HomeMy WebLinkAbout04-17-73~~ ~~' ~~ Y Minutes of the regular meeting of the Pulaski Town Council, held April 17, 1973, at 7:00 P. M. in the Council Chambers in the Municipal Building. There were present: Mayor C. Robert Edens, presiding. Councilmen: Raymond F. Ratcliff, Mason A. Vaughan, Andrew L. Graham., Glen K. Aust, William A. House, Arthur L. Meadows S . G. Frye Absent: Councilman J. L. Congrove Also present: Town Manager: J, E. Marshall Clerk: Gladys R. Dalton Town Attorney: Garnett S. Moore Visitors: Bonni McKeown, Southwest Times Joyce Gardner, WPUV Radio Station Approximately 100 citizens of the Town The invocation was given by Councilman Frye. The minutes of April 3rd and special meeting of April 6th were approved as recorded. Mayor Edens apolized for the delay in opening the meeting and stated Council would not entertain any discussion on the recent STATEMENT unpleasantness; that it was a matter for the courts and Council BY MAYOR EDENS was not a court of law. He further stated Council would hear the public on matters of streets, etc., and if there were no comments from the public, Council would proceed with the Town's business. There were no comments. Councilman Graham reported thatthe Water Committee had UTILITIES scheduled a meeting for 4:30 P. M. April I9th to discuss items in COMM. REPORT the 1973-74 budget, and since then the meeting had been rescheduled for 3:30 P. M. to meet with officials of the County.. Councilman Meadows presented a petition which had been PETITION handed to him objecting to the establishment of a mobile home OBJ . TO MOBILE trailer court west of Randolph Avenue, and the Town Manager HOME COURT was directed by Council to see that the petition was presented to the Board of Zoning Appeals. As representative of the Town on the District Planning COUNCIL Commission, Councilman House reported that a grant from the Economic ACCEPTS OFFER OF Development Administration had been received by the Commission and DIST.PLANN. COMM. TO plans for the development of industrial areas throughout the District STUDY INDUSTRIAL SITES AVAILABLE 1 1 1 ~'"'~, , April 17, 1973 are now in the making. As a part of this undertaking, members of the Commission have been asked to identify industrial lands which are owned or controlled by a public agency such as a local industrial authority, etc., and the Commission will endeavor to provide pre- liminary engine eying to furnish basic utilities to the site and working drawings which will indicate what grading improvements will be necessary. Mr. House asked Council for any comments. Town Manager Marshall stated some comments would be made in this regard to Loving Field. Councilman Aust also suggested the old Dora Furnace site as a possible site. Councilman Ratcliff stated the offer by the Commission to study these sites was accepted, and moved the matter be referred to the Land, Buildings and Parks Committee for suggestions as to sites. The motion was seconded by Councilman Aust, and carried. Councilman Ratcliff reported that the Sewer Committee is SEWER COMM. STUDYING studying an analysis of sewage from the Long-Airdox Company, and moved ANALYSIS OF SEWAGE..:. the Committee study this along, with tha Town Manager, whicH motion was FR . LONG- AIRDOX CO. seconded by Councilman Graham; and carried.; Mayor°Eden$+reported that only ten minutes earlier he was handed a letter addressed.to-him, Mayor Edens read the letter, which was from Police Chief E.rK Burroughs retracting his resignation as RE: E. K. Chief :of .Police for,Pulaski. Mayor Edens stated: he felt sure the BURROUGHS, Council would want to-.take this under consideration. There were no CHIEF OF comments, andrMayor.Edens stated. he had several comments to make in POLICE thisregard.~~He stated that he sincerely .backed the Chief of Police, AND and felt that he had done a magniticant job in_improving the Police ~O1+T~L ~epartment..:Mayor Edens::also stated he.would like to see a re- LATER ASKINGtraction from the press and radio that the Town has three or four FOR RESTGNA-civii suits pending against it;~when he had:.knowledge of only one suit TION pending. Mayor Edens also stated he felt the publicity of-:the past weeks was bad for ths~Tpwn, and that he felt much of the harassment going on was from :a few individuals, and was:nat sound. thinking and judgment, and not the feelings of-.the-aa~ajority_ of the people- of the Town.. M~.yor Edens urged the public to use restraint and good judgment in their actions ~f ~~~~;~ c '' "`~ April 17, 1973 and thinking, and asked Council to make a statement as to their feelings in support of the Police Department. Councilman Graham, Meadows, Frye, Ratcliff and House indicated their support for the Police Depart- went and stated that without the Department there could be no law and order existing. At this point the public. spoke regarding the present leadership of the Police Department, and several of those present spoke rather heatedly. Councilman Aust stated he felt the situation had gotten all out of proportion. and it should never have happened. He further stated that regardless of how good the Chief was, he had lost his effectiveness; that his resignation of March 13th had been received and so moved that it be accepted. The motion was seconded by Councilman Ratcliff, who stated he also felt his effect- iveness would be affected, and believed it to be in the best interest of the Police force to let him resign. Councilman Vaughan also second- ed the motion and stated he felt that Chief Burroughs had done a good job with the Police Department and he would certainly hate to see all tote good work go down the drain. At this point there was some discussion as to the motion. Councilman Ault withdrew his motion, and Councilman Ratcliff and .Vaughan COUNCIL withdrew their second. Councilman Aust then moved that the Council VOTES 6 T'U 1 FOR of the Town of Pulaski ask Chief Burroughs, or request Chief RESIGNATION OF E.K. Burroughs to submit a written resignation effective the 27th day of BURROUGHS CHIEF OF this month, 1973. The motion was seconded by Councilman Ratcliff, POLICE and Councilman Graham,followed by expressions from Councilman Meadows, Frye and House. Mayor Edens asked for a show of hands in voting on the motion. The vote was six to one favoring the motion. Town Attorney Moore presented petitions. calling for an PET . FOR REFERENDUM election to be held on the Redevelopment Authority, and stated 104 ON HOUSING FILED - signatures had been verified from the tax records as being freeholders. ELECTION DATE TO BE He sugested that a date be fixed for the election, Councilman FIXED Graham moved that the Ordinance Committee meet with the Town Attorney and Town Manager Marshall and set a date for holding an election. The motion was seconded by Councilman Meadows, and carried. April 17, 1973 ~~"~ On motion of Councilman House, seconded by Councilman Frye, and carried, the following Resolution regarding the transfer of savings Account Funds to the Cemetery Trustees, was adopted as follows: WHEREAS, from time to time individuals have created either through the Town or directly with some of the financial institutions of the Town, certain trust funds for the care of burial plots in Oakwood or other town- owned cemeteries; and WHEREAS, there are now Trustees for the cemeteries owned by the Town, with authority to take, hold, invest and apply trust funds; and WHEREAS, the Town is of the opinion that it would be advantageous and beneficial to have all trust funds, in= cluding those individual funds in the form of savings accounts or other trusts held, administered by the Town of Pulaski Cemetery Trustees, and further, some of said ADOPTION OF trusts or saving accounts provide for their transfer to the Cemetery Trustees; RESOLUTION NOW, THEREFORE, BE IT RESOLVED by the Council of the RE: TFR. 0~ Town of Pulaski, Virginia, meeting in regular session on this 17th day of April, 1973, that: FUNDS TO (1) :The Treasurer of the Town of Pulaski is hereby CEMETERY authorized and directed to transfer all savings accounts ' or other trust funds which he now holds or which the Town TRUSTEES has deposited in the First Federal Savings and Loan Association of New River Va1Ley, the Virginia National RE: PERPETUAL Bank, or the Bank of Virginia in Pulaski, to the Town's Cemetery Trustees. CARE (2) The Trustees are directed to accept all of said trust funds and to hold, invest and use said funds as pro- vided by the bt-laws, resolutions or ordinances of the Town or the Trustees, and subject to specific conditions under which said funds were deposited with the Town. (3) The income from the individual trusts trans- f erred shall be applied as directed by the Trustors, and that any surplus over the need for perpetual care for the grave sites for which said trusts were established shall become a part of the Cemetery trust corpus and if and when sufficient trust funds have been accumulated by the Cemetery Trustees to provide perpetual care for all grave sites within the cemeteries, then said funds to become a part of the common trust. (4) The Trustees shall administer said funds trans- f erred to them under all general rules and regulations appli- cable thereto. (5) That a list of all funds transferred be attached to this resolution and made a part hereof, and that any other cemetery funds not included herein be added thereto. PLACED ON SAVINGS STREET KNOWN AS ALLISON LN. PROJ. Ta BE NAMED MEMORIAL DRIVE April 9th the Town received the revenue sharing check for January, February and March in the amount of Fifty-three thousand plus dollars, and that the funds had been placed on savings at both local banks on an equitable basis as the previous revenue sharing money received. Town Manager Marshall reported that the Planning Commission submitted a proposal to the Council for naming the Allison Lane Project, as had been referred to them by the Council. The three proposed names being: Memorial Drive - dedicated to all veterans of past wars; Wayside Drive and Sunny Drive. 1 1 ~., c~~ r'._;~r.
