Minutes of the regular meeting of the Pulaski Town
Council, held April 21, 1970, at 7:00 P. M., in the Municipal
Building.

The invocation was given by Councilman Macgill.
Minutes of the meeting of April 7th were approved as
recorded.
A public hearing was held on the application of Arnold C.
Garlic for permission to place. a mobile home on Dora Highway in the
GARLIC C. C. Abell Subdivision. There was no one present opposing this

APPROVED proposal. Town Manager Marshall stated that Mr. Garlic planned to
connect to the VICCCo. water system and town sewer is available.
It was his recommendation that the application be approved subject
to the connecting to the town sewer and meeting the requirements of
the Zoning Ordinance relative to the set back requirements. Council-
man Macgill moved the application be approved. The motion was
seconded by Councilman Vaughan, and carried.
Among matters brought to the attention of Council was the
railroad crossing on Madison Avenue between Third and Fifth Streets

McCormack, who operates the Mack Gulf Station on Rote 99 called
Council's attention to the traffic situation existing on Route 99,
and recommended a traffic light be installed at the intersection of
Franklin Avenue and Route 99. Town Manager Marshall advised that
the Town was pursuing this matter with the Highway Department.

The undersigned respectfully petitions the Council of the
Town of Pulaski, Virginia, to close those certain portions of
a twenty-five foot wide street or road and a fifteen foot wide
alley running through lands of Claremont Corporation of Pulaski
near Bob White Bou~vard in the northeast section of the Town of
Pulaski, Virginia, the centerlines of which are more particularly
described as follows:

Beginning at a point in the west Right-Of-

said point being located 12.5 feet northward
from the northeast corner of Lot No. 42, as shown

Book 1, page 257; thence parallel with, and 12.5
feet northward from north lines of Lots Nos. 42
and 41, the followin¢ courses and distances,
North 80° 00' West 566 feet; thence crossing
Bob White Boulevard, South 79° 20' West 598 feet;
thence North 65° 45' West 250 feet to a point
located 12.5 feet northward from the northwest
corner of Lot No. 41 of the J. M. Brown Farm,
said point being located approximately 480 feet
eastward from the east end of Macgill Street.

line of Appalachian Power Company land, to the 25 foot Street
described above.
Beginning at a point in the north line of land
of Appalachian Power Company, said point being located
North 77° 15' West 345.5 feet from the west right-of-
way line of Norfolk and Western Railway Company;
thence parallel with and 7.5 feet westward from the
west lines of Lot No. 42, J. M. Brown Farm, as follows:
North 12° 30' East 226 feet; thence North 0° 15' West
472.5 feet to a point in the south line of a 25-foot
wide street, described above.
And that all necessary steps and procedure, including any notices
appointment of viewers, etc., be conducted in this matter and
upon completion of all the required steps, that the Council by
ordinance grant the abandonment and closing of said street or
road, and said alley, and release any and all claims thereto to
the adjacent property owner as provided by law.
Your petitioner further attaches a copy of a notice which
he posted on the 9th day of April, 1970, in three public places
within the Town, including the Courthouse of the Circuit Court
of Pulaski County, the date of posting being at least ten (10)
days prior to the filing of this petition with said Council.
That the costs of this procedure be taxed against the
petitioner.

The petitioner owns the land on both sides of the portions
of said street and said alley proposed to be closed.
Given under its hand and posted this 9th day of April,
1970, on the bulletin board at the Pulaski County Courthouse,
at the Municipal Office of the Town of Pulaski, and at the
Pulaski Fire Department on the west side of Jefferson Avenue,
all in the Town of Pulaski, Virginia.

WHEREAS, the Council of said Town, upon viewing the
petition filed herein, finds it to be in proper order and directs
it to be received and filed, and further directs that the viewers
hereinafter appointed, view the described street and alley, and
that all other steps necessary be followed to bring this matter
properly before the Council for its final consideration;
NOW, THEREFORE, BE IT RESOLVED that:

describe the said street and alley, and set out therein that the
Town may vacate and close the same, and that the 4th day of Ma_y,
1970, be fixed as a date upon which the said Council will hold a
public hearing upon said matter pending before it, and that all
persons interested may be heard either for or against any or all
of said petition under consideration.
(5) That the said Town Manager and Attorney for said Town
do any and all other things necessary for the proper determinatio#
of this matter.

Councilman House reported that the Street Committee had
been asked to look into the situation at Northwood 8nd Claremont
RE:SIDEWALKS TO
Schools, whereby petitions had been received fnr safer facilities

CLAREMONT meeting had been scheduled for April 27th to meet with School
SCHOOLS Superintendent and School officials, PTA Presidents and the
Eresident of the Junior Woman's Club to see what can be doHe to

correct this situation.

As a result of the request from the YMCA officials for water
service to its new building off Oakhurst Avenue, Councilman Graham
advised that the matter had been considered by the Water Committee
YMCA WATER and Town Officials, and Town' Manager Marshall had advised the YMCA
LINE EXT.
COST $690. officials that the Town would extend the water line from its present
terminus in Oakhurst Avenue to the property Line of the YMCA, at
which point a f our inch connection would be extended over to the
COSTS MUST projected right of way line of Oakhurst Avenue which is approximately

BY YMCA twenty-five feet and there a two inch meter with vault would be
installed. At this point the YMCA, or its contractor, could pick up
and extend the line to the YMCA building. The cost for this extension
to the YMCA would be $690.00.
Mr. Alan Groseclose stated the Town had been requested to
donate these services and if the "Y" had to pay for them it would be
a great disappointment to the "Y" as well as a financial problem.
He was advised that careful conside"ration had been given the request
and it was felt the Town must follow its standard policy in this
matter.
Councilman Graham further reported that the Water Committee
RELOCATION had considered the request of Mr. L. G. Turman to relocate an old
OF WATER LINE water line on Lee Highway parallel to the Dyblin Road, which line is

EST. COST exposed and goes through the property of three taxpayers in that area.
$3,000. It was the recommendation of the committee that the water line be re-
located in the street in front of these properties, which is the
proper place for this water main, provided Town Manager Marshall can
work out the details of rights of way with the property owners. It was
estimated the cost of this relocation would be $3,000.00 and it was the
Committee's recommendation that it be done and paid for in the current
budget if the funds are available. If not, that it be carried in the
1970-71 budget, with the work to be done in July of 1970.
Mayor Edens brought to Council's attention the growing concern,
both natignal and state, relative to air pollution. Mayor Edens stated
AIR POLLUTIONhe felt Pulaski had a rather safe condition at this time, but suggested that
an air pollution ordinance be considered for adoption. Town Attorney

Moore advised that after June of this year, more will be known
about what steps should be taken in this matter. Councilman
Macgill stated that he felt water pollution should also be
considered at the same time. Town Attorney Moore followed this with
a report on what is being done about updating present sewer
facilities.
Town Manager Marshall advised Council that a petition had
been received to leave open the road leading off Valley Road into the
garbage disposal site and into Route I1. He stated further that
several years ago this road had been closed and had now been

COMMITTEE that since the receipt of the petition contact had been made with
the Director of Public Works and Fire Chief and it was their opinion
this would create quite a maintenance problem, and afire hazard in
the vicinity of the landfill. and surrounding timber if the road
was left open all the time. Also, that the site. of this road
will be used in the near future for a landfill. Several of the
visitors present who are residents of Valley Road in the County were
heard by Council. Councilman Aust moved the matter be referred
to the Street Committee to investigate and report and make
recommendation to the Council. The motion was seconded by Council-
man Macgill, and carried.
Town Manager Marshall presented a resolution relative to
ALLISON LANE right of way on Allison Lane. On motion of Councilman Vaughan,

HIGHWAY DEPT. seconded by Councilman Graham, and carried, the following resolution
was adopted:
WHEREAS, Section 33-57 of the Code of Virginia,
as amended by the 1966 Session of the General Assembly,,
authorizes the State Highway Commissioner to acquire
rights of way for the construction, reconstruction,
alteration, maintenance and repair of public highways
within municipalities on projects which are constructed
with State or Federal participation; and,
WHEREAS, Section 33-57, as amended, further provides
that the State Highway Commissioner may exercise such
authority only upon receipt of official request from
the Town involved, now

THEREFORE, BE IT RESOLVED, that the Town Council of
Pulaski hereby requests the,. State Highway Commissioner
to acquire the necessary rights of way for Project
U000-125-101, RW 201 within the Corporate Limits of
said Town and to convey the title to such right of way
to the Town of Pulaski upon completion of the project.
The Town of Pulaski agrees to reimburse the State Highway
De~tment for fifteen percent (15%) of alI costs incurred
in the acquisition and conveyance of such rights of way and
it is understood that such acquisitions will be handled by
the Commissioner under established polities and procedures
and his decision in all instances shall be final.
Town Manager Marshall reported that further investigation
i ndicated that town water is available to the Iot at 919 Jackson Avenue,
on which Joyce Kimbrough has applied for a permit to place a trailer,
but. sewer is not, and it would be necessary to extend the sewer line
approximately 300 feet ~t a cost of $1122.00. It was his recommendation

Health Department; and that a connection be made to the Town's water
system. Councilman Frye moved that the application be approved subject
to the stipulations outlined by Town Manager Marshall. The motion was
seconded by Councilman Ratcliff, and carried.
On motion of Councilman Aust, Seconded by Councilman
Graham, and carried, Council approved the application of B~. H. Porterfield

Town Manager Marshall reported that he had been asked to
make an investigation of the circumstances relative to the trailer appli-
cation which was granted for a six months period in November of 1969 to
Linda Adams Robinson. Mr. Marshall stated his investigation indicated

outlined in his report of April 13, 1970. Councilman Macgill moved,
and it was seconded by Councilman House, that the permit be extended for
another six months to see if they can work out something, either acquire

additional Iand for the trailer, or move it out. At this time
Councilman Frye moved to amend the motion to the effect that applicant
must connect to the Town water and sewer systems. This motion was
seconded by Councilman House., accepted by Councilman Macgill, and
carried. There followed more discussion and the first motion, made
by Councilman Macgill, was read by the Clerk. Councilman Macgill advised
that his motion was "that the permit be extended for another six months
to see if they can work out something, either acquire additional land
for the trailer, or make satisfactory arrangements for the trailer to
remain on the lot". There was more discussion of the matter, and Mr.
House withdrew his second, and Mr. Aust seconded the motion. The
motion carried.
There being no further business, the meeting adjourned
at 9:05 P. M.
