Minutes of the regular meeting of the Pulaski Town
Council held September 21, 1977 at 7:00 F. M. in the Council
Chambers in the Municipal Building.
There were present: Mayor Raymond F. Ratcliff, presiding.
Councilmen: Andrew L. Graham, Jr., Bob J. Clark,
Blair B. Brockmeyer, James M. Neblett,
John A. Johnston, William A. House,

Absent: Councilman C. William Hickam, Jr.

The invocation was given by Councilman Neblett.
The minutes of the regular meeting of September 6th and

APPROVED special meeting of September 8th, 1977, were approved as re-
corded.
Mayor Ratcliff stated this was the time and place, as
had been advertised in the local paper, for holding a public
hearing on the application of Moses Webb, Jr, and Oscar M.

RE: WEBB & Smith for permission to operate a public dance hall at 170

FOR DANCE HALL West Main Street, and that Council would hear any one who wished

to speak either for or against the permit,
At this time the applicants - Webb and Smith - had not
arrived at the meeting, and Mayor Ratcliff asked Town Manager
Marshall for a report on the request.
Town Manager Marshall reported that Fire Chief Hall and
the Building Inspector had made attempts to inspect the inside

of the building at 170 West Main Street, and had left messages

at the Webb residence that they be contacted to arrange a time

when the Fire Chief and Building Inspector could be allowed in

the building to inspect same, but that neither Webb nor Smith had
been in contact with them.. Mr. Marshall stated he had received
other reports, and since the application indicated that adults
and teenagers would be allowed in the dance hall, it was felt
not
it would/be in the best interest to grant the permit for the

dance hall, and recommended to the Council that the permit not be
granted.
Councilman House moved that the application for a permit to
operate a public dance hall at 170 West Main Street be denied. The
motion was seconded by Councilman Neblett, and carried on the f ollow-

Some time later the applicants (Moses Webb, Jr. and Oscar
M. Smith) arrived at the meeting and were advised by Mayor Ratcliff
of the decision of the Council regarding their application to operate
a public dance hall.
Mr. Vernon M. Newman, Chairman of the Pulaski County Highway
Safety Commission, advised Council that the American Automobile
Association presents to the Towns and Cities pedestrian safety awards, and
that recently the American Automobile Association for the northern

SAFETY AWARD district and Tidewater district met in Richmond at which time Governor

Council meeting to present the plaque to the Council. He further
stated Pulaski has received this pedestrian safety award for nine years.
Mayor Ratcliff accepted the plaque on behalf of the citizens of the Town
of Pulaski.
Mr. Newman also called Council's attention to possible

legislation that will come bef ore the General Assembly in 1978 concern-
ing individuals who have had their drivers license revoked because of
driving under the influence of alcohol, etc., who then use motorized
bicycles on the streets and highways, causing, in his opinion, to be
a very dangerous situation. Town Manager Marshall stated this problem
was discussed at the recent League meeting in Williamsburg, and he
thought a resolution was unanimously adopted by the League, which
would represent the entire State of Virginn.
Mayor Ratcliff called for Committee report.
Councilman Graham had no report.

At this time Town Manager Marshall reported that by
letter dated September 15, 1977 from the Environmental Protection
Agenvy, the Town was inf ormed of an increase in scope to include
the evaluation of pumpover alterndtfves to the Pepper's Ferry
and Hazel Hollow Service Areas, which reflects a grant increase
in the amount of $33,820.00 in the Step I Grant. Mr. Marshall
also stated the original and copy of Grant Amendment Number One
was enclosed in the letter. and asked that a motion be made that
the Town Manager be authorized to sign the Amendment for the

Councilman Brockmeyer had no report.
Mr. Brockmeyer stated there had been a good session on
POLLUTION & "pollution, etc." at the Virginia Municipal League meeting

Mr. Brockmeyer also stated it had been brought to his
attention that some of the sandlot games were cancelled and no
notice was given. Town Manager Marshall and Councilman Clark,
Chairman of the Recreation Committee, advised that it is the

Councilman Meadows reported that the Ordinance Committee
met on September 12th and considered several matters ref erred to
it, the main one being the request from Mr. Turman of Blue & White

Cabs, for a rate increase. Mr. Meadows stated it was the recommenda-
tion of the Ordinance Committee that the taxicab rate for Zone 1 be
increased 15G, and all other Zones to be increased lOG. Mr. Meadows
also reported it was the recommendation of the Ordinance Committee
that an ordinance be prepared requiring meters to be installed in

Town Attorney Moore advised that the ordinance on Erosion and

Councilman Neblett had no report
Town Attorney Moore advised that the Town of Pulaski was
inf ormed by the Water Control Board on September 9, 1977 that their
office had not received the draft permit and special Consent Order
for the extension of the NPDES Permit for the Town. Mr. Moore stated

Town Attorney Moore presented and read to the Council a
Resolution agreeing to the terms of the draft permit and the

ORDER the Consent Order on the part of the Town. 0n motion of Council-
man Neblett, seconded by Councilman Clark, and ca tried on the following
vote, the following Resolution was adopted:

Councilman House stated he voted "aye" upon the advice of
the Counsel,. with the priviso that in the future he could object to the
signing of the Consent Order.
RESOLUTION
WHEREAS, the State Water Control Board has forwarded to
the Town of Pulaski a draft permit and Special Consent Order for
the Town's NPDES Permit No. VA0025178, with a request that the
Town review both, and if the Town agrees therewith, that the Town
execute the Special Consent Order; and
WHEREAS, the Council has reviewed the above draft permit
RESOLUTION and Consent Order and agrees thereto;
NPDES PERMIT NOW, THEREFORE, BE IT RESOLVED~by the Council of the
Town of Pulaski, meeting in regular session on this 21st day of
September, 1977, that:
The Council, after reviewing the draft permit and the
Consent Order presented to them by the State Water Control Board,
agrees to the terms thereof in order to bring the Town's sewage
discharge in compliance with existing regulations.
BE IT FURTHER RESOLVED that J: E. Marshall, Town Manager
shall execute the Consent Order on the part of the Town, and
Gladys R. Dalton, its Clerk, shall attest same.
That a copy of this Resolution and the Consent Order
shall be returned immediately to the State Water Control Board.
Town Manager Marshall reported that the Town Planning
iPLANNING Commission held a public hearing to receive any comments re-
COMM. RECOMDS garding the proposed amendments to the Zoning Ordinance on height
ZONING ORD.
HEIGHT restrictions in the B-1 Zone, and it was the recommendation of
the Commission that Council adopt the proposed amendments to the
Zoning Ordinance by inserting sections that are proposed as 8-4
and 8-401 with regard to the height restrictions in the B-1 Zone.

Councilman House moved that Council accept the recommenda-
tion of the Town Planning Commission, and that Council schedule a
public hearing on the proposal for 7:00 P. M. October 18, 1977. The

Town Manager Marshall encouraged the Council to give as much
publicity as possible to the Energy Conservation Clinics during the
OCTOBER
ENERGY month of October and sponsored by the State of Virginia Energy Office.
CONSERVATION
CLINICS For the immediate area, clinics will be held at New River Community
College October lath thru October 15th.
On motion of Councilman Clark, seconded by Councilman House,

At 8:30 P. M. Councilman House moved that Council go into

SESSION executive session to discuss a personnel matter. The motion was
seconded by Councilman Clark, and carried.
At 9:35 P. M. Councilman Clark moved, seconded by Councilman
REGULAR Meadows, that Council return to regular session. Motion was carried.
SESSION
At 9:36 P. M. Mayor Ratcliff declared the Council to again be
in regular session, and inquired if there were matters to come
ADJOURNMENT bef ore the Council. At 9:37 P. M. there being no other business, Council-
man Meadows moved, seconded by Councilman Graham, that Council adjourn.
