Minutes of the regular meeting of the Pulaski Town Council
held April 19, 1977 at 7:00 P. M. in the Council Chambers in
the Municipal Building.
There were present: Mayor Raymond F. Ratcliff, presiding.
Councilmen: Blair B. Brockmeyer, Andrew L. Graham,
William A. House, Bob J. Clark,

The invocation was given by Councilman Brockmeyer.
The minutes of the regular meeting of April 5, 1977 were approved
as recorded.
Mayor Ratcliff stated Council would be glad to hear the

public at that time if any one wished to speak. However, at
this time most of the visitors had not arrived at the meeting
and no one spoke at this time.
Mayor Ratcliff called for reports of the Committees.
Councilman Hickam had no report.
Councilman Graham reported that he and Ronnie Coake had
talked with Mr. Gordon Dixon, Executive Director of the New River
Valley Planning District Commission, and Mr. Dixon indicated that

Regional Commission office. Mr. Graham suggested that the Finance
and Utility Committees meet and direct the Town Manager and Town
Engineer to proceed with the legal work and if necessary Council'

hold a special meeting to accomplish this. Councilman Graham moved that
this matter be referred to the Utility and Finance Committees for a
report back to the Council. The motion was seconded by Councilman
Neblett, and carried.
Councilman Brockmeyer reported that the Pollution and Sanitation
Committee met on April 14th with members of the Pulaski County Board
COUNTY of Supervisors to further discuss the possibility of the County using

Councilman Brockmeyer reported that the Pulaski County Chamber of
Commerce is bringing an Arts and Crafts Festival to Pulaski on June 25th
ARTS & and 26th, to be held on the County Courthouse lawn. Mr. Brockmeyer suggested

Barry D. Akers, a former employee of the Pulaski Police
Department advised Council that a petition is being circulated and
will be presented to the Council later, asking for a State Police
investigation of the Pulaski Town Police Department, Mr. Akers

Doug Manuel advised Council that he has been working with Little
League Baseball teams but felt they had been neglected because no

Clyde McMillan advised Council that about a year ago he requested
that an alley off Springer Avenue be opened, but that he had heard
nothing further about this. Mr. McMillan also advised Council that
surface water is damaging his mobile home Park. Me. McMillan stated
there are nine families Living in this park and he would like for the

OPENING
ALLEY Town Attorney Moore presented and read to Council an ordinance
establishing water rates for large volume users and multi-family housing
units. Tad Steger of Steger's Laundry told Council he felt the way in
which the ordinance steps up the fees to be unrealistic. He also stated
his utility bill at the Laundry would increase from $1400 to $2800, which
would mean a burden on older people who are forced to use the public
laundry system.. Mayor Ratcliff filed a letter from the Sadler Hosiery

Councilman Hickam moved the adoption of the ordinance establishing
water rate changes to be effective June 1, 1977 and water used after
June 1, 1977 to show on the next billing at the new rate. The motion
was seconded by Councilman Neblett, and carried on the following recorded

AN ORDINANCE TO REPEAL SECTIONS 29-13 AND 29-18
AND TO AMEND AND RE-ENACT SECTIONS 29-14 AND 29-15
AS 29-14.1 AND 29-15.1 AS AMENDED, AND TO RE-ENACT
SECTIONS 29-19 AND 29-20 OF THE CODE OF THE TOWN
OF PULASKI, VIRGINIA, ESTABLISHING WATER RATES AND
CHARGES
BE IT ORDAINED by the Council of the Town of Pulaski, Virginia,
meeting in Regular Session on this 19th day of April, 1977, that
certain sections of Chapter 29"BE, and they are hereby repealed, or
amended and re-enacted as follows:
Section 29-13. REPEALED.
Section 29-14.1 Charles for Water Service Generally.
(a) Consumers other than those subject to the provisions
of Sec. 29-15.1 within the corporate limits of the Town shall pay for
water purchased from the Town at the following rate:

First: 3,000 gallons minimum $3.50
Next 20,000 gallons 0.40 cents per thousand gals.
Next 200,000 gallons 0.35 cents per thousand gals.
Next 777,000 gallons 0.30 cents per thousand gals.
Over 1,000,000 gallons 0.25 cents per thousand gals.
(b) Consumers in the same category as sub-section (a )
above, but are outside the corporate limits who purchase water dir ectly
from the Town shall pay for the water at the following rate:
First 3,000 gallons minimum $5.25
Next 20,000 gallons 0.66 cents per thousand gals.
Next 200,000 gallons 0.522 cents per thous. gals.
Next 777,000 gallons 0.452 cents per thous. gals.
Over 1;000,000 gallons 0.372 cents per thous. gals.
Section 29-15.1 Water Rates for multi-family dwelling
units and trailer or mobile home parks.
The following policy is hereby established for rates and
billing procedure for multi-f amily units, trailers or mobile homes
where water used is measured by only one meter and the entire
amount due is billed to and paid by the owner or others for all
the facilities, contained within the multi-family unit, trailer,
or mobile home park.
WATER RATE
(a) Meters - new construction
ORDINANCE
Owners, lessees, builders, person, persons or,corporations,
constructing and operating multi-family housing units, trailers or
mobile home parks, after the eff ective date of this ordinance, shall
have the option to install separate water meters for each housing
unit or othhr separate facility therein or for each trailer or mobile
home within a park, and pay the water charge applicable to single-
dwelling units, or if they prefer, they may install one water meter
for the multi-family units, trailer or mobile home park and pay
water rates as established by this section for multi-family units,
etc.
(b) Meters - Existing construction
Owners, lessees, builders, person, persons or corporations,
who now own or operate multi-family housing units, trailers or
mobile home parks and pay all the water charges theref or through one
master meter shall elect within one (1) year from the effective
date of this ordinance, by notice in writing to the Town Manager,
whether they will continue to use one master meter and pay the rate
herein established for payment of water measured by such meter or
install separate meters for each unit, facility, trailer or mobile
home, and be billed and pay charges applicable to single dwelling
units for each such unit.
(c) Cost basis of separate meter installed
In the event consumers referred to in sub-sections (a) and (b)
above who now own or operate multi-family housing units, trailers,
etc., elect to install separate meters for each such unit or facility,
the Town shall charge them the actual cost for said meter and labor,
if any, which charge shall not .exceed the charge for Town connections
as set out in Section 29-9 of this Article.
(d) Rates for master meter charges - within Town
Consumers within the corporate limits who elect to use one
meter, shall pay water charges for multi-family housing units,.
trailers and mobile homes in a park, as follows:

Minimum rates for the first 3,000 gallons or any part
thereof used by a unit shall be $3.50 for the first unit,
and $2.00 for each unit thereafter.

Total rate to be paid shall be determined as follows:
Step No. 1: The total number of gallons of water for the
period measured by the waster meter shall be determined. If the
total number of gallons does not exceed the total number of housing
units (together with other separately measured facilities within
the building or park), multiplied by 3,000 gallons (minimum),
apply only the minimum rate to each unit.
Step No. 2: (a) If the total number of gallons calculated
in Step No. 1 exceeds the total number of housing units (Multiplied
by 3,000 gallons), apply the minimum rate for the first 3,000 gallons,
plus the additional rates on the number of gallons of water used in
each bracket determined at the rate and in the manner provided in 2 (b).
The total water charge due for the period, minimum plus the
additional, amount from each bracket shall be set out and billed as one
statement.
(b) Additional rates of Qallons used above 3,000 Qallons
to consumers inside of Town corporate limits
WATER RATE
Rates to be applied on the number of gallons above the minimum
of 3,000 gallons per unit shall be as follows:
ORDINANCE
Divide the total number of gallons used between 3,001
gallons and 23,000 gallons, by the number of housing
units and multiply each 1,000 gallons or part thereof
by .40 cents.
Divide the total number of gallons used between 23,001
gallons and 223,000 gallons, by the number of housing
units and multiply each 1,000 gallons or part thereof
by .35 cents.
Divide the total number of gallons used between 223,001
gallons and 1,003,000 gallons, by the number of housing
units and multiply each 1,000 gallons or part thereof by
.30 cents.
Over 1,003,000 gallons divided by number of housing
units and multiplied by .25 cents per 1,000 gallons or
part thereof .
(c) Rates applicable outside corporate limits
Consumers or water users outside the corporate limits shall
pay water charges for multi-family housing units; trailers and mobile
home in a part where owners or others elect to use one meter, as
follows:
Apply Step No. 1 and No. 2 above to outside users with the
exception that the minimum rate for 3,000 gallons for the first unit
shall be $5.25, and $3.000 for each unit thereafter.
(d) Apply the same formula established in Step No. 2 (b)
above to determine the number of thousand gallons in each bracket.
The rate to be charged in each of the four. brackets shall be as
follows:
Rates for gallons used above the 3,000 gallons for. each
housing unit:
Divide the total number of gallons between 3,001 and 23,000
by the number of housing units, and multiply each 1,000
gallons or part thereof by .60 cents.

Divide the total number of gallons between 23,001 and
223,000 by the number of housing units., and multiply
each 1,000 gallons or part thereof by .52-1/2 cents.
Divide the total number of gallons between 223,001 and
1,003,000 by the number of housing units, and multiply
each 1,000 gallons or part thereof by .45-1/2 cents.
Over 1,003,000 gallons divided by number of .housing
WATER RATE units and multiplied by .37-1/2 cents per 1,000 gallons
or part thereof .
ORDINANCE Section 29-18. REPEALED.
Section 20-19. Rebate in Case of Vacancy
No rebate of water charge shall be made due to a vacancy
of said property unless the owner or lessee thereof shall notify the
Town Treasurer of said vacancy within ten (10) days after the
vacancy occurs, and the vacancy continues for a period of at least ,-
ninety (90) days.
Section 29-20. Re-connection Charge
A charge of $2.00 shall be made for each time water is
turned on after same has been turned off at the request of the
owner or occupants, except the charge shall be $5.00 for each time the
water is turned on when the request is made at any time other than
during normal work hours of the Department of Public Works.
This ordinance shall become effective on June 1, 1977.
Water used after June 1, 1977, for which consumer is billed in
August and thereafter shall be charged at the rate herein provided.

RESOLUTION
WHEREAS, the County of Pulaski was declared a f ederal
disaster area;
NOW, THEREFORE, BE IT RESOLVED by the Council of the
Town of Pulaski, Virginia, meeting in regular session on this
RESOLUTION 19th day of April, 1977, that the County of Pulaski is hereby
authorized to act as agent for and and in behalf of the Town
of Pulaski for submission of Federal Disaster aid applications
for municipal damage.
Town Attorney Moore advised that the suit involving the
Town of Pulaski and the Pulaski Community Hospital relative to
easements for water lines across the Walter Allison property, the
Court had confirmed five easements to the Town and it had now been

found another water line had been installed where an easement had not
been obtained, however the Town had agreed to become liable for same.
The Court indicated the Town should pay for the sixth agreement in
the sum of $750.00, and that check in said amount should be mailed

commending Mr. Leroy Early, Director of Public Works, for his untiring
devotion to duty, the responsibilities of his office and the welfare and

Immediately upon the second, one member of the Council indicated

Councilman Graham moved that during the absence of Town
Manager Marshall Roger Williams will keep the Council advised on
finances, and H. R. Coake will serve as Acting Town Manager. The
motion was seconded by Councilman Brockmeyer, and carried.
At 8:50 P. M. Councilman Neblett moved that Council adjourn.
The motion was seconded by Councilman Meadows, and carried.
