Minutes of the regular meeting of the Pulaski Town
Council held March 16, 1976 at 7:-- P. M. in the Council
Chamber in the Municipal Building.
There were present: Vice-Mayor Mason A. Vaughan, presiding.
Councilmen: Blair B. Brookmeyer, C. William Hickam, Jr.,
Andrew L. Graham, Arthur L. Meadows,
James M. Neblett, William A. House
Absent: Councilman Bob J. Clark

The Invocation was given by Councilman Neblett.
The minutes of the regular meeting of March 2 were approved
as recorded.
Vice-Mayor Vaughan stated the Council would be glad to hear
HEAR the public at that time, however no one spoke and Vice-Mayor

Vaughan called for the Committee reports to Council.
Councilman Hickam, Chairman of the Street Committee, re-
ported that Pulaski Merchants Council had kept their promise and
have been trying to police other merchants on the two-hour free
parking granted by the Council, and that actually the Committee had
not had a full attendance in the meeting, however he and Mr. Scott
and the Merchants Council would like to propose another ninety day

FREE PARKINGtwo-hour free parking. Mr. Hickam commended Mr. Scott for his work

FOR 90 DAYS with the merchants in trying to police the two-hour free parking.
Councilman Hickam moved that the two-hour free parking be extended
for another ninety days. The motion was seconded by Councilman Blair
Brookmeyer, and carried on the following recorded vote:

Councilman Graham reported that as had been stated by Town
Manager Marshall in his administrative report, the Utilities

the water treatment plant, Mr. Graham further stated "we are
awaiting the Facilities Plan to go along with this, which should
be received within the next three or four weeks, bef ore making a firm
recommendation on this matter" .
Councilman Brockmeyer reported the Pollution and Sanitation
Committee had met with the Town Manager and staff and reviewed in
detail an alternative solution to the landfill leachate as prepared
by the Engineering. Department staff and it was the hope that this

thus far .
In the absence of and at the request of Councilman Clark,
Councilman Brockmeyer read a report from W. F. Edwards, Chairman of
the Recreation Commission, in which it was stated the Recreation
Commission met on March 15, 1976 and unanimously passed the following
REPORT recommendations:

The recommendations of the Commiessions were discussed by Council.
Councilman House enumerated the many facilities which the Town has
provided in recent years for recreational purposes. Councilman
Neblett moved that the recommendations be referred to the Recreation
Committee, for study and report to Council. The motion was seconded
by Councilman Meadows, and carried on the following recorded vote:

Councilman House, as Chairman of the Finance Committee,
reported that Council had requested the Finance Committee to con-
sider the salary of the Mayor. He further reported that two years

this was done at that time in order that anyone voting on the

Sal. $100/MO stated the Town Charter provides that Council may raise the Mayor's
salary at any time, and the Committee recommends that the Mayor's
salary be increased from $150.00 per month to $225.00 per month,
effective duly 1, 1976, and so moved. The motion was seconded
by Councilman Neblett, and carried on the following recorded vote:

Councilman Meadows reported the Ordinance Committee had
met and considered two ordinances which had been referred to that
Committee; One being an ordinance regarding parking in front of

CONSIDERED or filling stations, and the second was to amend the Garbage
TWO ORDS .
Ordinance to allow for the use and charge for the containerized
garbage system previously discussed by the Council. Mr. Meadows
stated he understood Town Attorney Moore had prepared the two
ordinances for Council's consideration.
At 7:30 P. M. Councilman Neblett moved that Council go
into executive session to discuss a legal matter. The motion was
seconded by Councilman Meadows and carried.
EXECUTIVE At 7:50 P. M. Councilman Graham moved that Council return
SESSION to regular session. The motion was seconded by Councilman House,
and carried. At 7:52 P. M. Vice-Mayor Vaughan declared Council
to be in regular session.
Town Attorney Moore read an ordinance to amend Sections
13-8, 13-23 and 13-25 of Article III and Article IV of Chapter 13
of the Town Code and to re-enact as Sections I3.I-8, L3.1-23 and

garbage cans together with charges for same. Councilman House explained
this would be a better method of garbage collection and would be a
convenience to those who wished to use the new system. Councilman
Meadows moved the adoption of the ordinance to become effective April 1,
1976. The motion was seconded by Councilman Hickam, and carried on the
following recorded vote:

ADOPTION
OF ORDINANCE AN ORDINANCE TO AMEND SECTIONS 13-8, 13-23,
FOR MECHANICAL AND 13-25 OF ARTICLE III AND ARTICLE IV OF
CONTAINERIZED CHAPTER 13 OPi TH1L PULASKI TOWN CODE, AND TO
GARBAGE COLLECTION. RE-ENACT AS SECTIONS L3.1-8, 13.1-23, and
& RATES 13.1- 25, AS AMENDED
BE IT ORDAINED by the Council of the Town of Pulaski, Virginia,
meeting in Regular Session on this 16th day of March, 1976, that:
Sec. 13.1-8, Garbage containers generally;-bins; mechanical
containerized containers, etc.
Garbage put out for collection by the Town shall be placed in a
metal container of not more than thirty-two gallons capacity equipped
with a tight-fitting cover, or such other types of containers as the
Town shall from time to time direct and approve. The garbage container
should be so placed and maintained that dogs or other animals cannot
spill the contents. Garbage containers shall be kept in good physical
condition at all times to prevent waste and leakage.
Business and commercial establishments may use a larger size
container; provided, that the combined weight of container and
contents does not exceed one hundred and fifty pounds. In lieu of a
container, business and commercial establishments may use suitable
bins or conveyors if they are so constructed as to dump or empty directly
into garbage trucks without the necessity of Lifting, including a
mechanical containerized collection system, and are first approved by the
Town Manager.
Sec. 13.1-23. Schedules.
The town, for services rendered by it in providing for municipal
collection and disposal of garbage and rubbish under this chapter,
does hereby provide for assessing fees, collecting and enf orcing the
provisions of this article and does hereby more particularly establish
those certain charges and fees contained in Schedule A, B and C as
follows:

For volume in ixcess of two hundred sisty total containers per
month, the charge shall be at the rate of four dollars and
ninety-five cents for each additional one hundred containers

In addition to the fees provided in Schedule C, a $10.00
monthly charge shall be added to the utility bill on each container
furnished, for maintenance and replacement costs thereof.

Section 13-17 is excepted from the provisions of this
Section. (2-1-55; 8-19-63; 7-1-65; 7-1-70; 7-18-72; 8-21-74)
Section 13.1-25. Procedure and basis of assessing charges
under Schedule B.
Schedule B as set out in Section 12.L-23 shall be applicable
to all business establishments, apartment buildings, including
duplex units, any buildings with two or more families dwelling
therein, lodging houses and rooming houses, hotels, industries,
plants, schools, officers, office building, private and public
institutions and establishments and all other establishments,
activities or buildings not coming under Schedule A, or under
Mechanical Containerized Collections as provided in Schedule C.
This ordinance shall become effective the 1st day of
April, 1976.
Town Attorney Moore then presented and read to Council an
ordinance to amend Section 16-24, Article II, Chapter 16 of the
Town Code and to re-enact as Section 16.1-24~ as amended, dealing
with parking in front of fire hydrants, fire stations, or blocking
public or private driveways or filling stations. On motion of
Councilman Meadows, seconded by Councilman House, and carried on
the following recorded vote, the following ordinance was adopted:

ADOPTION OF AN ORDINANCE TO AMEND SECTION 16-24,
ORDINANCE ARTICLE II, CHAPTER 16 of THE PULASKI TOWN
PROHIBITING CODE AND TO RE-ENACT AS SECTION 16.1-24,
PARKING IN AS AMENDED
FRONT OF
DRIVEWAYS, ETC. BE IT ORDAINED by the Council of the Town of Pulaski, Virginia,
meeting in regular session on the 16th day of March, 1976, that
Section 16-24, Article II, Chapter 16 be amended and re-enacted as
Section 16.1-24, Article II, Chapter 16 of the Pulaski Town Code,
as follows:
Section 16.1-24 - Parking in front of fire hydrant,. fire
station, or blocking public or private driveway or filling station, etc.
No person shall park a vehicle or permit it to stand, whether
attended or unattended, upon a street in front of a public entrance
or driveway, or to park any vehicle so as to block a public or
private driveway of a business, commercial, industrial or other
like establishment, or within fifteen feet in either direction of
afire hydrant, or the entrance to a fire station, nor within
twenty feet from the intersection or curb lines, or, if none, then
within fifteen feet of the intersection of property lines at an
intersection of streets.
This ordinance shall become effective upon passage.
There was a short discussion regarding the Town's Weed Ordinance
as it relates to a health hazard.

Councilman Meadows encouraged Council to attend the meetings
of the Town Planning Commission whenever possible, which meets the
CBD MEETS second Tuesday in each month. Mr. Meadows also stated the

TUESDAY IN Central Business District meets the fourth Tuesday in the quarter
QUARTER
and the next meeting will be sometime in April, and encouraged the
members of Council to attend some of the meetings.
Town Manager Marshall reported the Retirement Committee
met March 5, and discussed the idea of investigating the
Virginia Supplemental Retirement Plan for the Town employees.
As a result of this meeting the Retirement Committee voted to re=
commend to the Council that an appropriation of approximately
$500.00 be~made to have an acturial study to compare the Town's
Plan with that of the Virginia Supplemental Plan. Mr. Marshall
$500 APPROP.
FOR STUDY OF brought out in his report, and this has also been discussed by
VA . SUPPL.RET .
PLAN Council in the past, the General Assembly amended their action at
a previous session and extended the time for which all local plans
must substantially conf orm as of July, 1977. Councilman Neblett
moved that the sum of $500.00 be appropriated from the General
Fund Surplus for the purpose of an acturial study be made to
compare the Town's Retirement Plan to that of the Virginia
Supplemental Retirement Plan. The motion was seconded by
Councilman Graham, and carried on the following recorded vote:

Town Manager Marshall reported a letter has been received
from State Health Department that plans and specifications for the

PERMIT FOR traveling water screen to be installed at the Peak Creek pumping
SCREEN AT
PEAK CREEK station appear to be in order and that a recommendation will be
PUMPING STA.
TO BE ISSUED made to the State Health Commissioner that a construction permit
be issued for the project. Construction to begin upon receipt
of permit.
Town Manager Marshall reported that by telephone from the
X220,000 Department of Housing and Urban Development, the Town was notified

EXT. OF SEWER that their application for funds for funding sewer lines in

various locations within the corporate limits had been approved in
the amount of $220,000., and a final application will be submitted
as expeditiously as possible.
Town Manager Marshall reported the update of the Pulaski
Thoroughfare Plan being worked on by the Pulaski Transportation Study
Committee has scheduled a public inf ormation meeting for March 23 at
7:30 P. M. in the Council Chambers. Mr. Marshall stated the purpose
of the meeting is to receive comments and attempt to answer questions
MEETING AND concerning the 1975 and year 200 Socioeconomic Date that has been
PUBLIC MEETING developed by the Highway Department and reviewed by the Transportation
TO BE HELD Study Committee. Also, representatives from the Highway Department will

Marshall urged all members of the Council and Mayor Ratcliff to be
present for this meeting.
At 8:40 P. M. Councilman Graham moved that Council adjourn. The
motion was seconded by Councilman Brockmeyer, and carried.
