town Housing Authority ADDL. PROD- met on July 9, 1979 and reviewed several additional projects to be ECTS TO BE UNDERTAKEN undertaken in the Housing Rehabilitation Program, at which time BY HOUSING AUTHORITY 643 July 17, 1979 _ ' the Authority agreed to proceed with advertising of the projects for bids in order- that a recommendation can be made to the Council as soon as possible. Mr. Marshall stated it was felt that this has been a very successful project and it was hoped that additional grant funds can be received to have this as an on-going project for the Town. Town Manager Marshall reported that Ronnie Coake met with representatives of the Water Control Board on July 12th relative to the REPORT EX- PECTED FR. leachate condition of the landfill on the East side, and as soon as a WATER CONTROL BD. report is received from the Board, it will be passed on to the Council. RE:LEACHATE AT LANDFILL At 9:15 P. M. Councilman Neblett moved that Council go into EXECUTIVE executive session regarding a legal matter. Motion was seconded by SESSION Councilman Meadows, and carried. At 9:45 P. M. Council returned to regular session of Councils and ADJOUR~TMEN~a.yor Ratcliff inquired if there was further business to come before the Council. There being none, at 9:46 P. M. Council adjourned.
