Minutes of the reguhr meeting of the Pulaski Cown Council, held
September 7, 1971, at 4:00 P. M,, in the Municipal Building.
There were present: Mayor C. Robert Edens, presiding.

The invocation was given by Councilman Graham.
Minutes of the regular meeting of August I7th and special meeting
of September 1st, were approved as recorded.
Mr, Robert Love, Chairman of the Pulaski County Public Service
Authority advised Council that the County needs to obtain water from
the Town to serve the Thornspring area; that through the efforts of
Representative William C. Wampler the County has been granted an FHA
loan in the amount of $708,000 and a Grant for an additional $108,000,
TOWN TO subject to certain conditions, Mr. Love stated the County needs to

LETTER TO know something definite from the Town relative to its ability to furnish

SERVING water services, and asked that the matter be turned over to the Utility

COUNTY Committee of Council. Town Manager Marshall advised that the Town had
advised the County on what basis it could furnish water and sewer service
to the new schools in the County by letter of recent date. Councilman
White moved that the matter be referred to the Utilities Committee, which
motion was seconded by Councilman Ratcliff, and Councilman Ratcliff moved that
the Town re-affirm its letter to the Board of Supervisors relative to the
water and sewer services to the High School and Elementary School. This
motion was seconded by Councilman Frye, and both motions carried,
Mrs. Duncan mentioned the fact that several matters which she had

DUNCAN brought to the attention of Council had been taken care of for which she

COUNTIL was thankful, and then asked if something could be done about cleaning
out a culvert that is located to the rear of the CITGO Service Station
at Fifth and Monroe Avenue.

Town Attorney Moore presented to Council a Resolution accepting
the petition and notice of Frank Quesenberry, E, C. Quesenberry and
Vance Farmer that a certain portion of Second Avenue, in the Subdivision :,'`
of the lands of J. H, Powers, known as Adams Street, be closed and
abandoned. These being spread upon the minutes, as follows:
NOTICE OF APPLICATION TO THE
COUNCIL 'OF THE TOWN OF PULASKI, VIRGINIA
FOR VACATION OF A CERTAIN STREET SECTION
WITHIN THE TOWN OF PULASKI
AS PROVIDED FOR IN SECTION 15.L-364
OF THE CODE OF VIRGINIA, AS AMENDED
Take notice that the undersigned, named as Petitioners in
a certain Petition, a copy of which is attached hereto, shall,
on the 7th day of September, 1971, or as soon thereafter as
they may be heard, present to the Mayor and the Council of the
Town of Pulaski, Virginia, their Petition requesting that a
certain portion of a street lying within the Town of Pulaski,
Virginia, be vacated in accordance with Section 15,I-364 of the
Code of Virginia, as amended. The said street requested to be
closed is described as follows:

shown on the plat entitled "Subdivision of the

CLOSING PORTION and recorded in Pulaski County Circuit Court

FILED BEGINNING at the Western corner of Lot Number
Fourteen (14) in Block B of said subdivision
and running S 60 deg. 231 feet to the Southeastern
corner of Lot Number Seven (7), Block B of said
subdivision, thence S. 18 deg. IO' 30 feet to the
Eastern corner of Lot Number Seventeen (17), Block
D of said subdivision, thence N 60 deg. W 240 feet
to the Northwestern corner of Lot Number One (1),
Block D of said subdivision and the intersection
of Seamd Avenue and Dillon Street, thence with the
East line of Dillon Street N 36 deg. E 30 feet
to the point of BEGINNING, Second Avenue as
shown on plat is now Adams Street,
All of said street requested to be vacated and closed
lies adjacent to the properties of the Petitioners, all of which
is more particularly set forth in said Petition attached hereto
and made a part of this Notice.
Given under their hands and posted this 27th day of
August, 1971, at the Pulaski County Courthouse, Town of
Pulaski Municipal Office and Town of Pulaski Fire Department,
all of which are Located in said town.

The undersigned do respectfully petition the Town Council
of Pulaski, Virginia, to close that certain portion of Second
Avenue, now Adams Street, lying within said Town of Pulaski, and
bounded on either side by property belonging to the undersigned
as set out on the plat described below as follows:
(1) STREET - That portion of Second Avenue as
shown on the plat entitled "Subdivision of the
Lands of J. H. Powers", dated October 10, 1927,
and recorded in Pulaski County Circuit Court
Clerk's Office in Deed Book 57, at page 148.
BEGINNING at the Western corner of Lot Number
Fourteen (14) in Block B of said subdivision
and running S 60 deg. 231 feet to the Southeastern
corner of L.ot Number Seven (7), Block B of said
subdivision, thence S 18 deg. LO' 30 feet to the
Eastern .corner of Lot Number Seventeen (I7), Block
D of said subdivision, thence N 60 deg. W 240 feet

Block D of said subdivision and the intersection

Petitioners pray that all necessary steps and procedures,
including proper notice, appointment of viewers or Commissioner,
hearings, adoption of final ordinance, etc., be had in this matter;
and that upon the completion thereof, the Council vacate and agan-
don said street and release any and all claims thereto to such
property owners as shall be determined by law to be entitled to
said section of said street, which is to be vacated and abandoned
for public purposes.

WHEREAS, a petition and application for the closing of
a certain portion of Second Avenue, in the Subdivision of the
lands of J. H. Powers, now known as Adams Street, has been
filed with the Town of Pulaski, Virginia, by Frank Quesenberry,
E. C, Quesenberry and Vance Farmer, of Pulaski, which portion
of said street is as follows:
STREET - That portion of Second Avenue as
shown on the plat entitled" Subdivision of the
Lands of J. H. Powers", dated October 10, 1927,
and recorded in Pulaski County Circuit Court
Clerk's Office in Deed Book 57 at page 148.

VIEWERS
WHEREAS, it appears that proper notice as required by
statute has been posted in at least ithree places in the Town,
including the Municipal Office, Pulaski Firehouse and the
Courthouse of the Circuit Court of Pulaski County, Virginia,
on the 27th day of August, 1971, and at least ten (10) days
have expired since the said posting; and,
WHEREAS, the Council of said Town, upon viewing the
petition filed herein, finds it to be in proper order and
directs it to be received and filed, and further directs
that the viewers hereinafter appointed, 'view the described street,
and that all other steps necessary be followed to bring this
matter properly before the Council for its final considera-
tion;
NOW, THEREFORE, BE IT RESOLVED that:
(1) The application be reviewed and filed.
(2) Viewers be appointed, as follows:
1, Curtis C. Jordan
2. W. Marvin Board
3. E, C. Grigsby
Alternate: C. L. Plunkett and G. C. Hall
(3) Such viewers shall meet and report in writing whether in
their opinion, and if any, what, inconvenience would result
from the vacation and closing of the street as requested in
the said petition.
(4) That the Clerk of Council give written notice to
all landowners affected by closing of the street and, further,
that said Clerk of Council give public notice by publication
of same in the Southwest Times, a local newspaper, once a week
for two consecutive weeks, and that said notice describe the said
street, and set out therein that the Town may vacate and close
the same, and that the 5th day of October, 1971, be fixed as a
date upon which the said Council will hold a public hearing
upon said matter pending before it, and that all persons
interested may be heard either for or against any portion, or
all, of said petition under consideration..

(5) That the said Town'Manager and Attorney for said
Town do any and all other things necessary for the proper deter-
mination of this matter.
As had been advertised, a public hearing was held on the

application of Garland 0. Byrd to place a house trailer on Birch Street.
No one appeared to oppose this application, and Town Manager Marshall
recommended that it be approved subject to certain stipulations, as
follows;. That the l~.ot be subdivided into separate parcels of Land
to provide for the house trailer and also have a separate lot for any

TRAILER other existing structures; that a permit for a septic tank be obtained

SUBJECT from the Health Department, and that the trailer not be rented. Council-

Councilman Ratcliff advised that the Utilities Committee had met
with the officials of the BLP Corporation and worked out a tentative

Corporation, stating the conditions upon which the service is granted,
Said Agreement to be prepared by the Town Attorney.
On motion of Councilman Frye, seconded by Councilman Ratcliff,
and carried on the following recorded vote, the following Resolution per-
taining to the transfer of certain funds was adopted;

BE IT RESOLVED by the Council of the Town of
Pulaski, Virginia, meeting in regular session this
TFR. OF 7th day of September, 1971; hereby appropriates the
FUNDS TO amount of $65,972,23 of funds on loan from the Water
MUNICIPAL Fund to the General Fund now in the General Fund Surplus
BUILDING to the new Municipal Building Account. This resolution
ACCOUNT.- and appropriation to be for the period ending June 30,
1971.

Whereupon, motion duly made by S. G. Fr~Ze, seconded by A. L.
DELINQUENT
Graham, the following Res~.ution was adopted:
TAXES
BE IT RESOLVED that the Treasurer's list of improper and erroneous
assessments for taxes for the year 1970 be submitted to the Commissioner of
Revenue for further verification; that when same has been verified by the
Commissioner for Pulaski County, Virginia, as being improper and erroneous,
the Town Treasurer is hereby directed to correct tax tickets accordingly
and J. L. Patterson is hereby relieved from the duty and responsibility of
colts cting same.
Whereupon, motion duly made by S. G. Frye, seconded by J. H.
White, the following resolution was adopted:
BE IT RESOLVED that the Treasurer's list of improper and
erroneous assessments for taxes for the year 1969 be submitted to the
Commissioner of Revenue for further verification; that when same has

Graham, the following resolutions were adoptedt
BE IT RESOLVED that the certified list of the Town Treasurer
for the year 1969 showing remaining delinquent taxes be accepted, and
it is ordered that the revised list of real estate be transmitted to
the Clerk of the Circuit Court of Pulaski, Virginia, to be filed,
and the Treasurer is further directed to continue to collect the
unpaid taxes shown on said list.
