~~~ c ~,...,t ~..~ Minutes of the regular m acting of the Pulaski Town Council, held July 19, 1966, at tt:00 P. M., in the Municipal office. There were present: Mayor C. V. Jackson, presiding. Councilmen: Glen K. Aust, W. S. Cummings, B. H. Eggert, C. B. Gallimore, Rudolph Farmer, W. A. Larson, F. L. Carrico Absent: T. J. McCarthy Also present: Town Manager: Evan Norton Clerk: Gladys R. Powers, IGA Food Fair The invocation was given by Councilman Aust. Minutes of the regular meeting of July 7, 1966, were approved as recorded. The meeting was opened by holding a public hearing, as had been advertised in the local newspaper, an the application of Paul W. Ratcliff PAUL RATCLIFF {~ place a house trailer on Dora Highway. It appeared that all necessary TRAILER APPL. APPROVED. legal steps had been taken in this matter, and there was no one present to oppose this application. Upon the recommendation of Town Manager Norton, Councilman Eggert moved that the application be approved, which motion was seconded by Councilman Farmer, and carried. Town Manager Norton presented to Council the application of Wilma L. and Phil Kirby for permissi on to place a house trailer on Bertha Street. USUAL PRO. TO BE FOLLOW- On motion of Councilman Aust, seconded by Councilman Eggert, and carried, ED ON TRAILER APPL. OF it was, RESOLVED, that the regular procedure be followed with regards PHIL KIRBY,. to this application, and a notice of public hearing by Council be placed in the local newspaper. Mayor Jackson advised that as had been advertised in the local sewspaper, this was the date, time and place set for a public hearing cn the proposed budget for 1966-67 fiscal year, and that Council would be glad to hear anyone who had anything to say either for or against said budget. CURB & GUTTER TO BE Committee had recommended to Council that requests of this kind be paid INST. ON FIFTY- FIFTY BASIS. for entirely by the taxpayers or petitioners. There followed a dis- cussion of this new policy procedure, and it was the feeling of the three members of the Street Committee present, that this request was received prior to the change in policies having to do with requests of this nature and should be granted on the old fifty-fifty basis. Councilman Larson, being one of the Street Committee members, moved that the re- quest for curb and gutter on the right side of High Street be constructed on a fifty-fifty basis. This motion was seconded by Councilman Cummings, and carried unanimously. Mr. John Powers advised that since his petition to the Tawn for sidewalk in front of his property on East Main Street had been presented to Council, he had made several inquiries and found that because of a drainage problem which exists, the Southern States Cooperative is willing to give the Town an easement across their property to the Creek to correct this situation. He further stated that 0. H. Meredith, the owner of property at the corner of Madison and Main, was interested in having JOHN POWERS a curb and gutter along his property on Main Street, and willing to pay DISCUSSES PETITION FOR his share of the costs, and that the Norfolk and Western Railway Company SIDEWALK ON E. MAIN ST. was willing to cooperate with regards to the two railroad tracks across REF. TO ST. COMM. Main Street. Mr. Powers stated that Al Withers was interested in having a sidewalk in front of his property, and that it was his understanding that the New River Land Company was willing to give the Town additional right-of-way to the Finance Company office, if the Town would bear the cost of sidewalk construction along their property. The proposed project was referred back to the Street Committee and Town Manager Norton for further study and make recommendation to Council at its next regular meeting . Mr. Stone of the Travelers Insurance Company explained to Council the change which would be necessary in the Town's Group Plan for Mayor Medical for those employes 65 and over, as a result of the medicare plan which {~`~~~~ Council mina. contd. ?/19/66 became effective July 1, 1966. He also left with the Town Manager MR. STONE rate schedules which indicated that the amount to be assessed EXPLAINS CHANGE IN TOWNS GRP. against the employes 65 and over would be considerably more than INS. PLAN. they are pairing at present, however, those under 65 would receive a reduction in their assessment rate for the new year. No action was taken by Council as it was an administrative matter. On motion of Councilman Aust, seconded by Councilman Gallimore, JAMES MCMILLAN and carried, it was, RESOLVED that the request of James McMillan for REQ. FOR WATER water to his residence on Smith Lane be turned over to the tn'ater TURNED OVER TO WATER COMM. Committee for study and report. A request from Fire Chief Wm. A. Hall, that two fireman's tags be issued to all firemen who have two cars was discussed by Council. Mr. Hall advised that the reason for this was that the State allows only red FIRE CHIEF REQ. TWO FIREMEN'S lights on one vehicle per fireman, and there have been times when the TAGS PER FIREMAN. REQ. APPROVED. firemen would be driving the other car and could not get to the fire. On motion of Councilman Eggert, seconded by Councilman Aust, and carried, it was, RESOLVED that this request be approved, subseouent to the preparation of the proper ordinance amending the original ordinance now in force. Town Manager Norton presented to Council a letter frmm the A.D.T. CORP. A. D. T. Corporation in which letter it was stated their representative OFF'. UNABLE TO ATTEND would be unable to attend the meeting of Council, as had been requested MEETING. RE: BURGLAR by Council, and give further information regarding their requests to A LARM. place burglar alarms in the Town Police Department for Jefferson Mills and Virginia Maid Hosiery Mills. Councilman Carrico suggested that their officials be requested to be present at the next meeting of Council. Town Manager Norton read to Council a letter from Chief of Police C. E. Comer, in which letter the members of the Police Department thanked Council for the recent raise in salary and pledged their CHIEF COMER THANKS COUNCIL services to merit the raise. Letters from Samuel P. Moore, Attorney FOR RAISE IN SALARIES. at Law, Newton, North Carolina, and M. C. Moricle, Jr., of Reidsville, North Carolina, commending the Pulaski Police Department for recent services rendered them, were read to Council. MOORE and carried, it was, RESOLVED that the reauest of R. L. Moore on REQ. FINANCIAL Councilman Larson gave a brief financial report on the status of the REP. ON GEN. FtJND. General Fund for the period ending June 30, 1966. On motion of Councilman Larson, seconded by Councilman Eggert, and carried, the following ordinance was adopted: AN ORDINANCE TO AMEND AND RE-ENACT SECTION 23A OF THE LICENSE TAX ORDINANCE OF THE TOWN OF PULASKI, VIRGINIA, PERTAINING TO LICENSE TAX ORD. THE LICENSING OF CONTRACTORS, ETC. SECT. 23A, ADOPTED. BE IT ORDAINED Bg THE COUNCIL OF THE TOWN OF PULASKI RE: LICENSING OF ~ CONTRACTORS. VIRGINIA, THAT: 23-A Amendment and Re-Enactment of Section 23. A. (1) Any person accepting or offering to accept orders or contracts for doing any work on or in any building or structure requiring the use of paint, stone, brick, cement, mortar, wood, wallpaper, structural iton or steel, sheet iron, galvanized iron, metallic piping, tin, lead or other metal, or any other building material, or any electrical work on or in any structure; any paving or curbing on sidewalks or streets, alleys, public or private property, reauiri ng the use of asphalt, brick, stone, cement, wood, or at~y composition; excavation of earth, rock or materials for foundations or any other purpose; construction any sewer of stone, brick, concrete terra cotta or other material; building, remodeling, repairing, wrecking, demolishing; boring or digging a well; maintenance or repair of neon signs or air conditioning apparatus or equip- ment; fumigating or disinfecting air eradications or the extermination of rats and mice, termites, vermin or insects or bugs of any kind; whether such work is done or offered to be done by general contract or sub-contract, shall be deemed a contractor. (2) Every such contractor who does business or has an office or branch office ~n the Town of Pulaski for the privilege of transacting business in the Town of Pulaski, Virginia, shall pay a license of Fifteea Dollars ($15.00) for tie first Five Thousand Dollars ($5,000.00) of gross receipts from contracts or at~r portion thereof, and an additional one-fourth of one per cent for all over Five Thousand Dollars ($5,000.00) gross receipts from contracts during the license year, except that where a contractor has his principal office located in some other city, town or county within this State and has no branch office located in the Town of Pulaski and does business within the Town, no license shall be reouired except where the amount of gross receipts of said contractor in the Town of Pulaski exceeds the sum of Twenty-five Thousand Dollars in any year, in which event the license tax reouired of such contractors shall be Fifteen Dollars {$15.00) for the first Five Thousand Dollars ($5,000.00 of gross receipts from contracts and an additional one-fourth of one per cent for all over Five Thousand Dollars ($5,000.00) gross receipts from contracts performed within the Town of Pulaski, Virginia, during the license year. ~'~`~ j0 Council mina. contd. 7//s~/66 (3) Any person employed directly on a salary or wage basis to do any work hereinabove mentioned and who does not in addition furnish the materials and supplies therefor shall not be required to obtain a contractor's license as otherwise required under the terms of this section. B. {1) Any person engaged in any of the activities heretofore enumerated (by force account) on land or property owned, leased or otherwise controlled by said persons for purpose of ev®ntual sale, or who engage in the activity of sub-dividing land, improving and building thereon, shall b® termed a 'BUILDER" or "DEVELOPER". The license tax on such person shall be Fifteen Dollars {15.00) for the first Five Thousand Dollars 05,000.00), or portion thereof, of the total enpenditures on such property or properties, plus an additional one-fourth of one per cent of total expenditures above Five Thousand Dollars ($5,000.00). C. (1) Where an examination of qualification and registra- tion is required by the State Code or by local ordinance, for the purpose of determining the eligibility of the contractor, builder, or developer to undertake any trade, work or service, the payment of a business license shall not in itself permit the engaging in such trade, work, or service. (2) At~y contractor, builder or developer who shall con- tinue to engage in any trade, work or service after failure to properly qualify by examination or registration for such trade, work or service shall have given 3ust grounds for revocation of his business licenses, in which event such person shall be in the same position as if the license had never been granted. D. (1) Penalties: for the violation of this ordinance shall be as provided in Section 17 of the License Tax Ordinance. On motion of Councilman Fggert, seconded by Councilman Aust, and carried,~the following resolution was adopted: WHEREAS, Howard C. Jackson, a life-long resident of Pulaski, Virginia, began his first employment by carrying water for work crews of the Town of Pulaski, Virginia, while RESOLUTION COMMENDING still attending school, and upon finishing school worked for H. C. JACKSON ADOPTED. the Town at different intervals until he went into the Army and overseas during World War I; thereafter, upon returning to Pulaski he worked for a short period of time for the Pulaski Iron Works and then began his work for the Town as an employee in the water and sewer department in 1920, under the supervision of his father; and, WHEREAS, upon the death of his father in 1930, after having worked continuously for the Town for forty years, the Town appointed Howard C. Jackson Superintendent of the Water and Sewer Department, which position he held until 1951 when he was promoted to Superintendent of the Department of Public Works and continued in this fob until his retirement on Sept. 1, 1965, after having attained the age of seventy years on Aug. 2, 1965; and, WHEREAS, the Town, desiring to retain the vast knowledge and experience which he has, granted permission to postpone his retirement for a period of one year; and, ~~':a1 Council mina. contd. ?/19/66 WHEREAS, on June 2, 1966, upon his request, the Council retired Howard C. Jackson, from the position of Superintendent of Public ~~orks as of July 1, 1966, and at the same time employed Howard C. Jackson as consultant to the Town Manager; and, WHEREAS, it is the desire of the Council to make as a matter of public record the facts concerning the long, efficient and loyal service of Howard C. Jackson to the Town of Pulaski and it desires further to show its deep and abiding appreciation for the contributions made by Howard C. Jackson to the Town of Pulaski, its people and its development. NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Pulaski, Virginia, meeting in regular session on this 19th day of July, 1966; that (1) The Town Council therefore recognizes and pays tribute to Howard C. Jackson upon his retirement as the Director acid Superintendent of Public Works and expresses to him, for the Council and upon behalf of the people of the Town, its deep appreciation for his long, efficient and loyal service to the Town, and hereby directs that the facts herein- above stated be preserved as a matter of public record in the minutes of this Council. (2) Council wishes to hold up to the people of the Town, and especially to its own employees (as a model by which many could profit) the etaviable record compiled by Howard C. Jackson over the many years and would hope that this record proves to be a challenge for others to seek to match. (3) Council further desires to congratulate Howard C. Jackson upon his retirement as Director of Public Works, and to say to him that his consent to ast as a consultant to the Town Manager of the Town of Pulaski affords the Town Council a feeling of security and well-being; that the years of ex- perience and the vast knowledge of town installation is an irYValuable source of information for the Town and its present officials which the Town desires to use and draw upon for many years to come. (l~) The Council hereby recognizes the many contributions which Howard C. Jackson has made to the Town over and above his required duties and outside of his employment, and wishes for him many happy years of retirement, and looks forward to the continued congenial and pleasant association which it has enjoyed throughout the years. (5) It is desired that a copy of this Resolution be mailed to Howard C. Jackson as soon as it has been spread upon the minutes of the Council. Council rains. contd. 7/19/66 Town Attorney Moore suggested that before drawing an ordinance having to do with abandoned automobiles, to wait on mor information from the General Assembly and then turn such information over to the ordinance committee for their consideration. Town Manager Norton was authorized to employ Mr. Elmer W. TOWN MAN. RUTH. TO Holyfield, as Building Inspector -Engineer, for the Town, on a EMPLOY ELMER HOLY- trim. basis. On motion of Councilman Aust, seconded by Councilman Larson, and AUTO OWNERS carried, it was, RESOLVED, that owners of automobiles be invoiced OUTSIDE CDRP. LIMITS for services rendered by the Pulaski Fire Department when ca3.led outside TO BE INV. FOR SERVICES the corporate limits for fire protection of their automobiles. RENDERED. RE: FIRES Town Manager Norton advised that samples of plaques had been PLAQUE requested in selecting a proper plaque honoring the late Fire Chief SAMPLES ORDERID TO D. G. Ray, and he hoped to have more information for Council at its HONOR FIRE CHIEF RAY next meeting. The matter of Armory Fees was continued to the next meeting of Council.
