Minutes of the regular meeting of the Pulaski Town Council
held June 6, 1977 at 4:00 P. M. in the Council Chambers in the
Municipal Building.
There were present: Mayor Raymond F. Ratcliff, presiding.
Councilmen: C. William Hickam, Jr., John A. Johnston,
Bob J. Clark, Andrew L. Graham, Jr.,
Blair B. Brockmeyer, Arthur L. Meadows,
James M. Neblett
Absent: Councilman William A. House (Mr. House arrived at
the meeting at 5:35 P. M. as Council
was going into Executive Session)

The invocation was given by Councilman Graham.
The minutes of the regular meeting of May 17th and special
meeting of May 23rd were approved as recorded.
Mayor Ratcliff welcomed the visitors and stated Council
would be glad to hear any one who wished to spaek.
Dan Rooker, President of a citizens group for the renovation
of the Dalton Theatre, and Andrew Mayo, of the New River Valley
Planning District Commission, appeared bef ore Council seeking

BY LOCAL GROUP in the amount of $11,000 would complete renovation and design work,
and would be a continuation grant to the grant already received.
Mr. Mayo stated that with the endorsement of the Council they would
be in a better position to submit the application, and would give the
funding agency a reasonable idea of the sentiments of the Town
citizens. He further stated such an endorsement by the Council
would not require any financial endorsement by the Town. Council
was also advised that several meetings of citizens have begin held
and it was their belief the project has been well received. They
further advised Council that a non-profit corporation would be
organize the renovate and operate the whole Dalton Building, and
the corporation would receive rental income from the building.

Councilman Clark moved that Council endorse this project;
stating he felt it would be worthwhile for the community and the Town
would also benefit. The motion was seconded by Councilman Brockmeyer,
and carried on the following recorded vote:

l3oward Sadler appeared bef ore Council in support of his letter
to the Town Council dated May 23, 1977 regarding the establishing of a
citizens committee to investigate the administrative problems in the
Pulaski Town Police Department. Mr. Sadler pointed out that a great
deal of time would be involved to develop any laymans expertise concerning
law enf orcement or police administrative procedures bef ore one could
intelligently discuss them, and for this reason he urgently suggested
that, while the State Police investigation of the Town's Police Department
regarding criminal matters is pending, Council should choose the citizens
Committee and designate its chairman in order that the Committee could
begin to familiarize themselves with current administrative procedures
in the town police department as supplied by the Town Manager's office,

as well as talking with police professionals from New River Community
SADLER College or other police agencies to familiarize themselves with standard

police department procedures and when the appropriate time comes f ors
them to begin interviewing officers of the town force they will have
some well founded laymans expertise to aid any course they may take.
Mr. Sadler stated this could be done without any interf erence with the
State Police investigation, and would give the committee enough judgment
and expertise to begin their work inside the town police department at
the appropriate time. Mr. Sadler further stated that he had discussed
this with Mr. Dow Owens, Pulaski County Commonwealth's Attorney, and Mr.
Owens had stated he had no objections to the formation and seating of
such a committee, or that the committee begin its discussion and study
on police policies pending the outcome of the State Police investigation.
Mr. Sadler stated the committee should report back to the Council and the
committee take its direction from the chairman of the committee.

Mayor Ratcliff stated that Council has not been idle on this,
but it was the feeling that the citizens committee should not be in
force until such time as the State Police investigation is
completed and a report made.
Councilman Neblett moved that the Safety Committee, along
with Mr. Owens and Town Attorney Moore, take this under advisement

Councilman Hickam reported that it was the recommendation of
the Nominating Committee that Harry W. Foglesong and Earl G. Hill be

Councilman Graham reported the Utility Committee and Finance
Committee had met since the last meeting of Council to further
consider funds for the Town's wastewater treatment plant, based on

stated to be able to consider these alternatives it was necessary
that additional work by the Consulting Engineers be undertaken
and completed within sixty days, at an estimated cost of $57,425 -

Councilman Graham moved that the Town Manager be authorized
to begin immediately to prepare the necessary forms to amend the
town's Step I Grant in the amount of $57,425 and have it submitted as

Councilman Johnston reported that at the April 5th meeting of

Councilman Meadows reported the Ordinance Committee had con-
sidered an amendment to the Water Rate Ordinance recently adopted
by the Council, and asked Town Attorne Moore to read the ordinance

AN ORDINANCE TO AMEND SECTION 29-15.1
AND RE-ENACT IT AS SECTION 29-15.2 AS AMENDED,
OF THE CODE -OF THE TOWN OF PULASKI, VIRGINIA,.
ESTABLISHING WATER RATES AND CHARGES
BE IT ORDAINED by the Council of the Town of Pulaski,
Virginia, meeting in Regular Sessuon on this 6th day of June,
1977, that Section 29-15.1 of Chapter 29, BE, and it is hereby
amended and re-enacted as Section 29-15.2, as follows:
Section 29-I5.2 Water Rates for multi-family dwelling
units and trailer or mobile home parks,
commercial and business buildings
The following policy is hereby established for rates and
billing procedure for multi-family units, trailers or mobile
homes, commercial and business buildings where water used is
measured by only one meter and the entire amount due is billed
to and paid by the owner or others for aTl the facilities con-
tained within the multi-family unit, trailer, or mobile home
park, commercial and business buildings.
(a) Meters - new construction

ORDINANCE
Owners, lessees, builders, person, persons or corporations,
constructing and opera ting multi-family housing units, trailers
or mobile home parks, commercial and business buildings, after
the effective date of this ordinance, shall have the option to
install separate water meters for each unit or other separate
facility therein or for each trailer or mobile home within a
park, and pay the water charge applicable to single~;~welling
units, or if they pref er, they may install one water meter for
the multi-family units, trailer or mobile home park,. commercial
and business buildings and pay water rates as established by
this section for multi-family units, etc.
(b) Meters - Existing construction
Owners, lessees, builders, person, persons or corporation,
who now own or operate multi-family housing units, trailers or
mobile home parks, commercial and business buildings and pay all
the water charges theref or through one master meter shall elect within
one (1) year from the effective date of this ordinance, by notice
in writing to the-Town Manager, whether they will continue to use
one master meter and pay the rate herein established for payment of
water measured by such meter or install separate meters for each
unit, facility, trailer or mobile home, commercial or business
building and be billed and pay charges applicable to single dwelling
units for each such unit.
(c) .Cost basis of separate meters installed
In the event consumers ref erred to in sub-sections (a) and (b)
above who now own or operate multi-family housing units, trailers,
commercial or business buildings, etc., elect to install separate
meters for each such unit or facility, the Town shall charge them the
actual cost for said meter and labor, if any, which charge shall not
exceed the charge for Town connections as set out in Section 29-9
of this Article.
(d) Rates for master meter charges - within Town
Consumers within the corporate limits who elect to use one
meter shall pay water charges for multi-family housing units,
trailers and mobile homes in a park, commercial and business buildings,
as follows

Minimum rates for the first 3,000 gallons or any part
thereof used~by a unit shall be $3.50 for the first unit,
and $2.00 for each unit thereafter.

Total rate to be paid shall be determined as follows:
Step No. 1: The total number of gallons of water for the
period measured by the master meter shall be determined. If the
total number of allons does not exceed the total number of units
(together with other separately measured facilities within the
building or park), multiplied by 3,000 gallons (minimum), apply
only the minimum rate to each unit.
Step No. 2: (a) If the total number of gallons calculated
in Step No. 1 exceeds the total number of units (multiplied by
3,000 gallons), apply the minimum rate for the first 3,000 gallons,
plus the additional rates on the number of gallons of ,water used
in each bracket determined at the rate and in the manner provided
in 2 (b).
The total water charge due for the period, minimum plus the
additional, amount from each bracket shall be set out and billed
as one statement.
(b) Additional rates of gallons used above 3,000 gallons
to consumers inside of Town corporate limits
Rates to be applied on the number of allons above the minimum
of 3,000 gallons per unit shall be as follows:
Divide the total number of ,gallons used between 3,001
gallons and 23,000 gallons, by the number of units
and multiply each 1,000 gallons or part thereof by
.40 cents.

Divide the total number of gallons used between 23,001
gallons and 223,000 gallons, by the number of units and
RATE multiply each 1,000 gallons or part thereof by .35 cents.
Divide the total number of gallons used between 223,001
ORDINANCE gallons and 1,003,000 gallons, by the number of units and
multiply each 1,000 gallons or part thereof by .30 cents.
Over 1,003,000 gallons divided by number of units and
multiplied by .25 cents per 1,000 gallons or part thereof.
(c) Rates applicable outside corporate limits
Consumers or water users outside the corporate limits shall
pay water charges for multi-family housing units, trailers and
mobile home in a park, commercial and business buildings where owners
or others elect to use one meter, as follows:
Apply Step No. 1 and No. 2 above to outside users with the
exception that the minimum rate for 3,000 gallons for the first unit
shall be $5.25, and $3.00 for each unit thereafter.
(d Apply the same formula established in Step No. 2 (b)
above to determine the number of thousand gallons in each bracket.
The rate to be charged in each of the four brackets shall be as
follows:
Rates for gallons used above the 3,000 gallons for each unit
Divide the total number of gallons between 3,001 and 23,000
by the number of units, and multiply each 1,000 gallons or
part thereof by .60 cents.

part thereof by .52-1/2 cents.

Divide the total number of gallons between 223,001 and
1,003,000 by the number of units, and multiply each 1,000

ORDINANCE Over 1,003,000 gallons divided by number of units and
multiplied by .37-1/2 cents per 1,000 gallons or part
thereof .
This ordinance shall become effective on July 1, 1977,
Water used after July 1, 1977, for which consumer is billed in
August and thereafter shall be charged at the rate herein
provided.
Councilman Meadows inquired about the Randolph Avenue water

Town Manager Marshall recommended to Council that they
study the plans and sketches, and cost estimates regarding the

the desire of the Council, an attempt would be made to ascertain if a
Community Development Block Grant, or some other type 100% federal
funding is possible for a program of this type. Councilman Hickam moved
that the Town Manager be directed to find out what the Council can do on
this and the possibility of obtaining a federal grant. The motion was
seconded by Councilman Clark, and carried.
At 5:35 P. M. the following vote was taken on the motion of

At 6:20 P. M. on motion of Councilman Hickam, seconded by

Councilman Neblett moved that the action taken by Council at
their meeting on the 17th day of May, 1977, on the rezoning petition of
