HomeMy WebLinkAbout08-07-79;..644 Minutes of the regular meeting of the Pulaski Town Council held August 7, 1979 at 4:00 P. M. in the Council Chambers in the Municipal Building. There were present: Mayor Raymond F. Ratcliff, presiding. Councilmen: Andrew L, Graham, Jr., Blair B. Brockmeyer, Robert M.,Wallace, John A. Johnston, William A. House, Arthur L. Meadows, James M. Neblett, Jr. Absent: Councilman C. E. Boyd, Jr. Also present: J. E. Marshall, Town Manager Gladys R. Dalton, Clerk Garnett S. Moore, Town Attorney H. R. Coake, Assistant Towb Manager Roger A. Williams, Finance Director Visitors: Jane Graham, Dave Vascek and Lori Kinnan of the media Elzie Turman, Blue & White Cabs Ms. Mary Cox, President Merchants Council Approximately 20 citizens The invocation was given by Councilman Graham. The minutes of the regular meeting of July 17, 1979 wer e approved as recorded. Mayor Ratcliff advised that Council would hear the public at this time. Patel Jackson, 610 Maple Street, advised that the gutters on Maple Street extended have washed and that pedestrians have MAPLE STREET NEEDS REPAIRS to walk in the street and jump the ditch to get out of the way of TO GUTTERS traffic. Mr. Jackson was advised that this would be referred to the Town Manager to see what could be done. John Jenkins, 511 Maple Street, advised that the old Stuart property is grown up in weeds and needs some attention. PROPERTY ON MAPLE Bill Sheffy, Robinson Tract Road, said he lived .06 of a mile ST. IN NEED OF REPAIRS, ETC. on Robinson Tract Road, and was in need of water service. He further stated he had contacted the Pulaski County Service Authority relative to this matter, but that they were unable to help him. Obell Ratcliff advised that he understood Council would have a FLOOD INS. REPORT Flood Plain Insurance report at this meeting, and was advised that a Committee report would be made later on. Mayor Ratcliff called for Committee reports. COMMITTEE REPORTS Councilman ,Graham reported that a letter had been sent to the Water Control Board relative to the Wastewater Treatment Plant, and it was understood that the Town has all the inf ormation August 7, 1979 ~4`6cJ f needed to make a decision whether the Town would go to the Regional Plant or High-level Phosphorus plan. Mr. Graham stated the Council needs to knav how the Town will fit into the Regional Plan, and believed Council should appoint a committee to talk with the County Public Service Authority and Regional group and bring back a report to the Council. Councilman Johnston moved that Mr. Graham, Chairman of the COMMITTEE TO MEET WITH PUL. CO. Utilities Committee, Councilman House, Chairman of the Finance Committee, PUB . SERV~.AUTY RE: JOINING Town Manager Marshall, and Mayor Ratcliff should meet with the Regional REGIONAL PLANT or Peppers Ferry group and any other Town Administrative staff member, to represent the Council and bring back a report to Council. Motion was seconded by Councilman Neblett, and carried. Councilman Graham recommended and requested that the Town Manager FIRE LINEIFLOWSand Staff members review and identify the location of Fire Line Flow METERS TO BE IDENTIFIID Meters as well as to where these meters are not located, and report to Council together with the cost of these meters and pipe. Town Manager Marshall reported that bids for I&I Removal were STAFF REVIEW-opened on August 2nd and the Engineering Staff is now reviewing and BIDS OE ICI REMOVAL evaluating all of the bids. It is hoped to have a report at the next meeting of Council, Mr. Marshall stated, and a better accounting concerning ARC and Town funds. Councilman Brockmeyer presented a list of persons to be included in a proposed Downtown Renovation Committee to work with CBD Members and Council in an effort to get the Downtown Improvement program under- DOWNTOWN RENOVATION way. Councilman Brockmeyer moved that a Committee be created to further COMMITTEE TO BE study the Downtown Improvement program and report back to the Town APPOINTF~, LIST Council. CHAIR ~~~~ Councilman Johnston reported there have been several meetings FLOOD INSURANCE REPORT _ MOTION TO FILE WILEY & WILSON MAP & REQ. RE- STUDY August 7, 1979 regarding the flood insurance program in an attempt to arrive at some solution to the problem. Councilman Johnston stated the present situation is unacceptable to the Council and the Town and it was felt the ma.p prepared by the Corps of Engineers should not be endorsed. He further stated that with the new federal personnel, there appears to be a softening of flood regulations concerning flood plains and this might be of benefit to the Town's situation. Councilman Johnston advised that it was the consensus of the Committee that the Wiley & Wilson map be submitted to the Federal Insurance and Hazard Mitigation agency (FIHM) for their approval, and changes can be requested if so desired, and ask for a re-study. rl Councilman Johnston moved that. Council authorize Mr. Coake MORE DISCUSSION and the Firm of Wiley & Wilson to submit the Wiley & Wilson map to FIHM and that a letter be written requesting other forms of assistance from FIHM and the State Water Control Board~on the flood insurance program. Motion was seconded by Councilman Meadows. Discussion was had relative to the legal implications involved in submitting the Wiley & Wilson map prior to the Town making known its position and intent. ~I LJ Bill Norris, Coleman Furniture Engineer, whose plant is located in the flood plain, reported that he had been promised all the data used in the preparation of the Town of Pulaski Flood Study, and urged Council to withhold submitting the Wiley & Wilson map at this time. Councilman Graham made a substitute motion: Moved that Mr. SUBSTITUTE MOTION: JOHNSTON'S Johnston's motion be put on the agenda for the next meeting of MOTION TO BE ON AGENDA FOR NEXT Council, or continued until Council received the necessary inf ormation COUNCIL MEETING, UNTIL RECEIPT for making a decision. Councilman Johnston stated this CLEANING OF would be another point in the Town's argument for a re-study. He PEAK CREEK TO COST $25 000 stated the best cost estimate for this project was $25,000 and the & CHARGED TO "DOWNTOWN Committee suggested this cost be charged to "downtown renewal money" RENEWAL MONEY" $50,000 being ear marked, plus $100,000 in the current budget, and so moved. Neblett, Jr.Aye Town Manager Marshall presented to Council a letter from Elzie Turman, owner of Blue & White Cabs, asking that a rate increase in TAXI RATE INCR. BY BLUE & WHITE their fare structure be granted. Mr. Marshall recommended that the REF . TO ®RD . COMMITTEE request be ref erred to the Ordinance Committee, and if possible, bring back a recommendation to the Council. Councilman House moved that the request of Elzie Turman, owner of Blue & White Cabs, be referred to the Ordinance Committee, and that Mr. Turman appear at the meeting of the Committee and furnish such financial information as is requested by the Committee. Motion was seconded by Councilman Neblett, and carried. Councilman House reported there were some necessary bookkeeping matters as well as appropriations to be taken care of, and moved that the amount of $10,641.19 from Revenue Sharing Funds as of June 30, APPROVAL OF REVENUE SHARING 1979, be appropriated to Revenue Sharing Expenditure Account EXPENDITURES Numbers: 400.5 - Police Cars $94.76; 404.7 - Landfill $9,550.72; 406.4 - Snow Removal $70.61, and 407.4 - Snow Plow Blades $923,10. Councilman Neblett reported that matter of updating the terms of persons serving on the various committees and commissions of Council REPORT ON PERSONSis almost completed, and that two letters had been received from Town WILLING TO SERVE ON COMMITTEES OF citizens stating their desire to serve on certain committees. Mr. COUNCIL Neblett advised that it was the hope of the Nominating Committee to have a report for Council at its next meeting. Town Manager Marshall advised that the following report of Roger A. Whereupon, Roger A. Town Manager Marshall advised that a billing procedure for BILLING PROCEDURE FOR the Landfill User Charge ordinance recently adopted by the Council LANDFILL USER CHARGE ORD. had now been established whereby for the first month's bill the land- EXPLAINED fill users will be billed for the first fifteen days of August in order that it be incorporated on the regular utility billing. By letter, users will be advised that records will be kept at the landfill of ail charges and number of loads, with each form being signed by the drivers, which would provide the Town with a relatively clear record as to the total number of loads should this become questionable on any billing period. OVERTON DRIVE Town Manager Marshall reported that after meeting with the TO BE PUT BACK AS WAS FIRST Street Committee relative to the Overton Drive curb and gutter matter, & OWNERS TO DECIDE WHAT IS BEST August 7, 1979 1 make corrections and put back to the original state that portion which was torn out by the Town onto the peoples' driveways where the Town was involved in removing a portion thereof. Mr. Marshall stated an effort is being made to have an agreement signed by the property owners, but at present one property owner is away on vacation. However, the other three property owners have assured the Town that they believe he will go along with this procedure. At 7:05 P. M. Councilman Johnston moved that Council go into 649 it was generally agreed that the Town would reposition or move the present curb and gutter out to the proper location as a result of the errors in survey being corrected, and at this point the property owners would be responsible for making whatever changes in their driveways that are necessary by reason of the installation of the curb and gutter, even to the point of having to re-grade their driveways if the steepness OVERTON is such that they cannot enter them with their vehicles. Mayor Ratcliff declared Council to again be in regular session and inquired if there was other business to come bef ore the Council. Councilman House moved, seconded by Councilman Johnston, that TOWN ATTY. TO FILE ANSWER TO H.T.BOWLING SUIT Mr. Moore, Town Attorney, file the proper answer and def end the Town in the suit that has been brought against the Town by the Attorneys for H. T. Bowling,. regarding the rezoning request of the property at the corner of Memorial Drive and Lee Highway. This would be a motion for declaratory judgment.
