Minutes of the reorganizational and regular meeting of the Pulaski Town Council and a Joint Public Hearing with the Town Planning Commission, held July 1, 1976 at 4:00 P. M. in the Council Chambers in the Municipal Building. There were present: Mayor Raymond F. Ratcliff, presiding.• Councilmen: James M. Neblett, Andrew L. Graham, Arthur L, Meadows, Blair B. Brockmeyer, Bob J. Clark, William A. House, Mason A. Vaughan, C. William Hickam, Jr. Also present: J. E. Marshall, Town Manager Gladys R. Dalton, Clerk Garnett S. Moore, Town Attorney John A. Johnston, Councilman-elect Roger Williams, Treasurer-Director of Finance H. R, Coake, Town Engineer Members of Town Planning Commission: John_Powers, Mrs.Charles Settle, H. R. Chrisley Approximately ten (10) Town citizens The invocation was given by Councilman Vaughan. Mayor Ratcliff welcomed the visitors. He stated this was the reorganizational meeting of the Town Counei, which would be the end of a term for some aAd-the beginning for others. Mayor Ratcliff paid tribute to Mason A. Vaughan, the retiring Councilman, for his may services to the Town, and on behalf of his fellow Councilmen, presented to Mr. VAUGHAN Vaughan a plaque for eight years service as Councilman for the Town of RETIRING COUNCILMAN Pulaski. Mr. Vaughan expressed his thanks and stated it had been a GIVEN PLAQUE rewarding experience serving onthe Town Council, and that he had JOHNSTON enjoyed working with the members of the Council. TAKES SEAT AS Mayor Ratcliff called on Virginia Supreme Court Justice Alex M. NEW COUNCILMAN Harman, Jr., who•paid tribute and honor to the retiring member of Council, and on behalf of himself and the citizens of the Town, thanked Council he stated for their many services to the Town, a Town which/has been in existen~8 for eighty years. Council then seated and welcomed its newest member, John A. Johnston. Justice Harman stated oftentimes being a Councilman is a thankless job, but the progress of the community depends largely upon those serving as such. r._ ~ n ~ __ c-~'~~~~c~ July 1, 1976 The record will show that at a regular Municipal Election held for the Town of Pulaski, Virginia, on May 4, 1976, the following officers were elected with terms to begin July 1, 1976: N1$yoz~ Raymond F . Johnston, Councilmen to serve four years, each of whom have duly qualified bef ore the Clerk of the Circuit Court of Pulaski County, Virginia, as provided by Section IX of the Town of Pulaski Charter of 1948, and the Charter Amendements approbed by the Legislature. On motion of Councilman Graham, seconded by Councilman Brookmeyer, the reading of the abstract of votes cast in the Town of Pulaski, ABSTRACT OF VOTES Virginia Municipal Election held May 4, 1976 were dispensed with; and REELECTION MAY 4, 1976 further, they be accepted and entered into the minutes of the Town Council as an Abstract of Votes in the Municipal Election for the Town of Pulaski, held May 4, 1976, and the members so elected be seated: The motion carried on the following recorded vote: C. Graham to serve as Vice-Mayor for the period 1976 - 1978. There was no second. Councilman Neblett nominated William A. House to serve as Vice-Mayor for the period of 1976 - 1978. There was no second. Councilman Brockmeyer nominated Arthur L. Meadows to serve as Vice Mayor for the period of 1976 - 1978. The voting, on a show of hands, was as follows: For Andrew L. Graham: Hickam, Graham abstained, and Cla rk. For William A. House: Neblett and Johnston. For Arthur Meadows: Brockmeyer and Meadows. At this point Mayor Ratcliff proceeded with the other business r~~~p,,~}} of the Council, but for the purpose of continuity, the minutes will show that later in the meeting Mayor Ratcliff respectfully requested that RE: nominations on the floor for Vice-Mayor be reconsidered carefully to NOMINATION OV VICE-MAYOB.ome to some conclusion, and a short recess of Council was held on motion of Councilman Clark, seconded by Councilman House, and carried. 1 Mayor Ratcliff called for the decision of the Council regarding the nomira tion of a Vice-Mayor. Councilman Hickam moved that the previous action of the Council be rescinded. The motion was seconded by Councilman Clark, and carried on the following recorded vote: C. Neblett - aye Mayor Ratcliff stated the floor waf, open for nomination of a Vice-Mayor. Councilman Clark nominated Andrew L. Graham for Vice-Mayor. No second. Councilman Neblett nominated William A. House for Vice-Mayor. No second. Councilman Brockmeyer nominated Arthur L. Meadows for Vice-Mayor. No second. Councilman Hickam moved the nominations be closed for Vice-Mayor. Graham: Hickam, Graham and Clark. For Arthur L. Meadows: Meadows and Brockmeyer. For William A. House: Neblett, House and Johnston. The Run-off Vote was as follows: For Andrew L. Graham: Hickam, Graham, Clark and Meadows. For William A. House: Brockmeyer, House, Neblett and Johnston. At this point the name of Andy Graham was written on a GRAHAM TO slip of paper by Mayor Ratcliff; and the name of William House was SERVE AS VICE-MAYOR written on another slip of paper by Mayor Ratcliff. These were L9II6-1978 placed in an envelope by Town Attorney Garnett S. Moore, and Jane Graham, of the Press, was asked to draw from the envelope. The name of Andy Graham was drawn from the envelope, and Councilman • Andrew L. Graham became the Vice-Mayor for the period of 1976-1978. Mayor Ratcliff stated Council had been f urnished copies of the minutes of the regular meeting of June 15th, Public Hearing APPROVED MINUTES June 22nd, and special meetin June 29th, and asked if there were corrections to same. The minutes of the three meetings were approved as recorded. Mayor Ratcliff stated that as had been advertised in the local newspaper, this was the time and place for a joint public hearing bef ore the Town Council and the Town Planning Commission on a petition from Everett Junior Chirsley, t/a Tom's Drive-In, South JOINT PUBLIC Washington .Avenue, Pulaski, Virginia, and as proprietor and tenant HEARING ON REZONING OF of the property upon which Tom's Drive-In is located, asked that TOM'S DRIVE-IN AREA - TO BE the zoning be changed to allow the necessary expansions to the CONSIDERED AT NEXT physical structure of Tom's Drive-In, as stated in the petition. MEETING OF COUNCIL Byron R. Shankman, Attorney for Everett Chrisley, stated that according to the Town's Zoning Ordinance, the business of Tom's Drive-In is being operated as a Non-Conforming Use act-ivity, and it was felt with the present increase in business, should be allowed to expand; further, that rezoning of the parcel would not change the character of the areas inasmuch as there are stores along the street in that area. July 1, 1976 -~~=~~~~ Mrs. Thomas C. Huddle and Berman Grantham, both residents in the immediate area, opposed the rezoning. request, objecting to any further business development in that area-,.and asked Council to deny the request. Town Manager Marshall.: presented a peti:tan received in the mail containing the signatures of thirteen (13) property owners in the area, opposing the request for rezoning of the lot occupied by Tom's Drive-In restaurant. Mrs. Hubble and Mr. Grantham both had signed the petition. The petition was -received and filed. - At this point, 5:00 P. M., Mayor Ratcliff asked if there were others who would like to speak on the matter of rezoning. No ane spoke and the Town Planning Commission members retired to consider the matter and come t-o some conclusion~of same. At-5:15 P. M, the Town Planning Commission returned to Council and Chairman John Powers gave the following report of the Commission: "It is the decision of the Commision to recommend that REPORT OF this area not be rezoned due to zoning ordinances and objections TOWN PLAN. of residents of this.: area which. was submitted: in the form of a COMMISSION petition. RE REZONING _ ,, REQUEST TOM'S "Although the Commission has recommended against rezoning DRIVE-IN it does not want to place a hardship on the business operated by Mr. Chrisley and would suggest that a review of the situation be made to determine-if the Town Council could permit the expansion of the existing non-conf orming use without re- zoning, provided that permission was ob-tained from the residents whose signatures appear on the. petition ." Councilman House moved that the matter be placed on the agenda for the next Council meeting. The motion was seconded by Councilman Clark, and carried on the following recorded vote: C. Neblett - aye Mayor Ratcliff called for Committee reports. COMMITTEE Councilman Hickam had no report. REPORTS Councilman Graham had no report. Councilman Brockmeyer had no report. Councilman House had no report. Councilman Clark .had no report. But commented that the Recrea- tional Program was progressing well and .all seem happy with the program this year. ~~'-~~$-~ July 1, 1976 Councilman Meadows had no report. But discussed briefly the request for a rate increase by the Pulaski TV Cable System, but no firm report at this time was made. Councilman Neblett had no report. Mayor Ratcliff asked all members of Council to visit the FLOAT F OR JULY Armory and view the float Rich is being prepared to be entered in FOURTH PARADE the July 4th parade celebration by the Town. Town Attorney Moore stated work is still being done by MEDALEIAN the Engineering Department on the Medallian Drive situation, and DR . WORK CONTINUES there was nothing to report since the last meeting of Council. Town Manager Marshall reported that notice has been received that the Town is eligible for a $220,000 HUD Grant for sewer extensions and improvements. He stated there is a provision that it be accepted or rejected by an official of the Town. Council:;- TOWN MGR. AUTHORIZED man Brockmeyer moved that the Town Manager be authorized to execute TO EXECUTE HUD GRANT the form indicating the Town will accept th e Grant. Neblett - aye Town Manager Marshall briefly pointed out to Council the request received from .Chief H. B. Childress regarding the "loitering" and vandalism in,the:Town and mor particularly Jackson Park, and the fact that under the present ordinances of tie Town the situations VANDALISM are impossible for the officers to cope with. Mr. Marshall stated he IN PARKS REF. TO had explained this more fully in his Administrative Report, and COMMITTEE asked that the matter be referred to the Ordinance Committee, Town Attorney, Town Manager and Chief of Police.
