Schrader, Jr. and Sharon Gemmell The invocation was given by Councilman Ratcliff. held July 20, 1971, at 7:30 P. M., in the Municipal Building. Absents S. G. Frye Glen K. Aust Mason A. Vaughan Minutes of the regular meeting of July 6th were approved as recorded. 1 Mr. Warner complained of the dust situation which exists on TOWN MGR. TO CHECK ON DUST SITUATION OAKHURST AVE.& NEW YMCA Oakhurst Avenue as a result of traffic to and from the new YMCA building, and it was suggested that the Town Manager look into this to see what could be done to eliminate this situation. It was also brought out that the Town would be responsible for hard surfac- ing the fifteen (15) feet of street to the property line of the YMCA, which will help in the dust problem. ~-_ Bob Bunts asked why the cannon in Jackson Park was moved to CANNON MOVED TO DORA HWY PARK EXPLAINED EXPLANATION OF CURVE IN ST. IN FRONT OF NEW MUNICIPAL BUILDING the Dora Highway Park, and Mayor Edens advised that the Beautification Committee felt another gun similar to the one south of the statute would give better balance and as the American Legion had no objections to this move, it was placed in the Dora Highway Park. He also stated it was felt that children would feel freer to climb on and explore the cannon in its present home. Mr. Bunts also inquired whose idea it was to pur a curve in First Street in front of the new Municipal Building. Mayor Edens replies that it was at the suggestion of Council and himself that the street had been so laid out, as it was felt it would enhance the new 1 ~{ . Mayor Edens stated there were very few complaints to these two projects, in fact, more compliments had been received than complaints from the public. about Mr. Bunts also asked/that his suggestion of dancing or REC. Sam Skeens, Bill Watson and Forrest Gregory of the New River Valley Rescue Squad appeared before Council to ascertain what amount, if any, the Town Council had placed in its budget for the fiscal year NEW RIVER RESCUE ~ 1971-72 for the Rescue Squads. They were advised that the sum of SQD. ADV. BUDGET HAS $1500.00 had been placed in the budget for "Life Saving Crews" and $1500. FOR "LIFE SAVING no definite amount was, designated to either of the Rescue Squads now CREWS" in operation. Mr. Skeens pointed out that for. the past eight months the New River Valley Rescue Squad has been operating under new manage- ment; that its volunteers undergo extensive training in first aid and all of its services are free to the public, but it must be understood they cannot operate without contributions from local governing bodies. Roy Rives of 909 North Jefferson Avenue informed Council that a sewer line is leaking into a storm drain causing a terrible ROY RIVES COMPLAINS odor in the vicinity of his home and surrounding area. TO INV. because of this odor. Town Manager Marshall advised that this matter would be looked into at once. Mayor Edens advised it was the time and place, as so advertised in the Southwest Times, for a public hearing on the request of Reginal D. PUBLIC HEAR- Scott and Myrtle G. Scott, his wife, for the abandonment of a certain ING ON PET. C. present opposing the closing of this walkway, or alley, and Town Attorney Groseclose stated all proper and legal steps had been taken in the matter. Mr. Groseclose presented a report of the viewers in which it was stated that in their opinion no inconvenience would result from the ~-,~ ~ a t~~~ July 20, 1971 abandonment and discontinuance of the use of or by closing the walkway set out in the petition filed with Council. It was brought out that this walkway was originally for the safety of children in keeping them off Newbern Road many years ago, but that it now dead ends on private property, and the owners of this property have signed a statement that they have no objection to it being closed. Councilman House stated that since the walkway now serves- no real purpose and dead ends on private property, moved that the Council adopt an ordinance abandoning and discontinuing the walkway, which motion was seconded by Councilman Congrove, and carried on the f ollowing recorded vote: J. M., 20th, July 1971, on the petition of PUBLIC Reginald D. Scott and Myrtle G. Scott, requesting the closing, HEARING abandonment of certain streets, avenues and alleys within the Town of Pulaski, Virginia, as follows: 10 FEET WALKWAY OR ALLEY PROPOSED TO BE CLOSED That certain LO feet wide walkway or alley begin- ning in the Southern boundary of Lynwood Street between Lots 67 and 68, in Section C, as shown on a revised map of Macgill Subdivision on record in the Cle rk' s Office of the Circa it Court of Pulaski County, Virginia, in Plat Book L, Page 62; thence running between parallel Lines of Lots 67 and 68 the length of the of oresaid lots a distance of 150 feet to the Northern boundary line of a service driveway near a parcel on the of oresaid plat as being "reserved for business". Jordan, Viewers TO Viewers are hereby instructed by the sa~.d Town Attorney VIEWERS as follows: (1) That your appointment was made by the said Town under authority granted in Title 15.1-364 o.f the Code of Virginia of 1950, as amended, and any and alI other general powers granted said Town. (2) That as viewers appointed by said Town, you are, instructed to view that certain 10-foot walkway, or alley, set out and described in the Resolution adopted by the Town on June 21,,1971. a copy being attached hereto for the purpose of describing the 10-f oot walkway, or alley, to be closed. JORDAN ALLEY - AN ORDINANCE TO VACATE A CERTAIN WALKWAY OR ALLEY IN THE MACGILL SUBDIVISION LY- ING AND BEING IN THE TOWN OF PULASKI, VIRGINIA, AND TO PROVIDE FOR PAYMENT OF COSTS OF THIS PROCEEDING WHEREAS, Reginald D. Scot t, and Myrtle G. Scott filed their petition on the 22nd day of June, 1971, with the Council of the Town -of Pulaski; Vir ginia, after posting. on the 4th day of June, .1971, notice as required by law in at least three places in said ORDINANCE Town, which posting was at least ten days prior to the filing on June 22, 1971, said petition requesting the Town to vacate and AUTHORIZING abandon a certain walkway or alley in Macgill Sttbelfuf•aicx~,--•set out and described in said petition; and, CLOSING - WHEREAS, by Resolution adopted on the•22nd day of June, 1971 the Council appointed C. Plunkett an alternate, pursuant to Section 15.1-364 of the Code of Virginia of 1950, as amended; and, OR ALLEY e WHEREAS, subsequent thereto, all the landowners who whould be affected by the vacation of the aforesaid portion of said walkway or alley in Macgili Subdivision were notified of the filingof said petition and of the public hearing thereon set for the 20th day of July, 1971, in the Town Office of Pulaski, Virginia, by notice delivered to the landowners, if any, and also by proper publication of a Public Notice in the Southwest Times, a local newspaper; and, 1 1 July 20, 1971 WHEREAS, on the 20th day of July, 1971, said public hearing was held pursuant to the of oresaid notice, and no one appeared in opposition to the vacating and abandoning of said walkway as set out in the petition and hereinbef ore described, and upon the viewer's report dated the 20th day of July, 1971, stating that in the opinion of the viewers no inconvenience would result .from the abandonment and discontinuance of the use of or by closing the walkway set out in the petition filed with Council and hereinafter more particul- arly described; and, WHEREAS, the Council of the Town of Pulaski, Virginia, is ORDINANCE of the opinion and so finds that no inconvenience would result from the closing of the walkway, and that alI requirements of law have been complied with; CONTINUED NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE TOWN OF PULASKI, VIRGINIA, as follows: That certain LO foot wide walkway or alley begin- ning in the Southern Boundary of Lynwood Street be-. tween Lots 67 and 68 in Section C, as shown on a re- vised map of Macgill Subdivision of record in the Clerk's Office of the Circuit Court of Pulaski County, Virginia, in Plat Book 1, page 62; thence running be- tween parallel lines of Lots 67 and 68 the length of the of oresaid lots a distance of 150 feet to .the Northern boundary line of a service driveway near a parcel on the aforesaid plat as being reserved for busi- ness; be, and the same is hereby, vacated as a public walkway in the Town of Pulaski, Virginia. BE IT FURTHER ORDAINED that the Town Manager of the Town of Pulaski, Virginia, cause to be recorded in the Deek Books of the County of Pulaski, Virginia, located in thee-Clerk's Dffice of the said County, a copy of this ordinance, and to take any and all other steps necessary to properly place on the record the said ordinance. BE IT FURTHER ORDAINED that C. C. Jordan, C. L. Plunkett, G. C. Hall, the of oresaid viewers, be paid the sum of Ten. Dollars, ($10.00) each, and that the costs involved in the,. vacating of .the aforesaid walkway be paid by the petitioner. And thereupon, .the Mayor of the said Tawn ~of Pulaski, upon presentation to him of said ordinance, approved and signed the same, this 21st day of July, 1971. Reporting for the Utility Committee; Councilman Graham moved that the matter presented to Council by Mr. Roy Rives of Jefferson Avenue be referred to the Utility Committee and Town Manager for a report to Council, which motion was seconded by Councilman White, and carried. Mr. Graham further stated that Donald Vaughan of Twin Oaks, a residential area-between Peppers Ferry Road and Newbern Road, had contacted UTILITY COMM. TO him and Councilman Ratciiff, requesting the Town to furnish water to that STUDY & REPORT area, and moved that this also be referred to the Utility-Committee and ON TWIN OAKS REQ.FOR Town Manager for a proper report to Council. The motion was .seconded by WATER SERVICE Councilman Ratcliff, and carried. ~_ July 20, 1971 Mayor Edens again reviewed the Committees needing re- COUNCIL TO CONTACT appointments and no definite action was taken by the Council at that PERSONS FOR time. However, members of Council were asked to contact certain APPOINT- MENT TO individuals relative to serving on certain committees. COMMITTEES Town Manager Marshall presented to Council two trailer applications in the name of Lesli_e.Moore, 408 Birch Street, and Kelly R. Councilman Ratcliff so moved, seconded APPLICS . TO BE ADV4y Councilman House, and carried. ..Town Manager Marshall stated it was. hoped that Gatewood Recreation area would soon be ready for Council to establish some REPORT ON opening date. That the Town forces would prepare the proper base and if possible have the blacktopping contractor lay the materials. Town Manager Marshall reported that a petition had been received from residents of Pinnacle Street and Vine Street relative PET. He stated further that it was hoped this matter could CROSSING be worked out with the Railroad Company to eliminate the problem.
