There were present: Mayor Raymond F. Ratcliff, presiding. Councilmen: Andrew L. Graham, Jr., Bob J. Clark, Blair B. Brockmeyer, James M. Neblett, John A. Johnston, William A. House, Arthur L. Meadows Absent: Councilman C. William Hickam, Jr. Also present: Town Manager: J. E. Marshall Clerk: Gladys R. Dalton Town Attoeney: Garnett S. Moore Visitors: Jane Graham, WPUV Radio Station Steve Austin, Southwest Times Herman Largen - Vernon M. Newman Moses Webb and Oscar Smith The invocation was given by Councilman Neblett. The minutes of the regular meeting of September 6th and MINUTES APPROVED special meeting of September 8th, 1977, were approved as re- corded. Mayor Ratcliff stated this was the time and place, as had been advertised in the local paper, for holding a public hearing on the application of Moses Webb, Jr, and Oscar M. PUBLIC HEARING RE: WEBB & Smith for permission to operate a public dance hall at 170 SMITH APPLICATION FOR DANCE HALL West Main Street, and that Council would hear any one who wished PERMIT to speak either for or against the permit, At this time the applicants - Webb and Smith - had not arrived at the meeting, and Mayor Ratcliff asked Town Manager Marshall for a report on the request. Town Manager Marshall reported that Fire Chief Hall and the Building Inspector had made attempts to inspect the inside REPORT OF of the building at 170 West Main Street, and had left messages TOWN MANAGER at the Webb residence that they be contacted to arrange a time ON DANCE HALL when the Fire Chief and Building Inspector could be allowed in PERMIT the building to inspect same, but that neither Webb nor Smith had been in contact with them.. Mr. Marshall stated he had received other reports, and since the application indicated that adults and teenagers would be allowed in the dance hall, it was felt not it would/be in the best interest to grant the permit for the 609 September 21, 1977 dance hall, and recommended to the Council that the permit not be granted. Councilman House moved that the application for a permit to operate a public dance hall at 170 West Main Street be denied. Clark - aye Blair B. Brockmeyer - aye Arthur L. Meadows - aye John A. Johnston - aye .James M. Neblett - aye Some time later the applicants (Moses Webb, Jr. and Oscar M. Smith) arrived at the meeting and were advised by Mayor Ratcliff of the decision of the Council regarding their application to operate a public dance hall. Mr. Vernon M. Newman, Chairman of the Pulaski County Highway Safety Commission, advised Council that the American Automobile Association presents to the Towns and Cities pedestrian safety awards, and that recently the American Automobile Association for the northern PEDESTRIAN SAFETY AWARD district and Tidewater district met in Richmond at which time Governor PRESENTED TO COUNCIL Godwin presented the award for the Town of Pulaski and he was at this BY NEWMAN Council meeting to present the plaque to the Council. He further stated Pulaski has received this pedestrian safety award for nine years. Mayor Ratcliff accepted the plaque on behalf of the citizens of the Town of Pulaski. Mr. Newman also called Council's attention to possible USE OF MOTORIZED BICYCLES BY PERSONS WHOSE DRIVERS LIC. HAVE BEEN REVOKED legislation that will come bef ore the General Assembly in 1978 concern- ing individuals who have had their drivers license revoked because of driving under the influence of alcohol, etc., who then use motorized bicycles on the streets and highways, causing, in his opinion, to be a very dangerous situation. Town Manager Marshall stated this problem was discussed at the recent League meeting in Williamsburg, and he thought a resolution was unanimously adopted by the League, which would represent the entire State of Virginn. Mayor Ratcliff called for Committee report. Councilman Graham had no report. so~o September 21, 1977 At this time Town Manager Marshall reported that by letter dated September 15, 1977 from the Environmental Protection Agenvy, the Town was inf ormed of an increase in scope to include the evaluation of pumpover alterndtfves to the Pepper's Ferry and Hazel Hollow Service Areas, which reflects a grant increase in the amount of $33,820.00 in the Step I Grant. Mr. Marshall also stated the original and copy of Grant Amendment Number One was enclosed in the letter. and asked that a motion be made that the Town Manager be authorized to sign the Amendment for the COUNCIL Step I increase. AUTHORIZES TOWN MANAGER TO SIGN Councilman Graham moved that the Town Manager be GRANT AMENDMENT FOR INCREASE authorized to execute the Amendment for the Town. Mr. Brockmeyer stated there had been a good session on POLLUTION & "pollution, etc." at the Virginia Municipal League meeting SANITATION COMM. TO USE recently and the Sanitation and Pollution Committee will be using MATERIAL FROM LEAGUE some of this information. MEETING Mr. Brockmeyer also stated it had been brought to his attention that some of the sandlot games were cancelled and no notice was given. Town Manager Marshall and Councilman Clark, Chairman of the Recreation Committee, advised that it is the SANDLOT - CANCELLATION responsibility of the coaches of the different teams to contact OF GAMES IS RESPONSI- the parents and advise when there will be no game, and this was BILITY OF COACHES not the responsibility of the Recreation Department. NOT THE RECREATION DEPT. Councilman Johnston had no report. Councilman House had no report. Councilman Cla rk had no report. Councilman Meadows reported that the Ordinance Committee met on September 12th and considered several matters ref erred to it, the main one being the request from Mr. Turman of Blue & White September 21, 1977 60'71 Cabs, for a rate increase. Mr. Meadows stated it was the recommenda- tion of the Ordinance Committee that the taxicab rate for Zone 1 be increased 15G, and all other Zones to be increased lOG. Mr. Meadows also reported it was the recommendation of the Ordinance Committee that an ordinance be prepared requiring meters to be installed in ORDINANCE COMM. the cabs within six months from this date. RECOMMENDS TAXICAB RATE Councilman Meadows moved that an ordinance be prepared carry- INCREASE ing out the recommendation of the Ordinance Committee that the taxicab ORDINANCE TO BE rate for Zone 1 be increased 15~ and all other zones to be increased PREPARED BY TOWN ATT YlOG. Neblett - aye Councilman House moved that Council adopt a resolution to the effect that prior to the asking of another r ate increase, that meters METERS TO BE be installed in the taxicabs. Neblett - aye Town Attorney Moore advised that the ordinance on Erosion and EROSION & SEDIMENT Sediment Control has been put in draft form and the Ordinance Committee CONTROL ORD . IN DRAFT will meet and consider this again. FORM Councilman Neblett had no report Town Attorney Moore advised that the Town of Pulaski was inf ormed by the Water Control Board on September 9, 1977 that their office had not received the draft permit and special Consent Order for the extension of the NPDES Permit for the Town. Mr. Moore stated RESOLUTION ADOPTED the letter further stated that the town's facility discharges without & TOWN MGR . AUTHORIZED a valid NPDES permit and enf orcement action will be necessary if this TO EXEC. CONSENT is not corrected in the near future,. and that this permit reissuance ORDER RE: NPDES in concert with the proposed Consent Order is the only method the town's PERMIT FROM discharge can be brought into compliance. Town Manager Marshall stated WATER CONTL. BOARD further that this Consent Order refers specifically to the present plant operation and has no relationship to the one pending before the 60'2 September 21, 1977 State. Water Control Board for the expanded plant discharge into the flow line of New River . Town Attorney Moore presented and read to the Council a Resolution agreeing to the terms of the draft permit and the TOWN MGR . T4 EXECUTE Consent Order, authorizing the Town Manager and Clerk to execute CONSENT ORDER the Consent Order on the part of the Town. 0n motion of Council- man Neblett, seconded by Councilman Clark, and ca tried on the following vote, the following Resolution was adopted: C. Neblett - aye Councilman House stated he voted "aye" upon the advice of the Counsel,. with the priviso that in the future he could object to the signing of the Consent Order. RESOLUTION WHEREAS, the State Water Control Board has forwarded to the Town of Pulaski a draft permit and Special Consent Order for the Town's NPDES Permit No. VA0025178, with a request that the Town review both, and if the Town agrees therewith, that the Town execute the Special Consent Order; and WHEREAS, the Council has reviewed the above draft permit RESOLUTION and Consent Order and agrees thereto; NPDES PERMIT NOW, THEREFORE, BE IT RESOLVED~by the Council of the Town of Pulaski, meeting in regular session on this 21st day of September, 1977, that: The Council, after reviewing the draft permit and the Consent Order presented to them by the State Water Control Board, agrees to the terms thereof in order to bring the Town's sewage discharge in compliance with existing regulations. BE IT FURTHER RESOLVED that J: E. Marshall, Town Manager shall execute the Consent Order on the part of the Town, and Gladys R. Dalton, its Clerk, shall attest same. That a copy of this Resolution and the Consent Order shall be returned immediately to the State Water Control Board. Town Manager Marshall reported that the Town Planning iPLANNING Commission held a public hearing to receive any comments re- COMM. RECOMDS garding the proposed amendments to the Zoning Ordinance on height ZONING ORD. HEIGHT restrictions in the B-1 Zone, and it was the recommendation of the Commission that Council adopt the proposed amendments to the Zoning Ordinance by inserting sections that are proposed as 8-4 and 8-401 with regard to the height restrictions in the B-1 Zone. 60`3 September 21, 1977 Councilman House moved that Council accept the recommenda- tion of the Town Planning Commission, and that Council schedule a public hearing on the proposal for 7:00 P. M. October 18, 1977. The PUBLIC HEARING SET FOR motion was seconded by Councilman Clark, and carried on the following HEIGHT RESTRICTION vote: FOR ZONING ORDINANCE C. Neblett - aye Town Manager Marshall encouraged the Council to give as much publicity as possible to the Energy Conservation Clinics during the OCTOBER ENERGY month of October and sponsored by the State of Virginia Energy Office. CONSERVATION CLINICS For the immediate area, clinics will be held at New River Community College October lath thru October 15th. On motion of Councilman Clark, seconded by Councilman House, PROPOSED and carried unanimously, the proposal and draft form ordinance FIRE LANE ORD. REE. establishing fire lanes for fire vehicles and other types of emergency TO ORD. COMMITTEE vehicles, was ref erred to the Ordinance Committee for study and recommendation to Council. At 8:30 P. M. Councilman House moved that Council go into EXECUTIVE SESSION executive session to discuss a personnel matter. The motion was seconded by Councilman Clark, and carried. At 9:35 P. M. Councilman Clark moved, seconded by Councilman REGULAR Meadows, that Council return to regular session. Motion was carried. SESSION At 9:36 P. M. Mayor Ratcliff declared the Council to again be in regular session, and inquired if there were matters to come ADJOURNMENT bef ore the Council. At 9:37 P.
