Council opened its meeting by holding a public hearing, as had been advertised in the local newspaper, upon the request of Foy Aust, and upon the recommendation of the Tawn Planning Commission,. that an ordinance be adopted to amend and re-enact Article IV, Section l and Section 2 of the Zoning Ordinance of the Town of Pulaski, and to add Article VI-A establishing a new residential district, R-1-A, to cover ZONING ORDINANCE SECT. 6.A-3 CIiA- NGED. RE: SETBACK REG. DRAPER mT. ESTATES. f~ conditions in the Draper Mountain Estates and other mountainous sectio~as of the Town. No one appeared at the hearing in opposition to the proposal. Mrs. Dan Rooker and Foy Aust appeared before the Council to ask that the 35 foot setback restriction, under 6.A-3 of the proposed ordi Hance be changed to forty (!t0) feet. On motion of Mr. Eggert, seconded by Councilman McCarthy, and carried, it was, RESOLVED, that under 6.A-3 Setback Regulation requiring structures to be located thirty-five (35) feet or more measured from the center of Hermosa Drive, Campbell Drive, be changed to forty (!t0) feet. Contd. May 17, 1966 A petition of Paul Knitting Mills was presented by their Attorney Mr. Howard C. Gilmer, Jr. in which petition it -: -,',:~ was requested that the Town Council close, abandon, alter or ~,, ~~ discontinue a certain alley on which the Paul Mills is now ~. located, and here made a part of the minutes as follows: TO THE COUNCIL OF THE TOWN ~' PULASKI, VIRGINIA: PETITION TO CLOSE ALLEY PRESENTED TO Paul Knitting Mills, Inc., respectfully petitions COUNCIL BY PAUL the Council of the Town of Pulaski, Virginia, to vacate, as KNITTING MILLS. an alley in the aforesaid Town, the following described parcel of land: Being the southern thirteen (13) feet of Lot No. 25, Block 118, as shown on the Official Map of the Town of Pulaski, Virginia, and being the same parcel of land dedicated by reference in a certain deed from the Pulaski Real Estate Exchange Company to the petitioner, dated the 21~th day of April, 1917, and of record in the Clerk's Office of the Circuit Court of Pulaski County, Virginia, in Deed Book 38, Page 113; said dedication having been accepted by the Council of the Town of Pulaski, Virginia, at its regular meeting on April 2l~, 1917, as will be more clearly shown by the minutes of said meeting of Council on that date. Your petitioner, in support of this request, would respectfully show unto Council: (1) That said above described parcel of land was never opened or used as a public alley, but lay to the immediate rear of the second expansion of Paul Knitting Mi11s, Inc., for a number of years. That in connection with the last expansion of Paul Knitting Mills, Inc., in 1938, said '--arcel of land was built upon by the said Paul Knitting Mills, Inc., pursuant to the deed of said parcel to your petitioner from the Pulaski Real Estate Exchange Company, dated the 19th day of August, 1918, and of record in the afore- said Clerk's Office in Deed Book 39, page 599, whereby said Pulaski Real Estate Exchange Company attempted to transfer the said alley from the southern portion of Lot No. 25, in Block 11$, to the southern portion of Lot No. 29, in Block 118. However, so far as your petitioner has been able to ascertain, the Council of the town of Pulaski, Virginia, never officially closed the above set forth portion of Lot No. 25. (2) That this dedicated alley is not now in operation, nor has it been si nce 1938, and that there would be absolutely no inconvenience to any one of discontinuing the same. (3) That your petitioner owns the ad3oining property on the north and south of said above set forth portion of Lot No. 25, in Block 118, and that the aforesaid portion is bounded on the west by LaGrange Street and on the east by an alley alongside the Jefferson Mills Hill Plant. (!~~) That your petitioner has posted notice of its intent to apply for the vacation of the aforesaid portion of Lot No. 25, at the Courthouse and at the Town Office Building and at the Fire Station, all in accordance with Section 15.1-36t~ of .the Code of Virgir~a, 1950, as amended. WHEREFORE, your petitioner requests that viewers be appointed as set forth in the aforesaid Code Section, and that Council may, by proper ordinance of vacation, vacate and close the aforesaid portion of Lot No. 25, in Block 118. May 17,.1966 On motion of Councilman Aust, seconded by Councilman Gallimore, and carried, the following resolution was adopted by Council: WHEREAS, a petition and application for the closing of a certain unopened alley has been filed with the Town of Pulaski, Virginia, by Paul Knitting Mills, Inc., through its counsel, which alley is the southern thirteen-foot portion of Lot No. 25 in Block 118, as shown on the Official Map of the Town of Pulaski, Virginia, and now being occupied by a part of the building belonging to Paul Knitting Mills, Inc., and, WHEREAS, it would appear from the records that the Town intended to close said alley in 1938, at which time it accepted other dedicated land for alley purposes in lieu of the parcel described in the petition; and, RESOLUTION ADOPTED TO FILE PETITION TO WHEREAS, it appears that proper notice as required CLOSE ALLEY OCCUPIED by statute has been posted in at least three places in BY PAUL KNITTING MILL. the Town, including the Courthouse of the Circuit Court VIEWERS APPOINTED. of Pulaski County, Virginia, on the ltth day of May, 1966, and at least ten (10) days have expired si nce the said posting; and, WHEREAS, the Council of said Town, upon viewing the petition filed herein, finds it to be in proper order and directs it to be received and filed, and further directs that the viewers hereinafter appointed, view the described alley, and that all other steps necessary be followed to bring this matter properly before the Co ncil for its final consideration; and, WHEREAS, said petitioners have requested the Council to appoint the necessary viewers and to take other steps to properly determine this matter; NOW, THEREFORE, BE IT RESOLVED, that: (1) The application be received and filed. (2) Viewers be appointed, as follows: Odell H. Mayberry, W. M. Board, C. L. Plunkett, - Alternate: F. H. Flanagan. (3) Such viewers shall meet and report in writing whether in their opinion any, and if any, what, inconvenience would result from the vacation and closing of the alley as requested in the said petition. (!t) That the Town Manager give written notice to all land owners affected by any changes by closing of the alley and, further, that said Town Manager give public notice by publication of same in the southwest Times, a local news- paper, once a week for two consecutive weeks, and that said notice describe the said alley, and set out therein that the Town may vacate and close the same, and that the 2nd da~,r of June, 1966, be fixed as a date upon which the said Council z~rill hole a public hearing upon said matters pending before i t, and that all persons interested ma,y be heard either for or against any or. all of said petition under consideration. (5) That the said Town Manager and Attorney for said Town do any and all other things necessary for the proper determination of this matter. c~ n ~~.~1LI Council mina. contd. 5/17/66 Town Treasurer Patterson advised that before he could make a report it was necessary to determine from the Council its wishes regarding setting aside certain funds for specific projects. Council- man Larson reported that the Finance Committee had met with the FINANCE COMM. RECOMMENDS SPEC. Auditor and Town Treasurer, and it was the recommendation of the ACCT. FOR SPEC. PURPOSES. MOTION Committee that a special account be set up with the funds ear- CARRIED. marked for specific purposes for capital expenditures; that said money be deposited in the bank, with interest, and earmarked for specific projects. Mr. Larson put the recommendation in the form of a motion, which motion was seconded by Councilman Cummings, and carried. Reporting on the recommendation of the Recreation Committee, Mr. Aust moved that the Town provide aaintenance for the recently TOWN TO PROVIDE installed scoreboard at Calfee Park, with the and erstanding that MAINT. This motion was seconded. by Councilman Gallimore, and carried. Mr. Cummings reported that the Water Committee had met and considered the request of Industrial Research Laboratories that they be relieved of the sewer charge as they claimed about ninety WATER COMM. There was some discussion by the Council concerning mutual interest of the Town with the County of Pulaski. In order to afford sow discussion of this it was moved by Councilman McCarthy, seconded by Councilman Gallimore, and passed, that the Mayor and the DINNER MEETING Town Manager be authorized to schedule a dinner meeting to be held TO BE SCHEDULED FOR COUNCIL & jointly by the Town Council and the members of the Board of Supervisors BOARD OF SUPER. of Pulaski County to discuss mutual problems.
