HomeMy WebLinkAbout10-19-76 Minutes of the regular meeting of the Pulaski Town Council, held October 19, 1976 at 7:00 P. M. in the Council Chambers in the Municipal Building. There were present: Mayor l~aymond F. Ratcliff, presiding. Councilmen:- James M. Neblett, Arthur L. Meadows, Bob J. Clark, William A. House, John A. Johnston, Andrew L. Graham, Blair B. Brockmeyer, C. William Hickam, Jr. Also present: J. E. Marshall, Town Manager Becky Plott, Acting Clerk of Council Garnett Moore, Town Attorney Roger A. Williams, Town Treasurer Visitors: Jane Graham, WPUV Radio Station J. R. Schrader, Southwest Times Mr. Joseph A. Shoda, Pulaski Cable TV 23 Citizens of the Town The meeting was called to order by the Mayor. The invocation was given by Councilman House. The minutes of the regular meeting held on October 5, 1976 were approved as recorded. Mayor Ratcliff opened the discussion of the proposed rate in- crease by the Pulaski Cable TV System. Councilman Meadows gave his Committee report which consisted of changes made by the Cable TV company in their operation. The Mayor asked for the public to voice their opinion on the subject and noted PUBLIC HEARING that this meeting was being held in order that the public might be allowed to have their say. Several citizens felt the rate increase was not justified as the ON TV CABLE service of the company was not good. RATE INCREASE, referred Town Attorney Moore noted that the schedule needed to be more precise according to the cost of each charge. Councilman House quentioned Mr. Shoda on the fairness of installa- BACK TO tion charges to customers if the cable is already in a house and asked ORDINANCE if it could not be considered as a relocation charge instead of being COMM as a new installation charge. Councilman Hfckam questioned Mr. Shoda on the fees charged to hospitals, motels, etc. in regard to the rates the company would charge them. Mr. Shoda said all this could be negotiated and worked out to suit the customers and Council. Councilman Meadows moved that this matter be ref erred back to the Ordinance Committee for them, along with Mr. Shoda, to work out these ~"~`~'~~~ October 19, 1976 detailed matters. Neblett - aye Mayor Ratcliff called for the next item of business which consisted of ahe removal of the parking meters from the streets. Bill Scott, President of the Pulaski Merchant's Council, noted that the two hour free parking has been good for the Town and for the business and, speaking for the merchants, would like to ask that the meters be removed. Mr. Scott told Council that the merchants MERCHANTS FEEL TWO HR. would help to keep from having the two hour free parking abused by FREE PARKING SUCCESSFUL, employees of the stores. & COUNCIL- Several other businessmen also requested that the meters be ADOPTS ORDINANCE removed as it helps business and also improves the possibility of FOR SAME renting the empty buildings downtown to prospective merchants. Councilman Neblett moved that Council approve the Ordinance which was prepared for the deactivation of the meters on the street to become effective as of October 20, 1976. Neblett - aye AN ORDINANCE to repeal Sections 16-28 through 16-36 and Sec. 16-39 of Chapter 16, Article II, Division 2 of the Pulaski Town Code, Parking Meters, and to enact in lieu thereof Sections 16.1-28 through 16.1-34, and to provide penalty for violation of said sections. PARKING METER BE IT ORDAINED by the Council of the Town of Pulaski, ORDINANCE Virginia, meeting in Regular session on this 19th day of October, 1976, that: The provisions of Chapter 16, Art. II, Division 2, Sec. 16-28 through 16-36 and Sec. 16-39 are hereby repealed, and Sections 16.1-28 through 16.1-34 are enacted in lieu thereof. 16.1-28 Parking of vehicles shall be allowed on the streets of the Town for a period of two hours, or for such period of time as indicated on a lawfully posted sign, in any space which is appropriately marked for. parking, or where a proper sign indicates that parking is permitted. 1 16.-1-29. If any such vehicle shall remain parked in a parking space beyond the parking limit of two hours, or beyond the lawfully posted time, such vehicle shall be considered as parked over-time. 1 PARKING METER ORDINANCE October 19, 1976 16.1-30 The parking of a vehicle for more than two hours or more time than is allowed as shown by a lawful sign, or in any such part of a street where parking is permitted as set out above, by the owner, operator, manager or driver thereof, shall.be unlawful and a violation of this ordinance. It shall be unlawful and a violation of this ordinance for any person to cause, allow, permit or suffer any such vehicle registered in his name to be parked overtime or beyond the lawful period of time as above provided. 16.1-31 Reference to Parking Meters in Section 16-77 or any other sections of the Town Code, insofar as they ref er to overtime parking at meters and penalties to be assessed for violation of such overtime parking; shall not apply to the en- forcement of this Division of the Town Code. However, other provisions of Sec. 16-77 or other sections in the Code, such as the duties of the Town Manager in reference to parking, issuing of warrants if a ticket is not paid within the time hereinafter provided, and the provision requiring payment of all sums to be credited to the general fund of the Town, shall apply to this ordinance, as well as any other provision of the Code in refer- ence to parking, as long as they are not in conflict herewith. 16.1-32. Notices of violation given under this ordinance may be satisfied by paying $2.50 on each citation, in the police department of the Town or at such place as the Town Manager shall provide within 24 hours of the time said notice was given. Upon failure to do so, the procedure for,enf orcement thereof shall be as provided in Sec. 16-77 and 16-19. ~_,~, ~. a e •.> ~ ~;;.~ 16.1-33. There is excepted from the provisions of this ordinance, spaces alongside of or next to meters located on off-street parking lots, and emergency parking of authorized vehicles. 16.1-34. Council by Motion or Resolution may provide for the removal, repair, storage, and disposition of meters and assessories, including the posts upon which they are mounted. This ordinance shall become effective on the 20th day of October, 1976. Councilman House noted this had been a matter of concern of his for several years. He advised the Merchants Council that it was up to them to handle the abusers of the free parking and not Town Council's responsibility. Councilman Graham made the motion that Town Manager Marshall have i the authority to remove meters and signs and install two hour free parking signs. Neblett - aye Mr. Philip Tickle, Manager of the Pulaski Theatre, questioned TICKLE QUESTIONED COUNCIL RE: BREAKIN AT THEATRE Council on what was being done in conjunction with a break-in at his theatre. He advised Council that the Police Department had not contacted ~-~ ~:~y~ October 19, 1976 him as to the progress of solving the burglarly and asked for some information in order that he might report to his home office on~the- progress being made. Councilman House moved that Council ask Town Manager Marshall TOWN MGR . TO CHECK to check with the Police Chief and have him contact Mr. Tickle and WITH POLICE CHIEF RE: discuss the matter. Seconded by Bob Clark, and carried. THEATRE BREAKIN Councilman Brockmeyer questioned Town Manager Marshall on the follow-up procedures by the Police Department regarding such matters. AND WHOSE RESPONSIBILITltown Manager Marshall stated it is the responsibility of the citizens to keep in touch with the Police Department as well as the Police to inform the involved parties of progress being made in solving such matters. Francis Watson questioned Council on the water condition in WATER PRESSURE ON ROBINS ON North Pulaski. Mayor Ratcliff advised Mr. Watson that .the matter TRT. AGAIN QUESTIONED was being investigated to determine cost and related inf ormation. Mayor Ratcliff reported on a notification received from Governor Mills Godwin asking the Local governing bodies to recognize November 11th as Veteran's Day. Councilman Clark moved that NOV . 11TH EACH YR. Council proclaim November 11th be set aside each year as Veteran's TO BE VETERANS Day.. Mayor Ratcliff turned the meeting over to Vice- MAYOR RATCLIFF LEFT Mayor Graham, and he requested that he be excused from the meeting. MEETING Vice-Mayor Graham then called for the Committee reports. Councilman Hickam had no report.. Councilman Graham had no report. Councilman Brockmeyer had no report, but asked if Council REQUEST FOR could have an executive session after this meeting to discuss a EXECUTIVE SESSION personnel matter. October 19, 1976 Councilman Brockmeyer stated he felt the area needed the Center for the Senior Citizens. Councilman Johnston noted that if Council waits to vote on the Grant until the financial inf ormation is gathered, we may loose the Grant. Councilman House stated he felt the program was excellent and ~~ ~~ ~~~~' GRANT FOR REPAIRS TO moved that the Town Manager be authorized to accept the Grant. Neblett - aye Town Manager Marshall also noted that 'a considerable amount of the renovation work can be done by the Town personnel which will help control the in-kind cost to the Town. Councilman Johnston moved that the Town Manager provide Council I i with facts and figures regarding as much as the cost analysis on the TOWN MGR . TO PROVIDE renovation of the building with regards to the operation of the Center. Neblett - aye Councilman House stated Council needed to take some action on appropriating funds for the payment of the Town's share of the cost of the Memorial Drive Project which can be paid for in stages of the entire amount at one time. Councilman House moved that Council pay the $75,251.22 the Town AUTHORIZED $75,251.22 BE PAID ON MEMORIAL DR. EXPENSE & REMAINDER OF COSTS BE PAID AS FUNDS ARE AVAILABLE has on hand and that Town Manager Marshall be authorized to pay the additional cost as the funds become available. Neblett - aye Councilman Clark had no r eport. Councilman Meadows called for an Ordinance Committee meet ing ORDINANCE COMMITTEE on October 28, 1976 at 5:00 P. M. TO MEET OCT. 28TH Councilman Neblett moved that the Council meeting schedul ed for November 2 be changed to N ovember 1 due to the 2nd being COUNCIL Election Day. Town Manager Marshall reported the Twin Oaks Water line had REPORT ON TWIN OAKS been approved by the State Health Department and the Town now WATER LINE had to go through the process of obtaining a permit from the 1 _J Highway Department as these are secondary roads. Town Manager Marshall advised Council there needed to be an amendment to the Utility Tax Ordinance and asked that the Ordinance NEED TO AMEND Committee get with the Town Manager and the Town Attorney to work out UTILITY TAX ORD. this matter. Town Manager Marshall asked Council to consider approving October 25th as a holiday for the Town employees in observance of Veteran's Day. VETERAN'S Council noted that Veteran's Day was not a scheduled holiday DAY HOLIDAY, OCT. 25TH for the employees. Councilman Hickam moved that the subject be REF . Councilman SESSION Neblett moved, seconded by Councilman Johnston that Council go into an Executive Session to discuss a personnel matter, and so carried. REGULAR At 10:05 P. M. Councilman Brockmeyer moved that Council return to SESSION regular session. Seconded by Councilman Meadows, and carried. At 10:-6 P. M. Vice-Mayor Graham declared Council to again be in regular session and inquired if there was other business to come bef ore ADJOURNMENTthe Council.
