M. in the Council Chambers in the Municipal Building There were present: Mayor Raymond F. Ratcliff, presiding. Councilmen: Arthur L, Meadows, Blair B. Brackmeyer, William A. House, Bob ,J, Clark, C. William Hickam, Jr., Andrew L. Graham, James M. Neblett, Mason .A. Vaughan Also present: Town Manager: J. E. Marshall Clerk: Gladys R, Dalton Town Attorney: Garnett S. Schrader, Southwest Times James R. Mabe, One Hour Janetizing Co. Mrs. Fred Mitchell The invocation was given by Councilman Brockmeyer. The minutes of the regular meeting of June 1 and special meeting of June 7, 1976 were approved as recorded. Town Attorney Moore stated notice of the joint public hearing to be held at this time by the Town Planning Commission and PUBLIC HEARING Pulaski Town Council had appeared in the local newspaper, to REZONING REQ. CHRISLEY TO BE hear the public on the petition of Everett Junior Chrisley for RESCHEDULED rezoning of property occupied by Tom's Drive-In on South Washington Avenue. Mr. Moore stated further that through error copies of said notice were not mailed to the adjoining property owners, nor those property owners across the street, as required by law, and because of this oversight it would be necessary to continue the joing public hearing. Mayor Ratcliff asked the Planning Commission members if they PLANNING COMM. wished to correlate their efforts with those of the Town Council, TO GO ALONG WITH COUNCIL and Mr. Powers, Chairman of t~-e Commission, stated that would be ON RESCHEDULE OF PUBLIC HEARING in order since the property owners had not been notified by mail and no action could be taken at that time. Councilman Graham moved that the joint public hearing be continued until July 1, 1976 at 4:00 P. M. and that notices of such be mailed to the property owners involved. The motion was June 15, 1976 seconded by Councilman Brockmeyer, and carried on the following re- corded vote: C. William Hickam, Jr. - aye William A. House - aye Andrew L. Graham - aye Bob J. As there was no HEAR PUBLIC one who wished to be heard at that time, Mayor Ratcliff called for the Committee reports of Council. Councilman Hickam, as Chairman of the Street Committee, reported that the Committee had considered the request of Claremont Corporation that Holyfield Drive and Monte Vista Drive, Extended, be included in the HOLYEIELD DR. & MONTE VISTA Town's street system. Mr. Hickam stated it appeared the streets DR. COMMITTEE Councilman Hickam brought this to the attention of the Town Planning Commission and moved that the Commission make a study of the present Subdivision Ordinance on street specifications. Neblett - aye Councilman Hickam stated it was the recommendation of the Street Committee that the Town accept Holyfield Drive and Monte Vista Drive, Extended, into its street system. Neblett - aye r*~'~!dj June 15, 1976 Councilman Hickam reported this week marks the end of the trial period for free parking in the downtown-area, and the Committee had considered alternatives to this situation, with FREE TWO-HOUR PARKING EXT. no definite conclusions. Mr. Hickam also stated it had been 45 DAYS brought to the attention of the Committee that people working in the downtown area have abused the free parking privileges granted by the Town. Mr. Hickam stated it was the recommendation of the Committee that the free parking be extended for forty-five (45) days, and so moved. M. the Pulaski Lodge BPOE presented BENNINGTON to Mayor Ratcliff the Bennington Flag to fly on the Town's flag pole, FLAG PRESENTED TO TOWN BY and asked that mention of this be incorporated in the minutes of this BPOE CLUB meeting, and so moved. The motion was seconded by Councilman Clark, and carried. Councilman Brockmeyer had no report. Mr. Brockmeyer brought CLEANING up the subject of cleaning of lots and cutting of weeds, etc. OF LOTS OF WEEDS DIS- There followed a lengthy discussion regarding the method of CUSSED handling the situation and the Town ordinance governing same. Councilman Vaughan reported the Retirement Committee had received a request from Ernest Draper, an employe of the Public ERNEST DRAPER PERMITTED TO Works Department, for early retirement as of August 1, 1976. Mr. RETIRE EARLY AUGUST 1, 1976Vaughan stated Mr. Draper had been with the Town a little over thirty-five years, and it was the opinion of the Retirement Committee that his request be granted, and so moved. Councilman House brought to the attention of the Council that several years ago certain General Fund monies had been set aside as restricted funds for a new Fire Department Substation and Equipment theref or. The total amount of these funds restricted was $45,846.55, $45,846.55 Restricted and during the budget work sessions, it was discussed that these funds Funds for " Fire Substa. be unrestricted and re-restricted for use on the Memorial Drive Project re-appropriated for Memorialand it was appropriate to do so bef ore the end of the present fiscal Drive year. Mr. House moved that the amount of $45,846.55 that had been restricted for the Fire Substation and Equipment be.unrestricted and re- restricted for the Memorial Drive Project and used theref or. Neblett - aye Councilman House also reported that for accounting purposes, certain Revenue Sharing Fund appropriations should be made to certain APPROPRIATION Revenue Sharing Fund Expenditure accounts, and moved that the sum of OF REV . FUNDS- TO $1,000 to appropriated to Account ~~4010, Fire Department Substation; VARIOUS ACCOUNTS $1,000 be appropriated to Account ~~4013, Accounting & Billing Equipment; $5,000 to Account ~~4038, Sidewalk, Curb and Gutter, and $1,500 to Account ~~4040, Traffic Signals. Vaughan - aye SEEDING AT REC. AREAS NOT COMPLETE, WILL BE RE- S EEDED William A. House - aye Bob J. Clark - aye Arthur L.Meadows - aye James M. Neblett - aye Councilman Clark reported that some of the seeding of the recreational areas had not been completely successful because of the lack of rains, but that the contractor, Mr. Gregory, would come back and re-seed the areas. Mr. Clark stated Calfee Park was in good condition and that the first. Phillies game would be June 22nd. ~~~-~-~ June 15, 1976 Councilman Meadows had no report. However, Mr. Meadows asked that the members of the Ordinance Committee meet with REQ.MEETING OF ORDINANCE him on June 21st at 5:00 P. M. to consider the Pulaski TV CAble COMM. FOR CONSIDERATION System request for a rate increase in order that a recommendation OF TV CABLE REQUEST FOR can be presented to Council. RATE INCREASE Councilman Neblett had no report. Town Attorney Moore reported that a search of the records of the Pulaski County Clerk's Office indicates that although it was the intention of James L, McMillan and Paul Roop to dedicate Medallian Drive to the Town of Pulaski, the street location was TOWN ATTY. REPORT ON not entirely correct and not laid out as intended. Mr. Moore ST. LOCATION OF MEDALLIAN advised this discrepancy could be corrected by having Mr. McMillan DRIVE and Mr. Roop execute a Deed of Easement for the exact location of the street lines, together with a map to be recorded in the Clerk's Office along with the deed. Mr. Moore advised that the Street Committee would work on this further. Mayor Ratcliff at this time recognized Mr. James R. Mabe, owner of One Hour Janetizing Company. Mr. Mabe stated he had appeared JAMES R .MAB~E OPPOSES in protest to the proposed utility consumer tax. Mr. Mabe stated UTILITY CONSUMER TAX this utility tax rate would increase his tax by five hundred percent, and maintained it was not a fair tax for him when it is compared to the tax local industries would be required to pay. Mr. Mabe was advised his objection would be given consideration. Town Managwr Marshall again brought to the attention of the Council the requirements being laid down with regards to the permit ORD . ON PERMIT & OPERATION and operation of the Water Treatment Plant, and discussed with REQUIREMENTS FOR WATER Council the adoption of an ordinance regulating cross connection TREATMENT PLANT OPERATIONS control and backflow prevention for the Town's Waterworks. Mr. REF . TO COMMITTEE Marshall suggested that this be referred to the Ordinance Committee, Town Engineer, Town Attorney and Town Manager. Council- man Graham so moved. Neblett - aye June 15, 1976 5820 Council reviewed the request, as presented by Town Manager Marshall,. of the four (4) Town employes who are 65 years of age and over and drawing their retirement, that they be allowed to work another twelve C FOUR TOWN EMPLOYES months under the provisions of the Town's Retirement Plan. The four OVER 65 & STILL WORKING employes being Ed Hurd and Winf ord H, Morris in the Public Works GRANTED PERM. TO WORK Department; Maxwell Wheeler in the Police Department and Gladys Dalton ANOTHER YEAR Secretary and Clerk of the Council. Councilman Vaughan moved that the four employes (as named) be allowed to continue in the employ of the Town for another year. Neblett - aye Town Manager Marshall reported that the containerized garbage 1 NEW CONTAIN- collection system has been placed into operation at several different ERIZED GARBAGE COLL. WORKING locations within the Town and appears to be working quite well with WELL only some slight changes that may be necessary from a time standpoint or from a pickup standpoint. Mr. Marshall stated the equipment seems to be working quite well mechanically. Mrs. Fred Mitchell was recognized by Mayor Ratcliff. Mr. Mitchell had several questions relative to the upcoming fiscal year MRS . FRED MITCHELL 1976-77 budget, and after some discussion with Council, Mayor Ratcliff HEAR RE: 1976-77 advised- her that these matters would be considered at the public BUDGET hearing on the proposed budget to be held on June 22nd at 4:00 P. M. and suggested Mrs. Mitchell attend the public hearing. Council agreed to hold its organizational meeting July 1, 1976, at 4:00 P. M. At 8:30 P. M. there-being no further business, Councilman Vaughan moved-that Council adjourn.
