HomeMy WebLinkAbout09-01-70H ~.~=~ At a regular Municipal Election held for the Town of Pulaski, Virginia, on June 9, 1970, the following officers were elected with terms to begin September 1, 1970. Mayor C. Robert Edens - two year term; Raymond F. Ratcliff, Glen K. Aust, S. G. Frye, and J. L. Congrove, Councilmen to serve for four years. Mayor Edens advised that the seating of the new Council is QUALIFICATION AND SEATING OF an important obligation of the Council, and a serious matter; that it must be remembered that any act of the Council can be contested and any litigation of a later date could create a serious problem if it was decided that the Council had acted with unqualified members or member serving at such time. That it was, theref ore, the responsibility of the Council to question its new members and to determine their eligibility, and as Chairman of the Council, he would, theref ore, assume the responsibility. Mayor Edens then asked Mr. Aust, NEW COUMCILMEN Mr. Congrove, Mr. Frye and Mr. Ratcliff if each was a resident of the Town of Pulaski, and qualified to vote, to-which question each answered he was. Each Councilman-elect was then asked if he owned property in the Town of Pulaski at the time of their elecyion, to which question Mr. Frye, Mr. Ratcliff and Mr. Aust answered that he did. Mr. Congrove stated that he was not a freeholder. Mayor Edens then J 1 asked each Councilman-elect if he had qualified bef ore the Clerk of the Circuit Court of Pulaski County, as provided by Section IX of the Town Cha Charter of 1948, and the Charter Amendments approved by the 1956 Legislature, and each Councilman-elect, with the exception of Mr. Congrove, stated that he had so qualified. Mr. Congrove stated that he had not qualified. Mayor Edens then read an opinion from Attorney General Andrew P. CONGROVE Miller obtained by the Mayor through Delegate Garnett S. Moore as a NOT result of having been advised bef ore the d ection that there were QUALIFIE& candidates thought to be ineligible for Council. In Mr. Miller's letter of opinion it was stated very clearly that an individual could not properly qualify and take his seat on Council if he was not a freeholder "when elected to or seeking the office of Councilman". Mayor Edens asked for an expression of Council regarding the seating `~~~ Sept. 1, 1970 of the incumbents. Councilman House moved that Raymond F. Ratcliff, Glen K. Aust, and S. G. Frye be seated, and that J. L. Congrove not be seated at the present time for the reason he was not a free holder at the time of the election and had not qualified bef ore the Clerk of the County. The motion was seconded by Councilman Vaughan, and carried. Mayor Edens stated it was regrettable that the action of denying a seat to Mr. Congrove on the Town Council must be taken, but that Section 8, subparagraph 2 of the Town Charter stipulates the. qualifi- cations, but that Council could appoint Mr. Congrove at a later date upon his becoming a freeholder and taking the oath of office bef ore the Clerk of the County. FOR MAYOR FOR C. ROBERT EDENS, were castEleven Hundred Fifty-eight (1158) votes. FOR RUDOLPH FARMER, were cast Four Hundred Fourteen (414) votes. FOR COUNCIL FOR CLEN K. JUNE 9 1970 We, the undersigned Commissioners of Election held in the Town of Pulaski, on Tuesday, June 9, 1970, do certify that the above is a true and correct abstract from the return of said election, ELECTION and do, theref ore, determine and declare that C. Robert Edens received the highest number of votes cast at said election for Mayor of said Town; that Raymond F. Ratcliff, Samuel G. Frye, Glen K. Aust and Jack L. Congrove, received the highest number of votes cast at said election for members of the Council of said Town. Accordingly, we do certify that C. Rob ert Edens is duly elected Mayor of said Town and Raymond F. Ratcliff, Samuel G. Frye, Glen K. Aust and Jack L. Congrove, are duly elected members of the Council of said Town. Frye for Vice-Mayor, S.G.FRYE to serve as Vice-Mayor of the Council for the period 1970-72, which VICE MAYOR nomination was seconded by Councilman White, and carried. Sept. 1, 1970 name of persons to be appointed to the Recreation Commission if it is felt the Commission should continue in the future, which motion was seconded by Councilman Aust, and carried. Minutes of the regular meeting of August 18th were approved as recorded.. 0 Walter McDaniel of Alum Spring Road appeared bef ore Council relative to damages to his property as a result of dynamiting by Town crews for the installation of the sanitary sewer line extension on Alum Spring Road. Town Manager Marshall stated this matter WALTER MCDANI$L had been discussed with Mr. McDaniel and it was believed that CLAIMS DAMAGES the suggestion by Mr. McDaniel is the best solution possible to the problem and this would be taken care of. Mr. McDaniel also asked Council to consider the extension of the Town's water line to that area. Councilman White moved that the request for water service be turned over to the Public Utilities Committee, which motion was seconded, by Councilman Aust, and carried. Upon the request of Bob Bunts and J. B. Warner, Council- NIGHT MEETINGS man White moved that the next regular meeting of Council be a night TO BE HELD meeting. , and that all night meetings of Council be held at 7:30 AT 7:30 P.M. P. M. rather than 7:.00 P. M. as had been in the past. The motion was seconded and carried. Councilman Frye stated it was necessary to have an appropriation from the General Fund in the amount of $450.00 to APPROPRIATION be credited to the Cemetery Fund, for an option on additional land FOR PINEHURST CEM. OPTION Raymond F. Ratcliff - aye Wm. A. House - aye Glen K. Aust - aye S. G. Frye - aye for the Pinehurst Cemetery, and so moved. The motion was seconded by Councilman White, and carried, on the following vote: J. H. White - aye A. L. Graham - aye Mason A. Vaughan - aye As Council's representative, Councilman House gave a brief PLANNING DIS T . ~~4 report on the activities of the New River Valley Planning District Commission. He also filed with the Clerk a copy of the June 30, 1970 Audit Report to be made a part of the minutes, as follows: & NEW RIVER AUDIT REPORT ~~ Sept. 1, 1970 Councilman House also reported on the establishment of a Health Center to be located one hundred miles west of Lynchburg, Virginia, which would employ approximately 350 staff personnel, LOCATION OF HEALTH CENTER plus care for approximately 500 patients. He stated a site of DISCUSSED approximately I00 acres was needed and the Commission had asked each political subdivision to make a recommendation to the Commission of a site in their area. Councilman Aust recommended that the Land, Buildings and Parks Committee, of which Mr. Ratcliff is Chairman, as well as Mr. House, be appointed to look into the possibility of recommending a site in the Pulaski area. An application for a house trailer permit by H. D. Coltrane, to be located at 2217 Lee Highway, was presented to Council by the H. D. COLTRANE TRAILER Town Manager. Councilman Frye moved that the usual aduertisement APPLIC. TO BE ADVTSED of a public hearing be followed, and the motion was seconded by Councilman Ratcliff, and carried. Town Manager Marshall reported that three bids had been received for blacktopping of approximately 1800 tons to surface two miles of town streets: Newman Brothers, Hillsville, $9.80 per ton; H. D. Cr~ NEWMAN BROS. LOW BIDDER Crowder, $10.75 per ton, and Pendleton Construction Company, $12.50 per ON BLACKTOPPING ton. Mr. Marshall recommended that the Council accept the price per ton at this point. Councilman House moved that the low bid be accepted, which was seconded by Councilman White, and carried.
