4947 April 28, 1970 At this point Mayor Edens introduced members of Council 1 EXCHANGE the Association for World Travel Exchange in sponsoring projects in STUDENTS VISIT AMERICA international educational travel. Mayor Edens presented each student GROUP ATTEND with a certificate making them "Honorary Citizens of Pulaski". COUNCIL MEETING There being no further business, a motion was made, to the visiting students and in turn, their Leader John Dimmock of London, introduced the ten students. There followed a discussion by the students relative to the American Iife, which is the purpose of WORLD TRAVEL seconded and carried, that the meeting adjourn, at 5:00 P. M. M. in the Municipal Building and Appalachian Power Company Auditorium. There were present: Mayor C. Robert Edens, presiding. Councilmen: W. D. Macgill, Jr., Wm. A, House, Glen K. Aust, J. H. White, A. L. Graham, 8. G. Frye, Mason A. Vaughan, Raymond F. Ratcliff Also present: Town Manager: J. E. Marshall Clerk: Gladys R..Dalton Town Attorney: Garnett S. Moore Visitors: J. R. After having assembled again in the Appalachian Audi- torium, the minutes of the regular meeting of April 21st and special meeting of April 28th were approved as recorded. again YOUTH DAY Mayor Edens/welcomed the visitors and the members of the STUDENTS youth Day Council and Department Heads. Mr. Obell R3cliff complimented Mayor Edens and the new Council members upon their accomplishments since taking office. Mrs. 0. M. Duncan of Peppers Ferry Rosd suggested to Council that the air pollution meastaring device placed at the Fire AIR POLLUTIONStation by the State Air Pollution Control Board be moved to a DEV IC E PLACED AT location that would better measure the fly ash from local plants. HIGH SCHOOL ~ha was advised that this equipment was now located on the roof of the Pulaski High Sch ool and had been for some time. ~~: May 5, 190 Mayor Edens advised this was the time and place as advertised in the local newspaper for a public hearing on the request of Claremont Corporation for the closing and abandonment of a certain street and alley lying within the Town of Pulaski, and more fully set out and described in a petition filed with the Town by Claremont Corporation. No one appeared opposing the closing of said street and alley. Town Manager Marshall reported that he had been approached by Bruce B. McCall on behalf of the Appalachian Power Company relative to the closing of the alley; that Mr. McCall had discussed this matter with the officers of the Claremont Corporation and it seemed Claremont Corporation will give Appalachian Power Company .an easement across their lands to the Appalachian property, at which time the alley can be completely abaondoned from its present location to a pointthat would parallel the right of way which would give Appalachian access to their property, and that the Town would only be interested in whether this would be a private access or dedicated fifteen foot alley across Claremont Corporation's property on the east PUBLIC HEARING RE:CLAREMT. side parallel to the N & W tracks to the Appalachian building, from a CORP.REQ. Town Attorney Moore then presented copy of the instructions to the viewers appointed by Council and their report to the Town Council. Councilman Ratcliff moved that the Instructions to the Viewers and Report of the Viewers be received and filed and that the street defined in the Instructions to the Viewers and other proceedings, together with the 15 ft. easement to the Appalachian Power Company property be abandoned and closed; that the property owners dedicate by deed the new street and extension of Monte Vista Drive; that a proper ordinance be prepared and brought back to the Council for this closing upon the conditions stated and that alI other proper proceedings be had in the proper closing and abandoning of the street. The motion was seconded by Councilman Vaughan, r and carried. Councilman Graham and Councilman Frye abstained from voting. (see page 4952, etc. for Instructions and Report of Viewers) ~" ~~. ~ I~ay 5, 1970 Councilman House reported that the Street Committee had met with the Superintendent of schools, Northwood PTA President and P OLICE OFFICER members of the Woman's Club with regards to a solution to the traffif AT NORTHWOOD situation existing at this School, but that the Committee had not met SCHOOL SEEMS since this meeting. Town Manager Marshall reported that the Town had TO BE SATISFACTORY endeavored to put a Police Officer at Northwood in the morning and afternoon with the hope that the situation can be evaluated by the end of this school year, and it may be that this will be the best solution for the next school year. Councilman House advised the Street Committee had not had VALLEY RD. an opportunity to meet regarding the request of citizens for the opening REQUEST of a street from Valley Road to Route 11. There was no report from the Water Committee. Counciiiaan Vaughan, of the Retirement Board, stated the Board had met several times during the last year and half in an eff ort to work out what was hoped would be a better retirement plan for town employees. RET.BD.RECOMMEND TRAVELERS PLAN It was the feeling of the Board that the plan submitted by the Travelers FOR EMPLOYE RETIREMENT Insurance Company is the best of all submitted and so recommended PLAN - TURNED OVER TO PROPER the plan to the Council. Councilman Frye stated that inasmuch as COMM. OF COUNCIL the Retirement Board is not a committee of the Council, moved that the matter be turned over to the proper committee of Council, which motion was seconded by Councilman Ratcliff, and carried. Mayor Edens asked what provisions are being made in the upcoming budget on a precedent basis for capital improvements, such as, CAPITAL ITEMS IN BUDGET water, sewer and street improvements, and Town Manager Marshall answered this by saing that the Department Heads are now working up their budgets which will be included in the overall budget. There was no report from Town Attorney Moore. Town Manager Marshall advised that by reason of a Court Order ~~] TREAS.RELIEVEDthe Macgill Village Corporation was relieved of payment of any taxes OF COLLECTING TAX ON LAND on the 10.77 acres of land belonging to the Corporation and condemned by PURCHASED FROM MACGILL VILL. the Town for Recreational purposes, and on motion of Councilman Frye, CORB. seconded by Councilman White, and carried, the following Resolution was adopted; ~'~ ~~: May 5, 1970 WHEREAS, the Town of Pulaski condemned 10,77 acres of land belonging to Macgill Village Corporation and lying within the said Town, in 1969; and the Iand- owner, Macgill Village Corporation was by order of con- RESOLUTION demnation relieved of payment of any taxes on said portion awarded the Town after Augast 3I, 1969. NOW, THEREFORE, BE IT RESOLVED BY THE TOWN OF PULASKI, VIRGINIA, that: (I) The Treasurer of said Town is relieved of the collection of any taxes upon 10.77 acres of Land awarded to said .Town by the Circuit Court of Pulaski County, Virginia, in its condemnation suit against Macgill Village Corporation for that period between September I and December 31, 1969, and if said taxes have heretof ore been paid, the Treasurer is hereby authorized to refund same for the of oresaid period to Macgill Village Corporation, or to such other corporation or person as they may designate. Town Manager Marshall gave a brief report of the activities of the Fire Department for the month of Aprii, 1970. On motion of Councilman Aust, seconded by Councilman Aust, TOWN MGRI. seconded by Councilman Ratcliff, and carried, the matter of the condition HAS PLANS -- FOR DLEEIRINGof Peak Creek from Duncan Memorial Bridge East, was placed on the agenda PEAK CR. Town Manager Marshall advised that the Town has plans for using heavy equipment from the Army Reserve to clear this channel out, or move it to the side so the Town trucks can get to it. Convening of the duly appointed viewers of said Town at 4:00 o'clock P.M. on the 4th day of May, 1970, at the site of the property in question. PRESENT: Alan D. Groseclose, Attorney for the Town of Pulaski; Arches Vaughan, Jr.; Dan C. Bell; and A. C. Sumner. Viewers are hereby instructed by the said Town Attorney as follows: (1) That your appointment was made by the said Town under authority granted in Title 15.1-364 of the Code of Virginia of 1950, as amended, and any and all other general powers granted said Town. (2) That as viewers appointed by said Town, you are instructed to view that certain street and alley set out and described as follows: 25-foot STREET PROPOSED TO BE CLOSED Beginning at a point in the west Right-of- Way line of Norfolk and Western Railway Company, said point being located 12.5 feet northward from the northeast corner of Lot No. 42, as shown on map of J. M. Petitioner: Claremont Corporation of Pulaski file, the undersigned, viewers duly appointed by resolution of the Town of Pulaski, Virginia, adopted on the 21st day of April, 1970, having been instructed on the 4th day of ^~ay, 1970, by the Town Attorney as to our duties as viewers, said written instructions being attached as a part of these proceedings. After reading the instructions, the undersigned did personally visit the location described in the aforementioned petition and in the instructions and agree that the closing of the street and alley in question will, in our opinion, cause no inconvenience to any person by reason of the abandonment and discontinuance of said street and alley. Our opinion is based on the assumption that the petitioner will dedicate an extension of Monte Vista Drive running from Bob White Boulevard to the Norfolk ~ Western Railway and upon the further assumption that Appalachian Power Company shall agree to the closing of the 15-foot alley proposed to be closed.
